City man sentenced in sexual assault case

WINCHESTER -- A city man must serve time in prison for sexually assaulting a 4-year-old girl several times last year.

Judge John Wetsel Jr. sentenced Mario Ernesto Flores, 40, of 848 Butler Ave., in Winchester Circuit Court last week to nine years in a state penitentiary for each of nine counts of aggravated sexual battery of a child under 13 years old. The judge suspended four of the one-year terms and ordered Flores to serve 20 years of unsupervised probation.

However, once Flores serves the five years in prison, he will be deported by Immigrations and Customs Enforcement to his native El Salvador, according to Assistant Commonwealth's Attorney Jason Caccamo. The prosecutor said Flores had temporary protection status to be in the United States.

Court records indicate sentencing guidelines called for Flores to receive an active prison term of 10 years and four months to 22 years and two months. Flores faced serving a maximum 180 years in prison for all charges, Caccamo said.

On April 27, a Circuit Court jury found Flores, represented by David Downes, guilty of all nine counts of aggravated sexual battery and recommended he serve one year for each offense. The incidents happened on different dates through May 1, 2008, according to court records.

Court documents indicate the girl, who is not a relative of the defendant, told her mother that Flores had touched her on her genital area while at home. In an interview with investigators, Flores admitted that the girl was telling the truth and that he had touched the victim nine to 10 times, documents state.

But Flores gave later statements, also in court documents, that he made the admission out of fear for the girl's welfare. Flores claims investigators urged him to admit to committing the crimes because the victim was suffering because of the process. He states he "pleaded guilty" to the investigators to help her.

Flores states he "loved the child like my own daughter." He also made accusations of neglect against the child's parents.

what time is it now?  Right, he will not serve five years -- and when he is released, he will get back in under whatever "special status" he had.  Loved her like a daughter, you don't touch your daughter like he did
