He cannot.   Remember Casey counter sued, so if Kasen wants it dropped "good faith" would be offering Casey's willingness to drop the counter suit in order to dismiss - not happening.   It will go forward because Casey has NOT sworn under oath.   Furthermore, Cindy went on camera even after Casey reportedly said "this is not Zanny" and put forward that it still could be (the argument at the end of the deposition).
Well I do not understand why Kasen is trying to use them as his concrete foundation that "this is not the Zenaida".  They can not know for sure unless they wish to purger themselves further by stating that they "met" this suposed Nanny and it is not this Zenaida.  It boils down to a he said/she said and that is what he is basing his arguement on???
