Jackson estate confronts fake merchandise dealers

LOS ANGELES – Down a crowded merchant-lined street in downtown Los Angeles called Santee Alley, a handful of vendors are selling Michael Jackson T-shirts. Two shirts memorialize his passing, but one gets the date of his death wrong. The other has no collar tag.

Martin Melendes, a store manager, looks askance at a reporter's questions about the $15 Jackson shirts worn by his mannequins. "You're not with the FBI?" he asks. Stepping away from his boss, he says excitedly, "We sold 2,000 T-shirts in the first week. We're still selling a lot."

Since the King of Pop died, people around the world have mourned his passing. Others set out to make a quick buck. Now, as estate lawyers battle to secure his fortune in court, they are turning their attention to the hucksters flooding stores and street corners with unauthorized Jackson memorabilia.

This is not just about a T-shirt or two. At stake are tens of millions of dollars in annual merchandising royalties alone, estimates Mark Roesler, chief executive of CMG Worldwide, the business agent who handles licensing and collects revenue for the estates of Marilyn Monroe, James Dean and other deceased celebrities.

Elvis Presley's estate brought in nearly $55 million in revenue last year, 32 years after his death. That included $14 million from retail sales. Royalties from DVDs and TV projects and money from tours, exhibits, hotel rooms and events at the Graceland museum made up the rest. Monroe and Dean's estates took in nearly $5 million each.
Jackson may prove to be more popular than all of them.

The estate and AEG, the concert promoter behind Jackson's planned comeback, are selling Jackson T-shirts, mugs and other paraphernalia online through Universal Music Group's retailing arm, Bravado. Last week, the estate cut a deal with Harmony Books, a division of Random House Inc., to re-release his 1988 biography, "Moonwalk." Deals are in the works for a movie based on concert rehearsal footage — for which Sony bid $50 million to distribute worldwide — and a TV special based on his music and dance moves. There is even a section devoted to Jackson merchandise on QVC, the television and online retailer, which said it spent time vetting the legitimacy of each item.

Jackson's popularity also is providing plenty of opportunities for others to cash in.

"In the piracy and anti-counterfeiting world, this is as big as it gets," Roesler said. "It's a daunting task for the rights holders to get on top of this."

Already, a dozen vendors are hawking Michael Jackson T-shirts, fedoras, watches and buttons on Amazon.com, which removes merchandise it deems illegal but does not screen items beforehand. Five entities with no obvious link to the Jackson family have tried to trademark the phrase "King of Pop" on everything from drink umbrellas to juggling balls since the day he died.

Others, like street vendors and T-shirt shops from Los Angeles to New York are more brazen, openly flouting laws meant to ensure that the estate of the late singer gets its cut.

John Branca and John McClain, the estate's special administrators, told The Associated Press in a statement that the estate will take legal action to prevent the sale of unauthorized items.

"The sale of unauthorized Michael Jackson merchandise is illegal and provides nothing for the beneficiaries of his estate, namely his mother, his children and charitable causes that were important to him," they said.

The estate's concern is not just limited to memorabilia. Americans freely swapped 9.5 million of Jackson's songs, everything from "Thriller" to "Rock With You," using file-sharing software in the week ended July 16, according to tracking firm BigChampagne Media Measurement.
That alone represents about $24 million in lost revenue, based on what the swappers would have paid if they bought the songs from Apple Inc.'s iTunes.

Legitimate sales of Jackson's music are still booming, with about 3 million albums sold in the U.S. since his death, according to Nielsen SoundScan.

Experts say it will take a sophisticated legal and business team to succeed at securing Jackson's rights worldwide. Los Angeles police say they won't take action against suspect retailers or manufacturers unless a trademark owner appears in court to claim that the other items are fakes.

Girlytops.com, a New Jersey-based retailer which also sells items featuring American Idol runner-up David Archuleta and Britney Spears, has sold thousands of Jackson T-shirts online, said owner Pete Ray. He claimed the company purchased the designs from "licensed retailers," but wouldn't clarify which ones.

"There's been an amazing response by his fans to his death," Ray said by phone. "It's just countless. I haven't really sat down. We've been just too busy sending them out. As fast as they come in, they go out."

Complicating matters is that the phrase "King of Pop" was not actually registered to the singer, according to the U.S. Patent and Trademark Office, which has some of his applications on display in a free exhibit in Washington.

He registered "Michael Jackson" as a trademark, the office said, but only on sound recordings, videotapes and movies involving music and entertainment. Jackson owned a patent on a shoe that allowed the wearer to lean past his center of gravity, as he did in the "Smooth Criminal" video, but it expired in 2005 because he didn't pay a $2,480 maintenance fee.

That doesn't mean there is a free-for-all on certain products using his name and likeness, because common law can establish ownership of trademarks if they have been used in commercial ventures before, said Sharon Marsh, the USPTO's deputy commissioner for trademark policy.

An applicant can be denied if his or her trademark application creates a false association with a person or an institution, she said.
The quickest way for the estate to end unlicensed selling would be to seek a judge's temporary restraining order, which can take less than a week and requires little proof, said Alan Drewsen, executive director of the International Trademark Association.

The difficulty is tracking down all of the manufacturers that jump into the business and then bail when legal questions arise, he said.

"It's going to be very difficult for the estate to shut down every source of T-shirts," Drewsen said.

TUTM Entertainment, a New Jersey-based maker of party goods, said it applied for the trademark "King of Pop" on everything from cover artist CDs to buffet decorations, as a way to keep the party Jackson started going.

"The market's already flooded with tons of T-shirts and stuff," said TUTM's chief operating officer, Dianne Aronica. "We felt the smartest way to do it was obtain a trademark and do focused items that made sense. We typically like to do it right."

If history is any indicator, Jackson's earning power will last many years past his death and the estate still has time to overcome the sea of knockoffs.

"Elvis Presley's merchandise still sells extremely well," said Charles Riotto, president of the International Licensing Industry Merchandisers' Association. "Whether this would hold true for Michael Jackson, I don't know. There'll have to be a well-organized and cohesive licensing program to achieve that sales result.

As expected,Katherine Jackson was granted permanent guardianship of her son Michael's three children during a hearing Monday that also included a last-minute objection by the dermatologist of the late King of Pop.
n court Monday morning, Los Angeles Superior Court Judge Mitchell Beckloff approved Jackson's guardianship petition, saying it was in the "best interest of the children."

Beckloff stated in court that the two older children, Prince and Paris, and Katherine's estranged husband, Joe Jackson, all signed consent forms supporting Jackson's bid for guardianship.

The judge also granted Katherine Jackson's request for monthly stipends to raise the children. But Beckloff only granted her 83.5 percent of the allowance requested, saying some of the money for the children appeared excessive. Monetary figures were not disclosed.

The judge's ruling came after a few tense moments in which an attorney for Michael's longtime dermatologist Dr. Arnold Klein raised non-specific objections to the custody arrangements.

"Legally, he is not a presumed parent," the attorney Mark Vincent Kaplan told the judge, stating that Klein had concerns about the children's education and other day-to-day parenting issues, based on his "long-standing involvement with the children."
Last month, Klein denied tabloid rumors that he is the biological father of Michael's children. "To the best of my knowledge, I am not the father of these children," Klein told ABC News' Diane Sawyer in a "Good Morning America" exclusive. "I can't answer it in any other way. I don't want to feed any of this insanity that is going around."

The judge also preserved the parental rights of Debbie Rowe, Michael ex-wife and the mother of Prince and Paris, giving her "meaningful visitation" with the children. Rowe and Jackson reached an out-of-court agreement giving her "meaningful visitation" rights in exchange for permanent custody for Jackson.
Today the parties in the California court brought about a result that is selfless and wise through a process that was collaborative and fair," Rowe's attorney Eric George told reporters outside the courtroom. "Everyone sought the same objective, doing what's best for the children of Debbie Rowe and Michael Jackson. Today's result, five and a half weeks after the tragic death of Michael Jackson, eliminates uncertainty and offers some stability to the lives of these children."

George also applauded his client. "She faced difficulties and pressures none of us know," he said, "and today's agreement shows that she responded with heart, integrity and selflessness."

Jackson's lawyer Diane Goodman stated in court that Michael's youngest child, son Blanket, was born to a surrogate who has no parental rights.

The parties will be back in court on October 2nd to review the "investigator's report," which will assess how the kids are doing and what kind of "meaningful visitation" Prince and Paris will have with Rowe.

4:54 -- During the lunch break John Branca said Jackson's estate has reached a settlement with AEG -- re: merchandising and rehearsal footage.

4:49 -- Katherine Jackson just withdrew her petition asking that she be put in charge of the estate. This petition was filed before she knew a will existed. The issue now -- will she oppose the appointment of Branca and McClain.

4:40 -- The Jacksons have all filed back into court and the judge has taken the bench.

3:00 -- The judge just admitted Jackson's 2002 will into probate. The will names John Branca and John McClain as co-executors. We know Katherine has a beef with that. The question -- will she challenge the co-executors or possibly ask that she be named as a third executor. Court is in recess for an hour-and-a half. Stay tuned.

2:50 -- The judge has ruled that AEG has to provide a copy of their contract with Michael to Katherine Jackson.

Kaplan says Klein has a long-standing commitment to Michael Jackson and has concerns about Joe Jackson being involved with the children. There are reports Klein is the father, but he hasn't confirmed or denied.

12:14 -- The judge is on the bench. He'll be dealing with the guardianship settlement between Katherine and Debbie Rowe first.

12:00 ET -- Rebbie Jackson, Michael's older sister, has just showed up. We're told, day to day, she'll be the one taking care of Michael's kids.

11:56 AM ET -- Katherine, Randy and La Toya were escorted upstairs to the courtroom. La Toya is wearing a black jacket, slacks, and a white blouse. Katherine is wearing a brown suit, looking calm ... and chewing gum.

MICHAEL Jackson was killed by a shot of powerful painkiller Demerol given by an aide as his personal medic Dr Conrad Murray slept, The Sun can reveal.

Dr Murray is reported to have confessed to cops that he had ALREADY given the singer surgical anaesthetic Propofol that same day.

Jackson is feared to have woken when the effects wore off and demanded pain relief.

The Demerol was duly administered by the compliant aide - with devastating effects.
The combination of Demerol and Propofol, known by the brand name Diprivan, triggered a massive heart attack.

US sources have claimed the cardiologist was asleep and therefore not paying attention when his patient's heart stopped beating.

He woke to find 50-year-old Jackson dead and desperately tried to revive him.

A case insider told The Sun: "Murray would set up a system to give Michael a steady intravenous release of Diprivan through the night.

"But this time Michael woke up before Murray did and asked one of his aides for some Demerol.

"The aide gave it to him, but it was too soon after receiving the anaesthetic. That's what killed him."

Jackson is thought to have first taken Demerol to control the pain of burns to his scalp he suffered filming a Pepsi advert.

Dr Murray is said to have told Los Angeles police about administering Propofol two days after Jacko died on June 25.

Propofol - which should only be given in a hospital environment - can be delivered by an intravenous drip to release a steady supply.

But there should always be equipment available to monitor the electrical impulses of the patient's heart and the level of oxygen in their blood supply.

An ECG would trigger an alarm if the patient flatlined, while a pulse oximeter would sound if oxygen supplies changed.

Neither device was found by detectives when they searched Jackson's rented Holmby Hills mansion following his death.

Dr Murray's lawyer Ed Chernoff has always maintained that his client denies giving Jacko anything that killed him.

Meanwhile a picture believed to be of the bedroom in which Jackson died has emerged. On the floor at the foot of the deathbed is a manual oxygen pump.

Surrounding the bed are alcohol pads used for cleaning skin before injections, a roll of surgical tape and a box of latex gloves.

On the bedside table is a phone, contradicting Dr Murray's claim he was delayed calling 911 because there was no phone nearby.

On the bed are prayer beads. There is also what appears to be an incontinence pad and a makeshift tourniquet. The source of the pic said oxygen bottles used in the star's drugs regime are just out of shot.

TUESDAY UPDATE....    Multiple sources tell me the toxicology report on Michael Jackson is complete and that the Coroner's Office has submitted it's report to the LAPD.

I am told the report was finished very recently and most of the tests were conducted at the Coroner's Office and samples were for the most part not sent to outside labs. The Coroner's Office is not holding a press conference as they had originally planned, but is waiting for direction from the LAPD.

That doesn't mean they won't release cause of death, but the Coroner's Office doesn't want to jeopardize the investigation and is waiting for LAPD guidance.

WEDNESDAY UPDATE:    One of our sources has told me for a couple of days that he does believe the release of the toxicology report will come next week. Having said that, anything can happen, so we remain prepared to cover the release when it is anounced. This all comes as we also prepare for the court battle coming Monday over custody of the Jackson children and control of his will. I have just been e-mailed this statement from the Special Administrators listed in the 2002 Jackson will, who are preparing for that courtroom battle on Monday.  Since being appointed by the Probate Court as Special Administrators of the Estate of Michael Jackson, John Branca and John McClain, who were specifically designated by Michael Jackson in his will to be executors of his Estate, have been focused on preserving Michael's legacy and carrying out his wishes. According to two of my sources from different offices involved in this search.....They insist, this is NOT a raid. A raid "is when we go in with guns, knock down doors and arrest people." He continues, "This is serving a search warrant as part of an intense ongoing investigation."

The Special Administrators have and will continue to provide timely information to Mrs. Jackson's counsel regarding potential business opportunities for the Estate. Any inference that we have not been forthcoming in providing information to Katherine Jackson's attorneys is not accurate.

There is one agreement being requested by Mrs. Jackson's attorneys where the other party to the contract has agreed to provide the document to Mrs. Jackson and her attorneys but requested that the terms be kept confidential and not be shared with third parties. Mrs. Jackson's lawyers have refused that offer.
Based on comments made on The Today Show by one of Mrs. Jackson's attorneys it appears that they want to rewrite Michael's will to make Mrs. Jackson "Guardian of the Estate" and have her appointed as an Executor and Trustee of Michael Jackson's Estate.

In his will Michael was very specific that his mother act as the Guardian of his children and that Mr. Branca and Mr. McClain be the Executors of his Will and Trustees of his Trust.

FROM TUESDAY:

The reason why the raid is taking place in Las Vegas today and not last week is due to complications with obtaining a search warrant on Dr. Murray's home. As one tells me "Justice is sometimes slow and there is a strict protocol and method we have to follow. This is not a totalitarian state and we have to absolutely respect the right of someone being investigated like Dr. Murray."

6 Agencies are taking part (state, Fed and local). This is very similar to last weeks search warrant in Houston. It is under seal, initiated by Las Vegas Police and led by LAPD. The investigators are looking for documents and records. They are building a very detailed case and much of this stuff can't easily be destroyed without obvious.

The DEA is taking part in this investigation NOT due to a possible manslaughter investigation. They are strictly looking at Doctor Murray and his connection to the drugs involved in this case and possibly others.

Remember, last week we reported there might be more searches of locations connected to Dr. Murray.

I am also told: Investigators DO NOT feel that Dr. Murray is a flight risk. As of right now, they don't expect to arrest him any time soon, but that could always change on short notice. They suggest this investigation closely resembles the Anna Nicole investigation, which took months to wrap up.

I am also told, "prosecuting a person in a case like this is extremely difficult and some prosecutors would argue almost impossible. It is so hard to prove."

There was a recent ( yesterday ) voice clip played of Katherine Jackson where she says there was no way this was natural causes. I believe it was a clip from Geraldo but it played on CNN.
I think this is all going to fizz-ille where the cause of death = undetermiend or natural causes.
Then there will be a long period of time and then some sort of charges like in the Anna Nicole case.

Deals could make King of Pop king of merchandising

LOS ANGELES – Authentic Michael Jackson products could start appearing on store shelves, cell phones, even in X-Box add-ons if a judge signs off on merchandising deals proposed by the singer's estate.

The current administrators of the singer's estate have presented several proposed contracts to a probate judge for approval. The agreements offer a taste of how the King of Pop may be sold in the coming months and years.

Trading cards, T-shirts, calendars, lighters, stuffed animals that play Jackson's music and games are among the tangible items being considered. So too are denim products and high-end clothing lines, according to the filings.

But Jackson seems destined to try to conquer the digital domain too. Some of the possible products include cell phone screen savers, X-Box themes, video games and digital tattoos for characters in games such as "Second Life."

The proposed deals are between Jackson's estate, concert promoter AEG Live and Bravado International Group Merchandising Services. The contract calls for Bravado, which is Universal Music Group's retailing arm, to receive worldwide merchandise rights.

AEG Live will retain rights to sell certain merchandise related to Jackson's canceled London performances, the agreements state.

Despite a tainted legacy while he was alive, some believe Jackson will even top The King, Elvis Presley, in annual merchandise sales. Presley's estate earned $55 million in revenue last year, $14 million of which came from retail sales.

A separate agreement is being pursued between the estate's administrators and Columbia Pictures for a feature length movie based on footage of Jackson's preparations for his 50 comeback concerts in London. The studio paid $60 million for the rights to the project, the contract filed in Los Angeles Superior Court states.

Jackson's estate — which primarily benefits his mother and three children — would receive 90 percent of the profits from the film, according to the agreement.

The agreements with Bravado are more heavily redacted and do not indicate how much the estate would be paid.

A judge has scheduled a hearing for Monday to consider the proposals.

Jackson died June 25 in Los Angeles and his lavish spending had pushed him hundreds of millions of dollars in debt. Attorneys for the current administrators of his estate, attorney John Branca and music executive John McClain, have stated in court records that they believe Jackson's estate is solvent.

One of the men's attorneys, Jeryll S. Cohen, wrote in a court filing on Friday that the merchandising and film and other entertainment agreements are expected to generate "advances in the high eight figures." Negotiations for other deals are also in the works, Cohen wrote.
The administrators have the authority to combat unauthorized merchandise, and the deals provide Bravado with access to the use of Jackson's name, image, symbols, emblems and other trademarks.

Jackson's estate would have input into which products are ultimately manufactured, the proposed agreements state.

An amendment to an agreement between Jackson's estate and AEG Live allows for a traveling exhibit of the performer's memorabilia. Exact details of the exhibit were redacted, but it calls for the displays to be shown only at museums or venues that both sides agree on.

If approved, the agreements would continue a trend that Jackson seemed to be pursuing in his final months — marketing products based on his days of superstar status.

A lawsuit filed in January by "Thriller" director John Landis accused Jackson of trying to turn the groundbreaking 14-minute music video into comic books and video games.

The director also sued over a proposed Broadway show based on "Thriller." Landis owns some of the creative rights to the project and didn't grant approval to the ventures Jackson was apparently pursuing.

Reports have claimed a shirt stained with blood was found in the pop star's wardrobe days after his death.

A fresh mystery surrounds the death of Michael Jackson after reports a blood-stained women's blouse was discovered in his wardrobe.

The garment, smeared with a dark red liquid, was caught in a series of photographs taken in the days after the pop superstar's death in June.

According to an article in The Sun, the blouse was not taken by Los Angeles police in their investigation into the 50-year-old's death.

The item appeared not to have been worn, with its $3.99 price tag still attached. The newspaper speculated that the white top could have been used to mop up blood.

Prominent American attorney Craig Silverman told the paper: "It's pretty extraordinary that a bloody shirt would not be taken as evidence."

Mr Silverman, who has no legal role in the Jackson case, suggested the item of clothing might provide a clue to the star's mystery death.

The Los Angeles Police Department declined to explain why the shirt was not seized by detectives.

A spokesperson for the LAPD said: "I don't know why."

He added: "Our detectives aren't speaking to the media about the investigation so we won't have an answer at the moment. I don't foresee one for some time."

Katherine jackson wants 3rd autopsy

Two autopsies have already been carried out on the King of Pop, who died on June 25th, but Katherine Jackson wants a third to be held.

One of the autopsies was carried out privately at the request of the Jackson family, and now another is set to be held later this week.

A source told the Sun: 'Katherine looked at the second autopsy, and she wasn't happy with what it did not reveal to her.'

It's thought Katherine, 79, wants to see murder charges brought rather than manslaughter based on negligence.

Multiple law enforcement sources tell us the toxicology report in the Michael Jackson case shows Jackson had a lethal amount of the anesthetic Propofol in his system -- but that wasn't the only drug.

We're told the toxicology findings show there was also Xanax -- generic is called alprazolam -- in Jackson's system. Xanax is used to treat anxiety.

But our sources say Propofol was -- as one source put it -- "front and center in terms of why he died."

Michael Jackson was a pop star icon who earned the title, ‘King of Pop.’  He was a talented singer and dancer who broke down barriers for the African-American community.  Unfortunately, he was also a tortured soul who suffered through two marriages and divorces, along with medical and substance abuse problems.  His lifestyle and behavior often bordered on the bizzare and controversial.  This may be why the public and media are so fascinated by him.

There are also questions and concerns plaquing the minds of people.  Some areas of interest are, what kind of drugs he took, which doctor or doctors will be held responsible for his death, or whether his elderly mother will be able to care for his children.  This opinion is further solidified by the media that has continually played out his life over the airwaves and in print.

It has gone so far that government has gotten involved.  It amazes me that Congress, our Congress was so affected by his death, they honored him with a moment of silence.  There has also been talk of putting his image on a postage stamp.  It is so tempting to say, ‘please, wake me up when it’s over!’

American culture has changed its views on what constitutes an American hero worthy of high praise.  This is unfortunate for the American soldier, who is now taking a back seat in place of wildly popular personalities, including a pop star icon.  The American soldier might have a special loved one, kids and extended family members that are praying for his or her safety.  This soldier is a person who has dreams, wishes and plans for the future.

In spite of everything, for the love of family and country, this person lays it all down, all the while knowing that they may not make it back home again.  The soldiers who come back are the lucky ones.  For those who pay the ultimate sacrifice, their dreams, plans and wishes die too.  What remains in the hearts of loved ones, are the memories along with the pain and knowledge that children will grow up without a parent, a wife is now a widow and parents have experienced a pain like no other.  They are faced with the reality that they are going to bury their child.

How are the American soldiers honored?  Was there a moment of silence to honor them?  Are their lives and sacrifice honored by the media showing respect, giving testimonies and tributes to these worthy soldiers?  I am sure there are a select few, but not enough.  For starters, it would be a good thing to see an American soldier image on a postage stamp.  It would also be nice to see Congress set aside time each session to give a moment of silence to our fallen soldiers.  How about a memorial to honor those who have died?

American society and culture has changed so much, people no longer recognize a real hero when they see one.

More than six weeks after Michael Jackson's death, the Los Angeles County Coroner's Office announced on Monday that it had completed an autopsy on the singer that details his cause of death. Those results, however, are being withheld indefinitely to allow police to complete their investigation, according to the Los Angeles Times.

"The investigation was thorough and comprehensive," a coroner's official explained in a news release. But in order to avoid interfering with the ongoing criminal probe by the Los Angeles Police Department into what might have killed the 50-year-old singer, the office will honor the LAPD's request to put the results on a "security hold."

Quoting an unnamed police source, TMZ reported that the LAPD doesn't want the autopsy released, because it could hamper their ongoing investigation. In a statement released on Monday, the police department said its investigation "has included dozens of individual interviews and the service of search warrants locally and out of-state."

To date, the LAPD has interviewed a number of Jackson's former doctors, most prominently his personal physician at the time of his death, Dr. Conrad Murray. The doctor's Las Vegas and Houston offices have been searched in recent weeks, and police have carted away records and computer equipment related to Murray's treatment of Jackson.

Murray reportedly told police that he administered the powerful anesthetic Diprivan to Jackson in the 24 hours before the singer died, and police have identified the cardiologist as a suspect in their manslaughter investigation. Murray's lawyer has said his client did not "prescribe or administer anything that should have killed Michael Jackson."

The doctor was hired at a cost of $150,000 a month to be Jackson's personal physician in the lead-up to the singer's planned 50-date string of This Is It comeback shows at London's O2 Arena. Footage of rehearsals for those shows will now be released as a documentary on October 30.

Jackson was reportedly found in Murray's bed on the morning of his death, and when emergency workers arrived to try to revive the pop star, they are said to have found an IV stand, an empty IV bag and oxygen tanks in Murray's room, all indications of the administration of an intravenously delivered drug such as Diprivan. No charges have been filed in the case to date

No final word yet on Michael Jackson burial

LOS ANGELES — He spent the last few years of his life on a globe-trotting odyssey, and now in death Michael Jackson still seems unable to find a permanent home.

On the certificate recording Jackson's June 25 death, the entertainer's body is listed as being at Los Angeles' Forest Lawn Memorial Park, but that location is listed as temporary, and no amended death certificate has been filed with Los Angeles County.

With the announcement Monday that the county coroner's office had completed its autopsy of Jackson, coupled with reports that investigators had returned a portion of Jackson's brain to his family, rumors of where his final resting place might be swirled across the Internet. But the people who know exactly where he is and where he might be going aren't saying.

Forest Lawn spokesman Bill Martin declined to say if Jackson's body would be laid to rest permanently at the cemetery or if it is still there, citing the family's request for privacy. A family spokesman Jesse Derris said the family had no statement to make.

In an interview broadcast Friday with CNN's Larry King, Jackson's older brother Jermaine said he would like to see his sibling laid to rest at Neverland Ranch, the bucolic estate in central California's wine country that the entertainer bought in 1988 and turned into his personal Peter Pan-like wonderland. But Jermaine Jackson said it would be up to his mother, Katherine, to make the final decision.

Although it's rare for someone's remains not to be promptly buried or entombed, it's not unheard of. The body of one of Jackson's musical heroes, James Brown, remained unburied for two months after his 2006 death while people fought over control of his estate.

Elvis Presley, whose daughter was once married to Jackson, was entombed at a Memphis, Tenn., cemetery for nearly two months after his death in August 1977, then moved to a garden at his Graceland mansion. The Forest Hill cemetery says on its Web site the temporary arrangement was made while Graceland was being prepared for Presley's burial.

For Jackson to be buried on private property like Neverland his family would have to get approval from both state and local authorities. Before local officials would sign off they likely would want to schedule public hearings, said Nicole Koon, deputy communications director for Santa Barbara County.

"Certainly there would be a review process that would be triggered when and if that permit request comes through to the county," she said, adding no such request had been made.

During the nearly 20 years he lived at Neverland, Jackson turned its rolling hills and verdant pastures into a children's paradise, complete with bumper car rides, a Ferris wheel, a train modeled after the one at Disneyland and a zoo filled with tigers, elephants, orangutans and a giraffe.

He regularly opened the estate to children by the hundreds, many of them from local schools, until he was arrested in 2004 and charged with molesting a 13-year-old boy.

After being acquitted in 2005, Jackson abandoned Neverland, taking his three children with him on an international journey, living for a time in Bahrain and then Las Vegas. More recently he shuttled to London, where he was to launch a 50-show run of concerts in July that were to mark his return to the public eye and, he hoped, restore his image as the King of Pop.

He was living in a rented mansion in Los Angeles and rehearsing for the shows when he died at age 50.

Propofol Link at Pharmacy in Jackson Case

Dr. Conrad Murray purchased Propofol -- the drug we're told killed Michael Jackson -- from the Las Vegas pharmacy that was searched today by the DEA, according to a new report.

An unnamed law enforcement official reportedly claims evidence was uncovered at Applied Pharmacy Services this morning, proving Dr. Murray legally bought the strong anesthetic there. We don't know if there is any link to Jackson.

We did some checking ... Applied Pharmacy Services is a home infusion pharmacy -- meaning they specialize in infusions in the home. Interesting.

As we first reported, the DEA searched the pharmacy for documents, computer hard drives, prescriptions and shipping information of controlled substances that may have been given to Jackson by Dr. Murray.

A Jackson family spokesman was not immediately available Monday to comment on the Daily News story, nor was a spokesman at Los Angeles' Forest Lawn cemetery, where Joe Jackson said his son would be buried.
A public memorial for the singer was held in July, but there was never an official confirmation that the "Thriller" singer was buried after the event.

The reason behind Jackson's cardiac arrest remains a mystery. The Los Angeles County Coroner's office has completed its autopsy report but its findings remain sealed until police conclude their investigation.

A judge on Monday approved a deal for the sale of Michael Jackson merchandise, but delayed making a decision on a traveling exhibition dedicated to the King of Pop, amid objections from the singer's mother.

Los Angeles Superior Court Judge Mitchell Beckloff, who is overseeing matters related to Jackson's estate, approved the deal between the co-executors of Jackson's will and Bravado International Group, a division of Universal Music Group owned by Vivendi SA.

But Beckloff postponed until Friday a decision on whether to approve concert promoter AEG Live's plans for a traveling exhibition of Jackson memorabilia. He did so amid objections from attorneys for Jackson's mother, Katherine, who said the planned exhibition may not bring enough money to the estate.

On August 7, Beckloff approved a deal between Jackson's estate, AEG Live and Columbia Pictures, a division of Sony Corp, for a movie to be released October 30 using footage from the pop star's final rehearsals.

The executors of Jackson's will, longtime attorney John Branca and music executive John McClain, have said the deals will generate millions of dollars for the estate.

As much as I liked MJ's music, this selling of his memory is over the top. There is enought in his Estate right now to support a small country. How much more can these people ( the Jackson's, AEG and all the rest of them ) want from him. He is dead. His life was pathetic. He was an addict who never grew up. When a person sees and hears these court proceedings over his money and his legacy, I can see why they never tried to help him, he wasn't a person to them, he was a paycheck and they were all afraid that the gravy train might end if MJ got mad at them and cut them off or did not do business with them. I really do pity his children, they will be living in a shark infested environment.

Michael Jackson died of lethal levels of propofol, court documents show [Updated]

L.A. County coroner's officials found lethal levels of the powerful anesthetic propofol after examining Michael Jackson's body, according to a search warrant affidavit unsealed today in Houston.

According to the search warrant, Jackson's doctor, Conrad Murray, told LAPD detectives that he had been treating Jackson for insomnia for about six weeks. He had been giving Jackson 50 milligrams of propofol every night using an intravenous line, according to the court records.

But Murray told detectives that he feared Jackson was forming an addiction and began trying to wean the pop star off the drugs. He lowered the dosage to 25 milligrams and mixed it with two other sedatives, lorazepam and midazolam. On June 23, two days before Jackson's death, he administered those two medications and withheld the propofol.

On the morning Jackson died, Murray tried to induce sleep without using propofol, according to the affidavit. He said he gave Jackson valium at 1:30 a.m. When that didn't work, he said, he injected lorazepam intravenously at 2 a.m. At 3 a.m., when Jackson was still awake, Murray administered midazolam.


Over the next few hours, Murray said he gave Jackson various drugs. Then at 10:40 a.m., Murray administered 25 milligrams of propofol after Jackson repeatedly demanded the drug, according to the court record.

[Updated at 12:45 p.m.: Although Murray acknowledged to police that he administered Profofol, authorities said they could find no evidence that he had purchased, ordered or obtained the medication under his medical license or DEA tracking number. However, police detectives saw about eight bottles of Propofol in the house along with other vials and pills that had been prescribed to Jackson by Dr. Murray, Dr. Arnold Klein and Dr. Allan Metzger.

Other drugs that were confiscated in the search included Valium, Tamsulosin, Lorazepam, Temazepam, Clonazepam, Trazodone and Tizanidine. They also found Propofol in Murray’s medical bag. Murray told detectives that he was not the first doctor to administer the powerful anesthetic to Jackson.

 At least two unidentified doctors gave Jackson Propofol in Germany but there was time given in the court documents. Between March and April 2009, Murray said he called Las Vegas Dr. David Adams at Jackson’s request to arrange for Adams to administer Propofol. Murray said he was present at a cosmetologist’s office, where Adams used Propofol to sedate Jackson. Since he began treating Jackson, Murray said he repeatedly asked the pop star what other physicians were treating Jackson and what drugs they were prescribing. But Jackson declined to provide the information, Murray told authorities.

 Murray said he noticed injection marks on Jackson’s hands and feet. When he asked Jackson about them, the pop star told him he had been given a “cocktail” to help him. In addition to Murray, authorities subpoenaed medical records from Dr. Arnold Klein, Dr. Allan Metzger and Dr. David Adams, the affidavit states. They also asked for medical records from Dr. David Slavitt, who conducted the independent medical examination of Jakcson for Anschuntz Enetertainment Group, Dr. Randy Rosen and nurse practitioner Cherilyn Lee.They also subpoenaed records from Dr. Mark Tadrissi, who stored medical records with Adams. ]


Murray has already acknowledged obtaining and administering propofol to Jackson the morning that he died. In an interview with police, Murray told them that he left Jackson alone under the influence of the medication to make telephone calls to his Houston office and family members.

When he returned, he discovered Jackson was not breathing. He performed CPR, and one of Jackson’s staff members called 911. The 50-year-old pop star was rushed to the UCLA Medical Center, where he was later declared dead. Much of the investigation has focused on propofol — a drug typically administered by anesthesiologists during surgery — and whether Murray’s decision to give it to Jackson as a sleep aid outside a hospital setting reaches a level of negligence required for an involuntary manslaughter charge.
