California to Compensate Jaycee Dugard With $20 Million
State Allocation Acknowledges Failure to Supervise Sex Offender Who Kidnapped Dugard

The state of California approved a $20 million payment today to kidnap victim Jaycee Dugard for failing to properly supervise the registered sex offender who held her captive for 18 years.

California legislators today overwhelmingly approved the negotiated settlement the state and Dugard. The allocation was part of a larger Assembly bill, labeled only as "claims against the state; payment."

Though there were three other claims in the same bill, the total sum was $21.1 million, giving the lion's share to Dugard, now 30 and the mother of two daughters she bore while in captivity.

The bill will now to go Gov. Arnold Schwarzenegger's desk for approval, but because of a glitch caused by the state's operating without a budget into the new fiscal year, the governor will have to formally request to see the legislation.

Schwarzenegger will sign the bill, spokesman Aaron McLear said today.

The settlement was reached with Dugard and the Department of Justice on June 24.

I find it sad that this was paid from victim restitution funds. This should have been paid in addition to any restitution she deserved. This was a failure of the system.

SAN FRANCISCO — Disturbing new video released Tuesday shows the wife of convicted kidnapper and rapist Phillip Garrido luring a young girl into the couple's van, asking her to do the splits and videotaping her, two years after the couple kidnapped 11-year-old Jaycee Dugard.

The videos were released by El Dorado District Attorney Vern Pierson, along with a report highlighting failures in the criminal justice system that allowed Phillip Garrido to roam free despite warnings, and snatch Dugard off a street in South Lake Tahoe in 1991.

He held her for 18 years, raped her and fathered two children with her while holding her captive in a backyard compound in the San Francisco Bay area town of Antioch.

Pierson said "law enforcement failed to see Phillip Garrido for what and who he truly is ... evil" and outlined a number of startling details that show how the enterprising Garrido gamed the parole system.

Reporting from Sacramento -- El Dorado County Dist. Atty. Vern Pierson, who prosecuted the man convicted of abducting Jaycee Lee Dugard and holding her for nearly two decades, on Tuesday blasted the criminal justice system that let onetime parolee Phillip Garrido previously go free.

In a report issued the day before state Sen. Ted Gaines (R- Roseville) has scheduled a "community discussion" here to focus on tightening parole requirements, Pierson cited the fact that parole agents over the years had made about 60 visits to Garrido's home and failed to discover Dugard, who was kept hidden in the backyard.


The prosecutor directed his sharpest criticism toward what he called the criminal justice system's "over-reliance upon the psychiatric profession to predict future dangerousness."

September 22, 2011

(CNN) -- Jaycee Dugard filed a complaint against the federal government Thursday, seeking compensation for what she called its failures to track the man who held her captive for 18 years.

The lawsuit was filed in the U.S. District Court for Northern California, said Nancy Seltzer, whose Los Angeles-based firm represents Dugard and detailed the complaint. According to a press release from the company, the U.S. government "summarily rejected" two requests from Dugard "for private mediation in the case."

The U.S. Justice Department had no immediate comment Thursday, as it had not seen and thus did not know the details of the complaint, said spokesman Charles Miller.

"My name is Jaycee Dugard, and I want to say that, because for a long time I wasn't able to say my name and so it feels good," she said, according to People magazine.

KIDNAPPING survivor Jaycee Dugard has made her first public appearance over the weekend at a star-studded New York awards ceremony, but she plans to remain in hiding until her daughters are mature enough to understand what happened to them, she said in a recent interview.

Dugard, 31, and her two children, ages 14 and 17, have been living at an undisclosed California location since being found by authorities in 2009, 18 years after she was abducted from a bus stop.

She was held by Phillip and Nancy Garrido in their backyard, where she gave birth to two children conceived by rape.

In an interview set to air on Tuesday night, Dugard told ABC News that she's spent the last three years healing and experiencing life with her family.

"I want my girls to have a normal life as much as possible," she told ABC News' Diane Sawyer.

"I feel like on some things I have to do it a little bit differently ... not be recognised ... for their sake."

Jaycee Dugard, who is suing federal officials over her 18-year rape and kidnapping ordeal, has accused the government of tampering with the sole expert witness in her case.

Miss Dugard claims that convicted rapist Phillip Garrido should have had his parole revoked by the Department of Justice before he abducted her.

Garrido and his wife snatched 11-year-old Jaycee from a street in South Lake Tahoe in June 1991 while on her way to school.
She was held captive in a compound behind their Antioch house where Garrido repeatedly raped and drugged the girl. During her captivity, Dugard gave birth to two daughters fathered by Garrido.

Dugard's lawsuit claims that federal agents failed to meet with Garrido as frequently as required and to properly report his frequent marijuana use. He was on parole after serving 11 years of a 50-year sentence when she was kidnapped.

A verdict in Dugard's favor in the federal compensation suit would leave a jury to determine the amount of damages.

In court papers filed on Monday, Dugard's lawyers complained the Department of Justice fouled up their case by contacting their sole expert witness.   ::snipping2::

Court Rejects Lawsuit by Kidnapping Survivor Jaycee Dugard
March 15, 2016

SAN FRANCISCO — The federal government cannot be held responsible for kidnapping survivor Jaycee Dugard's 1991 abduction and subsequent 18 years in captivity, an appeals court said Tuesday.

The 9th U.S. Circuit Court of Appeals rejected Dugard's lawsuit alleging federal parole officials should have revoked her abductor's parole well before he kidnapped her, but failed to do their jobs.

Phillip Garrido was on parole following his conviction on kidnapping and forcible rape charges when he and his wife Nancy abducted 11-year-old Jaycee from a California street and kept her captive in a backyard compound. Garrido repeatedly raped her over years and fathered two daughters with her.

The appeals court said in a 2-1 decision that Dugard had not been victimized by Garrido at the time he was placed under federal parole supervision, and there was no way to anticipate she would become his victim. As a result, federal authorities in California had no duty to protect her or other members of the general public from him, the court said. The decision upheld a lower court ruling.
 
Dugard alleged in her lawsuit against the federal government that parole officials should have returned Garrido to prison for any number of parole violations that preceded her abduction, including testing positive for drugs and alcohol.

In a dissenting opinion, Chief District Court Judge William Smith said the majority had improperly analyzed Dugard's case, and there was good reason to hold the government liable.

Dugard was identified and rescued in 2009 after Garrido took her and the girls to a meeting with his parole officer

Phillip Garrido was sentenced to 431 years to life for kidnapping and rape. His wife Nancy was sentenced to 36 years to life.

Dugard and her children have received a $20 million settlement from the state of California.

March 15, 2016

A divided U.S. appeals court on Tuesday dismissed a lawsuit filed by kidnapping victim Jaycee Dugard against the federal government for failing to supervise her captor when he was on parole from another kidnapping in the years before she was abducted.

A three-judge panel of the 9th U.S. Circuit Court of Appeals said by a 2-1 vote that Dugard could not sue over the alleged failure to supervise Phillip Garrido in the three years before she was kidnapped in 1991 because she was not a "specifically identifiable victim" at the time.

Dugard's lawsuit claimed that if federal parole officials had supervised Garrido properly, they would have revoked his parole and sent him back to prison for numerous instances of drug use and other violations, thus making him unable to kidnap her.

Dugard, now 35, was kidnapped at age 11 by Phillip and Nancy Garrido on the morning of June 10, 1991, as she walked to a school bus stop outside her home in South Lake Tahoe.

She was kept captive in sheds and tents in the backyard of their house near Antioch for 18 years, was repeatedly raped by Phillip Garrido and gave birth to two daughters when she was 14 and 17.

Dugard and her daughters were discovered and freed in 2009 after Garrido raised suspicions when he brought the two girls with him to the UC Berkeley campus to seek an event permit.

Both Garridos pleaded guilty in El Dorado County Superior Court in 2011 to charges of kidnapping and rape. Phillip Garrido was sentenced to 431 years in prison and Nancy Garrido to 36 years to life.

Garrido was on federal parole from 1988 to 1999 after being released early from a 50-year prison sentence for the 1976 kidnapping and rape of a South Lake Tahoe woman. In 1999, the parole supervision responsibility was transferred to the state of California.

Dugard filed the lawsuit against the federal government in U.S. District Court in San Francisco in 2011. The appeals court majority Tuesday upheld a lower court decision that dismissed the case in 2013.

Circuit Judges Richard Clifton and John Owens said in a brief ruling that parole officials can be sued for failing to carry out their duties only by people who were identifiable victims at the time of the alleged failure.

Judge William Smith, a federal district judge from Rhode Island temporarily assigned to the appeals court, said in a 29-page dissent that parole officials' duty should extend to victims who are foreseeable, even if not specifically identifiable.

Establishing such a legal duty would promote "greater care, vigilance, and concern for the safety of foreseeable victims," Smith wrote.

Dugard could appeal for further review by an 11-judge panel of the circuit court. Jonathan Steinsapir, a lawyer for Dugard, said he could not comment on the ruling or on whether a further appeal is planned.

Separately, Dugard received a $20 million settlement from the state of California in 2010 for failures in the state parole supervision between 1999 and 2009.
