Dr. Conrad Murray's mother says she's "suffering" from overwhelming sadness because her only son is incarcerated -- and has begged the judge to go easy on the Doc when it comes to his sentence.

Mrs. Milta Rush sent a letter to Judge Pastor -- explaining why Murray deserves mercy ... because he's a good person who has "never drank alcohol, took drugs or smoked cigarettes in his life."

Milta explains, "He has never been in trouble with the law before and I am barely standing, scared and worried sick about him being incarcerated."

"He is saddened and remorseful about the death of his friend Michael Jackson and I do believe he is certainly learning the toughest lesson of his life."

(AP)  LOS ANGELES — The voice of Michael Jackson helped put the man who killed him behind bars.

It wasn't the familiar voice of hits such as "Billie Jean" and "Thriller," but the slow, slurring recording of the singer that was found on his physician's cell phone that helped convince a judge to sentence the doctor to jail for four years.

The four-minute recording was one of the blockbuster revelations of Dr. Conrad Murray's involuntary manslaughter trial, a previously unknown piece of evidence that revealed an impaired Jackson describing his ambitions and aspirations as his personal physician listened.

The disgraced doc convicted of accidentally killing Michael Jackson has filed a notice of appeal, one of his lawyers confirmed Friday.

Dr. Conrad Murray signed the paperwork from jail this week saying he's representing himself, a step that's required to get court-appointed counsel, lawyer J. Michael Flanagan said.

Flanagan said the Houston cardiologist can no longer afford private legal help.

"There's probably going to be a restitution decision that puts him underwater," Flanagan explained.

"We're helping him with the appeal paperwork, and eventually there's a possibility we might be appointed to work on his appeal. We know the case and think we're the logical people to be appointed, but you never know," he said.

The Friday filing was first reported by TMZ.com.

A court spokeswoman confirmed the court's receipt of the form.

Prosecutors have asked for $100 million in restitution from Murray for Jackson's estate. A hearing on the matter has been set for January.

BEVERLY HILLS, Calif. (AP) — The contents of the home where Michael Jackson lived with his three children before his death in 2009 have sold for nearly $1 million at auction.

Among the highlights were a chalkboard inscribed with a message from Jackson's children, which sold for $5,000, and an armoire upon which Jackson wrote a message to himself on the mirror, which fetched $18,750.

The headboard from the bed where the pop star died at age 50 was removed from the sale at the family's request, but the rug that was beneath the bed sold for $15,360. The estimate had been $400 to $600.

LOS ANGELES (AP) — The doctor convicted of involuntary manslaughter in Michael Jackson's death asked a judge Friday to release him from jail pending his appeal.

Dr. Conrad Murray, who is serving a four-year jail sentence, said in a declaration that he should be released either on his own recognizance or on bail with electronic monitoring.

He said he is not a danger to society, will not flee the area, and wants to work to help support his seven children.

His lawyer, J. Michael Flanagan, said in the motion that Murray knows he cannot work as a doctor but would find other employment. He suggested the sentence and Murray's mode of confinement is extremely severe for a man with no prior criminal record.

He said Murray is being held in solitary confinement and is chained to a table when he meets with his lawyers. He also said Murray is extremely sorrowful about Jackson's death.

Murray's appeal has not yet been filed, but the motion offered a preview of some issues that will be raised, including the claim that Superior Court Judge Michael Pastor should have allowed testimony about Jackson's financial condition.

Flanagan said the exclusion of that evidence "seriously compromised the defendant's ability to demonstrate the desperate situation which was guiding the decisions and choices of both Mr. Jackson and Dr. Murray."

Flanagan also cited the judge's refusal to sequester the jury and the presence of cameras in the courtroom as appellate issues.

With Murray's appeal expected to take more than a year to move through the courts, the attorney said it would be unfair to keep him jailed in the interim.

Under sentencing guidelines, Murray is expected to serve no more than half of his sentence. The attorney said if he served his complete sentence he would not receive the benefits of a favorable appeal decision if his case was overturned.

A hearing on the motion was set for Feb. 24.

Dr. Conrad Murray, convicted of involuntary manslaughter in the death of pop icon Michael Jackson, will have to remain behind bars while he appeals his conviction, a judge said today.

Superior Court Judge Michael Pastor denied the request of Murray's attorneys to release him on bail while he appeals his four year sentence. Pastor called Murray a flight risk and a danger to society if he ever practiced medicine again, the Associated Press reported.

Murray, 59, was not present at the hearing.

The former doctor of the King of Pop has been serving his four year sentence in solitary confinement at the Los Angeles County Jail.

Murray was found guilty of involuntary manslaughter for injecting Jackson with a lethal amount of the drug propofol.

10:13 AM -- The hearing is underway.  Before getting to TJ's petition, Judge Mitch Beckloff is handling several other MJ Estate matters.

10:29 AM The Judge will not hear TJ's petition, BECAUSE no one notified Diana Ross, who is Katherine's successor to guardianship under Michael's will. 

10:31 AM  TJ's lawyer, Charles Schultz, just told the court, Katherine is unavailable and all they want is a temporary guardianship so he seems to be saying Ross is an unnecessary party.
Schultz also said there was an "incident" at the Calabasas house last night that escalated.  He added TJ is unsure Katherine is acting voluntarily

10:33 AM  Katherine's lawyer, Sandra Ribera, just said she (Sandra) has been to the house several times recently and she believes Katherine has been held against her will.

10:34 AM  The judge just ordered that MJ's 3 kids NOT be removed from California without a court order.   The judge added that TJ should file a petition for PERMANENT GUARDIANSHIP.  The judge said in addition to giving Diana Ross notice, they must also give notice to Debbie Rowe.

TJ Jackson -- Tito's son -- is about to enter the probate court in downtown L.A., along with an army of lawyers, trying to get temporary guardianship of Michael Jackson's 3 kids.

Katherine's lawyer, Perry Sanders, tells TMZ, "This is a very tense time when of course we don't feel Mrs. Jackson should be removed as guardian and we would vigorously oppose that on anything other than an extremely short-term basis, until she returns home.

LOS ANGELES – A judge appointed Tito Jackson's son, TJ, Wednesday to serve as the temporary guardian of Michael Jackson's children after hearing about the absence of the family's matriarch and details of the family's recent turmoil.
Superior Court Judge Mitchell Beckloff temporarily suspended Katherine Jackson as the children's guardian because she is in Arizona and hadn't spoken with them in several days.

He said there was no evidence that she had done anything wrong and that he would restore her to the guardian role after she returned.
The appointment came after days of turmoil among the Jackson family, with a relative reporting Katherine Jackson missing before she was located safely with other family members in Arizona.

TJ Jackson appeared in court and was appointed after describing a "strange" conversation he had with Katherine Jackson on Tuesday evening.
"I've never heard my grandmother talk like that," he said reluctantly. "In every way. The sound in her voice. The pauses."
He said some of her speech sounded slurred and she used words that made him wonder if she was speaking in code.

The judge initially said he wouldn't grant a temporary guardian but changed his mind after hearing arguments from TJ Jackson's attorney, Charles Shultz. The children's guardian ad litem, Margaret Lodise, said she also spoke with the children and the two oldest, Prince and Paris, supported the appointment of a temporary guardian.

Katherine Jackson had FULL ACCESS to a working phone during her stay in Arizona and could easily have called her grandkids whenever she wanted ... so says a rep for the resort.

A spokesperson for the Miraval Resort -- where Katherine stayed for nine days, beginning last week -- tells TMZ, Katherine stayed in a luxury villa that DEFINITELY contained a working phone.

For the record ... the villa also came with a full kitchen, a private patio, its own pool ... and its own butler.

And if full phone access wasn't enough -- Katherine also had FREE WI-FI.

Bottom line ... the Miraval Resort is adamant ... Katherine wasn't as cut off from the outside world as she previously claimed.  ::snipping2::

Katherine Jackson says she's had a change of heart ... and is now ready to SPLIT guardianship of MJ's 3 children with her grandson TJ.

Katherine's attorney, Perry Sanders, tells TMZ ... TJ and Katherine  will file a request for JOINT GUARDIANSHIP with the court early next week ... and they expect it will be approved.

Perry tells us, "That pleading will essentially now legally reflect how Mrs. Jackson and TJ have often shared  responsibilities of raising the children since Michael Jackson's tragic passing."

Katherine's lawyer says the new arrangement "reflected the wishes of [Michael Jackson's] children" ... Paris, Prince and Blanket.

If the court grants the joint request, Katherine's lawyer says TJ will be able to assume a lot of the day-to-day responsibilities that have been stressing Katherine out ... including management of household personnel and security. ::snipping2::



"Mrs. Jackson will then be freed up to focus on the more personal everyday decision making related to the lives and activities of the children."

Katherine's lawyer says the agreement would still empower Katherine to CONTROL THE FAMILY'S ALLOWANCE ... which is $70k per month.
