Religious Runaway Gains Legal U.S. Residence

COLUMBUS, Ohio -- A lawyer for a runaway Christian convert from Ohio who was also an illegal immigrant says the 18-year-old woman has gained permanent residency in the United States.

Kort Gatterdam, a lawyer for Rifqa Bary, said Tuesday the news means Bary can now start applying for a driver's license, Medicaid coverage and college scholarships.

Gatterdam says Bary, a native of Sri Lanka, received her permanent residency card last week and can apply for citizenship in five years.

Bary had sought the green card as she argued in court she could not reunite with her Muslim parents, whom she alleged threatened her with harm for converting.

Bary also sought legal residency to achieve health coverage as she battles uterine cancer.

So much for such a young woman to have to go through -- may the peace of the Lord bring her comfort.

A blogger championing the case of a Muslim-to-Christian convert from Ohio says allegedly defamatory comments she's being sued over were protected free speech.

Atlas Shrugs blogger Pamela Geller also says many of the postings singled out in a federal lawsuit could fall into the realm of hyperbole and not defamation.

Geller says in a federal court filing Tuesday that she is a journalist writing about a matter of public interest and is protected by the First Amendment.

Ohio attorney Omar Tarazi sued Geller for $10 million last month to compensate him for damage he alleges Geller's comments did to his reputation.

Tarazi represented the parents of Rifqa Bary, a Christian teenager who fled from her Columbus-area home to Florida, saying she feared harm from her Muslim mother and father.

ORLANDO --

The Florida Bar has filed a complaint alleging misconduct by the former attorney of an Ohio teen who ran away to Florida after converting from Islam to Christianity.

The complaint alleges Orlando lawyer John Stemberger accused the attorney for Rifqa Bary's parents of being paid by groups with terrorist ties based solely on information from Facebook and a blog.

The complaint also said Stemberger appeared on TV as an attorney for the teenager after he stopped representing her.

The Florida Bar said its complaint was mailed to the Florida Supreme Court on Monday.

Stemberger and his attorney did not immediately return messages for comment.

Possible penalties range from a reprimand to disbarment.

Hello Monkeys--long time no see.  It has come to the point in this country, IMO, that Sharia is no longer creeping, it is racing.  Anyone who criticizes a Muslim for any reason whatsoever is open to attack. Pamela Geller serves a great public service by exposing Islamists for what they are--enemies of the US who are bound and determined to bring this country into a grand caliphate which will rule world-wide according to the book written by a pedophile whom they seek to emulate.

I thank God that Rifqa is free of them, if one can ever be free.  I wish her the best in her future life and especially in her serious health problems.  This young girl has been through so much in her young life and now that she is free of the pernicious influences under which she suffered so much, including the loss of vision in one eye, now this.  Sometimes life isn't fair, but if anyone deserves a happy life, it is Rifqa.

Bary stated Stemberger “behaved in a very professional and ethical manner during the entire time he represented me.” She continued saying that Stemberger “played a major role in my eventual safety… and securing my position as a Legal Permanent Resident of the United States. I am grateful to this lawyer for his pro-bono service to me...and was completely satisfied with his legal services.”

When discussing Tarazi’s behavior, Rifqa said he “conducted himself unprofessionally and harmed my ability to reunite myself with my parents in a number of ways…”

She criticized him for filing motions to bar her from receiving Christmas cards from friends and supporters and to have her computer activity monitored. She also said he fought her efforts to obtain a special immigration status for juveniles in the country illegally.

Bary and her parents appeared estranged each time they were in court together, often sitting just a few feet apart across a juvenile courtroom without ever speaking.

Tarazi said Tuesday that Bary's statement was inaccurate and said she was being used by Stemberger.

"If she wants to reconcile with her family the doors are always open," Tarazi said. "She can call them anytime, and they miss her very much."

Bary, a native of Sri Lanka who has since turned 18 and obtained a green card, had not commented publicly about her case previously.

Authorities have said they found no credible threats to the girl following her conversion.

ORANGE COUNTY, Fla. -- Police recommended charges against six of the people who helped a teenage Christian convert run away from her Muslim parents in Ohio in 2009, an investigation by The Associated Press has found.

But prosecutors in Ohio and Florida have declined to file charges against anyone who helped 16-year-old Rifqa Bary leave Columbus on a Greyhound bus and shelter her for two weeks in Orlando without notifying authorities, according to police reports obtained by the AP through freedom of information requests.

The six include a Kansas City minister, a Columbus family friend, an Orlando pastor and his wife and two members of the pastor's church.

A lawyer for Bary, now an adult, says prosecutors made the right choice.
