Judge stands by decision in Bustamante case (with video)

COLE COUNTY, MO. -- Update: Tuesday, July 27 at 6:28 p.m.

Cole County Judge Pat Joyce has set a May 16, 2011 trial date for a teenage murder suspect Alyssa Bustamante.

Bustamante is accused of murdering 9-year-old neighbor, Elizabeth Olten, last October.

Joyce also stood by her earlier decision that the county has no obligation to provide Bustamante with education services while she awaits trial in jail.

The motion was already rejected, but Bustamante’s attorneys apparently wanted a better court record of the issue of whether someone must provide the teenager with an education behind bars.

Attorneys believe state law requires that Bustamante continue her education.

However, the Jefferson City School District feels its obligation ended when Bustmante was certified to stand trial as an adult, was charged with first-degree murder, and was sent to jail. At that point, she was formally expelled from Jefferson City High School in accordance with the “Safe Schools” Act.

So, whose responsibility is it to educate Bustamante?

"That's a good question,” Jefferson City Public School's Secondary Education Director Myron Graber testified.  “I mean, it's out of our hands at that point in time. So, it would either be a parental responsibility, or some other agency.”

Defense lawyers think it falls to Cole County Sheriff Greg White, who has custody of Bustamante as she awaits trial.

"I don't see in statute anywhere where a sheriff is responsible for the continuing education of anyone placed in their custody,” White tesified.

The lawyers think their client should have access to the internet at the county's expense. White said he and the sheriff of Morgan County, where Bustamante is now held, made arrangements for access to general education diploma materials and that's where they draw the line.

"So, she's being treated like any other inmate, with no special treatment," Cole County Mark Richardson asked White.

“Yes,” replied White.

Judge Joyce scheduled another status hearing in the Bustamante case for Oct. 19.

Two months ago, Bustamante’s attorneys filed three motions, two of which Cole County Judge Pat Joyce granted. Attorneys filed motions so that Bustamante could wear regular clothes at the trial and to file future motions ex-parte and under seal.

Joyce did not grant the motion for Bustamante to finish her high school education as she waits for trial.

A judge decided Tuesday that Alyssa Bustamante, 16, will stand trial May 16 on a first-degree murder charge in the slaying last fall of a 9-year-old neighbor in St. Martins, a rural area just west of Jefferson City.

Bustamante will be tried as an adult in the killing of Elizabeth Olten.

Authorities said Bustamante dug two holes several days before the killing and confessed that she killed Elizabeth to know what it was like to kill someone.

Police said Bustamante had led them to Elizabeth's body. Bustamante, has pleaded not guilty.

JEFFERSON CITY | A prosecutor wants to conduct DNA testing on a knife and clothing taken as evidence in the slaying of a 9-year-old girl near Jefferson City.

Court documents released Monday in the murder case against 16-year-old Alyssa Bustamante reveal authorities seized the knife and jeans as evidence in last October's slaying of Elizabeth Olten.

Bustamante's attorneys said Monday that they could not say whether the evidence was taken from their client. Bustamante has pleaded not guilty.

Documents reveal a court hearing was held Aug. 5 by telephone to discuss the DNA testing. Prosecutors want to do tests even though they would consume the full sample, leaving nothing for defense attorneys to independently test.

Defense attorneys have asked to be present for the DNA testing.

Accused Mo. teen killer raises education request


JEFFERSON CITY, Mo. (AP) - A state appeals court will consider whether a central Missouri teenager should be allowed to continue her education while awaiting trial on a charge of murdering her 9-year-old neighbor.

The Western District appeals court agreed Wednesday to accept written arguments on the request from attorneys for 16-year-old Alyssa Bustamante.

A Cole County judge has twice denied requests to let Bustamante enroll in a distance learning program from jail to complete her high school degree.

Bustamante is being tried as an adult. She has pleaded not guilty to first-degree murder for the October slaying of Elizabeth Olten.

Law officers say Bustamante confessed in a police interview and led them to Olten's body in a wooded area west of Jefferson City.

JEFFERSON CITY | A Missouri appeals court has denied a request to let a teenager continue her education while waiting to be tried on charges of killing a 9-year-old girl.

The ruling last week by the Missouri Court of Appeals' Western District marked the third defeat on the schooling issue for 16-year-old Alyssa Bustamante.

Followup: Koster Says Bustamante Has Right To Education

(Jefferson City, MO) -- Missouri Attorney General Chris Koster has weighed-in on the question of whether teenage murder suspect Alyssa Bustamante has the right to schooling while in jail.

Koster said "yes", those awaiting trial that are of school age do have a constitutional right to an education.

The Missouri Supreme Court asked for Koster's opinion after Bustamante's attorneys asked the court to allow the 16-year-old to enroll in a distance learning program from jail to complete her high school degree.

Cole County Judge Pat Joyce has twice denied the request and the Missouri Western District Court also rejected the request.

In Koster's opinion, he writes that just because Bustamante has been certified to stand trial as an adult, does not make her an adult in other considerations.

However, Cole County Prosecutor Mark Richardson said in the response that Bustamante has been certified as an adult and is not in custody of the state because minors are in someone's custody, not adults.

Cole County Sheriff Greg White has argued in court that it is not his department's job to further a prisoner's education.


Bustamante is being tried as an adult on charges of first degree murder in the Fall 2009 death of 9-year-old Elizabeth Olten.

JEFFERSON CITY, Mo. (AP) -- Attorneys for a 16-year-old teen accused of killing a neighbor girl want prosecutors to return letters, cards and other personal property.

Alyssa Bustamante is charged as an adult with first-degree murder in the October 2009 death of 9-year-old Elizabeth Olten near Jefferson City. Prosecutors say Bustamante told police she wanted to know what it felt like to kill someone. She has pleaded not guilty.

Bustamante's lawyers asked Tuesday that letters, cards and notes be given to a family member so they do not appear in public or on the Internet. The clothing was requested for court appearances.

Cole County Prosecutor Mark Richardson said investigators still are reviewing the items to determine if they contain evidence.

Defendants Ask for Personal Property in Bustamante Case

JEFFERSON CITY - Alyssa Bustamante's lawyers were in Cole County Circuit Court today for a status hearing. Her attorneys asked the State of Missouri to release Bustamante's personal letters and documents to her family.  Prosecuting Attorney Mark Richardson says he's still going through these documents. Both parties and Judge Patricia Joyce agreed to a Dec. 2 meeting. Neither Alyssa Bustamante nor her attorneys were in court today. Bustamante is charged with last year's murder of 9-year-old Elizabeth Olten. She has pleaded not guilty. Bustamante's trial is set to begin in May, though another court case involving the teenager will be decided much sooner. Bustamante's lawyers want the Supreme Court of Missouri to order the Cole County Sheriff to let Bustamante continue her education.  The Missouri Prosecuting Attorney's office filed a motion Tuesday evening saying, however, the Cole County Sheriffs Office is not responsible for her education. Today the judge said the Supreme Court's decision would not affect the May start date for the trial.

Update: Family, friends honor murder victim at memorial

JEFFERSON CITY, MO. --  Update: Thrusday, Oct. 21 at 8:21 p.m.

Thursday marked the one year anniversary of Elizabeth's death. It was a somber event at Jefferson City's Concord Baptist Church. Elizabeth's mom took the stage and gave a tearful speech. Family members wore pink t-shirts that said "our precious angel". Dozens of supporters filed in throughout the serivce, at one point everyone joined hands and gathered in front of the sanctuary for a prayer.

A family spokesperson told us, the day was all about Elizabeth, "I'm afraid that she will be forgotten, and we don't want that, we want to remember her. We want to remember the little girl with the smile at that play that was a happy normal child. That was important to our world, that's gone, and we don't want her forgotten an and that's what matters to us. And this is paying tribute to her memory and who she was."

More than a 100 people came to the public memorial service the family of 9-year-old murder victim Elizabeth Olten held at the Concord Baptist Church.

The family said the event Thursday was all about Elizabeth.

Elizabeth’s family wore pink t-shirts that had a picture of Elizabeth with the words “Precious Angel” on them.

Thursday marks the first anniversary of the murder of 9 year-old Elizabeth Olten of St. Martins.

Her family is holding a public memorial service.

A candlelight prayer vigil will start at 5 p.m. Thursday, Oct. 21 at Concord Baptist Church, 3724 West Truman Blvd. in Jefferson City.

The gathering will then move to Hawthorne Cemetery at 4205 Hwy 50 West for a balloon release.
