Thanks Nut....my DH works for the State of Mo and happens to be in Jeff City today. He called me earlier and during our conversation he told me people are outraged.  At the crime, the Sheriff and the secrecy.

Edit:  I fixed it Sunny.  Yep, I'm pretty upset too that  they seem to be even considering this suspect may be able to stay at home until the hearing

is Elizabeth's service private?

COLE COUNTY -- Funeral plans for Elizabeth Olten have been scheduled.

Both the visitation and funeral are open to the public.

A visitation is planned Tuesday evening from 4 p.m. to 8 p.m. at the Houser-Millard Funeral Home on West Main in Jefferson City.

The funeral is set for Wednesday at 2 p.m. at Concord Baptist Church on West Truman Blvd.

Elizabeth's body will then be transported by horse-drawn hearse to Hawthorn Memorial Gardens.

Expressions of sympathy can be made to the Missouri Missing organization in memory of Elizabeth Olten.

Viewers have asked if Elizabeth's father and brother, Dale Olten Sr. and Dale Olten Jr., would be released from prison to attend Elizabeth's funeral.

Both men are behind bars at Northeast Correctional Center in Bowling Green, Mo. on drug and burglary charges.

We checked with the Missouri Department of Corrections.

A spokesperson there says department policy says offenders are not allowed to be released for funerals or visitations.

I am wondering if it is standard procedure that they have a meeting to determine if they are to stay in jail or be sent home to await trial.

I don't think any judge in thier right mind would send this girl back home. Not only would it be a danger to society, but to her as well. They will detain her, if there is no room they will move her to another county, that is my guess anyway.

I agree.

What I find interesting is there is SO MUCH that has not been released to the public.

They choose to release this?  Why would they tell the public this?

15-year-old faces hearings in girl’s death
St. Martins case a juvenile matter.

JEFFERSON CITY — Cole County juvenile justice officials said a 15-year-old girl suspected in the murder of 9-year-old Elizabeth Olten of St. Martins has two court dates ahead.

The first, a detention hearing set tomorrow, will take place by conference call at 9 a.m. and will determine whether she should remain in custody or be released into the community while awaiting trial. Cole County Juvenile Court Administrator Michael Couty said his office will ask that a judge order the juvenile to remain in detention at a juvenile facility.

Couty said the juvenile, identified by another official as female, has met with her family and her lawyer, Kurt Valentine. Couty declined to say where she is being held or describe her demeanor.

“We are taking every precaution that we need to take in order to ensure the protection of that individual,” Couty said at a news conference.

He characterized the case as “unusual” and said it is the first juvenile murder case in Cole County in four years.

On Wednesday evening, 9-year-old Elizabeth disappeared after she set out to walk about a quarter-mile home from a friend’s house in St. Martins. After a massive search-and-rescue operation involving hundreds of volunteers, Cole County Sheriff Greg White said physical and written evidence had led authorities to the suspect. After being interviewed, the suspect led authorities to Elizabeth’s body hidden in a thickly wooded area not far from her home on Route D.

Couty and victims’ advocates from the county prosecutor’s office and the FBI met yesterday with Elizabeth’s mother to explain the details of the case to her.

A certification hearing is scheduled Nov. 18 in Division 1 at the Cole County Courthouse to determine whether the suspect should stand trial in adult court. Couty said the court will evaluate 10 key areas during the hearing, including the suspect’s age, the seriousness of the crime and safety of the community, whether the offense involved viciousness and violence, whether the juvenile has a history of crime and whether the juvenile could benefit from treatment.

Collecting that information might require extensive interviews with family, teachers and caregivers, he said. After collecting the information, Couty’s office will make a recommendation to the court at the certification hearing. “We’ve got to determine, ‘Do we have the capability of taking care of this individual within the juvenile court setting, or would it be beneficial to transfer this case to the adult?’ ” he said.

Samantha Green, legal counsel to the juvenile office who will present the recommendation in court, said extra weight might be applied to one of the 10 factors to determine whether the girl should stand trial as an adult.

The difference between the juvenile and adult systems can be major. The juvenile system is primarily concerned with treatment while the adult system focuses on detention, punishment and protecting the public.

“Someone mentioned the word ‘punishment.’ We do not punish juveniles,” Couty said. “We treat them, and we try to find the most appropriate setting when they stay in this system here. We look at treatment and rehabilitative services in this system here. …We’re different than the adult system.”

Are you kidding me....we do not punish juveniles...that is the craziest thing I have heard in a long time. Give her treatment while she is being punished in jail if that makes it sound better to you.

Murdering juveniles might even get cotton candy.

I heard some rumor, that if it is true, this girl is very cold blooded! I feel for all concerned especially Elizabeth's mom and the parents of the girl who did this. I can not imagine how I would feel being either parent, nor do I want to!

oldpartygirl says...
She did an adult crime, why shouldn't she be certified? Treatment?? Please!!!

railnut26 says...
I have heard disturbing rumors also. I knew a couple of days ago it was a female and if the other details that I got are correct, then this was a premeditated act that was thought out and planned for at least a week. In my opinion there typically are few reasons to certify a minor as an adult, if this was in fact premeditated, and as cold blooded as I have heard, it's time to take off the "kid" gloves and teach some lessons.

Fine, treat and rehabilitate her all you like, slap her wrist give her some treatment, and I can tell you that any 15 year old that has done what she has done, is not going to magically turn the corner and lead a wonderful and peaceful life. Give me a break, with all this crap already. She is smart enough where she is going to fool whatever therapists that come knocking on her door, she will be able to convince after a period of time that she shows great remorse for what she has done, and that she is going to lead a productive life. Bad seed, have any of these so called specialists ever heard of it, or is that too simple for them to grasp?

Remember the killings in Ada, TX?  That girl had two friends kill her family, set fire to the house, then she and another girl drove the getaway car?  I believe it was handled quietly with a giulty plea - and the girl is doing life, I believe.  I just saw an update on the family and the dad has remarried a woman with 2 boys and he has forgiven his daughter...

Anyway - do you think in light of an ex-pros taking her case, that maybe what they are going to do is get this worked out under the radar as much as possible (such as the girl in Ada?)  Maybe a quiet guilty plea, no trial?

Interesting case which involved both Kurt Valentine and his wife Karen Valentine. Seems as though Mr Valentine is/was the general counsel for Missouri Department of Agriculture and his wife  represented the Department of Natural Resources.
