Los Angeles (CNN) -- A "smoking gun" e-mail allegedly connecting a concert promoter to Michael Jackson's death was revealed this week as a judge unsealed documents in the wrongful death lawsuit filed by Jackson's mother and children.
The trial next month in Los Angeles could shed new light on the pop icon's last days as Dr. Conrad Murray, who did not testify at his own involuntary manslaughter trial, and Jackson's oldest son Prince, 16, are on the witness list.
Jackson died two weeks before his "This Is It" comeback concerts, organized by AEG Live, were to have debuted in London in the summer of 2009. E-mails suggested that the promoter was worried about Jackson's missed rehearsals and they sought Murray's help in getting him ready.
Prince, Paris and Blanket Jackson and their grandmother, Katherine Jackson, contend that AEG Live's pressure on Murray to have Michael Jackson ready for daily rehearsals despite his fragile health led to his death from an overdose of surgical anesthetic.

Los Angeles (CNN) -- Michael Jackson's last concert promoter will defend itself in a wrongful death lawsuit filed by the pop icon's family by arguing that Jackson was responsible for his own demise.
Child molestation accusations against Jackson, for which he was acquitted after a trial, and evidence of his drug addiction will likely be presented by AEG Live's lawyers as they argue that the company had no liability in his death.
The Jackson v. AEG Live trial, which could last two or three months, begins in a Los Angeles courtroom Tuesday.

Lawyers for Jackson's mother, Katherine, and children, Prince, Paris and Blanket, argue that AEG Live is liable because the company hired and supervised Dr. Conrad Murray, who used a surgical anesthetic in a fatal effort to treat the singer's insomnia as he prepared for the comeback concerts. Murray was convicted of involuntary manslaughter and is serving a prison sentence.
Los Angeles County Superior Court Judge Yvette Palazuelos ruled in February that Jackson lawyers have shown enough evidence to warrant a jury trial on the negligent hiring case. She also ruled there was evidence to support the Jacksons' claim that AEG Live executives could have foreseen that Murray would use dangerous drugs in treating the singer.
The lawsuit seeks a judgment against AEG Live equal to the money Jackson would have earned over the course of his remaining lifetime if he had not died in 2009. If AEG Live is found liable, it could cost the company several billion dollars, according to estimates of Jackson's income potential. AEG Live is a subsidiary of AEG, a global entertainment company that was for sale recently with an $8 billion asking price.
The judge will hear arguments for television cameras in the Los Angeles courtroom just before jury selection starts Tuesday morning. While the Jackson lawyers are expected to support CNN's request to televise the trial, AEG lawyers say they are worried it could create a fan "frenzy" outside the courthouse.

BS News) A jury is set to hear opening statements on Monday, in a $40 billion wrongful death lawsuit surrounding the death of the so-called King of Pop, Michael Jackson. The Los Angeles courtroom will host an all-star cast of celebrity witnesses as the Jackson family battle for the estimated $400 million in potential profit from Jackson's "This Is It" tour.

Lawyers for Jackson's mother and children will try to convince the jury that AEG, the company behind the 2009 comeback "This Is It" tour, prioritized profit ahead of the pop star's health.

Diana Ross, Quincy Jones, and Spike Lee are among the big names expected to take the stand and Jackson's ex-wives -- Lisa Marie Presley and Debbie Rowe -- will also testify.

The family's suit alleges that AEG hired and pressured Dr. Conrad Murray to try to control the singer and ensure that he showed up ready to work.

An email from AEG that was leaked to the press reads, "We want to remind [Murray] that it is AEG, not MJ, who is paying his salary. We want to remind him what is expected of him."

Defense attorneys will argue there was never a signed contract between AEG and Murray and make the case that executives had no idea Murray was treating Jackson with the powerful anesthetic Propofol. They will also attempt to prove that Jackson had a long history of substance abuse.

LOS ANGELES — Michael Jackson's struggle against drug addiction was on display Monday during opening statements in his mother's wrongful death case against concert promoter AEG Live.
Competing portraits of Jackson emerged during the first hours of the trial, with Katherine Jackson's attorney acknowledging the pop star's drug problems while also trying to show he was a caring son and father.

AEG's attorney, Marvin S. Putnam, said that while Jackson's death was tragic, his guarded private life meant the company was unaware that he was using the powerful anesthetic propofol.
"The truth is, Michael Jackson fooled everyone," Putnam said. "He made sure that no one — nobody — knew his deepest, darkest secrets."
A jury of six men and six women will determine whether AEG should pay Jackson's mother and three children for their losses after his 2009 death from an overdose of propofol. Millions and possibly billions of dollars in damages are at stake in the case that opened with private photos of the singer with his children and video clips of Jackson dancing.
"This case is about personal choices," Putnam said about Jackson's decision to be treated by physician Conrad Murray. "Also, it was about his personal responsibility. There's no question that Michael Jackson's death was a terrible tragedy.
"I believe the evidence will show it was not a tragedy of AEG Live's making," Putnam said as he ended his opening statement. Testimony will begin Tuesday.

Los Angeles (CNN) -- Just one of Michael Jackson's brothers and sisters can sit in the courtroom at one time in the family's wrongful death suit against AEG Live, a judge ordered Tuesday.
AEG Live lawyers argued at the start of the second day of the trial that there was "a risk in allowing any of them in the courtroom."
AEG expects to call Janet, Jermaine, Jackie, Tito, La Toya, Rebbie and Randy Jackson as witnesses in its defense. Only brother Marlon Jackson is not on the defense witness list.
AEG lawyer Marvin Putnam said in his opening statement Monday that Jackson family members will testify about their failed attempts to intervene with Michael Jackson's drug addiction and their lack of knowledge about what was happening.
The defense lawyers asked that Randy Jackson, the only one attending the trial Tuesday with his 82-year-old mother, Katherine Jackson, be booted from court.
After that, Jackson lawyer Brian Panish told the judge that Katherine Jackson, who can stay in court because she is a plaintiff, needed one of her children to sit with her each day.
"He can remain, but you cannot have five in the courtroom," Los Angeles County Superior Court Judge Yvette Palazuelos said.
Randy and Rebbie Jackson attended court Monday, the trial's opening day. All of the siblings attended the 2011 criminal trial of Dr. Conrad Murray at various times.
Having members of the famous entertainment family in court could influence the jury because their seats are just a few feet away from the jury box in the small Los Angeles courtroom.

LOS ANGELES — A police detective who investigated Michael Jackson's doctor says he found massive evidence the physician was in dire financial straits, and he believed the doctor would do whatever necessary to get paid.

Detective Orlando Martinez told jurors hearing a negligence case filed by Jackson's mother that former cardiologist Conrad Murray was more than $500,000 in debt when Jackson died.

Murray was expecting a $150,000 a month paycheck to serve as Jackson's tour doctor, but the singer died before the contract was finalized.

Jackson's mother is suing concert giant AEG Live, claiming it failed to properly investigate Murray or his finances.

Murray was later convicted of involuntary manslaughter after Jackson died of an overdose of the anesthetic propofol.

AEG has denied wrongdoing.

(Reuters) - Michael Jackson looked pale, thin and like a hospice patient on the day he died in 2009, a Los Angeles paramedic told a jury on Tuesday in the wrongful death lawsuit involving the pop star and the promoters of a never-realized series of London concerts.

Richard Senneff, the first witness in the civil trial, testified that he was initially unaware that the person lying in pajamas on a bed in the rented Los Angeles mansion was the world famous pop singer.

"The patient appeared to be chronically ill to me," Senneff testified, saying he could see Jackson's ribs. "He was very pale and underweight. I thought perhaps this was a hospice patient."

Jackson's personal physician, Dr. Conrad Murray, appeared "frantic" but never mentioned that the "Thriller" singer had taken the anesthetic propofol, Senneff said.

"He was pale, he was sweating, he was very busy," Senneff said of Murray, who was convicted in 2011 of the involuntary manslaughter of Jackson through an overdose of propofol, which is usually used in surgical settings.

Witness: Michael Jackson was paranoid, talking to himself in last days

Los Angeles (CNN) -- Michael Jackson appeared paranoid, repeating himself and shivering from chills in his final days, his longtime makeup artist testified Thursday.
"This was not the man I knew," Karen Faye testified. "He was acting like a person I didn't recognize."
Faye, who did Jackson's makeup and hair for 27 years, was the sixth witness called by lawyers for Michael Jackson's mother and children in their wrongful death lawsuit against concert promoter AEG Live. She testified Thursday and will return to the stand Friday in a Los Angeles courtroom.
 
In Jackson's last days, Faye was pressured to ignore what Jackson told her to do and instead take her direction from Randy Phillips, AEG's CEO, she testified. She once was ordered to put Jackson on stage and place his earpiece in when he did not want it, she said.
"I was supposed to exhibit tough love" and not listen to what Jackson was telling her to do, Faye testified.
At one point, Jackson locked himself in a bathroom at his home, refusing to leave for rehearsals at the Forum. AEG Live Co-CEO Paul Gongaware, who was in charge of the production, was "angry and kind of desperate to get Michael to the Forum," she said.
She overheard a phone call in which Gongaware was telling Jackson's security guard "to get him out of the bathroom. Do you have a key? Do whatever it takes," she said Gongaware screamed.
At a rehearsal in mid-June, Jackson was "very stoic" and seem "frightened." He was talking to himself, she said. "When I was around, he was repeating himself an awful lot, saying the same thing over and over again."
"He kept repeating, 'why can't I choose,' it was one of the things he repeated over and over again," she said.
A show producer testified Wednesday that Jackson told Ortega "God keeps talking to me."
Faye said she suggested to Ortega that a psychologist should be brought in to assess Jackson.
Faye, who had to touch Jackson when she put on his makeup, said it was "like I was touching ice." At one rehearsal, she covered him with blankets and put a space heater next to him, she said.
"I've never seen him so emaciated," she said.
Faye said she raised her concerns once in June with Phillips. He told her, "Yeah, this is bad. It's not so good. I had to scrape Michael off the floor in London at the announcement because he was so drunk," she said.
Faye testified that Phillips told her at Jackson's funeral that "he tried to do everything he could."
Did she believe him, asked Jackson lawyer Brian Panish.
"Sir, Michael Jackson is lying in a casket only a few feet away from me," she said. "I had no words to respond. That's not everything you can do."

Sweet controversy at Michael Jackson death trial

Los Angeles (CNN) -- Every issue in the Michael Jackson wrongful death trial is so disputed that even giving candy to jurors caused an argument.
AEG lawyers gave a bag of peppermint candy to the bailiff to hand out to the jury this week. Even Katherine Jackson -- the pop icon's mother -- enjoyed the treat.
But Jackson's lawyer raised an objection Tuesday afternoon, suggesting jurors might be influenced if they realized the source of the sweets.
A compromise was reached. Each side can provide snacks for jurors, but they'll be placed at the bailiff's desk before jurors enter court so they have no clue who brought it.
While the candy controversy might seem trivial, the stakes are high for AEG Live. The promoter and producer of Michael Jackson's comeback concerts could be found liable for billions of dollars in damages if the jury decides the company is responsible for the star's death.
Jackson's mother and three children are suing AEG Live for the negligent hiring, retention or supervision of Dr. Conrad Murray, the physician convicted of involuntary manslaughter in Jackson's death.
The candy argument may be the most interesting thing about Tuesday's proceedings, unless you are a student of employment law and budgeting.
AEG Live Senior Vice President/General Counsel Shawn Trell was on the stand for a second day hoping to give testimony that would convince the jury that Murray was chosen, hired and supervised by Jackson -- not his company.
Murray never had an executed contract with AEG Live, although one had been negotiated. The doctor signed it and returned it to the company on June 24, 2009, but the AEG Live executive decided not to sign it after Jackson died the next day.
Jackson lawyers contend Murray was already on the job, working under an oral agreement confirmed by a series of e-mails that promised him $150,000 a month to be Jackson's full-time physician.
With Trell on the stand, Jackson lawyer Brian Panish played part of an interview that AEG Live President Randy Phillips gave to Sky News television soon after Jackson's death.
"This guy was willing to leave his practice for a very large sum of money, so we hired him," Phillips said.
Panish also showed jurors an e-mail between AEG lawyers suggesting that Phillips told other interviewers AEG Live "hired" Murray.
Jackson's manager's e-mails found, could be key in AEG trial
Trouble at the Front
The Jackson lawyers argue that AEG Live executives ignored a series of "red flags" that should have alerted them that Jackson needed help as he prepared for his comeback concerts.
Earlier testimony from Jackson's makeup artist, choreographer and an associate director described his failing health and mental condition in the last two weeks of his life.
Panish asked Trell about e-mails titled "trouble at the Front" between AEG executives and people working on the production starting on June 19, 2009 -- a night that show director Kenny Ortega sent Jackson home because of his strange behavior.

LOS ANGELES  -- A lawyer for the parent company of AEG Live LLC called Michael Jackson a freak on the day the singer signed a multimillion contract for a series of ill-fated comeback concerts, emails displayed for a jury on Wednesday showed.
The emails were presented by Brian Panish, an attorney for Jackson’s mother in her lawsuit claiming AEG was negligent in hiring the personal physician who was later convicted of killing the pop superstar.
The lawsuit also says AEG pushed Jackson too hard despite signs that he was in poor health.
The emails were sent Jan. 28, 2009, roughly four months before the singer’s death.
In the exchange, AEG Live General Counsel Shawn Trell told his boss that he was going to Jackson’s home to sign contracts for the “This Is It” shows later that year in London.
Ted Fikre, the general counsel for Anschutz Entertainment Group, wrote back in two minutes.
“Does this mean you get to meet the freak?” Fikre replied, according to the emails.
“Apparently. Not sure how I feel about that. Interesting for sure, but kind of creepy,” replied Trell, who had spoken approvingly while testifying on Tuesday about his only meeting with Jackson,
Katherine Jackson was seated in the front row of the courtroom when the emails were displayed, and she passed Trell on her way out at the end of the day. They did not acknowledge each other.
“That email just exemplifies that AEG had no respect for Mr. Jackson.,” Panish said outside of court. “All he was was a vehicle to make money and to promote their concert business to catch up to Live Nation.”
Live Nation is the chief rival of AEG Live.

LOS ANGELES — Jurors in the Michael Jackson case were shown an email on Monday in which the top executive at AEG Live LLC expressed grave concerns about treatments Jackson was receiving from his longtime dermatologist.
The email sent by AEG Live CEO Randy Phillips said the company was "scared to death" of drug injections given to Jackson.
Phillips told jurors the email was a response to a $48,000 bill that Jackson's manager received for the treatments by Dr. Arnold Klein.
"He scares us to death because he is shooting him up with something," Phillips wrote.
The email was sent to Jackson's business manager Michael Kane after a meeting was held at the singer's house to address his health and missed rehearsals.
The treatments included numerous shots of cosmetic drugs such as Restalyne and botox, as well as other unidentified intramuscular shots, Phillips said, citing the bill.
Klein's attorney has defended the doctor's treatment of Jackson.
Katherine Jackson is suing AEG Live, claiming it failed to properly investigate her son's personal doctor, Conrad Murray, and missed warning signs about his failing health. Murray was convicted of involuntary manslaughter after giving Jackson a lethal dose of the anesthetic propofol.
AEG denies any wrongdoing, and Phillips and other executives have testified during the trial that it would have been inappropriate to ask about or intervene in Jackson's medical care.
Earlier in the day, Phillips was told by a judge to answer questions posed by a lawyer for Katherine Jackson without arguing and that his demeanor might be hurting his case.
Jurors were sent from the courtroom before Superior Court Judge Yvette Palazuelos addressed Phillips, who has sparred with attorney Brian Panish throughout his testimony. The lawyers have been repeatedly warned by the judge about the behavior.
"Arguing with the lawyers isn't really going to help," Palazuelos told Phillips. "It's not going to help your case. It's not going to help anybody."
Phillips said Panish was repeatedly asking him questions about the same subject.
"I'm just trying not to say the wrong thing," Phillips said.
The admonition by the judge came after Panish asked Phillips about characterizations of Murray that Phillips made in an email sent five days before the singer died.
Phillips acknowledged that some of the statements — including that AEG Live had checked out Murray and that the former cardiologist didn't need the job — turned out not to be true.
When Panish asked if Phillips had acknowledged that some of his statements to the director of Jackson's "This Is It" shows weren't true, the executive said: "Honestly, only to stop you from badgering me, yes."
Palazuelos briefly stopped the testimony and issued the warning.

Los Angeles (CNN) -- Michael Jackson died while preparing to set a world record for the most successful concert run ever, but he unknowingly set another record that led to his death.
Jackson may be the only human ever to go two months without REM -- Rapid Eye Movement -- sleep, which is vital to keep the brain and body alive. The 60 nights of propofol infusions Dr. Conrad Murray said he gave Jackson to treat his insomnia is something a sleep expert says no one had ever undergone.
Propofol disrupts the normal sleep cycle and offers no REM sleep, yet it leaves a patient feeling refreshed as if they had experienced genuine sleep, according to Dr. Charles Czeisler, a Harvard Medical School sleep expert testifying at the wrongful death trial of concert promoter AEG LIve.
If the singer had not died on June 25, 2009, of an overdose of the surgical anesthetic, the lack of REM sleep may have soon taken his life anyway, according to an opinion by Czeisler.
Lab rats die after five weeks of getting no REM sleep, he said. It was never tried on a human until Dr. Murray gave Michael Jackson nightly propofol infusions for two months.
Czeisler -- who serves as a sleep consultant to NASA, the CIA and the Rolling Stones -- testified Thursday that the "drug induced coma" induced by propofol leaves a patient with the same refreshed feeling of a good sleep, but without the benefits that genuine sleep delivers in repairing brain cells and the body.
"It would be like eating some sort of cellulose pellets instead of dinner," he said. "Your stomach would be full and you would not be hungry, but it would be zero calories and not fulfill any of your nutrition needs."
Depriving someone of REM sleep for a long period of time makes them paranoid, anxiety-filled, depressed, unable to learn, distracted, and sloppy, Czeisler testified. They lose their balance and appetite, while their physical reflexes get 10 times slower and their emotional responses 10 times stronger, he said.
Those symptoms are strikingly similar to descriptions of Jackson in his last weeks as described in e-mails from show producers and testimony by witnesses in the trial.
Jackson's mother and children are suing AEG Live, contending the company is liable in his death because it hired, retained or supervised Dr. Murray, who was convicted of involuntary manslaughter. They argue the promoter pressured Dr. Murray to get Jackson to rehearsals, while failing to get Jackson help despite numerous red flags warning that he was in trouble.

LOS ANGELES (AP) — A lawyer for Michael Jackson's mother says the entertainer's oldest son Prince will testify in the family's negligence case against concert promoter AEG Live LLC.
Attorney Brian Panish expects the 16-year-old to take the witness stand on Wednesday, becoming the first of three Jackson family members to testify.
Panish also wants to call TJ Jackson, the co-guardian of Jackson's three children, and TJ's brother Taj.

LOS ANGELES (Reuters) - Michael Jackson's eldest son testified on Wednesday in the wrongful death lawsuit filed by his family against AEG Live that the late pop star was unhappy with the concert promoter in the run-up to his "This Is It" concert series in 2009.

Prince Jackson, 16, said he saw his father often get upset on the phone with AEG Live Chief Executive Officer Randy Phillips, but was unable to stand up for himself in disagreements.

"He would get off the phone, he would cry sometimes," Prince told jurors in a Los Angeles courtroom about his father. "He would say, 'They're going to kill me. They're going to kill me.' ... He was like my grandma. He was too kind to fight anybody."

Small parts of a video recording of Prince and younger sister Paris' deposition recorded months earlier had been played in court last week, but Prince was the first Jackson family member to testify in person at the trial.

Prince, who took the stand four years and one day after his father's death, was 12 when Jackson died at age 50 in Los Angeles from an overdose of surgical anesthetic propofol ahead of a series of comeback concerts in London in 2009.

The "Thriller" singer's mother, Katherine, is suing privately held AEG Live, which was promoting Jackson's "This Is It" concerts, for negligence in hiring Dr. Conrad Murray as his personal physician.

Murray was caring for the singer as he prepared for the shows and was convicted of involuntary manslaughter in 2011 for administering the propofol that killed Jackson.

Prince, wearing a dark suit and tie, showed little emotion while testifying until he described his father's death, which was the first time any of Jackson's children have spoken publicly about it.

The teenager said he and his two younger siblings - sister Paris and brother Prince Michael II, also known as Blanket - were at their rented Los Angeles home when they heard a scream from the home's second level.

"I ran upstairs and I saw Dr. Conrad doing CPR on my dad on the bed," he said. "My dad was hanging halfway off the bed, and his eyes were rolled back in his head."

He added: "My sister was screaming the whole time, saying she wants her daddy. I was waiting at the bottom of the stairs, crying, waiting for the ambulance."

'IT HURT A LOT'

Prince, his voice cracking with emotion, said Murray told them in a hospital waiting room that Jackson had a heart attack.

"Sorry kids, your dad's dead," Prince remembered Murray telling him.

LOS ANGELES –  Michael Jackson's eldest son testified Wednesday that his father was excited about going back on tour before his death but wasn't happy about the pressure that came with the ill-fated shows.

Prince Jackson told jurors his father wanted more time to rehearse and had several tense phone conversations with promoters of his "This Is It" shows that sometimes ended with his father in tears.

The 16-year-old said his father remarked after one of the conversations, "They're going to kill me." He did not elaborate.

The testimony came in a lawsuit claiming AEG negligently hired Conrad Murray, the doctor who was later convicted of involuntary manslaughter for giving Jackson an overdose of the anesthetic propofol.

AEG denies it hired the physician or bears any responsibility for the entertainer's death.

Wearing a black suit with a dark grey tie and his long brown hair tucked behind his ears, Prince testified that he saw AEG Live CEO Randy Phillips at the family's rented mansion in a heated conversation with Murray in the days before his father died. The teenager said Phillips grabbed Murray's elbow.

Phillips "looked aggressive to me," Prince testified.

Michael Jackson wasn't at home at the time and was probably rehearsing, Prince said.

Murray's attorney Valerie Wass and AEG defense attorney Marvin S. Putnam later denied outside court that the meeting Prince described ever happened.

Putnam said Prince would be recalled to the witness stand during the defense case later in the trial.

"I think as the testimony will show when he is called in our defense that's not what happened," Putnam said. "He was a 12-year-old boy who has had to endure this great tragedy."

For the first time, the teenager publicly provided details about the day his father died. Prince testified that he saw Murray performing CPR on his father, who was hanging halfway off a bed. It appeared his dad's eyes were rolled up in the back of his head, Prince told jurors.

Prince's eyes appeared red as he recalled being told by Murray at a hospital that his father was dead.

Prince said he never saw Murray's treatments of his father.
