Grandmother: Police 'Disrespected' Amber By Ignoring Report
Sheila Welch Says Dog Team Picked Up Trail 6 Months Ago

ESCONDIDO, Calif. -- Amber Dubois' grandmother said she is bouncing between sorrow and anger -- with that anger directed at the Escondido Police Department.

"She should be a sophomore in high school now. But she's not," said Sheila Welch, Amber's grandmother.

Welch told 10News she's a mixed-bag of emotions. She's sad for Amber, but angry at the police because she said they did not consider information gathered by privately hired scent-sniffing dogs.

"They disrespected my granddaughter by ignoring the report," said Welch.

The report showed the dogs had followed Amber's trail from Escondido to the Pala area last August.

When the announcement was made this weekend that Amber's remains were found in the Pala area, it outraged Welch, who had hired the dog team from Virginia.

Welch said a full report was given to Escondido police six months ago.

"And if it turns out that Amber was alive at that point in time … it would be an absolutely unforgivable error in judgment for them to have ignored it," said Welch.

Escondido police did not return 10News' calls.

In the meantime, Welch said she is agonizing over the loss of her granddaughter but wants to make sure it never happens again.

"And how many times are we going to continue to let this happen? Whose child is it going to be next?" said Welch.

Search Team Captain Details Search
Sarah Platts of the VK9 Scent Specific Search and Recovery Unit told 10News from her Virginia home that it took her dogs less than a day to follow Amber's trail to Pala.

"That's where we went. That's where we ended up at and that's what we relayed to the police department," said Platts.

Platts said her team started their search at Amber's Escondido house the first night they were in San Diego County. The dogs took them from the home, past the school and onto Interstate 15. The team put the dogs in a truck, drove north and got out at every exit to search.

"Then we just started working down the interstate until we reached the Pala exit. At that point the dogs wanted to exit the road," said Platts.

The team worked their way inland to a spot near where police found Amber's remains.

"It's always questionable when it's an asset that's brought in by the family. They're held a little bit suspect by the police versus an asset the police department themselves have brought in," said Platts.

Platts said Escondido police never responded to her report.

"If they considered us credible, I don't know. I didn't quite get that feeling that they were very interested in what we had done, though," said Platts.

The convicted sex offender charged in the murder of Poway teenager Chelsea King remains the focus of the investigation into the slaying of Escondido teenager Amber Dubois, Escondido police said Monday.

Escondido police Lt. Craig Carter issued a statement saying John Albert Gardner III continues to be a suspect as investigators search the hillside in Pala where 14-year-old Amber’s skeletal remains were found Saturday.

Moe Dubois, Amber’s father, said Monday that he couldn’t discuss any details of the investigation that have been shared with him. He said police have not told the family what led them to his daughter’s remains.

“We’re on a gag order,” he said.

Investigators have openly questioned whether Gardner played a role in Amber’s disappearance since semen on a piece of Chelsea’s clothing led to Gardner’s arrest on Feb. 28. The police statement appears to indicate that those questions remain even after the discovery of Amber’s remains.

Amber, a student at Escondido High School, disappeared Feb. 13, 2009, as she walked toward campus an hour before class. Until Gardner’s arrest, police said they knew nothing more about her whereabouts than they did on the day she went missing.

The remains were found west of Pala Temecula Road, about three miles north of the historic Pala Mission and the Pala Casino. There is a single-lane asphalted road that leads up a steep mountain and then over a hill. The grave appears to be out of sight over the hill.

Two law enforcement officers guarded the entrance to the road Monday morning keeping people out, and “no parking” signs were posted along the few turnouts within a half-mile either north or south of the road.

Dubois said he was eating dinner at a restaurant Saturday when he was called and asked to come to Escondido police headquarters, where he and Amber’s mother, Carrie McGonigle, were told the news.

“Everything is going to change for us,” Dubois said. “It’s going to be so much different.”
    KLAAS, on the tree is USA and on the street earlier there was spray painted USA  and some other words. Was that from LE or from something else? I mean the arrows on the street saying USA and on the street? Sorry if this has already been asked. TIA JSM Could it be for a marathon or one of those hashin things?

JSM - I'm just not sure.  I know that there are plans in the works to widen highway 76 but this is way off of 76.  I really don't know.

Grandmom has every right to be rip roaring pizzed off if Escondido LE just tossed the report aside about the dogs trail.  It is a very good thing I don't live down there or I would be going ballistic on someones arse right now until they proved what they did to follow up on the report.

I am a believer in the death penalty but ... when I consider Amber's family living in a perpetual state of not knowing ... I think maybe a deal would be exceptable as long as that monster never experiences another day of freedom.

Hi Janet, I agree with your thinking. Besides rapists and child killers don't do well in prison.........he might do the world a favor and kill himself.  But I would really love to see these monsters put to death in a public forum and forget being such a 'civilized society', when dealing with these monsters.

I would assume that the truth regarding the origin of the "tip" should be revealed soon.  It is the timing that causes me to suspect that it is Chelsea's killer (JAG).

JSM - I'm just not sure.  I know that there are plans in the works to widen highway 76 but this is way off of 76.  I really don't know. 

Cartfly made a good find that there are hashs that have taken place out there as well. Not sure what the green symbols are under the white USA writing but here is the map from the hash site.  Looks like they started at the Casino.

Good Night Janet.  I think if a deal was struck the public would be furious.  He has already had his chance at rehabilitation after beating the tar out of a 13 year old.  Proves yet again that second chances are at the cost of innocent children.

To be honest I am on the fense about the DP. Sometimes I am for it, other times I am not. I think it depends on the case. Anyway, with this one I would not mind one bit if they executed JAG for his crime, but if they took it off the table in return for his saying what he did with Amber or other victims, I would approve.
I think the thought of having a poor kid murdered and just dumped is just to horrible to think about.

No kidding they have a lot of explaining to do and although they want to save their reputation it is too flippin bad. Not only did they disregard the report but they told the family not to talk about it and they hid it. Can you imagine if that information had come out then? I think we would have had a totally different outcome. There is no excuse for what we have found out, no excuse.

We have learned.... even though we would wish not to have anyone deceased before their time...

I am having difficulty putting this into words...

Dogs who look for deceased would have been nice after the first ones hit on 3 places but I think the family, like most of us, would rely on the LE to follow up.

We must here, make sure their are answers from the LE on this.

I know of a family a missing girl who still pays for searches for her in the ocean just because the unregistered sex offender involved said he panicked and put her there.

Yes, those in CA prisons usually live a longer life then those on death row, but it sure is costly for CA residents.

If the law in place was followed, the one we voted for state=wide was followed we wouldn't have had 17000 released last year.

How Sex Offenders Are Processed

John Gardner III, a registered sex offender, is suspected of multiple violent crimes. The allegations are raising concern for many about how closely sex offenders are monitored.

Garner is suspected in several cases:

He's suspected in the death of Amber Dubois, 14, of Escondido. The missing teen's body was found Saturday in Pala.
Gardner has already been charged with the murder and rape of Chelsea King, 17, of Poway. He has pleaded not guilty to the charges.
He is also charged with attacking a 22-year-old jogger in Rancho Bernardo Community Park. Gardner pleaded not guilty to that charge.
Riverside County Sheriff's Deputies are also investigating a possible connection to an attempted kidnapping in Lake Elsinore in October.
Gardner is a registered sex offender here in Riverside County. He admitted to molesting and beating a neighbor girl in 2000. He served five years in prison before he was released.

"They are required to register for the remainder of their life," said Deputy Randy Paulsen, with the Riverside County Sheriff's Department Palm Desert station. Deputy Paulsen registers sex offenders in the local database which he says is connected statewide.

He says requirements for sex offenders are stringent.

"If they move, they have to notify the jurisdiction where they're moving from and where they're moving to," Paulsen said.

At least once a year, sex offenders are contacted and must update where they live, work, their phone numbers.

Our county's S.A.F.E task force also goes to their homes to do compliance checks. All registered sex offenders are listed on the California Megan's Law website allowing the public to check if a sex offender lives nearby.

Sex Offender Registration

There are 500,000 registered sex offenders across the country, said Mika Moulton, with Christopher's Clubhouse, a youth empowerment non-profit group.

Moulton says 100,000 thousand sex offenders are not listed though.

"(Who) are nowhere to be found. They've disappeared (or moved from) one state or another," Moulton said.

In Gardner's case, he was registered in San Diego County when police believe he attacked a girl in Riverside County. He wasn't considered a person of interest until recently.

Deputy Paulsen says even though sex offenders are monitored closely, the public should always stay vigilant.

"Just because a guy stays in compliance (and everything looks good), you never know," said Paulsen.
