NASHVILLE, Tenn. - A Tennessee newborn kidnapped in a knife attack on his mother was placed in foster care with his three siblings after allegations arose that a family member tried to sell the infant, sources familiar with the case said Monday.

Week-old Yair Anthony Carillo was recovered safely in Alabama Friday, three days after he was taken from his Nashville home. Soon after, the state took custody of the children away from his mother, 30-year-old Maria Gurrolla. An Alabama woman is in custody, facing federal kidnapping charges.

Two officials confirmed the baby-selling allegations but spoke to The Associated Press on condition of anonymity because they weren't authorized to discuss the case.

A custody hearing is set for Tuesday, but records are closed because the case is in juvenile court. Rob Johnson, a spokesman for the Department of Children's Services, and spokesmen for the FBI and Nashville police declined to comment on the baby-selling reports.
Gurrolla and other family members could not be reached at her home on Monday, and it wasn't clear if they are being represented by a lawyer.

Tammy Renee Silas, 39, of Ardmore, Ala., is being held on federal charges of kidnapping. She has given a statement to investigators, according to Tennessee Bureau of Investigation spokeswoman Kristin Helm, who declined to detail what Silas said. A lawyer for Silas couldn't be identified Monday.

She was arrested after authorities found the baby at her home about 80 miles south of Nashville.

Silas has not been charged in the attack on Gurrolla, who was stabbed several times and suffered a collapsed lung. Gurrolla told police that her attacker was a heavy-set, blonde white woman who claimed to be an immigration agent.

NASHVILLE, Tenn. -- Child welfare officials now suspect the mother of kidnapped baby Yair Carillo of trying to sell the child, a source close to the case told Channel 4 News.
A "dependent neglect" hearing is scheduled for Maria Gurrolla Tuesday afternoon in Juvenile Court. The source, who had direct knowledge of the hearing, said documents accuse Gurrolla of arranging to sell the infant.

The new accusations appear to explain why the Department of Children's Services removed all children from Gurrolla's home over the weekend.

A statement released Monday by DCS said, in part, that "the Department of Children's Services still has concerns about the well-being and safety of these children, based on credible and serious information that we are currently receiving."

Meanwhile, Tammy Renee Silas, the woman who authorities said kidnapped the child Sept. 29, will not fight being moved to Nashville to face charges.

The court clerk's office in Huntsville, Ala., said a magistrate is expected to sign papers authorizing Silas to be moved to Tennessee by federal marshals.

Law enforcement officials said the case is still under active investigation. Federal documents indicated a second person could be involved. According to Silas' arrest warrant, Maria Gurrolla, the mother who was stabbed, heard Silas make a phone call in Spanish after the stabbing. Gurrolla said Silas told someone "the job is done" and that Gurrolla "was dying."
The baby was briefly reunited with his mother Saturday, when she got a chance to hold him for the first time in three days. But state child welfare officials then took custody of the infant and his siblings -- ages 3, 9 and 11 -- for "safety" reasons.

DCS spokesman Rob Johnson declined to talk specifically about the Gurrolla case but said taking children into custody after a kidnapping is not necessarily standard procedure.

He said the caseworkers saw something in this situation that made them concerned enough that they felt the safest thing to do was find a foster home for the children. He declined to say what caseworkers were concerned about or whether complaints had been filed against the family.

Johnson said children are often placed with family members but not until a background check and home study are done.

"DCS is acting with an abundance of caution," said Johnson.

Officials told the family that they are holding the children until they can be sure that the suspect acted alone.

Monday, sources close to the investigation into the kidnapping of Gurrolla's newborn baby boy, Yair Anthony Carillo, said DCS accused Gurrolla of trying to sell her infant. Gurrolla is the woman who was stabbed in her home and then had her then 4-day-old son abducted on Sept. 29.

Now, after being without her infant son for a week, Gurrolla will have baby Yair and her three other children returned to her. DCS took Gurrolla's four children into custody over the weekend after filing paper work alleging Gurrolla tried to sell the baby.

Tuesday's hearing in regards to DCS's allegations was canceled.

Although, DCS has closed their case, investigators said they are not finished.

Late Friday, the FBI arrested 39-year-old Tammy Silas in Ardmore, Ala. Police charged Silas with the federal offense of kidnapping. She was also accused of attacking Gurrolla with a knife.

Court documents show Gurrolla told investigators after the attack she heard the suspect speaking on the phone. Gurrolla told an FBI agent her attacker said quote "the job is done" and "she [Gurrolla] was dying."

Investigators said they will be looking at phone calls made by the suspect after the attack.

The FBI is holding Silas in the Morgan County Jail in Alabama. She'll appear in federal court when U.S. Marshals bring her back to Nashville. No court date has been set.

NASHVILLE, Tenn. - Kidnapped newborn Yair Carrillo is no longer in state custody and has been returned to his mother after the Department of Children's Services Tuesday withdrew a petition that would have kept the infant and his three siblings in foster care.

The infant was just four days old when he was snatched from his home one week ago.

He was found safe Friday night in Ardmore, Alabama, about one hour and 20 minutes south of Nashville, just over the state line.

Saturday, after a brief reunion with his mother, the child, along with his brothers and sister, were placed in state custody amid allegations a family member had tried to sell the infant.

The allegations turned out to be false and Metro police said Tuesday Yair's parents, Maria Gurrolla and Jose Carrillo, are not persons of interest.

"We have no information at this point to believe that the mother or the father [was] involved in the kidnapping scenario," said police spokesperson Don Aaron.

Thomas H. Miller, who was appointed guardian ad litem for Gurrolla's children, told News 2 the nature of the allegation "surprised" the parents but that the department "did the right thing at the time."

"Given the violent and traumatic way that the baby was taken from the mother and given the fact that someone, whose identity I don't know informed the department that the parents were involved in buying and selling that baby, I think department did the right thing at the time," he said.

News 2 caught up with Gurrolla at the family's home on East Ridge Drive in south Nashville Tuesday afternoon.

She, her two oldest sons and the father of her children, stopped by the home to pick up a few belongings.

Baby Yair was not with the family.  Gurrolla said he was with family members, whom they are staying with.

She said emotionally she was not ready to comment on the case publicly but that she and her family are thrilled to be back together again.

The suspect in the case, Tammy Renee Silas, 39, remains in federal custody in Alabama.

Police said significant unanswered questions remain, including why Gurrola and her newborn son were targeted, and the investigation continues.

"There is very much a continuing investigation to determine if anyone else is involved in this as to why or how," Aaron said.

Silas has yet to be charged in the attack on Gurrolla, who was stabbed several times moments before Silas allegedly stole baby Yair.

For weeks, Tammy Silas had been preparing for the arrival of a baby.

She bought bags of clothes, sizes 0-3 months, and a Sesame Street diaper bag. She put a bassinet next to her bed. She bought a bathtub small enough for a newborn.

Her boyfriend, Martin Rodriguez Guerrero, said what he believes was a lifelong dream of Silas, 39, was fulfilled on Tuesday when they brought home a newborn baby with a full head of dark hair and chubby cheeks.

They decided to name him Martin Jr.

"He was in good shape, he didn't cry much," Guerrero said through a translator. "He ate lots of milk. Everything was fine."

The illusion was dashed on Friday night, when eight or 10 officers came through the front door of their Ardmore, Ala., home with their guns drawn and put them both in handcuffs.

They laid the baby on a blanket that's still on Guerrero's kitchen floor, and stripped off the tan overalls Silas had put him in that said "Mommy Loves Me." They looked for birthmarks to ensure that Martin Jr. was really Yair Carrillo, abducted at 4 days old.

Guerrero says he had no idea the baby was kidnapped from a South Nashville home on Tuesday, and the mother brutally stabbed.

He says he thought his girlfriend of two years had legally adopted the baby in Texas. Guerrero said he spoke with federal investigators Friday night and told them what he knew.

He said he hasn't done anything wrong and doesn't expect he will face any charges.

Inside their home on the Alabama side of State Line Road in Ardmore, baby clothes and police-issue blue gloves are scattered through the kitchen. A pan on the kitchen stove still had uneaten pork chops in it; baby formula and a bottle were still on the counter.

Now, he's worried - not about Silas but about his truck payments, and the bills for the house. Silas could face up to life in prison.

"How am I going to pay for all this without her income?" he said.

Silas is being held in federal custody in Alabama on a charge of kidnapping. Police believe she told Maria Gurrola she was an immigration agent to get inside her East Ridge Drive home.

Authorities say she stabbed Gurrola eight times, leaving her with a collapsed lung and serious wounds, then left with the baby.

Investigators were able to analyze surveillance video that showed a rental car following Gurrola on Tuesday morning with enough detail to make out a license plate number. They followed the trail that led to Silas, and FBI agents saw her walking into her home with a bundle in her arms Friday night.

Neighbors surprised

Neighbors in the small town straddling the Tennessee-Alabama line said Silas and Guerrero mostly kept to themselves, but there was no sign of trouble at the brick and vinyl-siding home that they'd recently built an addition onto.

Silas was born and raised in Texas, Guerrero said, and they moved in together in Alabama two years ago. They worked at the same remodeling company - Guerrero in construction, and Silas translating for the workers and setting up jobs.

Silas was arrested once in Nashville for a parole violation but that was later dismissed, Metro police said, and she has an active warrant from California on a drug-related charge.

Guerrero said Silas has no history of violence that he knows of, but he believes the police are impartial. If they say she posed as an immigration agent, stabbed a woman and took her baby, he has no reason not to believe it. Things seemed fine from Tuesday until Friday, he said.

Rosie Higginbotham, who lives a few doors down and across State Line Road, said she has spoken with the couple in passing and left flyers on their door inviting them to church but they never came.

She had been looking for the couple this week to talk about their dog getting out of the yard. "There was no sign they'd been there all week," she said.

Next door, young mom Jayla Chandler said Silas seemed like a friendly enough lady. But when she heard the news, she was scared - she just gave birth in August, and she remembers Silas casually bringing over the mail when her baby's birth certificate got put in her mailbox by mistake. "I didn't think nothing else about it then," Chandler said. "Now it scares me."

The town was buzzing with the news that the kidnapping they'd heard about on the national news networks had ties to Ardmore, but there was one question that stood out above the rest in the small town.

"Who is she and where did she come from?" said Mildred Mitchell, who runs Blondie's Beauty Shop downtown.

"Nobody knew who she was, where she lived, anything. My customers were telling me there were roadblocks into town (Friday night). I guess they were looking for her."

Ala. Woman Indicted In Tenn. Newborn Kidnapping

(AP) NASHVILLE, Tenn. - An Alabama woman has been indicted on charges of kidnapping a Tennessee newborn.

Tammy Renee Silas has been in custody since Oct. 2 after police found the week-old infant, Yahir Anthony Carrillo, at her home in Ardmore, Ala. He was kidnapped and his mother stabbed three days earlier at their Nashville home.

Court filings made available on Thursday show the grand jury returned the indictment Wednesday. That was the day after her attorney told a judge that the 39-year-old Silas had tried to commit suicide in jail and that certain mental health medications have been withheld from her.

Silas wasn't indicted on any charges related to the stabbing of the mother, Maria Gurrola.

Alleged Baby Kidnapper Waives Right To Hearing

NASHVILLE, Tenn. - Tammy Silas, the woman accused of kidnapping a newborn baby after stabbing his mother, waived her right to a detention hearing and preliminary hearing.

Attorney Isaiah Gant asked a judge during the hearing on Monday to investigate Silas' claim that she is being mistreated at the Robertson County Jail and to consider moving her to another facility.

Gant told the judge that Silas informed him that she was being denied certain medications by jail staff. He said he's noticed that Silas has become increasingly disoriented, which has effected his ability to communicate with her.

When a reporter asked about scars on Silas' wrists after the hearing, Gant said it was a result of her trying to kill herself.

A woman who answered the phone at the Robertson County Jail refused to comment about the allegations.

Police said Silas stabbed Maria Gurrolla at her South Nashville home on September 29, and then stole her then 4-day-old baby.

Kidnapping Suspect Questioned In Nashville Murder

(AP) NASHVILLE, Tenn. - Police said an Alabama woman charged in the kidnapping of a Tennessee infant was questioned nearly five years ago in the murder of a Nashville man she claimed to be married to.

Tammy Renee Silas is charged with kidnapping 4-day-old Yahir Anthony Carrillo from Nashville on Sept. 29. The baby was found with Silas three days later at her home in Ardmore, Ala., about 80 miles south.

Don Aaron, a spokesman for Nashville police, said Silas was questioned regarding the fatal shooting of Ramon Hernandez-Trejo in November 2004, and then was extradited to Ohio on a probation violation. The case has not been solved.

Kristin Helm, a spokeswoman for the Tennessee Bureau of Investigation, said at this point, the homicide case doesn't appear to be related to the kidnapping.

Tammy Silas reaches plea deal in kidnapping of Nashville infant

A woman accused of abducting a 4-day-old infant from a Nashville mother would spend 20 years in federal prison under a plea deal reached Monday.

Tammy Renee Silas, 41, pleaded guilty to a single charge of kidnapping in the Sept. 29, 2009, abduction of Yahir Anthony Carrillo from his mother, Maria Gurrola. She had faced up to life in prison and a $250,000 fine, but prosecutors and Silas struck a deal sparing her that fate.

"The plea agreement, the punishment, adequately represents the seriousness of the crime," U.S. Attorney Jerry Martin said. "I think it's a very good outcome.''
