Woman is fighting extradition; DNA test of baby put on fast track
 
A 35-year-old woman suspected of kidnapping an infant cut from the womb of a woman found dead Monday in Worcester was arraigned yesterday from a New Hampshire jail on a fugitive from justice charge.

Julie A. Corey of 3 Henry Terrace, Worcester, was ordered held on $2 million bail at her arraignment via videoconferencing at Concord District Court, N.H. Ms. Corey remained in lockup at New Hampshire's Merrimack County House of Correction in Boscawen for the brief arraignment. The judge, prosecutors and defense lawyers were at the courthouse. Ms. Corey looked away from the camera throughout the proceeding, and spoke only to give yes and no answers to the judge.

The fugitive from justice charge stems from Massachusetts authorities' plan to charge Ms. Corey with kidnapping of a baby they believe was taken from the womb of Darlene L. Haynes, 23, of 94 Southgate St.

Authorities named Ms. Corey as a "person of interest" on Wednesday in the homicide of Ms. Haynes, who was found wrapped in a comforter in a closet of her Worcester apartment. She was eight months pregnant, but her baby was missing. Police believe the death occurred sometime late Thursday night or early Friday morning of last week, according to Detective Capt. Edward J. McGinn Jr.

Ms. Haynes suffered head injuries and there was a large incision in her abdomen, he said.

A warrant for a charge of kidnapping was issued yesterday morning out of Central District Court in Worcester. The state Department of Children and Families has custody of the infant pending a closed custody hearing Monday in Worcester Juvenile Court, according to District Attorney Joseph D. Early Jr.

Mr. Early said at a press conference yesterday afternoon that he expected DNA testing to be done "relatively quickly" to positively identify the newborn that authorities have referred to as either "Baby Girl Haynes" or "Jane Doe." Ms. Corey is fighting extradition from New Hampshire. An extradition hearing is scheduled for Aug. 28, Mr. Early said.

Police said Ms. Corey told them she gave birth to the baby.

Mr. Early and Capt. McGinn said the investigation into what the district attorney called a "horrific crime" was continuing.

Although they provided few details of the probe, Capt. McGinn did say that no murder weapon had been recovered. He said police, with a warrant, searched at the Henry Terrace apartment yesterday where Ms. Corey and her boyfriend, Alex Dion, stayed.

Authorities traced Ms. Corey, the missing baby and an acquaintance to Plymouth, N.H., on Wednesday. Worcester police, as the lead agency, New Hampshire and Massachusetts state police, and Plymouth, N.H., police, pinpointed Ms. Corey's location to a homeless shelter off Highland Street in Plymouth by late afternoon Wednesday. New Hampshire State Police arrested her about 5:45 p.m., and the baby was whisked in a waiting ambulance to a nearby hospital down the road.

Cathy Bentwood, director of the homeless shelter where Ms. Corey was arrested, said nothing like this had ever happened before. She said her staff acted professionally, and the police were on top of the situation.

"The woman arrived Tuesday evening with a man and an infant," Ms. Bentwood said. "They were here less than 24 hours."

Ms. Bentwood said she popped her head in to see the new arrivals, and as she would with anyone with an infant, advised Ms. Corey to take the child to a local pediatrician for a checkup. Ms. Corey told Ms. Bentwood she had an appointment with a pediatrician Wednesday afternoon.

Meanwhile, a social services official from New Hampshire's Department of Health and Human Services contacted a second-shift employee at the shelter who had just come on duty Wednesday, according to Ms. Bentwood. The employee confirmed that the woman was acting suspicious, and the state officials requested that the shelter employee "engage Ms. Corey," Ms. Bentwood said. When the couple appeared ready to take off, Ms. Bentwood said the shelter employee contacted police and Ms. Corey was arrested just outside the shelter.

Authorities were in place, ready to make their move: Worcester police, Massachusetts and New Hampshire state police, Plymouth police and Plymouth EMTs had set up along Highland Street. Though the shelter has a Highland Street address, the building is sheltered from the main road.

"After she contacted police, there was almost no time lapse when the couple was leaving (until the arrest), Ms. Bentwood said." I think the whole thing transpired very smoothly; there was no drama as far as I understand."

Plymouth Fire Chief Casino Clogston said yesterday afternoon, "Our guys were staged by police on Highland Street. They weren't told why," He said, "They were handed an infant baby."

From there, he said EMTs took the baby by ambulance to the emergency room at Speare Memorial Hospital in Plymouth, just a few minutes from the shelter. An emergency room doctor and pediatrician examined the baby girl and determined her to be "days old." She was admitted, and released just about 24 hours later to the custody of the Massachusetts Department of Children and Family Services, according to Michele Hutchins, hospital spokeswoman.

"Baby Jane Doe, she does not have any other name," Ms. Hutchins said. "No one even asked to visit her. She had no visitors."

Though Ms. Hutchins added, visits to the infant would have been prohibited.

State and local police guarded the shelter from media yesterday to protect the residents' privacy. Many people in Plymouth yesterday noticed the influx of television trucks and reporters, and most had heard of the bizarre case.

"I read about it in the paper ("The Laconia Daily Sun") this morning," said Amy Green of Center Harbor. She works in a downtown hair salon in Plymouth. "I was surprised the baby was actually still alive."

Boyfriend wants custody of baby cut from womb


WORCESTER, Mass. (AP) -- A man who says he is the father of a baby who was cut from her slain mother's womb said Monday that he wants custody of the baby girl.

A Monday afternoon hearing was scheduled in Worcester Juvenile Court to determine who should get temporary custody of the 4-pound infant. Her mother, 23-year-old Darlene Haynes, was found slain in her Worcester apartment last Monday.

The baby was found two days later at a New Hampshire homeless shelter with Haynes' former neighbor Julie Corey, who has been charged with kidnapping and is being held on $2 million bail.

The infant is now in the custody of the state department of Children and Families. DNA tests are being done to establish paternity.

Roberto Rodriguez, Haynes' estranged boyfriend, told The Associated Press outside court Monday that he wants custody of the baby and of an 18-month-old girl he had with Haynes.

"I just want my two girls. That's all I want," Rodriguez said.

Rodriguez, 24, declined to say who else may be seeking custody of the infant.

An uncle of Haynes, Karl Whitney, was seen leaving a Juvenile Court office Monday morning. Whitney would not say whether he or other family members are seeking custody. He said he had been advised by his attorney not to talk about
he juvenile court proceeding, which is closed to the public.

Craig Smith, clerk magistrate of Worcester Juvenile Court, would not discuss the case, but said typically in such cases, a judge would appoint an investigator to check on the background of anyone who seeks custody. Smith said children generally remain in the custody of the Department of Children and Families until investigations are completed.

Haynes, the baby's mother, was eight months' pregnant. Her landlord found her body in her apartment, wrapped in bedding in a closet. The exact cause of her death has not yet been determined, but police said she suffered head trauma.

Family members and Corey's boyfriend have said that Corey, 35, fooled them for months into believing she was pregnant. She later told them that she had given birth and presented Haynes' baby as her own, they have said.

Haynes, who had three other children, had a restraining order against Rodriguez, who allegedly pushed her into a glass table in June and cut her arm, then grabbed her by the throat and slapped her, according to court records. Court records also showed Rodriguez was charged with hitting Haynes in 2008 in a case that was continued without a finding.

The 18-month-old girl is also in state custody. Whitney told reporters last week that Haynes' grandmother, Joanne Haynes, is raising her two other children, Jasmine, 5, and Lillian, 3.

Whitney told the Telegram & Gazette that Haynes had picked the name Sheila Marie for her fourth child.

Woman found with baby denies a role in mom's death



WORCESTER, Mass. (AP) -- An attorney for a Massachusetts woman accused of kidnapping a baby who had been cut from her mother's womb said his client denies any involvement in the mother's killing.

Julie Corey is being held in a New Hampshire jail. She faces a kidnapping charge in Massachusetts.

Corey was arrested July 29 at a homeless shelter in New Hampshire with a baby girl.

Police say the baby was cut from Darlene Haynes' womb. Haynes' body was found July 27 in her Worcester apartment. No one has been charged in her killing.

Attorney Louis Aloise told the Telegram & Gazette of Worcester that Corey denied "any complicity" Haynes' death. Aloise declined to comment on whether Corey says the baby is her child.

Aloise didn't return messages left by The Associated Press on Wednesday.

The story tugged at hearts nationwide. The horrific murder of a Worcester mother as her 8 month old fetus was carved out of her womb. Then, days later, an amazing story of survival. The baby was found alive in the the arms of an acquaintance.

"Speechless, I didn't know what to say when I first found out," says Karl Whitney, uncle of the victim. He resides in Palmer.

The woman found with Darlene Haynes baby is behind bars awaiting trial. Meanwhile a custody battle has broken out. Three parties are fighting for control of baby Haynes.

The girls alleged biological father, Roberto Rodriguez, is the first.

Rodriguez submitted to a paternity test. The results aren't yet public. At the time of the murder, a restraining order was filed against him for alleged domestic abuse.

The state wants custody too, but DSS has been tight-lipped throughout the case and now, it's been impounded. That means all details from here on out won't be public.

Finally, Karl and Beverley Whitney: They are the uncle and aunt of Darlene Haynes. Inside their Breckenridge Street home in Palmer, are several other kids, some special needs. Several were adopted by the family. It's proof, their lawyer says, that makes them the prime candidates for the baby.

In an earlier interview with Feeding Hills lawyer Debra Rosenthal, the Palmer family had been in close contact with Darlene and her other children.

I really hope all this gets sorted out for the baby's sake. She needs a good home with lots of love.

I agree but I also feel that as many siblings that they can place together should happen.  These children will no longer know their mother but they have every right to know each other.  They should not be split unless it is impossible for them to be together.  I hope the court adds the childs right to know its siblings in their views of the best interest of the child/ren.

The woman accused of kidnapping a baby cut from a dead woman’s womb stood silently yesterday at her arraignment in Worcester as the still-stunned family of the child’s slain mother watched the suspect’s every move.

Julie A. Corey, 35, pleaded not guilty in Worcester District Court to the baby snatching and was ordered held on $500,000 bail.

There were no new leads in the murder of Darlene L. Haynes, 23, who was found dead in a closet at her Worcester apartment July 27 - her baby cut out of her.

“It’s very hard to put my emotions out there. It gets very difficult. I have a hard time understanding why someone would do this to a pregnant woman,” said Karl Whitney, the uncle of the slain woman.

Corey was arrested July 29 at a New Hampshire homeless shelter where she was staying with a newborn baby and her boyfriend Alex Dion.

Dion, 27, later told the Herald that Corey convinced him the baby was her child and he was the father.

But Worcester District Attorney Joseph Early’s office said the baby belonged to Haynes, an expectant Worcester mom whose bloody, bludgeoned body was found wrapped in a bedspread, the fetus ripped from her womb.

DNA test results confirmed the baby belonged to Haynes and her on-again, off-again boyfriend Roberto C. “Tito” Rodriguez, 24.

The baby is now in state custody and being cared for by a foster family. Haynes’ family said the baby is safe and doing well. Whitney would not divulge the progress of court proceedings regarding the custody of the child, which he said are confidential.

“As far as I know the baby is healthy and doing well,” Whitney said. “I would hope the baby becomes part of the family.”

He sat among a line of the dead woman’s relatives who packed the front row of the courtroom and stared at Corey when she was brought into the courtroom in handcuffs and wearing a red-hooded sweatshirt, her dirty-blond hair tied in a ponytail.

No one has yet been charged with the murder, a crime that was gruesomely compounded by the days that passed before anyone found the body and further still when authorities discovered the fetus had been removed from the mother, who was eight-months pregnant.

A Worcester woman accused of killing her pregnant friend and cutting the baby from the womb has been ordered held without bail after pleading not guilty to murder and kidnapping charges.
 
Julie Corey was arraigned in Worcester Superior Court on Wednesday.

Corey and the baby were found in a homeless shelter in Plymouth, N.H., in July, just days after Darlene Hayes was found dead in her Worcester apartment.

DNA tests showed that the baby girl with Corey was cut from the womb of the 23-year-old Haynes, who was eight months pregnant at the time of her death.

Corey is due back in court Jan. 28 for a pretrial conference.

Her lawyer has said that his client denies the charges.

The baby is in the custody of the state Department of Children and Families.

WORCESTER, Mass. (AP) — A woman accused of killing her pregnant friend three months after her own miscarriage was convicted Wednesday of beating and strangling her, then cutting the baby from her womb and passing the child off as her daughter.
Julie Corey sobbed as a Worcester Superior Court jury found her guilty of the 2009 murder of 23-year-old Darlene Haynes. The jurors had deliberated for 10 hours over two days. Sentencing was scheduled for Tuesday.
Prosecutors said Haynes was eight months pregnant when Corey attacked her and cut the baby out of her body. They told the jury that Corey had been pregnant, too, but had a miscarriage three months earlier and told her boyfriend and family that Haynes' baby was her own.
"It's probably the most horrific case this office has ever seen in terms of facts," District Attorney Joseph Early Jr. said in a statement after the verdict was handed down. "This woman was killed for her baby."
Corey, 39, did not testify during the trial.
Corey's lawyers contended that police failed to follow up on leads that could have implicated other potential suspects in the killing, including Haynes' ex-boyfriend. They also suggested that Haynes' ex-boyfriend had given Corey and her boyfriend, Alex Dion, the baby. Dion denied that on the witness stand.
Defense lawyer Michael Wilcox said he was disappointed with the verdict, but not surprised. He said they plan to appeal.
"We were aware of the evidence against her," Wilcox said, adding that the facts alone in the case were difficult to discuss. "We worked very hard to present the jury with a different picture, but we weren't ultimately successful."
 
Haynes' body was found in a closet in her apartment on July 27, 2009. She had been beaten in the head and strangled with an electrical cord. Her abdomen had been cut open, and her baby was gone.
Corey, Dion and Haynes' baby were found two days later at a homeless shelter in Plymouth, N.H. Her lawyers acknowledged that she was found with the baby but said she played no role in Haynes' slaying.
Dion testified that Corey, whom he believed was pregnant at the time, called him on July 23, 2009, and told him she was giving Haynes a ride to a store. Later that night, Corey called him to say her water had broken and a friend was taking her to the hospital to give birth, Dion said.
A couple of hours later, Corey called him again and said, "We had a baby," Dion testified. Dion said Corey arrived home the next morning with a baby girl he believed was his daughter. He said he and Corey introduced the baby to family and friends over the next couple of days.
The girl, now 4, lives with her biological father.
