New Hearing Scheduled In Anthony Case
Judge To Hear Several Motions In Murder CasePOSTED: Wednesday, October 7, 2009
UPDATED: 5:40 pm EDT October 7, 2009

Caylee Marie Anthony.
ORLANDO, Fla. -- The murder case against Casey Anthony is heading back to a courtroom to try to resolve several motions filed by both sides.

•Motion To Dismiss Due To Spoilation Of Evidence

•State's Response To Motion To Dismiss

•State's Motion To Compel Reciprocal Discovery

•Defense's Response To State's Motion To Compel Reciprocal Discovery

•State's Motion To Strike Defense's Legally Flawed Motion

Local 6 investigative reporter Tony Pipitone said this will be the 19th court hearing held in the case against Anthony, dating back to her first court appearance on July 18, 2008.
The next hearing is scheduled for Friday, Oct. 16. Judge Stan Strickland wants to put lawyers from Anthony's defense and the state attorney's office in the same room in an attempt to resolve several issues and get the case moving.
In an attempt to correct itself, the defense recently added a sworn statement from Anthony, which said she did not report Caylee missing until July 15, 2008, one month after the toddler was last seen alive. Anthony claimed she left Caylee with a baby sitter named Zenaida Gonzalez.

It is unclear how those facts, which are not new, will prove Anthony's innocence in her daughter's death.

Judge Stan Strickland will hear motions from the defense team who want the murder case dismissed. The defense also claim deputies destroyed evidence at the crime scene.

The judge will also have a status hearing in the check fraud case.

Defense Wants Charges Dropped In Casey Case
Posted: 5:40 pm EDT October 7, 2009
Updated: 6:07 pm EDT October 7, 2009
<snipped>
In order to get those charges dropped, prosecutors say Casey must swear the evidence they have is true and convince a judge it's not enough to convict her.

However, so far, she's only admitted to two things.

Also Wednesday, Casey's defense team got another 42 pages from prosecutors detailing forensic entomology reports from August 28 and December 11 of 2008.

Casey Anthony: She still says she left Caylee with baby sitter, WKMG reports

The latest development in the Casey Anthony case? Put up or shut time for the defense, WKMG-Channel 6's Tony Pipitone reported tonight.

Judge Stan Strickland has set a court hearing for Friday, Oct. 16.

Pipitone quickly recapped developments: The defense wants the case dismissed, claiming the evidence is weak. Prosecutors want a list of defense witnesses who will support that view. And prosecutors also want the defense's motion to be wiped off the book because it is so "legally flawed."

What will be the focus of the hearing? The state's response to that "legally flawed" motion. "It does look like he [Strickland] wanted to get rid of this clutter with all these defense claims," Pipitone said.

The defense has tried to salvage its motion by adding a sworn statement from Anthony, Pipitone reported. She is charged with the first-degree murder of her daughter, Caylee.

What's the latest from Anthony? She swears that she didn't report Caylee was missing until July 15, 2008, and the young mother says she left her daughter with a baby sitter named Zenaida Gonzalez, Pipitone reported.

Another development: "The judge also set a status hearing on the check-fraud case for that Friday," Pipitone reported. "So we could have a trial date on that case as well very soon."

The report was another example of Pipitone's first-rate ability to explain technical matters simply and offer succinct analysis.

I am quite relieved that she is sticking to the Zenaida story. The Prosecutors are rubbing their hands at the news I am sure.  Even I as a lay person could prove that story was a pack of lies. She did not give her child to Zanny, She was not where she says she was, she was the last person seen with Caylee.....  etc

Casey is going to stick with her original ZG story it sounds like and this is why, as of July this year, there is magically a ZG, whose looks could be considered a "10", has been spotted in PR!     This BS just keeps going on and on and somehow the defense is letting Casey continue to concoct more lies that they think will be plausible. Just unbelievable!

New Hearing Scheduled In Anthony Case
Judge To Hear Several Motions In Murder Case

POSTED: Wednesday, October 7, 2009
UPDATED: 7:30 pm EDT October 7, 2009
[Caylee Marie Anthony.]
Caylee Marie Anthony.
ORLANDO, Fla. -- The murder case against Casey Anthony is heading back to a courtroom to try to resolve several motions filed by both sides.

Anthony is charged with first-degree murder in the death of her daughter, Caylee Anthony. Caylee was reported missing in July 2008 after being missing for a month. She was 2 years old.

Caylee's remains were discovered in a wooded area near Anthony's parents' home in east Orange County.

Anthony's defense has repeatedly claimed the case against its client is weak and should be dismissed. The defense said evidence in the woods where Caylee's body was found was spoiled by authorities before defense experts could examine it.

The defense has also claimed that the failure to discover Caylee's body in the months before it was found, despite searches near the area, is also evidence of Anthony's innocence.

The prosecution said the defense has yet to substantiate its claims of innocence and the state is demanding a list of witnesses the defense plans to call to support their claims.

Earlier this week, the prosecution ridiculed the defense's motions to dismiss, saying they were legally flawed and should not even be called for a hearing.

Strickland did not call the motion to dismiss to be heard at next week's hearing, but did set for hearing the state's move to have that motion to dismiss cleared from the record because it is flawed.

Strickland also set a status hearing in the check fraud case against Anthony for the same day as the hearing in the murder trial.

Pipitone said it looks like Strickland is trying to clear the clutter over the defense's claims that she case should be dismissed. Strickland also did not call the defense's motion to bar the state from seeking the death penalty to be heard next week.

Sounds like the defense has lost control of their client, she won't see her parents, suddenly G&C are looking for  ZG + 10 in foreign countries and Bozo seems to be saying that she is the one calling the shots. It would seem they have already said she should take a plea of some sort and she has declined.

Evening, everyone!  Apologizing in advance for this lengthy comment.

Actually Tupelo, the beauty of this is that Casey is forced to stay with the Zanny the Nanny story.  She has backed herself into this corner with her own mouth.  Her sworn statements declare she was the last verifiable human being having physical custody of Caylee:  she and Caylee told George goodbye and left the house (together); she dropped Caylee off at Sawgrass Apartments (together); and she took Caylee (together) to J Blanchard Park, where allegedly Zanny took Caylee from her (together).  To abandon the Zanny-the-Nanny story, automatically implicates Casey as the only verifiable human being with physical custody of Caylee when her death occurred.  Here’s where it gets interesting.  Abandoning the Zanny story would require the defense to document an air-tight alibi for Casey from the evening of June 15th- June 18th (when she borrowed the neighbor’s shovel).  It would also necessitate arguing yet another perpetrator committed the crime and successfully defending that argument with no evidence.  Lee is Cindy’s alibi for the evening of June 15th (per his Cindy-Casey fight testimony) and most likely would be George’s also.  Casey inadvertently provided George’s alibi for June 16th, when she described seeing him and the goodbye scenario as she and Caylee left the house.  Cindy most likely would be George’s June 15th p.m.-June 16th a.m. alibi and vice-versa.  Cindy’s work provides her June 16th alibi.  Therefore, the defense would have a difficult time asserting that Cindy or George killed Caylee.  Likewise, the defense would be foolish to imply that Jesse Grund or Rev. Grund kidnapped/killed Caylee.  Because there is no documented evidence in any private or public sector of Zanny the Nanny, the defense cannot claim a conspiracy theory between either Grund and Zanny to kidnap and ultimately harm Caylee.  On the other hand, Cindy's sworn statements of her listening at the door and hearing Casey & Caylee breathing (questionable to us or not) physically place Casey with Caylee at the house the morning of June 16th.  Similarly, George's detailed LE statements about seeing Casey and Caylee and telling them both goodbye the afternoon of June 16th physically place Casey with Caylee.

Going forward, Casey is: recorded cuddling and choosing movies with her boyfriend at Blockbuster (hours after her child was “kidnapped”); photographed partying at nightclubs;  recorded shopping at 2 Target stores (no items for Caylee);  and recorded cashing Amy’s stolen check at Bank of America- all without Caylee.  Numerous sworn witness statements place her at parties and cook-outs (post “kidnapping”) without Caylee. *Note: there may also be surveillance recordings from the airport when she dropped Amy off and picked her up from the Puerto Rico trip/toll road cameras along the way

Casey’s mode of operation has long been using lies, confusion, emotional manipulation, spiked with a sliver of truth to lend an air of credibility.  The truth is Casey is good at lying, but terrible at thinking on her feet.  She’s no match for the state’s Attorneys office.  They’ve had extensive training separating the wheat from the chaff.  They're going to rip her "story" and her credibility to shreds. They've got the gift of discernment and know how to use it.  I find it interesting that apparently Andrea Lyons operates on something of the same principle (MO) as Casey of using confusion to circumvent the facts and eclipse the truth.
“In late May, the University of Michigan Law School hosted its sixth Clarence Darrow Death Penalty Defense College, which is designed to help defense attorneys hone their skills through hands-on workshops that focus on the attorneys' current death penalty cases. According to the college’s founder and director, Andrea Lyon, the college is "not about innocence. It’s about saving people’s lives."http://lawprofessors.typepad.com/crimprof_blog/2005/06/u_of_ms_death_p.html

Miki Monkey-First, like your avi!  Secondly, thank you for bringing up Baez's comments to the public that Casey is the one calling the shots.

Monkey Pop Quiz:  Who else also told Casey that she's the one calling the shots?  Candy Corn for the first correct answer!  *starting timer now*

IMO, Baez is speaking Casey-eze.  He's using flattery to manipulate Casey, IMO.  While he's flattering her into thinking she's in control, he's actually pulling the puppet strings.  JMO

Dear georgie I believe was the one who told KC that she was the "boss" she called the shots in one of the infamous and maybe the last jail house visits.  Insanity at it's height, it never seems possible to get any crazier but it always does.

I see your point about Bozo but I hate to give him credit for anything particularly manipulating people, he is so transparently slimy. I agree he is speaking Casey-eze though as nothing he says makes any common sense. Makes me feel ill to think of him flattering the slore...

I now what you mean, Miki Monkey.  Truthfully, I struggle to keep anger in check at every motion hearing.  He comes across as so smugly arrogant.  Seriously, he has to know Casey is guilty (common sense, logic, deductive reasoning, tons of evidence).  I will never understand how a lawyer can say some of the outright lies (IMO) that he does.  I guess I'm more concerned about God.  I'm just not going to deceive people to get my client off, so I can "be somebody".  Not saying that's what Baez specifically is doing, but what I think a lot of defense lawyers do.  They can't disprove the truth, so they try to cast doubt.  That is deception because the defense lawyer first has already acknowledged to himself/herself that there is a truth in order to determine how to best attempt to subvert it.  JMO

On the plus side though, every time I feel that anger rising, instead of spewing, I am reminded to pray and it makes me pray harder for the judge and jury to clearly see and uphold the truth.     Also, keeps my blood pressure down.

Well, long past time for me to turn in.  Thanks for the discussion, everyone!  Hope you have a good evening/morning wherever this finds you.  God bless you!  Take good care!

I agree with all that you've said and besides the obvious lack of moral responsibility to expose the truth and defend his client with the facts, in a sane universe, all parties can see from the logical deductions, the physical evidence etc. that KC needs a lawyer to mitigate her guilt, not manufacture an alternate reality by indulging his clients wild, childish explanation(s) of the "nanny".  Because of that, the only reasonable explanation for his choices is greed, pure and simple.   The longer this drags on, the more sellable it becomes. Let's not forget conceit. His ego is monstrous and it will supercede what would be best for his client. No matter that he makes foolish mistakes and hasn't (seemingly) attempted to reason with kc to plea , to possibly save her life. I don't think he, nor any of her attys care really what happens to her, it's really about them, IMO.    I could never ever be a defense atty, never. My own guilt at allowing a killer or pedophile or thief or abuser to slip thru a loophole or an outright fabricated alibi would eat me alive.
