Baez Wants To Ban Bounty Hunter From Testifying
Attorney Says Leonard Padilla's Statements Privileged

ORLANDO, Fla. -- Casey Anthony's defense team filed a flurry of court papers Thursday afternoon, including a motion that would keep bounty hunter Leonard Padilla and his employees from acting as state witnesses during Anthony's trial.

Anthony is in the Orange County Jail. She is charged with first-degree murder in the death of her daughter, Caylee. Caylee's remains were found in a wooded area off of Suburban Drive near the Anthony family home last December.

Attorney Jose Baez has filed a motion for a protective order that includes privacy agreements Padilla and his employees signed last August, which was when nephew Tony Padilla bailed Anthony out of jail. Baez argues that Padilla and his employees were working for him at the time so their statements made to the police about what they heard from Anthony are privileged and should not be released to the public. He also says that attorney-client privilege should ban Padilla and his employees from being witnesses for the state.

One criminal defense attorney WESH 2 News spoke with said lawyers and bail bondsmen cannot enter in to confidentiality agreements and he does not think Baez' strategy to keep these statements out of court will work.

While his employees were in close contact with Casey, Padilla has said she made some potentially damaging statements. While she was out of jail and Caylee was still missing, Anthony allegedly blurted out, "They haven't even found the clothes she was wearing." In November, Padilla confirmed the statement.

"Everything's been a game to her...to lead us to believe the clothing was somewhere but not in the proximity of the body," Padilla said.

For more than a week, Padilla's employee Tracy McLaughlin essentially babysat Anthony in the Anthony home.

Padilla's employees routinely drove her to and from Baez's office. Padilla said Anthony was plenty chatty.

"She would drop little statements when she was being driven back when she was with Tracy," Padilla said.

What else Anthony may have told McLaughlin and other employees remains a mystery.

McLaughlin to this point has maintained a very low profile and turned multiple down interview requests.

Baez filed the motion now because the statements from Padilla and his employees were due to be part of an evidence release from the state attorney's office later this month.

ORANGE COUNTY, Fla. -- The clock is ticking in Orange County. In just three weeks, jury trials could grind to a halt, because the clerk of courts, Lydia Gardner, is still refusing to pay for them. But Friday, a county commissioner said Gardner says she can afford it.

The infighting could put dozens of trials in jeopardy.

Summonses have gone out for jurors through August 6, but Gardner says she's not sending any more. The chief judge says Gardner is playing games with the justice system over politics and a power struggle.

Orange County's jury system almost went dark overnight. Gardner pulled funding immediately on June 29, citing "fiscal constraints." But around the same time, she told Orange County Commissioner Scott Boyd she did have the money.

"Lydia called and said the clerk of courts has the capability of taking on jury services and saving the taxpayers dollars there," Boyd said.

Gardner funded the $360,000 a year jury program, but didn't run it because of past problems. Chief Judge Belvin Perry quickly got $219,000 from the county to keep it going, but now Gardner says she wants all or nothing.

"Maybe someone should look at her budget and see just how much money she has and what she's spending it on," Judge Perry said.

Eyewitness News left emails and voicemails a week ago for Gardner and never heard back from her, so WFTV reporter Kathi Belich went to her office Friday to try to get some answers and find out what's going on.

"She is not gonna be able to meet with you," a staffer told Belich Friday.

"Why is that?" Belich asked.

"She's in a meeting right now and she's actually on a call," the staffer said.

"I can wait until the meeting is over," Belich said.

"She's not gonna meet with you today," the staffer said.

Gardner wants Eyewitness News to make another written request to talk to her, besides the one made a week ago, and won't guarantee she will.

There could be a showdown in two weeks when she and Judge Perry make budget pitches to county commissioners.

Good to see you, Monkey With Class and Mission! Thank you MWC, Trimm, and Fanny for your comments about my obsessive analyzing of the diary.  I was really hoping for a conclusive bombshell with that diary, and was disappointed that the result wasn't even close to a "smoking gun" (lol).

Here's hoping that:

  • Padilla, Tracy, and Rob all get to testify -- and that they all have evidence that will help convict Casey. (If they were wired, so much the better.)

  • Casey's trial on the check fraud charges goes forward right away.  And it's a slam dunk, "Guilty!" -- and that she gets the maximum sentence, which is way, way more than "time served."

  • The A's are required to answer Morgan/Mitnik's depo questions.  "...Just the way WE like it, Cindy!"

  • Brad Conway finally drops the Anthonys like a couple of rotten hot potatoes.

  • Judge Strickland and Mark NeJame refuse to allow Lyon and Baez to bully and harass Tim Miller.

  • Unless Jesse's LE personnel record is relevant to the case, his attorney manages to get information about his private life redacted from the information released to the public.

  • A. Lyon's stupid book bombs.  So does LKB's.

  • Baez goes down in history as the dumbest, scummiest, most irritating defense attorney of any racial background.

  • Casey finally gets sick of the circus (or finally gets a glimmer of a conscience) and puts an end to this torturous, shameful, multi-million-dollar charade by pleading guilty to Caylee's murder in exchange for telling the TRUTH about what happened -- and gets to eat pop-tarts behind bars for the rest of her miserable life.

  • The TRUTH includes details about George's and Cindy's (and Lee's?) involvement, and each of them is duly prosecuted and convicted for his/her part in it.

  • In addition, the Milsteads, Michelle Bart, Dominic Casey, and anyone else who has hitched their wagon to the slimeball Anthonys, is held accountable for their words and actions.

  • Our precious Caylee will never be forgotten.   an angelic monkey

Those documents have not yet been released to the public.

Casey Anthony is accused of killing her young daughter Caylee and dumping her remains near the Anthony family home.

Why would Lyon be listed as an attorney for the check fraud case?  I thought she was only brought in to deal with the DP.

  Although I think it should be a death penalty for someone that you thought that was your friend to clean out your bank account, I don't think it is so in Florida. It looks like Ms Liar doesn't even trust Bozo with that one either.

Lenny says they were not beholden to Baez, and not employed by him.

He said they had their own agenda when they were there.

He has an assistant going to Orlando to straighten out the motion mess.

He said that Casey told Tracey that they haven't even found her clothes yet. There were clothes found nearby and other places around Orlando.

He said that Baez is worried about the change in stories about where Caylee was supposedly last seen by Casey.
