There were hundreds of people that came out tonight to show their love and support at the vigil. There were many speakers and Moe, Amber's father hit home. He wants to change the laws so that we have rights and not these predators. It was so wonderful to see the community coming together even though the occasion was so sad. We have to do anything that we can to make sure that our laws protect our children. There were new buttons tonight with Amber's beautiful angelic face. These buttons now say "Justice for Amber". I have no doubt in my mind that the Dubois family will make sure that justice is served. Although I have never met the King family, I feel that they too will make sure that Justice is served for Chelsea. This has been a sad sad time for San Diego County.

Thanks Mizjay and Sebastian for the updates! I know that it must have been heart breaking to be there. an angelic monkey an angelic monkey

Ya know Cartfly, I can get so riled up about these things but it is heartbreaking to know that most of these horrible things are preventable. I'm so sick of talking heads using the tragedy de jour for ratings and then the interest in change slowly ebbs away, I pray that the enormity of this is too big to slip under the rug.

I hear what you are saying Mizjay! One of the searchers for Amber said to me tonight "don't get me wrong, I am so happy to see everyone here, but where was everyone when Amber was missing?".

You are so right, everyone has so much interest at first then slowly it becomes a distant memory. Our children depend on us to protect them and we can't continue to fail them this way. I really feel the enoromous amount of attention that Chelsea and Amber are getting may finally change that. There has to be something positive to come out of all of this. These beautiful girls didn't die in vain. I truly hope this tragedy finally brings about change. an angelic monkey an angelic monkey

Where I live they put all the utilities underground a few years ago. I remember "USA" and was laughing with them. Could it be Underground Sewage something??

From the Fox video it looks as if the road continues way into the wilderness. Where does it end?

Does it looks to you all that the body placement was at a trash site loop?

It's a sad fact that sometimes until we are pummeled with unavoidable reality that yes, it could happen to us, yes,  sometimes we don't take the time to be helpful. We always assume that others are doing it, and honestly in Ambers case, it was confusing. It seemed like that LE was alluding that she was a runaway, details about searches were hard to come by thru the paper or LE, it was weeks before I think a lot of ppl. realized that indeed she was missing and had not returned home.  Sadly, in her passing, Amber has helped us to see the importance of taking a stand and working to make our towns safer

Yes, it was heartbreaking but so very touching. You would not believe all of the gifts and flowers. There was also a huge turnout from the Hispanic community in Escondido. It was so nice to see so many people who care. It is like when my kids see these horrible things and I tell them "yes, there are many bad people in this world, but there are so many more good, loving, people". That showed tonight!
I hope the support and love brings Amber's family some peace. I am brought to tears thinking of how a Mother or Dad goes on after something like this. I pray God gives them strength to find happiness again in there lives.

I do not remember the "USA" being on the tree in the initial photos. I wonder too, why it would be there after see the pic of it on the street already.

The loop I "think" might be a turnaround?? I heard something mentioned in the radio broadcast about "turnarounds" in the area though it could be a trash site as well. I am not quite sure. It also looked as though the loop was elevated like on "top" of a hill.

Did you notice JAG's mom has the same neck he does?

It seems his MO is to hang out at places where kids are early in the morning.  He appears to attack kids who follow the same routine, for example, Chelsea was home by a certain time every day and Amber also was a girl who didn't seem to stray from routine and was not a wild unpredictable child.  I know what I want to say, I am just having trouble putting it into words.

Vigil for Amber Dubois draws more than 1500 mourners

A candlelight vigil organized by the family of Amber Dubois drew more than 1,500 people to Escondido High School on Monday, just a day after police announced the skeletal remains of the 14-year-old had been found.

Amber's parents, Maurice Dubois and Carrie McGonigle, were among those who spoke and prayed.

Brent and Kelly King, parents of murdered teen Chelsea King, also attended the vigil for Amber. They greeted Amber's parents and the mothers shared a long embrace.

As the vigil came to an end, a spontaneous rendition of "Amazing Grace" started quietly and spread through the crowd.

Earlier in the day, students, staff and teachers filed into Escondido High School on Monday morning, with the grim discovery of Amber Dubois' body heavy on their minds.

The bookish high school freshman vanished while walking to the school Feb. 13, 2009, under similar dark rain clouds that drenched the suburban campus Monday morning. She was 14.

Law enforcement discovered her skeletal remains in Pala on Saturday.

Extra counselors were on hand throughout Monday at Escondido High. Grieving students, teachers and staff reached out to them and one another, said Karyl O'Brien, spokeswoman for the Escondido Union High School District.

Teachers spoke with their classes at length about Amber and issued safety reminders, students said. The school also observed a moment of silence in honor of the teen Monday morning.

Classmates also wrote messages on large banners that will be presented to Amber's family.

"It's just so hard to believe that someone so alive could have their life taken," said Karen Truong, 14, a freshman at the school who knew Amber from middle school.

Truong and others observed growing sets of memorials to Amber along north Broadway in front of the school. Hand-written notes, candles, stuffed animals, including Amber's favorite animal, a wolf, lined the sidewalk.

Near the school's football field, close to where Amber was last spotted alive, three teens from Escondido High's student government placed plastic cups along a fence spelling out the words "Aren't we worth protecting?"

They've contacted students at Poway High School about working together to push for stronger sex offender laws, said Scarlett Meadows, 17, a senior at the school and executive secretary of the school's student government.

Poway High was the school attended by 17-year-old Chelsea King, who disappeared on Feb. 25 at Rancho Bernardo Community Park.

A body believed to be Chelsea's was recovered March 2 and registered sex offender John Albert Gardner III has been accused of murder in the commission of a rape or attempted rape in that case. Gardner has pleaded not guilty.

Escondido police issued a statement Monday saying that Gardner remains the focus of the investigation into Amber's murder.

The discovery of Amber's remains caused some who never knew her to stop by Escondido High on Monday.

"I just wanted to come up here to pay my respects," said Margaret Austin of Escondido, who doesn't have any connection to the school or teen but kept a 'missing flier' for Amber attached to her small metal grocery cart for more than a year.

"She was such a beautiful girl," Austin added.

Early in the day, Escondido High School Principal Rich Watkins made a brief statement to reporters.

"The search for Amber has come to a close," he said. "Our hearts go out to her family and friends, and it is a loss for our school and community."

Jen Winters, a ninth-grade algebra teacher at the school, said she reacted with shock upon hearing about Amber's discovery. She left a red begonia plant at the small memorial for the teen along north Broadway outside the school.

"I'm going to be talking with my students today about how they can stay safe in the community," Winters said. "I think that one of the best ways we can honor Amber and Chelsea."

Pausing for a moment in the rain, freshman Ashlynn Simpson, 15, said she hasn't walked to school alone since Amber disappeared.

She added that she was glad, at the very least, that Amber's parents do not have to search anymore for their daughter.

Amber's parents, Moe Dubois and Carrie McGonigle, organized dozens of extensive searches for their daughter over the past 13 months. They thanked the community for its support Sunday.

Chelsea King's parents, Kelly and Brent King, released a statement Monday about this weekend's discovery.

"We have spoken with the Dubois family and our hearts go out to them in this time of deep sadness. We share their indescribable grief for the loss of Amber’s precious young life."

Sheree Dohanyos, moments after dropping off her son and daughter at Escondido High, said she hasn't found the right words yet to discuss the loss of Amber and Chelsea with her children. She said she's doing all she can to protect her kids, dropping them off each day instead of allowing them to walk.

"We felt if anything good could come from this Chelsea King (tragedy), Amber would be found," Dohanyos said.

Dave Cave, the longtime boyfriend of Amber's mother, spoke briefly outside the north Escondido home where he helped raise the teen.

"Amber's a wonderful girl," he said. "There's going to be a hole in my heart for the rest of my life."

"We've got to train our children so they don't become victim," Moulton said, suggesting parents talk to their kids about what to do if they are attacked.    I take great offense to this statement.  What a sad state we are in when we have to train our children not to be victims rather then letting them be children.  Though I know it is true, seeing it in print like this reinforces that acceptance of where society is and the broken system that has created it is long overdue for a change.

It's horrible isn't it? I have had to tell my sons what to do in the case they are taken, I know it scared them...it made me very sad to have to do it.

Police: Man Eyed in 2nd Calif. Teen Murder

Tuesday , March 09, 2010

ESCONDIDO, Calif. —
A registered sex offender charged with murdering a teen girl last month is a focus of the investigation into the death of a 14-year-old girl whose remains were found more than a year after she disappeared near her school, police said Monday.

Police said they are eyeing John Albert Gardner III in the death of Amber Dubois, whose bones were found Saturday in a remote area of the Pala Indian Reservation.

A police statement did not elaborate on the investigation and only said the scene was still being processed. Police Lt. Craig Carter did not immediately respond to a phone message seeking further details.

FBI teams worked under rainy skies during their search of the mountainous area of dense shrubs and rocks.

Gardner, 30, pleaded not guilty last week to murdering and raping or attempting to rape 17-year-old Chelsea King of Poway and attempting to rape another woman in December in the same park where King disappeared.

His public defender, Michael Popkins, did not respond to a phone message.

Gardner was expected to make his second court appearance Tuesday in the potential death penalty case.

Police have not revealed how they learned the location of Amber's remains, saying it was part of the ongoing investigation. Amber's mother, Carrie McGonigle, also declined to say what led authorities to the remains.

However, she said she was grateful for the sense of closure after the long hunt for her daughter.

"I'm managing," McGonigle said in a brief interview. "It was a roller coaster the last year and now we have closure, which is more than a lot of parents have."

Amber disappeared Feb. 13, 2009, near Escondido High School, about 10 miles north of the site where King vanished Feb. 25. A body presumed to be Chelsea was found March 2 in a shallow, lakeside grave, but authorities have said they would not make an official identification until Gardner's preliminary hearing.

At a candlelight vigil Monday night in memory of Amber, McGonigle and Dubois called for better laws to protect children from predators.

"We as parents in the community need to make a change for the protection of our children, Dubois told the more than 1,000 mourners who gathered near the site where Amber vanished.

"I still see a lot of kids walking by themselves and it scares me," McGonigle said.

Escondido High School Principal Rich Watkins called for families to re-evaluate their daily routines and take other measures to protect children.

"Let's work together to make sure we don't have to meet like this again," Watkins said

Brent and Kelly King shared their grief with Amber's family.

"We have spoken with the Dubois family and our hearts go out to them in this time of deep sadness," the Kings said in a statement. "We share their indescribable grief for the loss of Amber's precious young life."

Friends and classmates put candles, cards, flowers and balloons outside Escondido High School, near the spot where Amber was last seen at 7:10 a.m. that February morning. The school held a moment of silence in her memory. Crisis counselors were on hand to help students deal with their grief.

"They'll be here as long as it takes to make sure we get through this time," Principal Rich Watkins said.

Jeff Fidel skipped work as an investment adviser to stay home with his daughter Jade, who was Amber's best friend. Jade Fidel was watching television Sunday when Escondido Police Chief Jim Maher announced Amber's remains were positively identified through dental records.

"All I heard was a blood-curdling scream," Jeff Fidel recalled. "My wife and I came running in ... It's been rough."

Maher spoke at the Monday night vigil, vowing to work toward a successful prosecution of Amber's killer. "If not closure, we can certainly get justice," Maher said.

Amber, a member of Future Farmers of America, had left home with a $200 check to buy a lamb. It was never cashed, fueling suspicion of foul play.

Paul Levikow, a spokesman for the district attorney's office, said the brief hearing Tuesday would address procedural issues and could involve delaying the preliminary hearing now set for March 19. He declined to comment on the investigation into Amber's death.

Gardner was registered as a sex offender in Escondido, a north San Diego suburb, from January 2008 to January 2010, with some gaps, police said.

He served five years of a six-year prison term for molesting a 13-year-old neighbor in San Diego in 2000. He completed parole in September 2008.

Amber DuBois' Family Disagrees on Who Killed Her
Father Believes It Was Jailed Sex Offender, Grandmother Thinks Someone Else

The family of Amber DuBois, the missing California teenager whose body was found over the weekend, are divided as to whether she was killed by the same sex offender recently charged with the rape and murder of Chelsea King.

DuBois disppeared more than a year ago and her skeletal remains were discovered Sunday, less than a week after registered sex offender John Albert Gardner III, 30, was arrested for the rape and murder of 17-year-old King.

In the aftermath of King's disappearance on Feb. 25, police linked Gardner to several near abductions in the area and speculated he may have played a role in DuBois' disappearance last year.

At a press conference immediately following Gardner's arraignment on March 4, Maurice DuBois said "there are enough similarities" between the two cases that he was confident Dubois and King were both killed by Gardner.

DuBois' grandmother and the private eye the family initially hired to find Amber, however, believe someone other than Gardner else is responsible for killing the Escondido High School student who vanished Feb. 13, 2009.

"The M.O. [modus operandi] for Gardner doesn't fit," said Michelle Bart, spokeswoman Dubois' grandmother Sheila Welch. "He stalks his prey and waited for girls in secluded areas where he could take advantage of them. Amber was walking outside in plain sight with other kids on her way to school. She was excited to get to school that day. She had Valentines and wanted to buy a lamb."

The lamb was part of DuBois' project as a member of the Future Farmers of America.

"Someone had to get her attention, and it is likely it was somebody she knew or trusted," Bart said.

San Diego County sheriffs have said Gardner has not cooperated with police since his arrest, diminishing the chances that he told investigators where to find DuBois' remains.

Authorities said Sunday they were given a tip that led them to find Dubois' body, but would not comment on the details of who led them to the girl's remains, or if she was buried in a shallow grave similar to the one in which King was found.

A gun would get her attention. A gun was mentioned in some of the attempted abductions. My opinion.

This wannabe detective is speculating that a plea deal has been made with Chelsea's killer  and ... the death penalty has been taken off the table in exchange for ......

However ... I could be wrong.  Story of my life.

Janet

On Nancy Grace ... Marc Klaas shared his suspicions and ... those suspicions reflect mine.

In response ... Nancy Grace indicated that she would be furious ... the public would be furious ... if the prosecutor stuck a deal.

I am a believer in the death penalty but ... when I consider Amber's family living in a perpetual state of not knowing ... I think maybe a deal would be exceptable as long as that monster never experiences another day of freedom.

I would appreciate the opinions of others on this forum.

Thanks

Janet

This offended me too. How is a child to be taught what to do when attacked by a big muscular guy who has raped and brutally beaten a 13 year old and should not have been released in society?

A law enforcement officer attaches police tape to a tree along Pala Temecula Rd. north of Highway 76 at the road that leads up to the site where the body of Amber Dubois was found

Suspect in King homicide still a focus of Dubois case

The convicted sex offender charged in the murder of Poway teenager Chelsea King remains the focus of the investigation into the slaying of Escondido teenager Amber Dubois, Escondido police said Monday.

Escondido police Lt. Craig Carter issued a statement saying John Albert Gardner III continues to be a suspect as investigators search the hillside in Pala where 14-year-old Amber’s skeletal remains were found Saturday.

Moe Dubois, Amber’s father, said Monday that he couldn’t discuss any details of the investigation that have been shared with him. He said police have not told the family what led them to his daughter’s remains.

“We’re on a gag order,” he said.

Investigators have openly questioned whether Gardner played a role in Amber’s disappearance since semen on a piece of Chelsea’s clothing led to Gardner’s arrest on Feb. 28. The police statement appears to indicate that those questions remain even after the discovery of Amber’s remains.

Amber, a student at Escondido High School, disappeared Feb. 13, 2009, as she walked toward campus an hour before class. Until Gardner’s arrest, police said they knew nothing more about her whereabouts than they did on the day she went missing.

The remains were found west of Pala Temecula Road, about three miles north of the historic Pala Mission and the Pala Casino. There is a single-lane asphalted road that leads up a steep mountain and then over a hill. The grave appears to be out of sight over the hill.

Two law enforcement officers guarded the entrance to the road Monday morning keeping people out, and “no parking” signs were posted along the few turnouts within a half-mile either north or south of the road.

Dubois said he was eating dinner at a restaurant Saturday when he was called and asked to come to Escondido police headquarters, where he and Amber’s mother, Carrie McGonigle, were told the news.

“Everything is going to change for us,” Dubois said. “It’s going to be so much different.”
KLAAS, on the tree is USA and on the street earlier there was spray painted USA  and some other words. Was that from LE or from something else? I mean the arrows on the street saying USA and on the street? Sorry if this has already been asked. TIA JSM Could it be for a marathon or one of those hashin things?

JSM - I'm just not sure.  I know that there are plans in the works to widen highway 76 but this is way off of 76.  I really don't know.

Looks like graffiti, we have trees like that all around my neighborhood, why would they put spray praint on a tree in a reservation, maybe its a gang...??

Just feeling so helpless over all of this - one thing I could do was find out what the marking was for...

Underground Service Alert (USA) is an organization that provides information about underground utilities at proposed excavation sites in California and Nevada as a free service. Homeowners, excavators and professional contractors who are digging, blasting, trenching, drilling, grading, or excavating regularly use USA's services. Sites marked for investigation will often have a recognizable "USA" in spray paint on pavement, or be labeled in some other way.

USA began operation in 1975 and incorporated as a Non Profit Mutual Benefit Corporation in 1986. USA receives planned excavation reports from public and private excavators and transmits those reports to participating members of USA. USA members include private companies and public agencies that have underground lines or facilities. The USA members will either mark or stake their facility, provide information or give clearance to dig.
