Status Conference Scheduled For John Gardner

SAN DIEGO -- A registered sex offender who has been charged in the killing of 17-year-old Chelsea King and is the focus of an investigation into the death of 14-year-old Amber Dubois is scheduled to be in court Tuesday for a status conference.

John Albert Gardner III, 30, is charged with murder in the death of King, who disappeared Feb. 25 while running behind Rancho Bernardo Community Park. Her body was found five days later in a shallow grave near a tributary of Lake Hodges.

The charges against Gardner include a sentencing-enhancing allegation of murder during the commission of a rape or attempted rape. He could face the death penalty if convicted.

A decision on what penalty Gardner will face will be determined after a preliminary hearing, which is set for March 18 and is intended to help a judge determine if the evidence warrants ordering him to stand trial.

Gardner is also charged with sexually assaulting a woman in the same park Dec. 27.

Additionally, authorities in Escondido have said Gardner is the focus of their investigation into the disappearance and murder of Dubois, whose skeletal remains were found Saturday in Pala. Gardner has not been charged in Dubois' death.

The defendant was in court Monday after attorneys from the San Diego Union-Tribune asked a judge to unseal a probation report prepared for the defendant's 2000 sentencing for molesting a 13-year-old girl in the same area.

Judge David Danielsen ordered the report unsealed but suspended the order until Wednesday morning in case Gardner's attorneys wanted to appeal to his ruling.

Danielsen said he had to weigh the public's right to access court records versus the "very significant" right of the defendant to get a fair trial.

The judge said most, if not all, of the facts contained in the 2000 probation report have been disclosed already.

The report would normally be sealed, but if a person is charged with a subsequent crime, the law allows for it to be unsealed, the judge said.

In the 2000 case, the 13-year-old victim said Gardner repeatedly punched her in the face and fondled her at his mother's townhouse, which is about a mile from Rancho Bernardo Community Park.

Gardner subsequently pleaded guilty, was sentenced to six years in prison and was released in 2005. He was on probation until 2008 and registered as a sex offender using his grandmother's Lake Elsinore address, but he reportedly had been staying with his mother lately.

Defense attorney Mel Epley said his client was mentioned by authorities in connection with the the Dubois investigation and urged Danielsen to order law enforcement personnel, prosecutors, defense attorneys and court officials not to make any comment on the pending case. Danielsen said it wouldn't be appropriate for officials to comment.

Today, as I went into the jail on one of my 3x weekly assignments, I had the distinct displeasure of removing the Missing Person/Reward poster for Amber. Why is this worthy of mention? One, because the reward was up to $100,000. Two, I live in Northern Michigan! I was amazed that we would have that poster all the way up here. It's the only one I've ever seen at my jail. It was sad to take it down.

Good Morning Monks.  Tevye that was bittersweet for sure.

I am sure that was difficult.  As long as the poster is up it provides hope.  It is good to know that they placed this poster at the jails nationwide...sometimes other criminals are aware/or have street knowledge of the incident and would be happy to give information, of course, in return for a lighter sentence.

Registered sex offender John Albert Gardner III is under investigation for the killing of Amber Dubois, the Escondido teen who disappeared 13 months ago and whose remains were discovered Saturday near the Pala Indian Reservation, police said Monday.

"The Amber Dubois crime scene is still being processed and John Albert Gardner III remains a focus of the investigation," Escondido police Lt. Craig Carter said in a prepared statement.

Gardner was charged Wednesday with murder in the commission of a rape or attempted rape in the killing of Chelsea King, 17, of Poway. Chelsea was reported missing Feb. 25; a body believed to be Chelsea's was discovered March 2 in a shallow grave in the Lake Hodges area.

Gardner has pleaded not guilty.

Amber's remains were found early Saturday after what police have described only as a "lead" in their investigation.

"They would be derelict not to consider (Gardner) in this investigation," said Kerry Steigerwalt, a prominent San Diego defense attorney. "Let's give the police the time they need to make the case as solidly as they can make it."

Steigerwalt said it's unlikely that Gardner gave police information on Amber's case because his defense attorneys would have advised him against talking to investigators.

Gardner's attorney, Deputy Public Defender Michael Popkins, declined to comment on the latest police statement.

The 30-year-old Gardner has pleaded not guilty to the charges in the Chelsea King case.

He is due to appear Tuesday morning in San Diego County Superior Court for a scheduled status conference with defense attorneys and prosecutors.

Gardner lived in Escondido from January 2008 to January 2010.

Police said they contacted him eight times during that period and began a fresh look at him and any possible ties to Amber after his arrest in connection with Chelsea's killing.

Police released no further details Monday about the information that led them to Saturday's discovery.

It was unclear whether the Chelsea King investigation led authorities to Amber's remains, more than a year after the 14-year-old disappeared while walking to Escondido High School.

Riverside County sheriff's officials said Monday that they are continuing to investigate whether Gardner is connected to an attempted abduction in October of a Lake Elsinore girl.

Gardner registered his address in Lakeland Village, just outside Lake Elsinore, in early January.

Riverside County authorities also are investigating whether Gardner is connected to any sexual assaults or missing persons cases in the area.

But he is not labeled a "suspect" in any case, sheriff's Sgt. Joseph Borja said.

On Monday, Michelle Bart, a spokeswoman for Amber's maternal grandmother, Sheila Welch, said she and Welch are questioning why it took police until Saturday to find Amber when specially trained private search dogs picked up her scent in the same Pala area in August.

Search for clues continues

Law enforcement teams continued to scour a scrubby, rocky hillside west of Pala Temecula Road, about three miles north of Highway 76, where Amber's body was found.

Two officers guarded the single-lane road that leads up the hillside from Pala Temecula Road.

At the Pala Indian Reservation, a small group of men were talking Monday morning outside a grocery store about the discovery of Amber's remains near their small community.

All of them said they were upset that some news organizations had reported that the body had been found on the reservation.

"We don't like it because they say Pala," said Alan Majado, 59, a resident of the reservation.

Majado added that the reports make Pala sound like a "dumping ground."

In 1991, the remains of 7-year-old Leticia Hernandez, who had been missing from her Oceanside home for 15 months, were discovered in a remote canyon about three miles south of the Riverside County line near the reservation.

Gardner would have been 9 years old at the time of her disappearance.

The August effort

Amber was 14 when she was reported missing Feb. 13, 2009.

After months of investigation turned up no viable leads, Maine's VK9 Scent Specific Search Recovery offered the services of its dogs in August.

Welch paid the team's expenses.

Handler Julie Jones said the two Labrador retrievers used in that search effort have a proven ability to track an old scent trail, even if the missing person has traveled in a car.

For three days, the two handlers, Bart, an Escondido police officer and a private investigator Welch hired followed the dogs.

Both dogs picked up Amber's scent at her north Escondido home and followed it to Interstate 15, Jones said.

The animals and their handlers walked part of the way, Jones said.

When it was clear they were following a freeway, they traveled by car.

At off-ramps, the dogs were let out to test whether the trail continued north, Jones said.

At Highway 76, the dogs picked up Amber's scent and headed steadily toward Pala, Jones said.

Around the Pala Mission, and for approximately three miles north on Pala Temecula Road, the dogs found Amber's scent in numerous locations, the handler said.

In the area Amber's remains were found, the dogs again followed a trail, Jones said.

"Our reports are that we could not find any exit trail for Amber in the Pala area, so it either meant to us she is alive and she's there, or that she's there but no longer alive," Jones said.

Bart said the dogs' response amazed her, and she submitted a report to Escondido police describing the dogs' unequivocal path.

"The dogs were going crazy," she said. "Where they really went nuts was in the residential area across the street from the casino."

Jones said the dogs did not indicate a scent trail anywhere else.

The search team briefed Escondido detectives, emphasizing their belief that Amber was still in the Pala area.

But Jones acknowledged that traditional search and rescue experts are often skeptical of the dogs' abilities.

'Brazen claim'

Bart said family members wonder whether police ever followed up.

In September, Amber's parents, Maurice Dubois and Carrie McGonigle, who are long separated, accused police of "dropping the ball" in following the Pala leads.

It was not clear Monday whether they still hold that opinion.

However, Dave Cave, who lived with McGonigle and helped raise Amber for years before her disappearance, said it's too early to question whether police properly followed up on tips in Pala.

"I don't have enough facts to feel anything (about the job they did in Pala) and neither does Sheila or anyone else," Cave said.

In September, Lt. Bob Benton defended the department's response to the private search reports, noting that an Escondido police officer accompanied the search team in Pala.

Michael Boyle, an Orange County Fire Authority battalion chief who worked with search dogs as part of a multi-agency search and rescue task force for almost 20 years, called it a "pretty brazen claim" that dogs could follow a 6-month-old outdoor trail.

"There are so many variables" that can degrade a scent trail, even for the most sensitive dogs, Boyle said. "Hopefully, it doesn't rain and the wind doesn't blow."

Police: Man Eyed in 2nd Calif. Teen Murder

ESCONDIDO, Calif. —
A registered sex offender charged with murdering a teen girl last month is a focus of the investigation into the death of a 14-year-old girl whose remains were found more than a year after she disappeared near her school, police said Monday.

Police said they are eyeing John Albert Gardner III in the death of Amber Dubois, whose bones were found Saturday in a remote area of the Pala Indian Reservation.

A police statement did not elaborate on the investigation and only said the scene was still being processed. Police Lt. Craig Carter did not immediately respond to a phone message seeking further details.

FBI teams worked under rainy skies during their search of the mountainous area of dense shrubs and rocks.

Gardner, 30, pleaded not guilty last week to murdering and raping or attempting to rape 17-year-old Chelsea King of Poway and attempting to rape another woman in December in the same park where King disappeared.

His public defender, Michael Popkins, did not respond to a phone message.

Gardner was expected to make his second court appearance Tuesday in the potential death penalty case.

Police have not revealed how they learned the location of Amber's remains, saying it was part of the ongoing investigation. Amber's mother, Carrie McGonigle, also declined to say what led authorities to the remains.

However, she said she was grateful for the sense of closure after the long hunt for her daughter.

"I'm managing," McGonigle said in a brief interview. "It was a roller coaster the last year and now we have closure, which is more than a lot of parents have."

Amber disappeared Feb. 13, 2009, near Escondido High School, about 10 miles north of the site where King vanished Feb. 25. A body presumed to be Chelsea was found March 2 in a shallow, lakeside grave, but authorities have said they would not make an official identification until Gardner's preliminary hearing.

At a candlelight vigil Monday night in memory of Amber, McGonigle and Dubois called for better laws to protect children from predators.

"We as parents in the community need to make a change for the protection of our children, Dubois told the more than 1,000 mourners who gathered near the site where Amber vanished.

"I still see a lot of kids walking by themselves and it scares me," McGonigle said.

Escondido High School Principal Rich Watkins called for families to re-evaluate their daily routines and take other measures to protect children.

"Let's work together to make sure we don't have to meet like this again," Watkins said

Brent and Kelly King shared their grief with Amber's family.

"We have spoken with the Dubois family and our hearts go out to them in this time of deep sadness," the Kings said in a statement. "We share their indescribable grief for the loss of Amber's precious young life."

Friends and classmates put candles, cards, flowers and balloons outside Escondido High School, near the spot where Amber was last seen at 7:10 a.m. that February morning. The school held a moment of silence in her memory. Crisis counselors were on hand to help students deal with their grief.

"They'll be here as long as it takes to make sure we get through this time," Principal Rich Watkins said.

Jeff Fidel skipped work as an investment adviser to stay home with his daughter Jade, who was Amber's best friend. Jade Fidel was watching television Sunday when Escondido Police Chief Jim Maher announced Amber's remains were positively identified through dental records.

"All I heard was a blood-curdling scream," Jeff Fidel recalled. "My wife and I came running in ... It's been rough."

Maher spoke at the Monday night vigil, vowing to work toward a successful prosecution of Amber's killer. "If not closure, we can certainly get justice," Maher said.

Amber, a member of Future Farmers of America, had left home with a $200 check to buy a lamb. It was never cashed, fueling suspicion of foul play.

Paul Levikow, a spokesman for the district attorney's office, said the brief hearing Tuesday would address procedural issues and could involve delaying the preliminary hearing now set for March 19. He declined to comment on the investigation into Amber's death.

Gardner was registered as a sex offender in Escondido, a north San Diego suburb, from January 2008 to January 2010, with some gaps, police said.

He served five years of a six-year prison term for molesting a 13-year-old neighbor in San Diego in 2000. He completed parole in September 2008.

The convicted sex offender charged in the murder of Poway teenager Chelsea King remains the focus of the investigation into the slaying of Escondido teenager Amber Dubois, Escondido police said Monday.

Escondido police Lt. Craig Carter issued a statement saying John Albert Gardner III continues to be a suspect as investigators search the hillside in Pala where 14-year-old Amber’s skeletal remains were found Saturday.

Moe Dubois, Amber’s father, said Monday that he couldn’t discuss any details of the investigation that have been shared with him. He said police have not told the family what led them to his daughter’s remains.

“We’re on a gag order,” he said.

Investigators have openly questioned whether Gardner played a role in Amber’s disappearance since semen on a piece of Chelsea’s clothing led to Gardner’s arrest on Feb. 28. The police statement appears to indicate that those questions remain even after the discovery of Amber’s remains.

Amber, a student at Escondido High School, disappeared Feb. 13, 2009, as she walked toward campus an hour before class. Until Gardner’s arrest, police said they knew nothing more about her whereabouts than they did on the day she went missing.

The remains were found west of Pala Temecula Road, about three miles north of the historic Pala Mission and the Pala Casino. There is a single-lane asphalted road that leads up a steep mountain and then over a hill. The grave appears to be out of sight over the hill.

Two law enforcement officers guarded the entrance to the road Monday morning keeping people out, and “no parking” signs were posted along the few turnouts within a half-mile either north or south of the road.

Dubois said he was eating dinner at a restaurant Saturday when he was called and asked to come to Escondido police headquarters, where he and Amber’s mother, Carrie McGonigle, were told the news.

“Everything is going to change for us,” Dubois said. “It’s going to be so much different.”

JSM - I'm just not sure.  I know that there are plans in the works to widen highway 76 but this is way off of 76.  I really don't know. 

Looks like graffiti, we have trees like that all around my neighborhood, why would they put spray praint on a tree in a reservation, maybe its a gang...??

USA began operation in 1975 and incorporated as a Non Profit Mutual Benefit Corporation in 1986. USA receives planned excavation reports from public and private excavators and transmits those reports to participating members of USA. USA members include private companies and public agencies that have underground lines or facilities. The USA members will either mark or stake their facility, provide information or give clearance to dig.

That makes sense I guess for underground services, I was wrong about it being gang related, it would be plausible for hashers to graffiti a tree to satisfy their rambunctious antics.  Thanks for the info, Ampersand.
