This is great.  I can not open them though .  Can someone tell me if Morgan mentions the declaration that DC did  for the Fl Bar http://www.docstoc.com/docs/10715409/Declaration-of-Dominic-Casey---FL-Bar where he spells out the dates of his engagement for Baez?  I really hope Morgan has copies of that one.

I quickly scanned through the new filings, and I see no mention of the Decaration D. Casey made to the Florida Bar. It certainly seems Morgan and Mitnick could use it, as it is an official document in D Casey's own words. JMO

If the evidence remains part of an investigation, one that’s ongoing, any part “may be” surgically removed. But, is it enough to keep the defense’s evidence out of the hands of the public if it is ordered by the court to turn it over to the prosecution? In order to find an answer, I made a phone call. I did this yesterday, after 5:00 pm and I did it on the assumption that lawyers never keep banker’s hours. I guessed right.

“Hello,” the man answered after the phone rang one or two times.

“Hello, my name is Dave Knechel and I have a couple of questions regarding the Casey Anthony case,” I said. “May I ask who I am speaking to?”

“Yes, this is Jose.”

“Are you…”

“One of the Jose’s? Yes…”

“… Jose Baez?”

“No, but I am Jose.”

Close enough, but no Cuban cigar. I discussed a couple of issues pertaining to the civil case; the defamation lawsuit. He told me the Baez Law Firm has nothing to do with the civil litigation. Keep that information in your back pocket.

“Only the criminal?” I asked.

“Yes, only the criminal.” You see how easy it is to get information out of people?

“So, Jonathan Kasen is not affiliated with Jose Baez?”

“No, not at all.”

I proceeded to ask him gingerly about state law, Chapter 119  of the Florida statutes in particular. We discussed some things, but he was very reluctant to give up much information regarding this case because, after all, his client is Casey Anthony. I understood that fully, but I still managed to use my usual methods of persuasion and finally, I got an answer. Again, I reiterated that I want nothing from him that would reveal anything pertaining to his client. All I needed to know was a matter of law and why not come right to the source?

“Exemption” means a provision of general law which provides that a specified record or meeting, or portion thereof, is not subject to the access requirements of s. 119.07(1), s. 286.011, or s. 24, Art. I of the State Constitution.

Specifically, I wanted to know whether any of the evidence Todd Macaluso brought up at the August hearing would be revealed because of open government and public records laws. I wasn’t at all interested in how the judge would decide. I told him I was aware that discovery materials have nothing to do with Florida’s Government in the Sunshine Law, and that discovery is evidence shared, back and forth, by the prosecution and defense. That’s all the discovery aspect means. He agreed. Again, he reminded me that he wasn’t going to share any of the discovery information. I told him I wasn’t looking for any. I said I’m only concerned about whether this evidence, clearly a part of the defense’s strategy, could wind up in the hands of the public due to the sunshine law.

“I mean, is it only state’s evidence we get to see or does it include the defense’s side, too, once its handed over to the state?”

“It all depends.” He responded. “It might or it might not.”

That sounded very confusing, but we continued, and what he told me was something rather surprising. I thought it would not see the light of day until trial. Others told me it should be out in the open. Most of us merely guessed. In the end, it will come down to what the judge thinks. First, there will be the motion hearing, of course. Then, the judge will decide if the defense must turn over its secrets. My guess is he will say yes because the “defense made reference to this allegedly exculpatory evidence.” Why spend more of the state’s money? That’s a good argument. If the defense has any material that will clear their client of guilt or fault, why not vindicate her now and get it over with?

Needless to say, Jose and I did not discuss his thoughts on how the judge would rule, but we did talk about “discoverable material” and how Judge Strickland will ultimately decide what will be allowed to filter out into the public’s hands and what will not. That is, if the state gets its way.

I believe the two sides will come to some sort of “behind closed doors” agreement beforehand, yet insist the motion be heard in court for the simple reason of assurances. We’ll gladly turn over the material if you tell the judge you have no problems keeping it under wraps. Trust me, the state doesn’t care if we or anyone in the media sees it or not, nor does the judge. Personally, I don’t think any bombshells exist, but remember, I didn’t hear anything like that from Jose.

In the final analysis, it’s a matter of reciprocal discovery. Here was my opinion.

Back a month or so ago we were talking about Gale St. John being near where Caylee was found and we only had a small clip of her drive by. Here is the video in full. To me, it seems as if they drove a little past Caylee's spot, got out of the car and continued to walk forward away from Caylee.  But then later on, they are stopped, talking about coming back, hiding the car to search again. If you look out the window, there across the street it looks to me as if it is the house and backyard of the kid who was interviewed by the media the day Caylee was found. I'm confused. ANJ, please tell me your theory on this.

I will say this in deference to him, as he knows an associate of mine well. I don’t think he had a clue what he signed on for like half the other people that Baez duped, and make no mistake, when I say duped, I say D U P E D. I truly believe this guy started out thinking Caylee was kidnapped ( don’t even light the torch people I have my reasons). That changed at some point, and he has been backpedaling ever since, out of necessity to save his own ass. He knows what agreements are dated, to the letter, thus why they were not there at the hearing. He lied on the stand, he changed his testimony and I will bet a gazzillion I do not have that he won’t meet with LE as he promised he would if they had any other questions. Because I promise they will after that testimony. He had knowledge from somewhere that he is not copping to.

Page 2-3 she said she was at the Suburban Drive location 2 times - 1 time with TES and 1 time with her husband, BUT on page 25, line 20 she said "I've been out here probably about, I don't know how many times.I lo..lost count. AND on page 26, line 3 she said "over ten, ten, twenty times." She said she took the pics from that area 30' from the fence. Pages 26 - 27, she said she searched only the area where Caylee was found 2 days after Caylee was reported missing. She never searched down by the school or the other side of the road. She said it was a gut feeling.

Page 28 - LE asked her about the 2nd time she came out to the Suburban Drive area. She said "probably three weeks later". On page 29, she said there was standing water.... approximately 6" and it got deeper; she started "to sink a little bit".

Page 30, LE asks her when was the first time she was in there with water and she said "When uh, Equusearch was doing their searches." and she was there for "every one" of TES searches in that area, but she can't remember how many times, but...

On page 31, she said she was out there probably ten times by herself and half of the time there was standing water; page 32 she said the first times she saw water was her 3rd or 4th trip out there; it was 3-4 weeks after her first trip which was the second day after Caylee was reported missing.

Page 34-35 She told LE "George and them....Kid Finders" brainwashed her; George gave her a picture of the kidnapper's car and told her the kidnapper had short brown hair, brownish/green eyes, 5'6" - 5'7" tall, skinny, real nice dresser and real pretty.

And finally on page 45, LE's incident report, states Joy told LE she had been Baker Acted five times, she was "arrested for fleeing and eluding police, however the charges were dropped due to her mental state"

I’m trying to get past being shocked, angered or surprised by the actions of this appalling family. They are now infamous and are the poster children for how not to act when your daughter murders your grandchild.  I cannot understand why they were allowed to desecrate this latest memorial for missing children. What a shame that some people are not aware of their true motivations, $$$$$$. My heart goes out to the families truly grieving, but those grifters get nothing but my disgust.
