There are no good reasons that Robert's Mom did not turnover sole custody to his Dad, if she felt any sorrow in what was happening to him.
So she puts up with the abuse for 1 of 10,000 reasons..each different for each abused Mom..but no excuse for not getting Robert or the baby out..court was the perfect time..visits with the social workers about the baby was another. She had outs for the children..she didn't take them. That is a whole different area then spousal abuse. Many abused women would never ever think twice about helping their child if they were also being abused. They would get the children to safety. There is a huge difference between spousal abuse and abuse of everyone in the family. Most women have an instinct to save their young. This one didn't. And it appears she participated in some of that abuse.
The court found her guilty of child abuse with the infant. She could have stopped this at that point. She could have called from her job, when Robert was being abused.
Surely the bruises and cuts on that child would have told the story. There are many abused women who have died in order to protect their children from the abuse of their significant other. Nope..no excuses for this piece of chit Mom....she had ample time when she was away from the home to even anonymously report this..and she didn't.
Of course this is just my opinion..but abused women usually try to protect their kids.
imo..we have no info she was ever abused but we know for a fact she is alive and Robert is not.
Mamma it came out in the custody hearing for Robert when egg donor was having a difficult pregnancy with Aiden , that Robert had told his Dad he had seen Boyfriend abuse egg donor.

Hello Gypsy DD!
Sorry for not responding sooner. I totally agree the only thing that could have saved Robert would have been if Charles had was full custody, along with a restraining order against both egg donor and her man. I feel the system had failed Robert and his siblings every step of the way. I feel until children are viewed as citizens of this country vs. property, we will see more and more crimes of this nature.
What I liked about the article I posted yesterday is the way this community is comming together; not letting Robert's memory fade into the hum drums of everyday life. Now if someone sees marks on a child, suspicious body language, etc. they will report the incident. They will not assume someone else will report the abuse. They will not feel it is not their "place" to intervene. They will not assume the "system" will protect children. They will not be indifferent. They will get involved.
True you can not legislate compassion. However, the more people realize how horrible our justice system is they will stand up to the same system that is currently giving sex offenders and child abusers a slight slap on the wrist along with a stern finger shaking. The more out raged society becomes, change will come. Apathy and indifference will fade away (kind of like the careers of some of these poor excuses for judges!).

With it being stated that the state wants to help more kids in abusive situations, and presumably their families as a whole (women abuse husbands too) it is helpful to know where a battered woman/man is coming from. As my neighbor, and a battered woman herself said, she would rather be with someone abusing her that she loves than deal with people who are abusing her by putting her down and telling her how stupid she is that don't mean anything to her. Because people that judge the woman aren't helping her, they are abusing her as well. The programs that are in place need to be supportive and not condescending, or they are not successful at all.
The system totally failed this boy. It is amazing to me that the state did not make her present Robert to them when they were visiting the house. Amazing still that the courts knew that the bf abused he and still let her have visitation with him involved. In Texas they come to your house and suspect that abuse is going on and you can say goodbye to your kids. Their thinking is that you choose to be abused, your child wouldn't if he had a choice. And it is abuse if that child has to watch you be hit as well. The plans for programs are great ideas but they will be even more effective if they have some legislation passed to back them up.
Roberts justice is coming. I can't wait for the day. This is one case that I pray the max penalty is used. And hope to God that Idaho is not one of those states that does not have the death penalty.

Wonder, does she have any children, that she would rather have in an abusive household, versus people making fun of them?

Mamma..I don't think his Dad had any choice in the matter. He was given custody during the school year..and then she had a few weeks at time in the summer at this point. If the court says the mother gets the child so many weeks a year..and don't think there was anything else he could have done. Why the court allowed her to have either child in her custody at any time I'll never understand. Supervised visits yes..but not even short custody stays in summer.

As Boise Deputy Police Chief Jim Kerns promised Wednesday to "determine how and when Robert Manwill died, and who is responsible," his comments narrowed the field of suspects to people who knew Robert.
Police still won't name any suspects or even people of interest. Kerns said police would not prematurely release anything that could "compromise the legal procedures" and the integrity of their case.
A neighbor said she heard Melissa Jenkins tell police she was working the night 8-year-old Robert disappeared. Another neighbor said she saw Daniel Ehrlick Jr. about 7:45 that night outside his home. He often stayed home to care for Robert and the couple's 18-month-old son, Aidan.
State Health and Welfare officials had taken the younger boy away from Jenkins and Ehrlick Jr. last October, after Jenkins was charged with fracturing the child's skull.
Jenkins later was convicted of misdemeanor injury to a child and is on probation until March 2011.
A neighbor and friend, Carol Carrillo,
said Aidan had been back in their custody for about two months. She said the couple worked hard to meet Health and Welfare standards to get him back.

Robert lived primarily with his father, Charles, in New Plymouth - an arrangement crafted after Jenkins was laid up in the hospital for a few weeks before Aidan was born and she had no one to take care of Robert.
An affidavit that Charles Manwill filed at the time to get temporary custody of Robert states that Jenkins told him she "was being physically abused by her ex-boyfriend (the apparent father of the unborn child)."
He added that the hospital "has kept the admission of mother Melissa, and her room number, secret because mother Melissa is concerned that the ex-boyfriend may storm into the hospital and mother Melissa's room and cause extreme trouble."
Ehrlick Jr. also has been barred from being around Jenkins' daughter, not from anything he did, but because the father, Raymond Ames, said he didn't like him or want him around the toddler. The girl lived with Melissa Jenkins until Ames got custody last year.
Family and neighbors say Ehrlick Jr. has given at least two separate explanations about the night Robert disappeared.
Ehrlick Jr.'s father said his son accused him of taking Robert, but he denied it. A resident in the building who did not want to be identified said Ehrlick Jr. told her that Robert was in the hot tub and pool the night he went missing and that a heavy-set couple invited the child to a birthday party. Other neighbors say Robert was never near the pool that night.
Neighbors said neither Jenkins nor Ehrlick Jr. have been at the apartment since Wednesday. One neighbor and KBCI-TV said Ehrlick Jr. has been in a treatment center since being treated at Saint Alphonsus Regional Medical Center in Boise for an undisclosed reason.
Dorothy Aydelotte, Robert's aunt and sister of his father, said Charles Manwill is doing his best to deal with Robert's death.
"He's better than he was a couple days ago, but not good," Aydelotte said. "He's upset, understandably. Robert was very close with his dad."
On Wednesday, Carrillo, Jenkins' upstairs neighbor, said she trusted Jenkins and Ehrlick with her four kids and doesn't believe either of them could be involved.
"There's a little boy who's dead," she said. "There can be no common sense to that. Who could do that? It's hard for me to see that someone that I interacted with on a daily basis could do something like that. ... I'm not in the grieving stage, I'm in the shock stage."
Mindy Clark, who lives in the apartment complex, visited the makeshift memorial to Robert that has been growing for days.
"I feel kind of devastated ... . I've seen him playing," Clark said. "(Today's news is) just kind of hard to swallow. It's just hard ... . Who would hurt a child and just throw him away?"

Here's the article where it says the BF was abusing the Mom.
Which once again leads back to the baby Aiden with the fractured skull ever being placed back with them..as well as Robert should not have been able to visit them in the summer. The judge made a huge mistake ever giving this women visitation with either Robert or Aiden.

Melissa Jenkins and Daniel Ehrlick pleaded not guilty to charges of first-degree murder in connection with the beating death of Jenkins' 8-year-old son Robert Manwill.
The two stood silent as their attorneys entered the pleas Thursday in front of 4th District Judge Darla Williamson.
Ehrlick is accused of beating the boy to death, and Jenkins is accused of covering up the crime and lying to police about what happened.
The next hearing in the case is set for Nov. 5, when a trial date likely will be set.
Jenkins and Ehrlick were indicted and charged with first-degree murder by an Ada County grand jury Aug. 18.
The grand jury found that 8-year-old Robert Manwill was beaten by Ehrlick for weeks in a pattern of "escalating physical violence" that finally climaxed in his death, according to court records.
Ada County Coroner Erwin Sonnenberg said the boy died from blunt force trauma "on or about" the July 24 — the night he was reported missing. That report triggered a community-wide search for Robert Manwill that ended about two weeks later when his body was found in the New York Canal near Kuna.
Ehrlicks’s violence against the boy started as early as June, according to the grand jury indictment, which also says Jenkins "did actively and repeatedly hide (Robert) from government authorities" and kept "other persons from observing the ongoing harm" Ehrlick was doing to the boy.
The grand jury said Ehrlick repeatedly abused Robert and eventually killed the boy by the "intentional application of torture ... by inflicting extreme or prolonged pain with the intent to cause suffering, to execute vengeance, or to satisfy some sadistic inclination, by inflicting repeated acts of blunt force trauma to the abdomen and/or head of Robert Manwill."
The grand jury also found that Jenkins continued to leave Robert with Ehrlick despite the knowledge that he was "inflicting repeated acts of physical violence" on the boy, and that Jenkins lied to police about Robert's whereabouts after she knew he was dead.
Ada County prosecutors have not yet decided whether they will seek the death penalty against Jenkins and/or Ehrlick.
They have a little more than a month left to make that decision.
Ada County Prosecutor Greg Bower said last month much of the decision will depend on what kind of mitigating evidence defense attorneys provide to prosecutors as they swap discovery on the case.
The entry of plea hearings for Jenkins and Ehrlick were originally set Tuesday but were later rescheduled when 4th District Judge Deborah Bail, who was originally given the case, disqualified herself in late August.

BOISE - An Ada County judge has issued a not guilty plea for the two suspects charged with killing 8-year-old Robert Manwill.
On Thursday, Melissa Jenkins and Daniel Ehrlick stood silent in Ada County court Thursday afternoon, which prompted the judge to issue the plea.
Jenkins and Ehrlick are both charged with first degree murder of Manwill, who's disappearance and killing drew national media attention.

Couple refuse to plea in boy's death

BOISE, Idaho (AP) - The mother of an 8-year-old boy found dead in an Idaho canal and her live-in boyfriend refused to enter pleas to first-degree murder charges during an arraignment Thursday.
Thirty-year-old Melissa Jenkins and her boyfriend, 36-year-old Daniel Ehrlick Jr., were arrested last month in the death of her son, Robert Manwill.
Fourth District Judge Darla Williamson entered not guilty pleas on their behalf.
An Ada County grand jury indictment says the boy was tortured, beaten repeatedly and ultimately killed by Ehrlick Jr.
The indictment accuses Jenkins of hiding her son's injuries from government officials who could have intervened, as well as aiding and abetting her boyfriend in the death.
The couple also face charges that they failed to report the boy's death

Melissa Jenkins and Daniel Ehrlick pleaded not guilty Thursday to charges of first-degree murder in connection with the beating death of Jenkins' 8-year-old son Robert Manwill in July.
The two, both charged with first degree murder, stood silent during their entry of plea hearing Thursday in front of 4th District Judge Darla Williamson so not guilty pleas were entered for them.
Ehrlick is accused of beating the boy to death, and Jenkins is accused of covering up the crime and lying to police about what happened.
Ehrlick and Jenkins, who appeared separately in front of Williamson Thursday, both waived their speedy trial rights so a jury trial on the case won't likely happen until next summer at the earliest.
The next hearing in the case is set for Nov. 5, when a trial date likely will be set. Defense attorneys say they need to know whether or not Ada County prosecutors plan to seek the death penalty against Ehrlick or Jenkins before they can schedule a trial.
Prosecutors have until the middle of October to make that decision.
Rob Chastain, Jenkins' attorney, told Williamson he did not yet know if he planned to file a motion to sever the cases since he had not yet received any discovery from prosecutors as of Thursday.
Both Ehrlick and Jenkins are being held in the Ada County Jail and appeared in court Thursday shackled and dressed in jail uniforms.
Both answered Williamson's questions with simple "yes" and "no" answers, as family members and friends of both suspects and Robert Manwill watched from the courtroom.
Ehrlick initially said he did not understand his speedy trial rights but later said he did after talking to public defender Gus Cahill.
Family members left the courtroom without comment Thursday.
Jenkins and Ehrlick were indicted and charged with first-degree murder by an Ada County grand jury Aug. 18.
The grand jury found that 8-year-old Robert Manwill was beaten by Ehrlick for weeks in a pattern of "escalating physical violence" that finally climaxed in his death, according to court records.
Ada County Coroner Erwin Sonnenberg said the boy died from blunt force trauma "on or about" the July 24 — the night he was reported missing. That report triggered a community-wide search for Robert Manwill that ended about two weeks later when his body was found in the New York Canal near Kuna.
Ehrlicks’s violence against the boy started as early as June, according to the grand jury indictment, which also says Jenkins "did actively and repeatedly hide (Robert) from government authorities" and kept "other persons from observing the ongoing harm" Ehrlick was doing to the boy.
The grand jury said Ehrlick repeatedly abused Robert and eventually killed the boy by the "intentional application of torture ... by inflicting extreme or prolonged pain with the intent to cause suffering, to execute vengeance, or to satisfy some sadistic inclination, by inflicting repeated acts of blunt force trauma to the abdomen and/or head of Robert Manwill."
The grand jury also found that Jenkins continued to leave Robert with Ehrlick despite the knowledge that he was "inflicting repeated acts of physical violence" on the boy, and that Jenkins lied to police about Robert's whereabouts after she knew he was dead.
Ada County prosecutors have not yet decided whether they will seek the death penalty against Jenkins and/or Ehrlick.
They have a little more than a month left to make that decision.
Ada County Prosecutor Greg Bower said last month much of the decision will depend on what kind of mitigating evidence defense attorneys provide to prosecutors as they swap discovery on the case.
The entry of plea hearings for Jenkins and Ehrlick were originally set Tuesday but were later rescheduled when 4th District Judge Deborah Bail, who was originally given the case, disqualified herself in late August.

I am glad to hear that Judge Deborah Bail dismissed herself from this case. She is the judge with the poor judgement that allowed Melissa to have Aiden back and Robert for a few weeks in the summer. She is the judge who felt that $75 was enough payment for a baby's cracked skull. The women should should be removed from office..poor, poor judgement..knowing that the BF was an abuser, and part of the reason why Charles Manwill had custody of Robert through the school year. I am still steamed about the injustice in this case.

Gypsydd, I totally agree. Maybe I'm naive, but I think the judges should at least come under review when something like this happens. She should be accountable for the basis of her decision, including but not limited to the $75 fine for cracking the baby's skull. If I could find where to write to complain, I would do it. This is so insane!
