SANFORD, Fla. -- A pretrial hearing was held Friday for James Hataway, who is accused of the attempted murder of a Seminole County woman.

The woman said she met Hataway at a party in 2008, and he tried to choke her during a ride home. He is also considered a person of interest in the death of Christopher George and the prime suspect in the disappearance of Tracy Ocasio.

Ocasio's mother, Liz Ocasio, and Rachel George, who is the mother of Christopher George, were in court. Authorities believe they've found George's remains in an Apopka lake and are awaiting positive identification.

Both women said they're comforted to know this victim survived and is willing to testify.

"She has been able to continue on with this case, and hopefully, he will pay for what he has done to her," Liz Ocasio said.

"He has done a lot in his life, and I think he needs to be held accountable for it, and I am just glad to see this happening," Rachel George said.

James Hataway attempted murder trial on track for March 28

SANFORD – Instead of asking for a delay in his attempted murder trial, James Hataway today did the opposite: He told a judge he wants it to start on time, March 28.

Hataway, 30, is charged with attempted murder for the attack on a young woman early one morning in 2008. She says that when she tried to free herself from a good-night hug, he began choking her, banged her head into the ground and twisted her neck.

If convicted, Hataway could be sentenced to life in prison.

Hataway, though, is better known as the only named suspect in the May 2009 disappearance of Tracy Ocasio, 27, who's been missing since the night she walked out of a MetroWest bar with him.

He says he does not know what happened to her.

ORLANDO, Fla. -- The attempted murder case against James Hataway starts Monday morning with jury selection in Seminole County.

Hataway is being linked to the disappearance of 27-year-old Tracy Ocasio in May 2009. Ocasio was seen on surveillance cameras leaving the Florida Tap Room in Orlando with Hataway. Her car was later found abandoned near Hataway's home but she hasn't been seen since.

Hataway said he doesn't know what happened to Ocasio.

Ocoee police say he's a suspect in her disappearance, but he has not been charged.

However, Hataway is being charged with attacking another young woman in 2008.

The mothers of Ocasio and George will attend Hataway's trial at the Seminole County courthouse, and both said it will be hard hearing testimony about his alleged attack on Clarke.

"If he ever gets out, a lot of people will have to worry," said Tracy Ocasio's mother, Liz. "I'm going to be pretty much of a wreck because I'll be thinking the whole time that this is probably what happened to Tracy -- and it just went even farther than what happened with (Clarke)."

Tracy Ocasio disappeared after leaving a MetroWest bar with Hataway. George vanished in a wooded area in Apopka after last being seen with Hataway and others.

Ocasio, 27, was last seen leaving a MetroWest bar with Hataway May 27, 2009. He has not been charged in her disappearance.

He's also been tied to the disappearance of Onda "Chris" George, 29, who also disappeared in 2009. Apopka police recovered bones from Lake Carter last month that have tentatively been identified as George's.

A medical examiner has not determined a cause of death, and police say they have found no evidence of foul play.

Hataway is not facing any charges in either case, but Tracy Ocasio's parents are still convinced he is responsible for her disappearance or at least knows where their daughter is. That's why they plan to follow Clarke's case closely.

"I made a vow to my daughter that I would go to every single appearance that he made," said Liz Ocasio.

During the trial, a former cellmate of Hataway's, Thomas Malloy, is expected to give a key testimony.

Malloy says Hataway told him that he was obsessed with "breaking people's necks."

Malloy is in the Federal Witness Protection Program and his face will be hidden when he takes the stand.

However, it is uncertain if the testimony and the state's other evidence will be enough to convict Hataway and keep him in jail.

"Regardless of what happened to our daughter, this man should be off the streets period before he hurts someone else," said Ocasio's father, Joe Ocasio.

Eyewitness News' legal analyst Bill Sheaffer said there's a possibility that Hataway could walk free, and investigators in the Ocasio and George cases could no longer have confidence knowing where he is at all times.

Hataway faces life in prison if he is convicted.

Now, after spending nearly two years in jail, Hataway, 30, will have his day in court, facing four charges:

    * First-degree premeditated murder
    * Burglary of a conveyance with a battery
    * False imprisonment
    * Robbery

Clarke said she gave Hataway a ride home from a party in 2008, when he attacked her.

The alleged confrontation began in the car, when Clarke said Hataway tried to hug her, and would not let go.

According to Clarke's testimony, Hataway put her in a choke hold. She managed to escape, but fell down after getting out of the car.

That, Clarke said, was when Hataway grabbed her by the hair and slammed her head against the ground four times. She said she believes Hataway also tried to snap her neck.

Prosecutors have released a 911 call from a woman who heard Clarke scream. The caller told the operator: "The man [was] about to kill her," and asked for an ambulance.

But Clarke did not report the attack until nearly a year later, when a woman from Ocoee was reported missing after leaving a MetroWest bar with Hataway.

Tracy Ocasio was last seen alive in May 2009, when surveillance video showed her and Hataway leaving the bar together.

Tracy Ocasio was last seen leaving the Florida Tap Room Restaurant and Bar in Orlando with James Hataway on May 2009. The 27-year-old has brown hair, brown eyes, is 5-feet-5-inches tall and weighs 120 lbs. “We have to find a good jury, hopefully will listen to all the evidence and convict,” said Ocasio's mother, Liz Ocasio.

But, attorneys are concerned jurors will use their knowledge of those cases in this case.

The attorneys had to dismiss two potential jurors because one was Ocacio's co-worker and the other knew Hataway's ex-girlfriend.

Hataway's criminal history stretches back to when he was a child. He was in and out of juvenile detention between 1993 and 1998 and the worst crime he committed at that age was kidnapping.

He had eight convictions total, plus two as an adult.Hataway also has an extensive record of drugs, DUI, and traffic violations. This could all impact the sentencing, if he's convicted.

Hataway's lawyers said after interviewing close to 100 potential jurors, they're still not happy and they want 75 more people brought in from a leftover case. That totals up to three times the normal pool that would be interviewed for a case such as Hataway's.

Potential jurors had to fill out a questionnaire for this case. Attorneys hope to narrow the pool to 50 jurors and then pick six with a couple of alternates.

Defense lawyers said they want the people on the jury to have "no idea" who Hataway is. Prosecutors argue that doesn't matter, as long as the jurors are fair.

The defense is also asking jurors if they've heard of the case against Casey Anthony and the scandal surrounding the police chief and manager for the town of Windermere, to gauge how much TV news they watch.

On Wednesday, jurors could hear testimony from Hataway's alleged victim, Rachel Clarke. She claims Hataway tried to strangle her in 2008.

Florida Statute 913.10 Number of jurors.--Twelve persons shall constitute a jury to try all capital cases, and six persons shall constitute a jury to try all other criminal cases.
