"They would be derelict not to consider (Gardner) in this investigation," said Kerry Steigerwalt, a prominent San Diego defense attorney. "Let's give the police the time they need to make the case as solidly as they can make it."

Steigerwalt said it's unlikely that Gardner gave police information on Amber's case because his defense attorneys would have advised him against talking to investigators.



Information did come in and the location was revealed by some person with Knowledge..
That person will someday be revealed.. Not today.

Just relax and let our justice system operate.

A note from Pearl at BFN.. 

I'm glad this child is now going to be resting where those who love her will come, say good things to her and let her know how much they miss her.  It is a sad find, but a win find for those who know, love, and miss her. 

My condolences to all as fear now turns to grief and anger at this horrific taking of life.  I so hope it was this same monster and that he will never again be free to roam among the innocent.  Evil less by 1.

The parents of slain Escondido teenager Amber Dubois asked mourners last night to turn their anguish into action by pushing for tougher penalties and stricter laws to protect children from predators. Hours earlier, Escondido police said the investigation into Amber’s death remains focused on convicted sex offender John Albert Gardner III.

Amber’s parents, Moe Dubois and Carrie McGonigle, joined more than 1,000 people at Escondido High School for a candlelight vigil in memory of their daughter, whose remains were found Saturday in a wooded hillside in Pala after a 13-month search.

Escondido police say Gardner, who was charged last week with raping and murdering Poway teenager Chelsea King, continues to be a suspect in Amber’s case.

Dubois told those at the vigil: “Please take a minute for every tear you have ever shed for Amber, for Chelsea and for any other child who has suffered at the hands of these predators, and come back tomorrow and take just as many minutes of action in our fight to protect our children.”

McGonigle added: “We do need to make changes, and hopefully with the support of all the parents, we’ll be able to change the laws to make things safe.”

It was the second vigil in a week to commemorate a North County teenager. Thousands attended a similar event March 2 for Chelsea at a Poway church. The teens’ disappearances were eerily familiar, and each story ended in tragedy.

Escondido Police Chief Jim Maher told the hushed crowd last night that there’s never closure in a case like Amber’s but that their support helps the family heal.

“The Escondido Police Department, San Diego Sheriff’s Department, FBI and all the other agencies have and will continue to do everything else to bring this investigation to a resolution and successful prosecution,” Maher said.

Investigators have questioned whether Gardner played a role in Amber’s disappearance after he was arrested Feb. 28 in the Chelsea King case. Escondido police issued a statement yesterday to say Gardner, who received six years in prison in 2000 for molesting and falsely imprisoning a 13-year-old girl, remains “a focus” of their investigation.

Amber, a 14-year-old Escondido High School freshman, disappeared Feb. 13, 2009, as she walked toward the campus an hour before class. Her skeletal remains were found Saturday west of Pala Temecula Road, about three miles north of the historic Pala Mission and the Pala Casino. Police kept people out of the area yesterday as they searched for evidence.

In August, two dogs from Virginia-based VK9 Scent Specific Search and Recovery Unit, an organization dedicated to finding missing people, searched for Amber at her family’s request. The dogs were given Amber’s scent and tracked it to Pala. The information was passed along to police.

In an interview last month, Escondido police Lt. Bob Benton said detectives went to Pala and interviewed many people, most of whom were aware of Amber’s disappearance but none recalled ever having seen her. Then, in November, a different set of tracking dogs, often used by the FBI, were brought in to see if they could duplicate the finding. They could not.

Dubois had nothing but praise of law enforcement officials yesterday, but he did say he is angry about misinformation being spread by a private investigator the family hired shortly after Amber disappeared. He said that neither he nor McGonigle has spoken to private investigator Bill Garcia since their daughter’s remains were found.

“Carrie is livid that he is going out and speaking on behalf of the family,” Dubois said. “We haven’t talked to him.”

Garcia told The San Diego Union-Tribune in a phone interview Sunday afternoon that the tip leading investigators to Amber’s remains did not come from Gardner. A few minutes later, when he was asked again about the tip and how he knew it didn’t come from Gardner, Garcia said, “I talked to someone who knows it firsthand.” He said he couldn’t say any more without getting into trouble.

Garcia changed his story when contacted yesterday.

“What I said was somebody close to the family called me and said they had found Amber’s body near the Riverside County line,” he said. “That’s all they told me. I then said it’s my belief that the tip did not come from Gardner. That was just my opinion. I haven’t been told that.”

Garcia said he hasn’t worked for the family in nearly a year but has been doing some investigating on his own and feeding all of his findings to Escondido police.

Gardner, 30, of Lake Elsinore, could face the death penalty if convicted in Chelsea’s death. She disappeared Feb. 25 while heading for an afternoon jog at Rancho Bernardo Community Park. Her body was found March 2 in a shallow grave near Lake Hodges, about a half-mile from where her car was parked.

Semen found on Chelsea’s clothing led to Gardner’s arrest.

Chelsea’s parents, Kelly and Brent King, released a brief statement yesterday.

“We have spoken with the Dubois family and our hearts go out to them in this time of deep sadness,” they said. “We share their indescribable grief for the loss of Amber’s precious young life.”

The car used in the attempted abduction of a Lake Elsinore girl in October was hardly nondescript. It was a gold 1990s four-door sedan.

Turns out the man accused last week of raping and killing Poway teenager Chelsea King drove a gold 1999 Pontiac with four doors. He was most recently living and registered as a convicted sex offender in Lake Elsinore.

John Albert Gardner III was driving the Pontiac in June when he was stopped on Interstate 15 near Escondido going 82 mph in a 70-mph zone, according to court records The San Diego Union-Tribune obtained Monday. 

A California Highway Patrol officer cited him for driving without proof of insurance.

DMV records show Gardner has owned the car since June.

Gardner, whose face resembles an artist’s sketch authorities released after the Oct. 28 incident in Lake Elsinore, lived less than four miles away from where the attempted abduction occurred.

Sgt. Joe Borja, a spokesman for the Riverside County Sheriff’s Department, which is investigating the incident, said deputies know about the car Gardner drove but are looking for “something solid.”

“Many people drive gold Pontiacs,” Borja said. “I would venture to say that if you called Pontiac and asked them how many they put out, it’s a big number.”

He said the car connection is “big enough to be interesting, but it’s not big enough to file a case on him at this point.”

Borja said Gardner has not been named as a suspect in the October incident in which a young girl, whose name and age authorities are not releasing, said she was walking to a friend’s house before school when a man in a car approached her. He asked for directions, showed her a handgun and demanded she get in.

She refused and ran away.

She described him as unshaven, white, 30 to 35 years old, with a fair complexion, blond crew cut and brown eyes. Gardner is 30.

He was paroled in September 2005 after serving five years in prison for molesting a 14-year-old girl when he was 20. Since then, he has lived in Escondido and Lake Elsinore, and stayed at times with his mother in Rancho Bernardo.

He has been cited for several traffic violations since December 2006, when he failed to stop at a red light in Loma Linda. He was cited for marijuana possession in Buccaneer Park in Oceanside in November 2008 and for an open container of alcohol and not having his license in Escondido last April.

Riverside County deputies began exploring Gardner’s potential involvement in their attempted abduction after he was charged Wednesday with 17-year-old Chelsea’s murder.

A news release about the investigation had been removed from the sheriff’s Web site but was restored, along with the artist’s composite sketch, on Thursday.

Has anything official been revealed in regards to the origin of the tip.

Considering the timeframe encompassing the finding of Amber's remains ... I suspect that JAG may have been offered a plea deal.

On the other hand ... maybe the August, 2009 findings of the private investigator hired by Amber's grandmother were disregarded by LE and ... were only investigated recently to establish a possible link between the Amber and Chelsea cases.

Something has occurred in the Chelsea case with Gardner that has led the officials to the remains of Amber. There`s no doubt in my mind about that at all.

And I agree with you, I hope that it`s not some kind of a compromise, some kind of a plea deal to keep this character off of death row, which is exactly where he belongs to be -- or exactly where he belongs.

NANCY GRACE, HOST: I can tell you this much, Marc Klaas. If they have cut a deal with the devil and spared him the California death penalty in exchange for those whereabouts of her remains, there`s going to be hell to pay.

KLAAS: Well, the irony is, is that they don`t actually execute in California, which is unfortunate. But you know, if he`s not the one, if somebody else did it, then there`s another homicidal maniac on the loose in San Diego, and that`s the last thing anybody needs to hear.

Suspect in King homicide still a focus of Dubois case

The convicted sex offender charged with the slaying of Poway teenager Chelsea King remains the focus of the investigation into the slaying of Escondido teenager Amber Dubois, Escondido police said Monday.

Escondido police Lt. Craig Carter issued a statement saying John Albert Gardner III continues to be a suspect as investigators search the hillside in Pala where 14-year-old Amber’s skeletal remains were found Saturday.

Moe Dubois, Amber’s father, said Monday that he couldn’t discuss any details of the investigation that have been shared with him. He said police have not told the family what led them to his daughter’s remains.

“We’re on a gag order,” he said.

Investigators have openly questioned whether Gardner played a role in Amber’s disappearance since semen on a piece of Chelsea’s clothing led to Gardner’s arrest on Feb. 28. The police statement appears to indicate that those questions remain even after the discovery of Amber’s remains.

Amber, a student at Escondido High School, disappeared Feb. 13, 2009, as she walked toward campus an hour before class. Until Gardner’s arrest, police said they knew nothing more about her whereabouts than they did on the day she went missing.

The remains were found west of Pala Temecula Road, about three miles north of the historic Pala Mission and the Pala Casino. There is a single-lane asphalted road that leads up a steep mountain and then over a hill. The grave appears to be out of sight over the hill.

Two law enforcement officers guarded the entrance to the road Monday morning keeping people out, and “no parking” signs were posted along the few turnouts within a half-mile either north or south of the road.

Dubois said he was eating dinner at a restaurant Saturday when he was called and asked to come to Escondido police headquarters, where he and Amber’s mother, Carrie McGonigle, were told the news.

“Everything is going to change for us,” Dubois said. “It’s going to be so much different.”

Disappearance of Leticia still haunts many
Young girl’s abduction in ’89 brought national attention

The discovery of Amber Dubois’ skeletal remains along a remote road near the Pala Indian Reservation this past weekend brought back painful memories of a similar discovery in the same brush-filled canyon 19 years ago today.

Leticia Hernandez, 7, had been missing for 15 months when a caretaker working on property off Pala Temecula Road found a human skull. Dental records from Leticia, an Oceanside second-grader, were a match.

The discovery that day, March 9, 1991, ended a search that had captured the nation’s attention as sightings of the black-haired girl — usually in the company of a blond-haired couple in a maroon sedan — spread across the country.

The case was featured on the TV shows “America’s Most Wanted” and “Unsolved Mysteries” and was listed for a year as the nation’s top child-abduction case by the National Center for Missing and Exploited Children.

It even spawned a song, “Leticia We Love You,” written by an Oceanside police detective.

For those touched by Leticia’s case, the discovery of remains identified as Amber, a 14-year-old Escondido High student missing for 13 months, was like the tearing away of scar tissue. It hurt.

“That’s really eerie,” said Doug Sebastian, founder of KinderVision, a nonprofit child-safety organization that sprang up from the Leticia case. “That’s pretty isolated out there. Unfortunately, we’ve got a north San Diego County dumping ground for missing kids.”

It’s not just kids. The bodies of at least four women were found in that same area in the 1980s at a time when authorities were investigating a series of about 45 killings. Many of the victims were prostitutes.

Leticia’s killer has never been caught. A registered sex offender who was 40 at the time and lived a block away was reportedly the subject of a federal grand jury investigation in the weeks after her remains were found. Nothing came of it.

The only apparent connection between her case and the current investigation is the proximity of the remains — Leticia’s on the east side of the road, Amber’s on the west — roughly two miles south of the Riverside County line.

Leticia lived about 25 miles away, in an apartment in the 1300 block of Bush Street, a block east of Interstate 5. On Dec. 16, 1989, two days after her 7th birthday, she was playing in the front yard about 5 p.m. while her mother went to a nearby laundry room. When her mother returned 10 minutes later, the girl was gone.

Police were called. The initial focus was on reports that a man in a late-model black Cadillac had been seen in the neighborhood, offering children $50 to get into his car. That went nowhere.

“We don’t have a good feeling on this case,” an Oceanside police officer said at the time.

Then the sightings started, first at a Buckman Springs rest stop in East County, seven hours after she vanished. Ten days later, she was reported on Interstate 10, just west of the New Mexico border.

In all, police received more than a dozen “confirmed” sightings, reports where the witnesses were able to pick Leticia out of a photo lineup. The last one, in March 1990, was at a gas station in Greensboro, Fla.

Because of the coast-to-coast sightings, and because the abduction happened so close to the Christmas holidays — Leticia’s family refused to open presents while she was missing — the public was riveted by the case.

Her classmates at Palmquist Elementary School rotated what desks they sat in, so that Leticia’s was never empty. Baseball star Rollie Fingers headlined a fundraising benefit. Chris McDonough, an Oceanside police detective, composed the ballad, which was later made into a video.

McDonough, who moved to a Dallas suburb after retiring from the Oceanside force in 2003, remembers the case as particularly disturbing.

“This little girl was standing in her front yard and she evaporates,” he said.

He would like to see the case reopened.

“You can always hope for that,” McDonough said. “Any murdered child you want to see investigated fully.”

Oceanside police Sgt. Jeff Brandt said he knows of no plans to revisit the case. Police shelved it in 1992, after exhausting all available leads. Brandt said he believes cold-case detectives last looked at it about two years ago.

All the detectives originally involved are retired.

According to news accounts at the time, police looked hard initially at the sex offender, a landscaper who was married and had three children. The string of sightings cooled their interest in him, until Leticia’s skull was found. A federal grand jury then investigated him, but he was never arrested.

Searchers combed the area for days. No other bones were found. Investigators said they collected three dozen pieces of evidence, including some of Leticia’s clothing.

The medical examiner eventually concluded she had died within three months of her abduction.

Leticia had five siblings when she disappeared. Attempts to reach them for comment yesterday were unsuccessful. Her mother died of cancer in February 1998.

Probation report cites predatory traits of suspect

LOS ANGELES — A decade-old probation report on a sex offender accused of murdering Southern California teenager Chelsea King says a psychiatrist concluded he had "significant predatory traits" toward underage girls.

The report released by a San Diego court on Tuesday was prepared in 2000for the sentencing of then-20-year-old John Albert Gardner III after he pleaded guilty to committing lewd acts on a 13-year-old neighbor girl. The victim was also punched repeatedly.

The psychiatrist called for the maximum possible sentence.

The probation officer recommended a so-called middle term of six years, reasoning in part that Gardner had no prior criminal record. The judge ordered six years and Gardner served five.

Gardner has pleaded not guilty to King's slaying last month and a December assault.

ESCONDIDO, Calif. (AP) — A convicted sex offender charged with murdering one teen and suspected in the death of another appeared in court Tuesday as a judge issued a gag order and delayed a key hearing in the case.

Defendant John Albert Gardner III spoke only to acknowledge that he waived his right to speedy proceedings.

Superior Court Judge David J. Danielsen rescheduled the preliminary hearing from March 18 to Aug. 4. The hearing is meant to show if there is enough evidence to send Gardner to trial.

The defense sought a September date, and the prosecution wanted the hearing by July.

Danielson also issued a gag order on parties in the proceedings.

Gardner has pleaded not guilty to murdering 17-year-old Chelsea King. She vanished Feb. 25 and her presumed body was found March 2 in a grave in a park north of San Diego.

The case against Gardner also alleges he raped or tried to rape King.

Public defender Michael Popkins, who represents Gardner, declined to comment after the hearing.

Gardner is also under investigation in the death of 14-year-old Amber Dubois, whose remains were found Saturday 10 miles from the site where King disappeared.

At a Monday night vigil, the father of Dubois, whose bones were found more than a year after she vanished walking to school, urged supporters to behave like his late daughter's favorite animal, the wolf, to hunt down child predators.

"Wolves hunt to survive, wolves hunt together to catch their prey," Maurice Dubois told more than 1,000 mourners at the candlelight vigil. "We as parents and the community need to make a change for the protection of our children."

Mourners held a moment of silence for Amber Dubois and Chelsea King.

Escondido police say Gardner, 30, is also a focus of their investigation into Amber's death.

Carrie McGonigle, Amber's mother, said laws need to be changed.

"I still see a lot of children walking by themselves and it scares me," she said on a chilly night in the courtyard of Escondido High School, near the spot where Amber disappeared Feb. 13, 2009.

Police said Amber's remains were identified through dental records. They have not said what led them to the remote area near Pala because the discovery is part of a murder investigation.

Dubois noted in his remarks that rumors his daughter was a runaway hampered the family's efforts to bring national media attention to their search. Gardner's arrest three days after Chelsea King disappeared renewed interest in Amber.

Kelly Elsbernd, a cousin, said she and Amber grew up drawing animals together and pretending to be seals and otters when they went swimming.

"They never really played with dolls," said Nicole Elsbernd, Kelly's mother. "They played with bugs."

Jade Fidel, Amber's best friend, said Amber had two dogs, a cat and a bird, but wolves were her favorite.

"She liked them," Fidel said. "They were free, independent."

Gardner was registered as a sex offender in Escondido from January 2008 to January 2010, with some gaps, according to police. He served five years of a six-year prison term for molesting a 13-year-old neighbor in San Diego in 2000 and completed parole in September 2008.

Has anything official been revealed in regards to the origin of the tip.

Considering the timeframe encompassing the finding of Amber's remains ... I suspect that JAG may have been offered a plea deal.

On the other hand ... maybe the August, 2009 findings of the private investigator hired by Amber's grandmother were disregarded by LE and ... were only investigated recently to establish a possible link between the Amber and Chelsea cases.

MARC KLAAS, KLAAS KIDS FOUNDATION:  Nancy, I don`t believe in the coincidence of crime. I believe there is direct linkage between these two cases. Something has occurred in the Chelsea case with Gardner that has led the officials to the remains of Amber. There`s no doubt in my mind about that at all.

And I agree with you, I hope that it`s not some kind of a compromise, some kind of a plea deal to keep this character off of death row, which is exactly where he belongs to be -- or exactly where he belongs.

NANCY GRACE, HOST: I can tell you this much, Marc Klaas. If they have cut a deal with the devil and spared him the California death penalty in exchange for those whereabouts of her remains, there`s going to be hell to pay.

KLAAS: Well, the irony is, is that they don`t actually execute in California, which is unfortunate. But you know, if he`s not the one, if somebody else did it, then there`s another homicidal maniac on the loose in San Diego, and that`s the last thing anybody needs to hear.

LAWRENCE OLMSTEAD, PRIVATE INVESTIGATOR HIRED BY AMBER DUBOIS` GRANDMOTHER:  What happens is they (dogs) hit at three locations within the Indian Reservation. And we immediately followed up with people in these locations. Each one of the locations, for one, had people associated with it at the time we were there.

And immediately to, you know, speak to people we started interviewing witnesses, people that were at these locations, learned as much as we can about the locations and obviously showed flyers and photographs and tried to establish whether or not had anyone seen her, Amber, at these locations.

GRACE: Well, did you give the information to police?

OLMSTEAD: We did. On August 24th I prepared a final report on our visit to Pala to my client and we also supplied Escondido Police Department a copy of the same report for their review and follow-up investigation.

Garcia told The San Diego Union-Tribune in a phone interview Sunday afternoon that the tip leading investigators to Amber’s remains did not come from Gardner. A few minutes later, when he was asked again about the tip and how he knew it didn’t come from Gardner, Garcia said, “I talked to someone who knows it firsthand.” He said he couldn’t say any more without getting into trouble.

Last I heard this Garcia PI guy is FOS and he retracted that statement.
