Mother allegedly killed baby to hide relationship with juvenile

HAMILTON — A Hamilton mother could face the death penalty on charges that she allegedly killed her 5-week-old son and stuffed him in a garbage can because he was the product of a sexual relationship with a minor.

Asuncion “Suzie” Avila-Villa, 25, who lived in an upstairs apartment in the 1300 block of Shuler Avenue, was arrested Aug. 25, and charged with murder, endangering children, abuse of a corpse and tampering with evidence.

A Butler County grand jury returned an indictment today, Aug. 31, on Avila-Villa on charges of aggravated murder, endangering children, gross abuse of a corpse, tampering with evidence and unlawful sexual conduct involving a minor.

The indictment states Avila-Villa allegedly killed the infant to escape punishment for the unlawful sexual conduct charges.

Butler County Prosecutor Robin Piper said the infant was born from a sexual relationship between Avila-Villa and a man older than 13 but younger than 16. The relationship allegedly took place between September 2008 and November 2008, Piper said.

Piper said his office does not take the capital cases — those involving the death penalty — lightly, but that the grand jury was correct in its recommendation.

“The facts and details of the murder of this innocent child are unexplainably horrifying and clearly support that indictment that the grand jury handed down,” Piper said. “We’re never cavalier in seeking the death penalty, but where the law and evidence support it.

“The facts and circumstances are so horrifying, that this indictment is entirely warranted,” he said. “It’s entirely justified.”

On Aug. 24, Avila-Villa reported to police that her baby had been taken away by a former boyfriend the previous night and that he had not returned. But, following an investigation, detectives found the baby the next day in a trash can in an alley behind her apartment building. He had been placed in a plastic bag, police said.

According to an autopsy, the baby, Israel Santos, died of a crushed skull before being placed in the bag, Butler County Coroner Dr. Richard Burkhardt said.

The baby also had a broken arm and low body weight for a child his age, Burkhardt said.

The coroner said the baby boy had been dead for two days before he was found.

Piper said the tampering with evidence charge comes from Avila-Villa allegedly misleading police with false reports, and that there was no reason to believe anyone other than the mother harmed the baby.

Avila-Villa remains in jail on a $1 million bond. As of this morning, an arraignment had not been scheduled, but is expected to take place sometime early this week, Piper said.

$1M million dollar bond for mom in child's death

HAMILTON – A judge set bond this morning at $1 million for a Butler County mother of five who is accused of killing her 35-day-old son.

Asuncion Avila-Villa, 25, stood silently before Judge Daniel Gattermeyer in Hamilton Municipal Court as Municipal Prosecutor Mary Dudley read the allegations.

A few spectators in the courtroom, who were there for other cases, covered their mouths as they heard Avila-Villa was accused of murder, child endangering, abuse of a corpse and tampering with evidence.

She was arrested Tuesday, a day after she called 911 to report her son had been missing since Sunday from her apartment on Shuler Avenue in Hamilton.

Authorities say the child was never missing and Avila-Villa made the false report after killing her child and putting him in the trash.

Authorities say this is the first time in decades that a Butler County mother is accused in a fatal beating of her own child.

The baby, Israel Santos, suffered a crushed skull, a broken arm and other injuries authorities won't talk about.

Butler County Coroner Richard Burkhardt ruled the death a homicide and said the child had been dead for a day or two by the time police discovered his body amid trash that they had brought from Avila-Villa's apartment to the police station as part of their investigation of the missing-child report.

The child's teen father is not a suspect, police say.

Today in court, when Gattermeyer asked whether she worked, she shook her head, "no."

When he asked whether she was going to get an attorney or needed a court-appointed one, she replied, "I need one." Those were the only words she spoke during the few minutes she spent in court.

Gattermeyer set her next court date for Sept. 2. At that hearing, prosecutors are required to present some of the evidence against Avila-Villa, to show "probable cause" -- whether there is enough evidence to convince a judge that a crime probably happened and that Avila-Villa may have committed it.

That date would be canceled if Butler County Prosecutor Robin Piper is able to push the case through a grand jury and obtain an indictment before then.

Piper has said he will try to persuade the grand jury to indict Avila-Villa on charges that could bring the death penalty if she is convicted.

That means her attorney would have to be chosen from a short list of lawyers who are certified by the Ohio Supreme Court to handle death-penalty cases.

You and me both, Sister.

It's horrible to kill an infant. But to beat it, crush it's skull, stuff in a garbage can all so you can avoid getting in trouble for having sex with a young boy. I can't wrap my mind around it. My heart breaks for that baby. How it must have suffered.

Death is too easy for this kind of evil. I am sorry.

You wonder how she treated the other five children?

Woman Competent To Stand Trial In Son’s Death

HAMILTON, Ohio -- A Butler County woman who is accused of killing her 5-week-old son and throwing his body in a trash can was found competent to stand trial.

A judge decided that 26-year-old Asuncion Avila-Villa, of Hamilton, is competent to stand trial on aggravated murder charges in the death of Isreal Santos.

Prosecutors said she killed the child to escape punishment for having sex with a teenage boy who is the baby’s father.

Police said the infant’s skull had been smashed.

Woman heads to court charged with murdering her baby

A Butler County woman heads to court Friday for a preliminary hearing in one of the most horrific cases in recent memory.

The woman, 26-year-old Asuncion Avila-Villa, is charged with murdering her infant child and throwing him away in a trash dumpster before concocting a story of his disappearance.  Avila-Villa now faces the death penalty.

They say she killed her 35-day-old baby boy named Israel Santos, then put him in a plastic bag in the trash can behind her apartment on Shuler Avenue.

Investigators say they started looking for the baby after Villa called them and tried to cover up what happened.

Villa told the dispatcher: "I was just calling ‘cause ... one of my ex boyfriends came to pick up one of my sons ... He said he was going to take him. He hasn't come back yet."

Detectives worked the case all night.  They say they found the baby early the next morning in the trash can with a crushed skull and broken bones.

Avila-Villa is now charged her with murder, endangering children, abuse of a corpse and tampering with evidence.  She also faces a charge of unlawful sexual conduct with a minor.

To make matters even worse, police say that Avila-Villa committed the murder so that authorities would not discover that the father of the child is a 14-year old teennager.  Avila-Villa feared that paternity would be discovered because she applied for welfare.

In Ohio, when a single parent applies for government benefits a child support establishment hearing is automatically scheduled to have the absent parent repay the state through child support.  Avila-Villa allegedly realized that her government assistance would require disclosure of the father's name, which would lead to discovery of his age and subsequent prosecution of her for a sex offense.

The preliminary hearing for 26-year-old Asuncion Avila-Villa will be held at 9 a.m. today at the Butler County Courthouse.
