Trial delayed in Hataway attempted murder case
His lawyer says he’ll ask for a change of venue

SANFORD – The man at the center of the Tracy Ocasio missing person's case walked into court in Seminole County this morning, ready for trial in another case, but defense attorneys asked for and got a delay, so there will be no trial until June at the earliest.

James Virgin Hataway, 29, of Ocoee, is charged with attempted murder and several other charges in a 2008 attack on another woman.

During a long bench conference this morning, defense attorney Jeff Leukel said he wants the trial moved to another county.

He will make that formal request later, in writing, he said.

After Hataway was led from the courtroom and back to a cell, Leukel said that media reports about the Ocasio case will make it difficult for Hataway to get a fair trial here in this case, which has nothing to do with Ocasio.

Ocasio's mother, Liz Ocasio, was in the courtroom this morning. Last week, she vowed to be here every day of Hataway's trial.

Leukel today took over the case from another assistant public defender, Al Parsons. Earlier, Parsons had filed a motion, asking the judge to allow him to question potential jurors one by one.

To do it the regular way – to have potential jurors answer questions in front of teach other – he wrote in the motion, could taint other panel members, especially when the judge and attorneys ask about what potential members already know about Hataway.

It's not clear now when Hataway will go on trial, but it won't be before June 9.

This case involves a woman who told authorities she had driven Hataway home after a party Aug. 7, 2008, when he attacked her, choked her, banged her head into the ground several times and tried to snap her neck.

She escaped, she told authorities, and he ran away.

Eleven months later Tracy Ocasio disappeared. She was last seen leaving a Metrowest bar with Hataway. Ocoee police describe him as a person of interest.

At a hearing last week, Circuit Judge Donna McIntosh had ordered Hataway to court this morning for possible trial.

Search Team: New Tracy Ocasio search set for Saturday

May cannot be an easy month in the Ocasio home. Mother's Day comes Sunday and later this month will mark the one-year anniversary of Tracy Ocasio's disappearance.

But on Saturday, Ocasio's parents hope a new search, conducted by a group of 40 or so volunteers, will turn up still undiscovered clues in their missing daughter's case. The young woman's mother, Elizabeth Ocasio, described her feelings as "hopeful" on the eve of the search.

"The not knowing is the hardest part," she said Friday. "I know we're looking for a shallow grave of some sort."

The positive identification of remains — Tracy's bones — would at least confirm for her parents that she is gone. Then, Elizabeth Ocasio said, "We can lay her to rest."

"Finding her is one part and punishing the person that did this to her, that phase would begin," she said.

The searchers on Saturday hope to cover ground that was not thoroughly scoured in earlier search efforts.

"We're going to be looking at areas we have not previously been in," said Kathy Johnston with Search and Rescue of Central Florida.

Tracy Ocasio, then 27, vanished May 27 after she was seen at the Florida Tap Room in MetroWest. Many suspect that James Virgil Hataway was involved in her disappearance, including her father Joe Ocasio. Security video shows her leaving the bar with Hataway.

Hataway is awaiting trial on a charge of attempted murder in connection with a 2008 attack on a woman in Seminole County. Last month, that trial was delayed until June at the earliest.

Johnston said that areas around Ocoee-Apopka Road and near where Tracy Ocasio's car was found not far from Hataway's home have been searched. However, undeveloped and wooded areas between the Tap Room where the car was found have not been the focus of searches, and Johnston said that's where volunteers intend to concentrate their efforts Saturday.

The certified searchers will be joined by police dogs and their handlers. It is set to start at 7 a.m. The five or six teams doing the searching already have been selected.

"We're doing only certified searchers as opposed to the general public," Johnston said.

She did encourage anyone with information about seeing Ocasio late last May or recollections of the days immediately after she went missing to contact authorities, such as Ocoee police or Crimeline.

"Somebody may have heard something in the days after," Johnston said. "It's just hard to believe an entire person could disappear off the face of the earth and nobody see anything. There's somebody out there that definitely knows what happened to Tracy Ocasio."

Joe and Elizabeth Ocasio will not take part in the searching, but they will meet with searchers at a command post during the day. Part of the effort will include a search for Tracy Ocasio's keys with metal detectors. Boats with special scanning equipment also are expected to be used.

"I don't know if you can really prepare yourself for what they may find," Elizabeth Ocasio said.

And if they find nothing?

"If they don't, it's like we're going to just keep on trying," she said. "We're not giving up."

“Absolutely, I hope that this search puts an end to all the searches, and we can find something that leads us to her,” said Tracy’s father, Joe Ocasio.

Joe and his wife, Elizabeth, are expected to be on hand Saturday, but will not participate in the search.
Teams are setting out on boats with scanning equipment, and on land using metal detectors, hoping to find Tracy’s keys and wallet, or any other clues to give her grieving family some answers.

The man whom Tracy drove home from the bar, James Hataway, was named a person of interest, but has not been formally charged in her disappearance.

Hataway, 29, has maintained he had nothing to do with it.

He remains in jail awaiting an unrelated trial set for June, in which he faces attempted murder charges for attacking a woman in 2008

“He’s the one that murdered our daughter,” Joe Ocasio said. “At the minimum, he’s involved. So we’re hoping that this could lead us to some DNA on the keys and lead us to him.”

Florida Three Airboat Search and Rescue brought in 35 people to search between Kirkman and Edgewood Ranch roads, and between Winter Garden Road and Metrowest Boulevard.

Joe and Liz Ocasio said a tip came in that sparked the new search, but they can't say where it came from.

"(It was) someone familiar with the case and something similar where there was a car involved, keys involved," Joe Ocasio said.

Hataway is in jail facing attempted murder charges for allegedly strangling another woman who gave him a ride home and then slamming her head into the pavement.

"We feel strongly feel that's what happened to our daughter," Joe Ocasio said.

The Ocasios said the only thing left to do is prove it by finding their daughter, laying her to rest and using any evidence there is to lock Hataway away forever.

Late Saturday afternoon, four dogs zeroed in on an area near Lake Bennett, which is off West Colonial Drive, near Old Winter Garden Road.

The Ocasios said they will be meeting with the Ocoee Police Department on Monday to hopefully use their resources to search that area more closely.

OCOEE, Fla. --
It's been exactly one year Wednesday since an Orlando woman disappeared from a local bar.

Investigators and her parents continue the search for Tracy Ocasio.
Ocoee police will provide an update later Wednesday morning on the case, while Ocasio's parents vow to keep searching for their daughter.

Ocasio's father, Joe, showed WESH 2 News an area near Lake Meadows where they plan to search again next month.

Ocasio was last seen May 26, 2009 leaving a Metro West bar with James Hataway – who is the only person of interest in the case.

Ocasio's father said the past year has been extremely difficult for him and his family.

The new search for Ocasio will take place June 5 and 6. It will include 45 people and 19 K-9s.

Wednesday morning's briefing with Ocoee police is scheduled for 10 a.m.

OCOEE -- Wednesday marks one year since Tracy Ocasio disappeared, but her parents said they’re not giving up the search for their daughter.

Ocasio was 27 when she was last seen leaving a Metrowest bar with a man police named as a person of interest in her disappearance.

Her family said a search team will scour area waterways next weekend, hoping to find any sign of Tracy.

The person of interest, James Hataway, remains locked up in Seminole County on unrelated attempted murder charges for an attack on another woman.

Ocoee police are expected to update the investigation into Ocasio’s disappearance Wednesday.

Police Mark Anniversary Of Missing Ocoee Woman

OCOEE, Fla. -- One year ago Wednesday, Tracy Ocasio was last seen leaving an Orlando bar after an Orlando Magic game. Since then, there have been searches and a prime suspect was named in her disappearance, but no arrests and no sign of what happened to her.

Wednesday morning, the Ocoee Police Department is expected to talk about the status of its investigation. Ocoee police have not said if there is a big announcement coming from the media briefing, but they do indicate that they will announce a new search for Ocasio.

One year ago Wednesday morning, Tracy Ocasio vanished and has not been seen since. The 27-year-old was last seen with James Hataway, who has faced multiple accusations including attempted murder after Ocasio disappeared.

Ocoee police will mark the anniversary of her disappearance with a media briefing, and a chance for reporters to get the latest details on the investigation.

"Words cannot describe how we feel about what they're doing for us," said Ocasio's father.

Ocasio's parents applauded searchers earlier in May, during a new effort to find their daughter. On Wednesday, police are expected to announce yet another search effort and that detectives still suspect Hataway's involvement in her disappearance.

"At minimum, we know he's involved. We know that for a fact," said Ocasio's father.

Hataway is jailed in Seminole County on attempted murder charges involving another woman. As the one year mark approached, Ocasio's parents still express their pain.

"You're not crying everyday, but the hurt never goes away," said Ocasio's mother.

James Hataway is also the last person known to have seen a missing Apopka man. Onda Christopher George was a 29-year-old friend of Hataway who disappeared after a suspicious car crash.

Tracy Ocasio Missing: Suspect Named in 2009 Disappearance
ORLANDO, Fla. (CBS/WKMG) Nearly one year after Tracy Ocasio went missing at a Orlando bar, the man who has been considered a person of interest in the case has now been named a suspect, according to a local station.

The 27-year-old Ocasio was last seen leaving the Florida Tap Room Restaurant and Bar in Orlando with James Hataway on May 2009.

Her car was found abandoned near Hataway's home shortly after she was seen on surveillance video leaving the bar with Hataway.

Police executed a search warrant at Hataway's house in June 2009 after hearing from several of his friends that he was interested in the "dark arts," including Satanism, murderers and cannibalism, according to CBS affiliate WKMG. Now, according to Central Florida News 13, police have named Hataway as the suspect in Ocasio's disappearance.

Hataway has not been charged, but is currently in jail on attempted murder charges for allegedly attacking another woman.

Recently, Ocasio's parents organized another search for their missing daughter.

"Today it feels just like it did a year ago," her father Joe Ocasio told WKMG. "It just doesn't go away."

About 30 searchers from various counties started searching for Ocasio early on May 8, but found nothing.

"In some ways we also hope to find a shallow grave so we can put her to rest," her mother Elizabeth Ocasio told WKMG.

Ocasio has brown hair, brown eyes, is 5' 5" tall and weighs 120 lbs.

Crews Searching 400 Acres In Ocoee This Weekend

Crews were out searching for missing Central Florida woman Tracy Ocasio this weekend.

A team of about 35 to 40 ground searchers and eight K-9 teams with 12 dogs started looking through 400 acres in the area of North Clarke and A D Mims roads in Ocoee Saturday morning.

Joe St. Cyr, the head of the search and rescue team, said about 20 percent of the area was searched on Saturday. The search was ended at noon due to heat. It will resume again at 5 p.m. and go until dark.

The search will again resume Sunday at about 6 p.m., if necessary.

St. Cyr said Brevard and Osceola County sheriff's sent teams with human remains detection dogs. Nothing had been found as of 4 p.m., he said.

Officials said the searchers are professionals, and they're not seeking any volunteers.

OCOEE -- The family of a missing Ocoee woman are hoping for progress as volunteers start a new search for Tracy Ocasio.

That new hope comes because detectives are centering their investigation around a single suspect.

He left a bar with Tracy Ocasio and she was never seen again.

About one year after her disappearance, investigators named James Hataway as a suspect.

Teams had searched the area of AD Mims and Clarke Roads before Saturday. The possible link to Hataway generated the largest turnout since just after her disappearance more than a year ago.

"One of the things we discussed with the search teams is what were we doing when he was nervous and it happens to be this particular area we are searching again,” said Joe Ocasio, Tracy’s dad.

This time as they returned to the area, they used a grid system, meticulously going through as much of this 400-acre area to make sure no spot is left unsearched."

Eight police dog teams with cadaver dogs scoured the area. Help came from airboat and rescue teams from as far away as Tampa and local sheriff's deputies.
The area has ponds and dumping grounds.

The Ocasios say its area tipsters have told them Hataway frequented the area before he was jailed and charged in the attack of another woman.

"He's out of society now so he can't hurt anyone else, the fact they didn't pick him up before I can't go back there. What's done is done," said Liz Ocasio, Tracy's mother.

Now they want closure, and to see Hataway charged with Ocasio's murder, but for that to happen - they know her body must be found.

"There is that level of hope that maybe today or tomorrow searchers will find her and we can put her to rest. We just need anybody with any information, who did time with Hataway call police," she said.

In the meantime the Ocasios will be at every search, and every one of Hataway's court appearances.

Volunteers will return Sunday morning.

Volunteers and dozens of others have spent hours on Saturday searching several lakes and trails in Ocoee  for clues in the disappearance of Tracy Ocasio.

Her father, Joe Ocasio, said more than 45 people and at least 20 K-9 teams from the Ocoee Police Department and the sheriff's offices from Brevard and Osceola counties searched since 7 a.m.

He said boaters are searching Lake Meadow, Prairie Lake and Lake Bennet.

These are areas suspect James Hataway is known to have frequented.

The hot and muggy weather forced officials to rest their K-9 teams for several house. The dogs will rejoin the search before 5 p.m.

Ocasio's father said he and the others might be searching until 1 a.m. The search will continue Sunday.

Tracy Ocasio, 27, vanished after watching an Orlando Magic game at the Taproom bar on Raleigh Street in Orlando's MetroWest neighborhood on May 27, 2009.

She was seen leaving with Hataway, 29, who is facing attempted-murder charges in an unrelated case. He is being held in Seminole County Jail.

Her yellow Chevrolet Cobalt was found blocks from Hataway's home, which he shared with his father. Hataway told Ocoee police she had given him a ride home, but then left.

OCOEE -- There’s a possible major break in the search for missing Orange County woman Tracy Ocasio.
   
Cadaver search dogs picked up on a scent near a lake in Ocoee.

Ocasio's father told News 13 more than one dog detected something near Lake Bennett.  That's right off state Road 50 in an area where much of the search for Ocasio has been concentrated in recent months.

The family says they wanted to focus on that area after a dog picked up a similar scent during a search earlier this year.
   
It's an area where the only suspect in the case, James Hataway, was known to frequent.

Volunteers are now asking Ocoee police and the Orange County Sheriff's Office to come out to the lake to do a more involved search.
   
Ocasio hasn't been seen in more than a year now.
   
Hataway remains in jail in an unrelated case involving an alleged attack on another woman.

OCOEE, Fla. (WOFL Fox 35 News) - Joe and Liz Ocasio have been in anguish over the disappearance of their daughter Tracy for the last year. But as crews search again, their prayers may finally be answered.

"I hate to say it but we hope it is. We know that were looking for bones at this point but there's always a piece inside of you that just wishes she would walk inside back the door," Liz Ocasio said.

The Ocasios said search dogs keep alerting rescuers to something in Lake Bennett, and that it’s not the first time. In August,

"Back in August there were two dogs that picked up a scent two weeks during a previous search, we had two additional dogs pick up a scent there," Joe Ocasio said.

James Hataway was the last person seen with Tracy at a bar in Metro West. The Ocasios say Lake Bennett is an area that he’s known to frequent. He remains in the Seminole County Jail charged with attempted murder in an unrelated case.

OCOEE, Fla. -- Investigators are zeroing in on a new area in the search for Tracy Ocasio.

The missing Ocoee woman's family said police dogs picked up a scent at Lake Bennet over the weekend. It's the same area where dogs showed interest in August.

That prompted investigators to bring in divers from the Orange County Sheriff's Office.

"We have a change in behavior in the area, and with that being said it warrants more investigation," Dan Ibison of Florida Search and Rescue said.

Saturday's search covered 250 acres.

Investigators said they were able to rule out the area where Ocasio's car was found abandoned last year.

Investigators Head To Lake After Weekend Search

OCOEE, Fla. --
The search for a missing woman in Orange County sent investigators to a local lake on Wednesday.

Tracy Ocasio disappeared last year from a bar in MetroWest after being seen leaving with James Hataway.

Hataway was named a suspect in the disappearance in May. He was previously called a person of interest.

Authorities said the search on Wednesday was conducted after K-9 units showed interest in several areas around Lake Bennet, particularly the northeast shore.

The Orange County Sheriff's Office brought out a boat and torpedo sonar to take pictures and shoot video to map out the bottom of the lake.

"They did have two dogs that changed their behavior a little bit when they were at certain parts of this lake, so we asked Orange County to come out and maybe put divers in. Right now they're just mapping the lake so that they can see where to put the divers, where they would have the most luck of finding anything," mother Liz Ocasio said.
Ocoee police said they plan to review and pictures, see if they spot anything they can't explain and then send the divers in to look at it. They said the review will take a couple of days.

Ocasio, 27, vanished just after midnight on May 27, 2009, after watching an Orlando Magic game at the bar.
