Memorial honors slain 9-year-old Mo. girl

JEFFERSON CITY, Mo. (AP) - A memorial service to remember a 9-year-old Missouri girl is taking place on the 1-year anniversary of her death, allegedly at the hands of a teenage neighbor.

Fourth-grader Elizabeth Olten disappeared Oct. 21, 2009, while walking home from a friend's house in St. Martins, just west of Jefferson City. Her body was found in a wooded area near her home.

Thursday's memorial was set for 5 p.m. at Jefferson City's Concord Baptist Church, where the funeral was held last year. The memorial is to involve a prayer service, candle lighting and the release of balloons.

Sixteen-year-old Alyssa Bustamante has pleaded not guilty to an adult charge of first-degree murder in the death. Bustamante remains jailed without bail awaiting trial.

1 year later: Elizabeth Olten's death not forgotten (with video)

It was a crime that devastated the local community while drawing a national spotlight to the heart of Missouri.

It unfolded around dinner time on Oct. 21, 2009; a call came in from a family desperately looking for a missing child.  By the following day, a full scale manhunt was underway for 9-year-old Elizabeth Olten.

"What we're endeavoring to do is find a young lady very much alive and reunite here with her family,” Cole County Sheriff Greg White said on Oct. 22.

Hundreds of volunteers turned out in the rain that Thursday to help in the search

By this point, family clearly was frantic, already fearing the worst.

"She does not deserve this,” Elizabeth’s Aunt Vicki Olten said on Oct. 22, 2009. “Her family does not deserve this.”

By Friday, Oct. 23, 2009, investigators had already been pointed in direction of a suspect in Elizabeth’s disappearance. That evening, the suspect had lead them to Elizabeth’s body in a hand-dug grave in the woods near her home.

Family, Friends Remember Elizabeth Olten 1 Year Later (with video)

COLUMBIA - Family and friends remembered the life of deceased St. Martins 9-year-old Elizabeth Olten Thursday afternoon.

The ceremony started at 5 p.m at Concord Baptist Church in Jefferson City.

The ceremony was a simple service consisting of prayer and stories about Olten.

Then, at 5:30 p.m., the family went to a nearby cemetery to release balloons in her honor. Olten went missing one year ago today. 

Teenager Alyssa Bustamante is charged with her murder. She has pleaded not guilty.

Concord Baptist Church Senior Pastor Monte Shinkle said before the ceremony it would be an emotional time for the family.

"We just want to remember her for the great little girl that she was and the life that she lived so we might be able to comfort this family as they continue to walk through this," Shinkle said.

Shinkle said the Olten family originally intended for the ceremony to be a private one for family and friends.  However, it changed its mind after hearing community interest.

"Initially, it started as family and close friends, but obviously other people have learned about it and the family is not going to turn away others who just want to be a part of it," Shinkle said.

Court dismisses 16-year-old murder suspect's education request


JEFFERSON CITY | The Missouri Supreme Court won't get involved for now in deciding whether a 16-year-old murder suspect may continue her education while awaiting trial.

Alyssa Bustamante is charged as an adult in last October's killing of 9-year-old Elizabeth Olten. The two girls were neighbors in a town just outside Jefferson City.

Bustamante wants to continue her high school course work while she's jailed. The Cole County sheriff doesn't want to cover the costs and says Bustamante has access to GED materials like other inmates.

Missouri's high court on Thursday dismissed a motion seeking an order to the sheriff. But the court also said the motion may be refiled.

Bustamante has pleaded not guilty. Her trial is scheduled for next spring.

Family, Friends Remember Olten One Year Later  (with video)

JEFFERSON CITY - A community torn apart by a grisly murder last year came together Thursday night to honor Elizabeth Olten. It's a story that captivated the nation exactly one year ago when 9-year-old Olten went missing in St. Martins. Thursday night, more than 50 people filled the pews of Concord Baptist Church not to remember her death, but to remember her life. They say time heals all wounds, but for the family and friends of Olten her death feels like yesterday.

"It's very overwhelming," family friend Pam Cafourek said "It's very hard, everyday is hard. Everyday you get up and she's not with us. We miss her."

Concord Baptist Church senior pastor Monte Shinkle agreed.

"It's been a day by day thing, and a very difficult thing, but I am very thankful that a lot of people have rallied around the family and continue to stand beside them," Shinkle said.

Sixteen-year-old Alyssa Bustamante is accused of killing Olten one year ago. She has pleaded not guilty. The memorial service was a way for family members, friends, and community members to remember Olten.
"Elizabeth was a very sweet child, she was a very kind loving person, she had a smile that could melt your heart," Cafourek said. "She was your normal child. She laughed, she had hopes, she had dreams. She had her whole world ahead of her until it was taken from her."

The Cafourek family clings to the memories to keep them going.
"Two or three years ago we all went to McDonald's and Delaynee and her brother Anthony switched so Elizabeth was my sister," Hallee Cafourek said. "She was my sister for the day."

Eight-year-old Audrey Cafourek remembered the time she went fishing with Olten.

"She caught a fish. She would stand in this spot, it was like her special spot because she caught like three fish that day," said Audrey Cafourek.

Concord Baptist Church Senior Pastor Monte Shinkle said before the ceremony it would be an emotional time for the family.

"We just want to remember her for the great little girl that she was and the life that she lived so we might be able to comfort this family as they continue to walk through this," Shinkle said.

During the vigil, music flowed through the pews and sniffles filled the air. Olten's mother gave a tearful eulogy.

"Even though we're apart for now we know you will be with us forever," her mother said.

The vigil led by Shinkle included a candle lighting, prayer and later a ballon release at the cemetary Olten is buried.

"It's very important to us that everybody remembers her, that she's the victim in this and we do not want her forgotten," Pam Cafourek said. "That's what matters to us."

Young Murder Suspect's Request Rebuffed

    JEFFERSON CITY, Mo. (CN) - The Missouri Supreme Court will not get involved in deciding whether a 16-year-old girl accused of murder can continue her education while awaiting trial - for now. The court dismissed a request from Alyssa Bustamante's attorneys, but said the motion could be refiled.
     Bustamante is charged as an adult in the killing of her 9-year-old neighbor, Elizabeth Olten. Prosecutors say Bustamante killed Olten because she wanted to know what it felt like to kill somebody. Bustamante has pleaded not guilty.
     It is the fourth time Bustamante has been rejected in her quest to complete her high school course work while she's jailed awaiting trial.
     Missouri Attorney General Chris Koster filed a brief with the state Supreme Court this month, supporting Bustamante's request. But Cole County Sheriff Greg White said that Bustamante has the same access to GED programs as adult inmates.

Father of slain Mo. girl sentenced to prison

  The father of a girl who was killed near Jefferson City has been sentenced to more than 19 years in federal prison for illegal possession of firearms.

The U.S. attorney's office says Dale Olten Sr. was sentenced Thursday to a longer term because he had prior felony convictions. He pleaded guilty in February to being a felon in possession of a firearm and to possessing stolen firearms.

Olten was in prison on a state drug conviction when his 9-year-old daughter, Elizabeth, was killed in October 2009 in the small town of St. Martins near Jefferson City.

Alyssa Bustamante, who was 15 at the time, was charged as an adult with first-degree murder in the death of her young neighbor. Bustamante has pleaded not guilty and faces trial next May.

Jordan Harvey, 15, is charged with helping his parents kill a man and stuff him in a freezer.

Jordan’s 17-year-old brother, Ethan, has also been arrested in the crime.

A 13-year-old boy from Kaiser, Mo. was committed into the juvenile system Wednesday after he admitted to killing his mother and step-father. (Read more)

These rare situations cast new light on teenagers in the court system.

County jails across Mid-Missouri struggled to deal with young detainees especially when they have to share cells with adult.

“Once they're certified as an adult they get treated like any other adult we house here,” Jail Sergeant Cody Worthley said. “The only precaution we do, and we do this with anyone that comes in for the 1st time, we monitor them for a few days and make sure they get adjusted."

Alyssa is being held in a cell pod. It's similar to a dorm room with bunk beds for more than 20 other women all living together with no privacy.

“They have phones in there,” Worthley said. “They have games, cards and checkers. They have a TV in there they can watch all day long."

Alyssa also has access to GED books, but a court battle is still going on whether she can take long distance learning courses to finish high school.

Alyssa usually stays in bed, with a blanket over her head said Worthley.

"I think 15, 16 is the youngest we've ever had,” said Worthley. “She's like any other inmate. They just sit there and do their stuff upstairs. And she does keep to herself. Until problems arise, then I'll get concerned about it. But as long as everyone is on their best behavior up there, then I have no concern for them."

Worthley said Alyssa has never caused a problem.

Psychologist Dr. Colin Duggan, who has worked with adolescents in the correctional system, said teens in adult jails is a delicate situation and it needs to be looked at case by case when dealing with a defendants' mental health.

“Hypothetically, a child thrown into an environment like that could suffer consequences: not learning to deal with stress appropriately, learning how to contain  their impulses, acting out violently,” Duggan said.

Judge to prosecutor: hand over letters, cards, clothes, makeup to Bustamante defense

Defense counsel for accused child murderer Alyssa Bustamante is asking for her clothes and other personal affects, but the prosecution holds out.

Defense attorneys for Alyssa Bustamante, the central Missouri teen accused of killing 9-year-old Elizabeth Olten, are asking for bags of her clothes, makeup, and a stack of her letters and cards.

Bustamante lawyer Charles Moreland tells the judge there’s no reason much of Bustamante’s possessions taken in for evidence, such as letters and cards from her father, have no bearing on the case. He says she’ll need the clothes for the upcoming trial. But prosecutor Mark Richardson says anything with Bustamante’s writings need to be held.

Defense Attorney Charles Moreland says she’ll need her clothes for the upcoming trial, and that Christmas cards, birthday cards and other correspondence with her father are not relevant to the case.

Prosecutor Mark Richardson disagrees, saying anything with Bustamante’s writing needs to be held for evidence. Cole County Judge Pat Joyce asked him to make copies and turn them over in 60 days.

The defense has asked previously to have their own experts watch forensics experts conduct tests on DNA samples collected from the scene, but the prosecutor says many of them have already been consumed from testing. Judge Joyce said if there were any samples left over from future testing, they would need to be held for the defense’s own expert.

Bustamante was 15 when she led authorities to a grave holding the body of 9-year-old Elizabeth Olten, who died from stab wounds, strangulation and a slashed throat.

Olten’s family members were in the court room. They’ve appeared at every hearing since her death wearing t-shirts with Elizabeth’s picture on them

Alyssa Bustamante Wants Cards, Clothes Back

JEFFERSON CITY, Mo. (AP) -- — Attorneys for a central Missouri teenager accused of killing a 9-year-old neighbor girl say authorities seized birthday and Christmas cards received from the teen's father, as well as eight large bags of her clothes.

Cole County Judge Patricia Joyce on Thursday gave the prosecutor's office 60 days to inventory, copy and determine which items it needs for evidence so the rest can be returned to Alyssa Bustamante. She also denied a defense request to be present during some DNA testing.

Bustamante was 15 years old when she was charged with killing her neighbor, Elizabeth Olten, in October 2009. Police say Bustamante told them she wanted to know what it felt like to kill someone. Bustamante has pleaded not guilty. Her trial is set for May 16.

COLE COUNTY, MO. -- Lawyers for teen murder suspect, Alyssa Bustamante, filed a notice of deposition Wednesday morning.

Bustamante is charged with the first degree murder of her 9-year-old neighbor Elizabeth Olten. (Read more)

Bustamante’s attorneys will start depositions Monday, Nov. 29 through Wednesday, Dec. 1.

Attorneys will question law enforcement officials, juvenile court and others.

Cole County Prosecutor Mark Richardson is invited to attend the depositions.

Thank you, NORTHERN ROSE,for keeping this story active in the thread.  It seems that Elizabeth Olten has been almost forgotten in this horrible tragedy. Alyssa needs her clothes and her cards.

Bustamante's Defense Prepares For Murder Trial
March 11, 2011


Jefferson City, MO) -- Defense attorneys for teenage murder suspect Alyssa Bustamante released more information Friday about their preparations for trial.

Bustamante, 17, is charged with 1st degree murder in the stabbing and strangulation death of her 9-year-old neighbor Elizabeth Olten.

Bustamante's defense team has disclosed to the prosecution its list of witnesses who could be called to testify during the trial. Public Defender Donald Catlett said the list could be added to and declined to say how many witnesses are on the list.

The defense team also told prosecutors it has 11 extra pieces of evidence that could include books, papers, photographs and other objects that could be introduced at trial.

This is evidence that was not included in the prosecution's discovery. The defense team has invited to prosecution to inspect, test, copy or photograph the evidence.

Depositions are scheduled March 16th in the case. The prosecution has asked Highway Patrol Investigator David Rice and Tobie Meyer of the Prenger Family Center in Jefferson City to testify.

Bustamante Attorneys Want to Keep Statements from Murder Trial
March 19, 2011

(Jefferson City, MO) -- Attorneys for Alyssa Bustamante want to keep statements made by Bustamante from being used during her trial.

Her attorneys met with a Cole County judge in a close-door hearing earlier this week and asked to suppress statements she made to investigators.

The motion to suppress stated Bustamante's statements were not made voluntarily and that she was subjected to mental and physical duress prior to and during her investigation.

Attorney's also said her statements were made before she was advised of her constitutional Miranda Rights.

Supreme Court affirms lower court ruling for jury in Bustamante trial
March 29, 2011

JEFFERSON CITY, MO -- On Tuesday, the Missouri Supreme Court affirmed a lower court's ruling that the jury be imported for Alyssa Bustamante's trial.

Lawyers for the defendent previously requested a change of venue for the trial, saying it would be impossible to get a fair trial in Cole County. Judge Patricia Joyce decided that instead of taking the trial elsewhere, the jury would be brought in from another county.
