Clarke said Hataway tried to snap her neck and chock her when she pulled away during a hug.

Hataway's defense team claims the woman panicked and said Hataway did not attempt murder. They say the incident was a misunderstanding.

It took two days to pick a jury in the high-profile case.

Hataway is also the only person of interest in the disappearances of Tracy Ocasio and Chris George.

Clarke says there was no mistaking what was happening to her.

Watching in on this trial are the parents of Tracy Ocasio and Chris George.

Hataway is a suspect in the disappearance of both of them in 2009.

While the judge has ruled there is to be no mention of those cases, the jury is not being sequestered during this trial.

The trial is expected to take a few days to complete.

SANFORD — Jurors will hear more testimony today in James Hataway's attempted murder trial. Hataway, 30, is accused of attacking a young woman in Seminole County in 2008. The alleged victim, Rachael Clarke, testified Wednesday that Hataway tried to kill her after she gave him a ride home after a night of partying.

Hataway is also connected to two other high-profile cases in Orange County, including the separate disappearances of Onda 'Chris' George and Tracy Ocasio in 2009.

Witness: Hataway Was Fascinated With Neck-Breaking
Posted: 12:31 pm EDT March 31, 2011Updated: 4:44 pm EDT March 31, 2011
 ::snipping2::
Malloy said Hataway had a fascination with neck-breaking.

"Did Mr. Hataway ever talk to you about a technique of breaking a neck?" asked the prosecutor.

"Well, he talked a good bit about, uh, he called it a broken stick and a sock. He liked…he liked making references to that's how a neck felt whenever it was broken," Malloy replied.

The defense tried to discredit Malloy and pointed out that he testified in a previous case and got his sentenced lowered by 40 months. He had a sentence of 260 months and it was reduced to 220. Malloy is currently facing other charges, but denied any deals with prosecutors.

"What did he tell you about the deposition?" the prosecutor asked.

"He said that it was true," Malloy replied. "He remembers some of it. He said he remembers being angry in the car. Then he kind of blacked out."

Another witness was a woman who said Hataway tried to steal a bread knife from her home just hours before he allegedly tried to break Rachel Clarke's neck.

A third witness who took the stand on Thursday said she saw a weapon fall out of Hataway's pants the night he's accused of attacking Clarke.

Hataway is also linked to the disappearance of Tracy Ocasio and Chris George. Both mothers were at Clarke's trial, but those cases will not be brought up in Clarke's case.

James Hataway: 'I was not trying to kill her'
The attempted-murder case against Hataway could go to the jury today.
By Gary Taylor and Amy Pavuk, Orlando Sentinel
11:03 a.m. EDT, April 1, 2011

SANFORD — In a surprise move, James Hataway took the stand to testify in his own defense in his attempted-murder trial, denying he attacked a young woman in 2008.

Hataway, however, admitted Rachael Clarke was hurt and he did it.

"I cared about her. I was not trying to kill her,'' Hataway said.

He said he was very drunk the evening before he allegedly attacked Rachael Clarke. He played "beer pong" and other drinking games that night.

Jurors were briefly excused as Hataway walked to the stand so they wouldn't see his leg shackles.

Hataway is also the only named suspect in another, higher-profile case. Investigators say Hataway was the last person to see Tracy Ocasio alive. The Ocoee woman disappeared in 2009. She was last seen leaving a Metrowest bar with Hataway. So far though, he hasn't been charged with Ocasio's disappearance.

Hataway is also a person of interest in the disappearance of Christopher George, who also vanished in 2009. His remains were found in an Apopka lake earlier this year.

Hataway is also linked to the disappearance of 27-year-old Tracy Ocasio. He was the last person seen with her when they left a Metrowest bar in May 2009.

Hataway said he doesn't know what happened to Ocasio. Ocoee police said he's a suspect in her disappearance, but he has not been charged.

"I'm happy as hell," said Joanne Clarke, the victim's mother.

Rachael's mom said after her daughter relived the 2008 attack Tuesday, she couldn't bear to be in the same room as Hataway for the verdict.

"It's way too much," said Joanne Clarke.

Plenty of others, like Liz and Joe Ocasio, were there to celebrate the outcome of the week-long trial.

"That brave girl today, not only did she get lucky getting away, she put a monster behind bars where he belongs," said father Joe Ocasio.

"Once we find Tracy, we'll know where he is, so we can go after him. He didn't get away that time and he's not going to get away this next time either," said mother Liz Ocasio.

Hataway's friend, Dallas White, said he is disgusted by the verdict.

"If he wanted to hurt that girl, that girl would have been dead. That guy is 10 times stronger than me. He's a big teddy bear," said White.

James Hataway gets life in prison after apologizing for attack on woman

Overcome by emotion,Tiffany Rodriguez, 30, left, of Orlando, hugs Joe Ocasio, the father of Tracy Ocasio as other people hug Liz Ocasio, second from right, after James Hataway was sentenced Monday, May 9, 2011 to life in prison for attempted murder of Rachel Clarke. SANFORD — James Hataway, the only named suspect in the disappearance of Tracy Ocasio, was sentenced today to life in prison in an unrelated case in Seminole 'County.

Hataway was found guilty in April on charges of attempted first-degree murder, robbery, false imprisonment and burglary with battery – in the attack on Rachael Clarke in August 2008.

Circuit Judge Donna L. McIntosh today handed down the life sentence in the attempted-murder charge, making it clear she was only considering the circumstances of the attack on Clarke.

McIntosh also sentenced Hataway to 30 years in prison for burglary with battery, 15 years in prison for robbery and five years in prison for false imprisonment, with the sentences to run concurrently. He was given credit for the 1,062 days he has been in jail since his arrest on the Seminole charges.

Defense attorney Jeff Leukel immediately announced that he would appeal the sentence. He had urged McIntosh to sentence Hataway to 12 to 15 years in prison followed by probation of five to 10 years.

He is also the only named person of interest in the disappearance of two other people.

Ocasio's parents were in the courtroom for the sentencing.

She was last seen leaving a MetroWest bar with Hataway in May 2009. However, he has not been officially charged with her disappearance.

Hataway was also the last person seen with Christopher George, who vanished in February 2009.

Two years later, his wallet and ID were found near human remains in an Apopka lake. Investigators said they are still waiting for tests to come back to positively identify those remains.

Hataway's attorney said he will file an appeal.
