Oh, I know, muffy.  Sorry if my post sounded snarky.  I'm just floored by her carefree living while Meredith's parents spent another holiday in mourning.

I didn't take your post as "snarky" KittyMom.     When I said I'm just the messenger, I didn't want anyone to get the idea I think things with Amanda Knox are all a-ok in my book.   That was for the benefit of others  reading here and possibly believing when  a person posts an article we agree with it.     I often post articles with  views different than mine, and feel it's just bringing the news.  Monkeys can then feel free to agree, disagree or comment.     I'd have to be "Sybil" to agree with all the articles I post.    I think the courts where Amanda Knox was tried were fairly ridiculous at times, but on the other hand, I wouldn't want my sons to date her, that's for sure!

PERUGIA, Italy (Reuters) - Prosecutors in the trial of American student Amanda Knox, who was cleared last October of the 2007 murder of British housemate Meredith Kercher, filed a motion Tuesday to appeal against the verdict before Italy's highest court.

Prosecutors Giovanni Galati and Giancarlo Costagliola said in their motion that acquitting Knox and her ex-boyfriend Raffaele Sollecito was "contradictory and illogical."

Italian law permits prosecutors to appeal against not guilty verdicts. Now the Court of Cassation must rule whether there were any procedural irregularities that give grounds for a retrial.

Edda Mellas and Curt Knox face a prosecution that could be straight out of old fantasy novel. Amanda's parents are charged under Articolo 368 Codice Penale, Libro Secondo, Titilo III. It defines the various degrees of criminal slander under Italian law.

In June 2008, Knox's parents did an interview with London Sunday Times correspondent John Follain. They told Follain what their daughter had told them; namely that during Amanda Knox's interrogation by Perugia police in November 2007, she was abused both physically and verbally and that she was hit in the back of the head.

This wasn't a scoop for either Follain or the Sunday Times. Seven months earlier, the London Daily Telegraph had first reported Amanda Knox's police brutality charges. There was no comment from the Perugia police in either story. In fact, Perugia police waited until February 2009 to publicly deny Amanda Knox's brutality charges. So as of June 2008, Curt Knox and Edda Mellas had reason to believe their daughter's version of events. And that could be a critical fact under Italian law and at their upcoming trial.

The Italian Supreme Court has consistently ruled, as recently as January 25th, that criminal slander only happens when "the person making the false accusation has acted intentionally and with the awareness and with the certainty of the innocence of the accused." Cutting through the legalese, slander in Italy is when you are accusing a person of doing something you know, for certain, they didn't do. But saying it publicly, anyway. 
So why are Curt Knox and Edda Mellas being prosecuted? Perugia police could have, and by Italian law should have, recorded Amanda Knox's interrogation. But so far, no recording has surfaced. So how can anyone say, with certainty, that the police brutality didn't happen? And conversely, how could Curt Knox and Edda Mellas know, with certainty, that the Perugia police are telling the truth when the cops say they didn't brutalize their daughter during the interrogation in 2007? And then add in the fact that Perugia police waited two years to publicly refute the charges (in sworn testimony in February 2009 during Amanda Knox's first trial).

PERUGIA, Italy— Key witnesses failed to show up Friday for the slander trial of Amanda Knox’s parents, NBC News reports, causing the judge to delay the trial until next year.

Five police officers who were expected to testify for the prosecution against Curt Knox and Edda Mellas were not in court. They were reportedly busy dealing with other police matters.

The judge accepted the reason and postponed the hearing until January 24, 2013.

Curt Knox and Mellas are not in Italy, but have attorneys representing them. They are on trial for allegedly slandering Perugia police while their daughter, Amanda, was accused of murdering her roommate, Meredith Kercher, in 2007. Amanda was convicted of the murder in 2009, but won her appeal last year and was freed. She’s now living in Seattle.

The parents accused police of abusing and hitting Amanda during her interrogation.

Back in 2008, Amanda’s parents recounted her claims of mistreatment to a British newspaper, which led prosecutors in Perugia to charge them with slander. In 2011, there was a preliminary hearing. Last month, an Italian judge ruled there was evidence enough to go to trial.

Italian auditors have opened an investigation into two prosecutors over the cost of an animated video used in the murder trial of Amanda Knox.


The film, commissioned by investigating magistrates Manuela Comodi and Giuliano Mignini, cost 182,000 euros (£148,000).

It portrays their interpretation of what happened when UK student Meredith Kercher was killed in Perugia in 2007.

Her flatmate, Amanda Knox, and Raffaele Sollecito were cleared of killing Ms Kercher following a successful appeal.

The 20-minute video, made by a specialised video animation company, was shown during the first trial in 2009.

Umbria audit court prosecutor Agostino Chiappiniello will seek to establish whether or not the cost of the film was necessary for the case, or represents a waste of public funds.

The film depicts what the prosecution said happened on the night that Ms Kercher, a 21-year-old Leeds university student, was murdered.

The Daily Mail obviously got caught with their pants down in this case, by posting a story that never happened and then retracting it.     Odd isn't it, how Amanda's reaction to losing the case was recorded and written into a story, when in fact she didn't lose the case.     That's the problem nowadays with the media.  Even if you have a link, what you read in an article may not only have not been fact checked, but it's a bunch of lies.  I saw a lot of this in Madeleine McCann's case too.

The U.K.’s Press Complaints Commission rebuked the Daily Mail’s Mail Online for publishing a story last October saying Amanda Knox had lost the appeal of her murder conviction in Italy. Mail Online publisher Martin Clarke blamed “human error and over-zealousness” for the SNAFU, Will Sturgeon writes on The Media Blog.

The Guardian’s Roy Gleenslade reports that the Mail “said that it was standard practice in such high-profile cases for two alternative stories (plus supporting quotes) to be prepared in advance, and cited the fact that other news outlets had also initially published the wrong verdict due to some confusion in the courtroom.”

The problem is that the supporting quotes, like the scene they described — and this may not surprise anyone who follows Mail Online’s rollicking adventures in journalism — were entirely fictitious.

Malcolm Coles saved the Mail story, which was taken down within minutes of being posted and featured this gripping scene:
    Amanda Knox looked stunned this evening after she dramatically lost her prison appeal against her murder conviction. …

    As Knox realized the enormity of what judge Hellman was saying she sank into her chair sobbing uncontrollably while her family and friends hugged each other in tears.

    A few feet away Meredith’s mother Arline, her sister Stephanie and brother Lyle, who had flown in especially for the verdict remained expressionless, staring straight ahead, glancing over just once at the distraught Knox family.

    Prosecutors were delighted with the verdict and said that ‘justice has been done’ although they said on a ‘human factor it was sad two young people would be spending years in jail’.

    Following the verdict Knox and Sollecito were taken out of court escorted by prison guards and into a waiting van which took her back to her cell at Capanne jail near Perugia and him to Terni jail, 60 miles away.

    Both will be put on a suicide watch for the next few days as psychological assessments are made on each of them but this is usual practice for long term prisoners.

"...flushing the cache"  yes, this would have made the thing disappear.  BUT.  But the story that was written was about something that didn't actually occur.  Fiction.  "...inaccurate and misleading article..." yes it was.  Even if Amanda Knox HAD been convicted, the story would have been a pack of lies anyway.  Just how is a story written containing her reactions about a verdict, when the verdict hadn't even been passed.  The Daily Mail got caught with their pants down.  Period.  JMHO

The editor of the Mail Online Martin Clarke said three mistakes caused an article incorrectly reporting Amanda Knox's murder conviction being upheld to be published, adding "there was no need for it" to have occurred.

Appearing before the Leveson inquiry today Clarke was questioned about the article, which prompted a "number of complaints" to the Press Complaints Commission at the time.

The PCC upheld a complaint against the Mail Online for the "inaccurate and misleading" article, which was live for 90 seconds and, as the PCC said, "described reactions and behaviour that had not taken place".

The Daily Mail published "an online apology and explanation to readers; published the correct verdict in print the following day; launched an immediate internal inquiry (and subsequently changed its practices regarding such 'set and hold' stories); and disciplined the person responsible for the error" the PCC said at the time.

Thirdly he added that "once we killed the story we should have done something technical called 'flushing the cache' which would have erased the story from the internet very quickly".

Clarke added: "It boiled down to human error. The thing that made me angriest was there was no need for it. It's a bit of a fiction that internet sites are desperate to get a story out 10 seconds before the competition. I've no interest in that whatsoever."

I just can't grasp this new age crap where when someone is so involved in a murder case (lied about important stuff in the case) and is treated like a celebrity.  There are plenty of decent people out there that could have fit onto this list...the new thing is to stir up controversy...can't wait until this wave passes.  The only thing that gives me a tinge of a smile is that Casey Anthony is probably steaming because she isn't on it.

VELEZ-MITCHELL: Now, almost a year later, Amanda`s former boyfriend is speaking out about his relationship with Amanda Knox, his time in prison, how the couple was railroaded by Italian police. Raffaele Sollecito`s new book is "Honor Bound: My Journey to Hell and Back with Amanda Knox".

Raffaele, I hope I`m pronouncing your name right. Thank you so much for joining us. I was up all night until 2:00 in the morning reading your book. I couldn`t put it down. It`s fantastic. Do you still love her?

RAFFAELE SOLLECITO, AMANDA KNOX`S FORMER BOYFRIEND: No. Now I`m single. I`m moving on with my life. She`s completely different than my life -- I used -- as it was first. My life -- my previous life is gone completely. Now I`m moving on.

VELEZ-MITCHELL: Ok. Now I want to move onto another question.

SOLLECITO: Yes.

VELEZ-MITCHELL: I want to move on to the famous or infamous kiss at the crime scene. A lot of people say you brought suspicion on yourself because you and Amanda started kissing each other even though Amanda`s roommate had just been discovered murdered.

But you were telling in the book that you were trying to comfort her but that the media misrepresented it as sexual urges of two stone-cold killers. If you could go back and do it all over again, would you not kiss Amanda?

SOLLECITO: I just wanted to comfort her. So a kiss or a caress, whatever was just to say "I`m here for you. I want to comfort you," because I was the only one who she could trust at that moment because her family was really on the other side of the world at the time.

VELEZ-MITCHELL: I want to say I think you`re a gentleman. I know that everyone wanted you to cut Amanda loose. You were her only alibi. And you stuck with her, gallant and loyal, even though you could have saved your own skin and said, she did it and I didn`t. And you didn`t do that. And for that I`m very proud of you.

Your book is extraordinary. I couldn`t put it down. Everybody should read it. And I think you are adorable. And good luck with your life. Thank you, Raffaele.

SOLLECITO: Thank you so much.

IULIANO MIGNINI, PUBLIC PROSECUTOR (through translator): It is an appealable conviction and we will see all of this on appeal. But convictions must be respected by all.

VELEZ-MITCHELL: That`s the controversial prosecutor. Ok.

Amanda Knox is free and her ex-boyfriend, Raffaele Sollecito, has written this extraordinary book about the inside story. Let`s show you the man who is serving time for the murder of Amanda`s roommate, Meredith Kercher. And that man`s name is Rudi Guede and he was convicted on DNA evidence including a bloody hand print on a pillow at the scene.

But here`s the problem, Joey Jackson. And that is that Amanda behaved in a very strange way at the police station. She actually started doing cartwheels and splits.

Now, in his incredible book he explains that, hey, she was feeling really stiff and achy because she was tired and she was being interrogated. And he suggested, well, why don`t you stretch, you`ll feel better. So a cop saw her and said, oh, you`re so flexible. And then she decided to show off with a cartwheel and some splits.

Is this a cautionary tale how not to bring suspicion on yourself with your own behavior?

JOEY JACKSON, CRIMINAL DEFENSE ATTORNEY: You know what, Jane, it really is. I just met Raffaele. I share with you I think he`s very brave. I admire his resolve. But the problem that I have at this point is, remember that there`s a prosecution -- a prosecutor`s appeal pending. And of course, the high court is going to be evaluating that in March.

And as a result of that it may not be such a great idea at this point, you know, to be writing things about what happened and what your thoughts are about Amanda and her strange behavior. So let`s just hope that the judges have other things on their mind other than reading the book because it could shed some problems on it here.

But ultimately I think they got the right. I mean this was a travesty of course as we know from the beginning. And you can imagine, Jane, think about it and put yourself in that position where you`re told that you are going to spend 25 years in jail, if you`re him, Raffaele, or 26 if you`re her, and four years later what do you get? Vindication. It`s amazing.

VELEZ-MITCHELL: Wendy Murphy, you`re disagreeing with this.

WENDY MURPHY, FORMER PROSECUTOR: Oh, my goodness. First of all, I think this was an intentionally-timed campaign. And, you know, Knoxy got a book coming out in a couple weeks, all designed in my opinion to influence the public, keep the pressure on the Italian court to sustain the acquittal.

I think that`s outrageous primarily because victims can`t do that. Meredith Kercher doesn`t have a book coming out. Her family can`t write a book. Because if they did and they told the whole truth, Knox and Sollecito would be able to say it interfered with our fair trial rights to put all that poisonous information in the public realm. That I find disgusting and distasteful and wrong. And I`m offended.

But let me just say this. Sollecito --

VELEZ-MITCHELL: Wait a second. Are you suggesting that they might actually be guilty? Because I don`t think so -- I read this book and it explains everything.

MURPHY: No. Jane, not only am I suggesting they might be guilty, there`s a ton of evidence that they are guilty. Let me just say three quick things.

VELEZ-MITCHELL: What?

MURPHY: First of all, Amanda Knox -- Amanda Knox, you played a clip of her saying, "I respect life. I care about people." She falsely accused an innocent black man of the crime and let him rot in prison for four days. A lot of respect she had for him. She knew he was innocent. She was so selfish, so evil that she would let an innocent black man sit in prison. She knew he had nothing to do with it. She did nothing because she doesn`t really care about people that much.

VELEZ-MITCHELL: And we`re not talking about the man that was convicted. We`re talking about someone else.

MURPHY: Right. A different guy -- a totally different guy. And shame on her. And that`s the kind of person who could kill -- somebody with no feelings.

VELEZ-MITCHELL: That doesn`t mean she killed though because --

MURPHY: I`m just saying let`s not romanticize. This is not Romeo and Juliet. They had what -- five days together. That`s a booty call. Let`s not turn this into a love affair.

And by the way, her DNA was mixed with Meredith Kercher, the victim`s DNA in spots all over that apartment. That is not innocent evidence.

VELEZ-MITCHELL: Wait a second, they were roommates. They were roommates.

MURPHY: For two weeks. They hadn`t bled. Nobody had bled --

(CROSSTALK)

VELEZ-MITCHELL: He says in this book she goes back to the house after spending the night with him and goes in the, the door`s open and she proceeds to take a shower and there was blood on the tub.

MURPHY: That`s a lie. She lied. No Jane. And she first said --

VELEZ-MITCHELL: I don`t know that.

MURPHY: -- but look, the first night she said -- first time she spoke she said I have an alibi. I was at Sollecito`s apartment. The second time she gave a story she said, ok, I was there. I heard Meredith screaming. I was scared, but I was there. But I didn`t do it. But I heard everybody killing her. Third time, oh, no, I was at the apartment.

She`s a liar. She is guilty in my opinion. And I hope the Italian court treats this case fairly for the victim.

VELEZ-MITCHELL: I have to say this, Wendy, I respectfully disagree with you 100 percent. That young man I met on the elevator actually and we just interviewed struck me as a wonderful young man who has been trapped in a hellish experience. And again, I think you should read his book.

Now this prosecutor who prosecuted them, Giuliani Mignini -- I think I`m mispronouncing his name probably, Mignini. He is a mess. He has had so many problems. Here he is talking with CNN`s Drew Griffin. Listen to this.

DREW GRIFFIN, CNN CORRESPONDENT: Prior to the forensic investigation, prior to everything really, your intuition or your detective knowledge led you to Amanda Knox and Raffaele Sollecito?

MIGNINI: After the first few weeks we were convinced because of the behavior of the two people and especially Amanda that they were both involved in the crime.

VELEZ-MITCHELL: Joey Jackson, this guy has gotten in trouble before. I mean, he just whipped up this satanic sex orgy it would seem out of thin air. Raffaele describes how they go to his house and they pick up a knife and say, oh, this looks good -- basically like this looks good as a murder weapon. I mean, this was a railroad job if this book is true.

JACKSON: No. You know what, Jane, you`re absolutely right. And you know, what we expect of prosecutors is to behave responsibly. And we know that convictions are part of the mix, but ultimately -- and I know you`ll agree with this, Jane -- we want justice, right?

And of course victims deserve justice. But that justice has to come at the expense of holding the right people accountable and not saying things as a prosecutor that are irresponsible that are going to incite people just for the benefit of getting a conviction.

And so ultimately I think, you know, the appellate court will rule on it. It will have some finality in March it will be over and done with. But I think they got it right after those long, four, torturous years in that prison. Amen.

VELEZ-MITCHELL: All right. Well, we`re all disagreeing. I`m going to give Levi Page, crime blogger, the final word.

LEVI PAGE, CRIME BLOGGER: Well, you know what Jane, I think what`s very telling in this case is that the police had thought that the crime scene was staged because the room was ransacked. The victim, Meredith Kercher`s room was ransacked, objects everywhere.

And the glass that was broken, the glass fell on top of those objects, which means the room was ransacked before the window was broken. Who could have staged the crime scene other than Amanda and her boyfriend, Raffaele Sollecito?

I agree with Wendy Murphy. I think there`s a lot of evidence against them.

VELEZ-MITCHELL: I am shocked. I am shocked. And I got to tell you, you decide for yourself. Read this book. I couldn`t put it down. If I`ve got circles under my eyes, you know why. I was reading it until all hours of the night. And that`s all I can say.
