Teen murder suspect has hearing today

COLE COUNTY, MO. -- The case against a teen murder suspect is moving closer to trial.

A status hearing is scheduled Tuesday morning for Alyssa Bustamante.

Bustamante has been charged as an adult with first-degree murder of 9-year-old Elizabeth Olten and has pleaded not guilty.

The judge has excused Bustamante from appearing at the status hearing.

Bustamante Court Hearing Tuesday Morning

JEFFERSON CITY - Tuesday's 9 a.m. status hearing at the Cole County Courthouse will move the case closer to trial.

Judge Patricia Joyce will preside over Tuesday morning's status hearing. Judge Joyce waived Bustamante's appearance for today. Instead the teen's public defender will stand in for her.

The 16-year-old teenager from St. Martins pleaded not guilty to first degree murder and armed criminal action charges during her re-arraignment in December. However, prosecutors say Bustamante strangled, stabbed and cut nine-year-old Elizabeth Olten's throat before hiding her body in dense woods near the two girls' homes.

Authorities initially withheld Bustamante's identity until the court system certified her to stand trial as an adult. Bustamante had no prior criminal offenses, but records indicate she did try and attempt suicide in 2007. That prompted her public defender to request a psychiatric treatment evaluation for the teen. Even so, Judge Joyce has yet to rule on this request.

KOMU 8 News spoke with Cole County Prosecutor Mark Richardson who said it may take close to a year to prepare for trial due to the complex nature of this case.  Richardson added, "Our strong considerations first go to the victim's family. Second, what we think the community wants to be done in this type of case and ultimately what we think the jury will do on the facts of this case."

Out-of-town jury to hear case in Mo. girl's death

JEFFERSON CITY, Mo. — An out-of-town jury will hear the case against a central Missouri teenager accused of killing a 9-year-old neighbor.

Attorneys for Alyssa Bustamante had asked that her first-degree murder trial be moved to another county because of the publicity surrounding Elizabeth Olten's death last fall.

But during a hearing Tuesday, prosecutor Mark Richardson said he preferred to keep the case in Cole County because he expects to call several witnesses and out of respect for the victim's family. He suggested bringing in a jury from another county.

Judge Patricia Joyce scheduled a March 8 hearing to decide where the jury will be selected.

Bustamante has pleaded not guilty in Elizabeth's death. Authorities say Bustamante, who was 15 at the time, confessed to slaying her neighbor because she wanted to know what it felt like to kill someone.

Bustamante trial to stay in Cole Co., jurors to be brought in from elsewhere

A status hearing was held today in Jefferson City in the case Alyssa Bustamante, who is accused of killing 9-year-old Elizabeth Olten in rural Cole County.

The case has received national attention, and although Bustamante’s attorneys requested to move the trial to different county, Cole County Circuit Judge Patricia Joyce decided to select a jury from outside of Cole County and keep the proceedings locally centered, taking the family members into consideration.

Bustamante was 15 when she allegedly lured Olten into the woods, strangled, stabbed and cut her throat, then buried her. Authorities say she dug two graves days before the killing. She told them she “wanted to know what it felt like to kill someone” when she confessed to the killing, according to reports.

She has pleaded not guilty.

Bustamante is being represented by two attorneys from Columbia, Boone County — Donald Catlett and Charles Moreland — both with capital litigation division of the State Public Defender’s Office.

Bustamante’s legal counsel asked in December for a change in venue, but at today’s hearing, Prosecutor Mark Richardson says “he expects to call a large number of witnesses” and that it would be a burden to Elizabeth’s family to have to travel.

Catlett said he still is waiting to receive copies of police reports and other evidence needed for a trial; a date has not yet been set.

Bustamante was not present in the courtroom today, but will be at the March 8 hearing. Members of the Olten family were in the courtroom.

Thanks so much for the updates, I personally see no reason to bring in the jury from another county.

nrcg, I have been watching our local news about bringing a jury in and the news was showing videos of AB on the school bus.  Supposedly showing a different side to the 'monster' we have heard about...........a normal side. Interviews with a couple young girls all taking about how nice she was, how normal she was, how she must have just flipped out...........I agree about bringing a jury in.........I would be concerned about locals having children her age and listening to their take on her.  I am really concerned about her getting off on 'not guilty by reason of insanity' and someday being set free.

Lawyers in Bustamante case to decide from where to import jury

A jury from another county will hear the case against murder suspect Alyssa Bustamante.

Judge Pat Joyce granted the change of venue during a hearing Tuesday morning at the Cole County courthouse.

Alyssa Bustamante now awaits trial for the murder of nine-year-old Elizabeth Olten in the Morgan County Jail, where Bustamante turned 16 years old.

Bustamante did not appear in court for the proceeding, but was represented by her attorney Donald Catlett. On the question of venue, Cole County Prosecutor Mark Richardson was opposed to taking the trial on the road because of the number of witnesses he expects to call and out of respect to Elizabeth Olten's family.

"It would be burdensome for them to move to another county,” Richardson said. “What the state would propose is that the court would allow that a jury be selected from another county and brought here for the trial to occur here in Cole County.”

Catlett agreed, but was not ready to say which county should be tapped for jury selection.

 “Since Miss Bustamante isn't here today, I don't think we're really in a position to argue that at this time,” Catlett said.

Catlett was also unsure of when the defense would be ready to go to trial.

"Your honor, we have not received the complete discovery  yet, so it's really hard to make any kind of estimate on that until we get a look at all the police reports,” Catlett said.

"And are we gonna be looking at some things from the lab that are gonna delay the trial date?" Joyce said.

"I do not believe they will, your honor,” Richardson said.

Joyce directed the lawyers to return to court March 8 to determine from which county the jury will be chosen.

Bustamante will be in the courtroom at that time.

Killing for the thrill

Many Missouri community and family members, struck hard by the death of Elizabeth Olten, are struggling to make sense of the fact that a local teenager is charged with Elizabeth's murder.

A grand jury indictment says 16-year-old Alyssa Bustamante killed her 9-year-old acquaintance by strangulation, cutting her throat and stabbing her. Bustamante is charged as an adult.

Family and friends shared intimate details with us about both girls, answering some of the many unanswered questions about how such a thing could happen.

In exclusive video her friends shared, Alyssa Bustamante looks like a typical teen riding on a school bus, laughing, joking and sometimes hamming it up for the camera held by a classmate.

She says to another student on the bus, “I’m gonna pop a cap in your ass.”  It’s something a lot of kids jokingly say to others these days.

But when that kid is Alyssa Bustamante, now accused of murdering for the thrill of it, that statement raises eyebrows.

Lindsey Jones showed us the video she took of her friend Alyssa nearly a year ago.  Jones wanted us to see a different side of Bustamante.  Besides that one statement, most of the video shows Bustamante as an outgoing, loud and joking kid.

"I want to remember Alyssa as I know her, as I think she still is. I believe she’s a troubled girl who made a decision and didn’t really think it out.” Jones said.

Alyssa's public image is much different.  Some have called her a teenaged monster after learning that she is charged with murdering Elizabeth Olten.  Others have said Bustamante had been planning to hurt someone.   

During police interrogations, Bustamante made a startling admission according to sworn court testimony by the Missouri highway patrol sergeant who questioned her.

According to his testimony, Bustamante killed 9-year old Olten simply because "she wanted to know what it felt like."

Experts have also testified that Bustamante was on Prozac.  At the time of Elizabeth Olten's murder, Bustamante was living with her grandmother.  The grandmother had tried to help Alyssa cope with depression and a recent suicide attempt.

Alyssa Bustamante and Elizabeth Olten lived several houses apart in St. Martins, a small town just west of Jefferson City.

Authorities say Bustamante plotted Elizabeth's murder for months.

Sources close to the investigation say Bustamante intended to kill and bury only one person that October afternoon.

That leaves this question unanswered: Why did she dig two graves in the wooded area near her home?

Global news outlets are now covering the story.  So are student reporters with the Jefferson City High School student paper, "The Red and Black".   

Bustamante is supposed to be a sophomore at Jefferson City High.

In covering the story, student reporters say they have learned about a regular kid, with a sweet side, who hid emotional scars.

Alyssa was known to cut herself and even attempted suicide.

“I know that she had been to therapy before. I know that she had the history with the cutting and that she had tried to kill herself,” says Julie Blankenship, the lead student reporter on the story for "The Red and Black".

Blankenship says the murder has had a great impact on students at the high school.  She says many students became upset and angry when the news broke.  Now, the tone inside school hallways is returning back to normal.

Elizabeth Olten was outgoing.  She loved animals and playing with Barbie dolls.

Elizabeth's biological father said, "She’s my bug. She’s my heart,” says Dale Olten.

Bad Idea: Alyssa Bustamante's Attorney Wants Emo Teen to Wear Her Own Clothes in Court

Last fall the then 15-year-old "emo teenager" from outside Jefferson City allegedly dug a grave and plotted the murder of her nine-year-old neighbor. Days later authorities say Bustamante followed through with the act, strangling and stabbing to death Elizabeth Olten because she "wanted to know what it felt like" to kill someone.

Now, 16, Bustamante has a a pretrial hearing this coming Monday and her attorney has asked the court that she be allowed to wear her own clothing -- instead of a prison garb. As the Associated Press reports, the attorney believes that the "pretrial images the teen in jail clothing would impair the presumption of innocence."

To which, Daily RFT asks: Has the attorney ever seen the emo Bustamante (above) in her own clothes?

Bustamante status hearing canceled

COLE COUNTY, MO. -- The Cole County Court has decided to cancel the March 8 status hearing for teen murder suspect Friday.

Alyssa Bustamante, charged with first degree murder of Elizabeth Olten, had a status hearing scheduled that would determine which county the trial jury will be picked from.

Prosecutor Mark Richardson and Defense Attorney Don Catlett decided to pick the jury from Greene County, where Springfield, Mo. is located. The next court date is scheduled for April 28 at 11 a.m. where her appearance is excused

A motion was filed Wednesday to allow Bustamante to wear her own clothes to the trial. That motion is still being discussed.

I heard on the radio earlier that there was a ruling in which her juveniles records would be opened for her attorneys only. Attorneys are also allowed to consult with the professionals involved with her as a juvenile. Anyone else hear this stuff?

COLE COUNTY, MO. -- The public defenders for accused murderer 16-year-old Alyssa Bustamante have asked to keep their research and witness list secret.

Bustamante's attorneys said it's important their strategy for defending the teen be private so that Bustamante receives an adequate defense.

The defense wants private access to records from Bustamante's past.

But many of those records are privacy protected and can only be obtained by court order, meaning the prosecution would know what records the defense requested.

A judge could rule on the motion at the next court date of April 28.

Bustamante is charged with first degree murder in the October 2009 stabbing and strangulation death of her 9 year-old neighbor Elizabeth Olten.
