Mo. teen murder suspect seeks to continue school

Associated Press - April 20, 2010 5:14 AM ET

JEFFERSON CITY, Mo. (AP) - A central Missouri teenager charged with killing her 9-year-old neighbor wants to continue her education while awaiting trial.

Sixteen-year-old Alyssa Bustamante is charged as an adult with first-degree murder in last October's killing of Elizabeth Olten, whose body was found in a wooded area just west of Jefferson City.

Bustamante has pleaded not guilty and is in jail without bond. She had been a high school sophomore.

The defense has filed a motion asking a judge to let Bustamante continue her high school education through a distance learning program. The motion requests that the Cole County Sheriff's Office pay the costs.

Defense lawyers have asked a Cole County judge to consider their request during a hearing next week.

Will the Jury be brought from Springfield to Cole County, or will the trial be held in Greene County?  If so, I'm 20 minutes away from Springfield, maybe I could sneak into some of the trial Smile

Circuit Judge Patricia Joyce will consider the request by Alyssa Bustamante's attorney at a Wednesday hearing. The 16-year-old defendant is not expected to attend.

Bustamante is charged as an adult with first-degree murder in last October's killing of Elizabeth Olten, whose body was found just west of Jefferson City.

The defense also wants Joyce to allow Bustamante to wear regular clothes and to not be shackled during trial.

Bustamante has pleaded not guilty and is in jail without bond. She was a high school sophomore when she was arrested.

JEFFERSON CITY, Mo. (AP) - A Cole County judge has granted a central Missouri teenager's request to wear regular clothes instead of her jail uniform when she goes to trial on charges of killing her 9-year-old neighbor.

Circuit Judge Patricia Joyce ruled Wednesday in favor of the request by 16-year-old Alyssa Bustamante's state-appointed
attorneys. The judge did not rule on another defense request that Bustamante be allowed to take high school distance learning courses at public expense while awaiting trial.


      Bustamante is charged as an adult with first-degree murder in last October's killing of Elizabeth Olten, whose body was found
just west of Jefferson City. She was a 15-year-old high school sophomore when she was arrested.


      The teenager remains in jail without bond after pleading not guilty. She did not attend Wednesday's hearing.

      A jury from Greene County will hear Bustamante's case.

Today they released discovery to defense:  autopsy photos and yesterday, a DNA report.   I wish we could see all this stuff....ugh.

I guess we won't find out until July 27th if they are letting her do her "high school"....

Last month 16-year-old Alyssa Bustamante's requested that she be allowed to wear her "regular clothes" to trial instead of her prison uniform. Yesterday a judge in central Missouri approved Bustamante's request.

The teen is accused of the horrific murder last fall of her nine-year-old neighbor Elizabeth Olten. According to authorities, Bustamante dug a grave days before strangling and stabbing to death the girl because she "wanted to know what it was like to kill someone."

The question now is whether Bustamante will dress in her emo attire for trial or wear a more traditional outfit.

Murder victim's father gets different judge

JEFFERSON CITY, MO. -- Judge Pat Joyce granted a change of judge in a case against Dale Olten, Sr. of St. Martins, Mo.

Olten faces charges of burglary and being a felon in possession of a firearm.

He is also the father of 9-year-old murder victim Elizabeth Olten.

He asked for a different judge because Joyce is also presiding over the trial of murder suspect Alyssa Bustamante, who is charged for murdering his daughter.

Despite assurances from his lawyer, Olten was concerned over the possibility that something he might say or do in his case would prejudice the judge in the Bustamante case.

Judge Joyce reassigned the Olten Case to Judge Jon Beetem.


I wonder if he might know more than authorities/lawyers do regarding Alyssa's case. Otherwise I don't see why he would be so paranoid about getting a new judge. Just a thought.

Hmmm.. well I know we talked about this being a possibility before, just haven't read if it was a fact or not, that Alyssa was a juggalette.  At the following link, they say a bit, then link readers to the CBS article.  I found the title interesting, (bolded below), the bit they do say, and the 200+ comments following that.  It appears that some Juggalos/Juggalettes were caught by surprise by this news.  Some deny that Alyssa is a "Lette", some are convinced that she is. 

Interesting to read what they feel about this case.  Most are angry that someone could take the life of an innocent child.  Many feel this case is giving Juggalos/Juggalettes a bad rep.  Interesting reading, if you don't mind wading thru the lack of spell check and bad language incl F bombs.

The juvenile court could make a decision today or tomorrow on what the future holds for a twelve year old Kaiser boy accused in a double homicide.
Monday night just before midnight Osage Beach Police were called to the Palace Lane Mobile Home Park in Kaiser. A twelve year old boy apparently called his grandmother and then called 911 after shooting and killing his mom and step dad. Reports say the adults had several gunshot wounds each.

Lake Sun Reporter Rance Burger said on the Tuesday 411 that a decision on the boy’s fate could come at any time.

“As of right now there are no charges filed in the case. The twelve year old boy is being held on what’s called a temporary authorization for detention and that can last up to twenty-four hours, at which point, either charges will be filed or he will have a juvenile hearing,” said Burger.

Back in February fifteen year old Alyssa Bustamante of Cole County was accused in the death of nine year old Elizabeth Olten of Cole County. Burger says that case has set some precedents when it comes to murder and juveniles.

“Now we’ve got a case in Kaiser, Missouri, where a juvenile between the age of twelve and seventeen, he’s on the bottom end of that range to be tried as an adult. He could ultimately face what would be class A felony charges if he’s tried as an adult.”

The Miller County Sheriff’s Department is in charge of the investigation. No names have been released for the victims.

Hearing set in Mo. teen's murder case

JEFFERSON CITY, Mo. (AP) - Attorneys are scheduled to be back in a mid-Missouri courtroom for the case of a teenager accused of killing her 9-year-old neighbor last October.

A hearing is scheduled Tuesday afternoon for an update on the status of the trial for 16-year-old Alyssa Bustamante, charged as an adult with first-degree murder for the killing of Elizabeth Olten.

Bustamante has pleaded not guilty and is in jail without bond.

Authorities say Bustamante dug two holes several days before the slaying and confessed to police that she killed Elizabeth because she wanted to know what it was like to kill someone.

Law officers say that Bustamante led them to Elizabeth's body in a wooded area west of Jefferson City.
