Alyssa Bustamante murder trial delayed until September

JEFFERSON CITY, MO (AP) - The trial of a central Missouri teenager charged with killing a young neighbor has been delayed until September.

Seventeen-year-old Alyssa Bustamante had been scheduled for trial June 1 on a charge of murdering 9-year-old Elizabeth Olten in rural Cole County.

A judge rescheduled the trial Wednesday for Sept. 13 at the request of defense lawyers, who said they needed more time to prepare. Prosecutors had opposed the delay.

Bustamante Murder Trial Pushed To September
Jefferson City, MO) -- The trial of Alyssa Bustamante has been pushed to September.


The 16-year-old from St. Martins, Missouri, is charged with First Degree Murder in the death of 9-year-old Elizabeth Olten in 2009.

She pleaded not guilty and was originally set to go to trial this summer.

Defense attorneys for Bustamante cited another trial as one of the main reasons they requested a continuance from the previously set June 1 trial date.

Bustamante's primary defense attorneys, Charlie Moreland, is representing another first degree murder case in Joplin. The trial in Joplin began earlier this month, but a situation caused the trial to last longer than expected.

JEFFERSON CITY, MO. -- The new state of the art Cole County Jail is now home to inmates, including 17-year-old Alyssa Bustamante.

Transport vans moved all of them from the old jail to the new one yesterday afternoon.

Alyssa Bustamante is charged with the first degree murder of 9-year old Elizabeth Olten in 2009.

She was 15 when officers arrested her and that had everything to do with why she wasn't kept in Cole County.

Bustamante stayed in the Morgan County Jail for nearly two years since the Morgan County Jail was better equipped to handle the teenager, but now she's back in the county where she's accused of committing the crime.

JEFFERSON CITY, MO -- Alyssa Bustamante's trial could be in jeopardy even before it begins, according to her attorneys.

Having already been pushed back once, Bustamante's trial is scheduled for Sept. 13th on charges of 1st degree murder and armed criminal action in the October 2009 stabbing and strangulation death of her 9-year-old neighbor Elizabeth Olten.

In court documents filed on Tuesday, the 17-year-old's defense team argues that Cole County Prosecutor Mark Richardson has ignored a request for discovery and failed to turn over the names of  witnesses he plans to call at trial.

It was Sgt. Rice who initially questioned Bustamante and testified to the grand jury that Bustamante confessed to the slaying and led authorities to Elizabeth's body in the woods west of Jefferson City.

A judge has deemed a large portion of Bustamante's statement made during that videotaped interview as inadmissible in court because a juvenile officer wrongly participated in the questioning and used "deceptive tactics" to get Bustamante to speak.

Bustamante's lawyers have requested to meet with Judge Patricia Joyce and the prosecution in a closed hearing on Tuesday, Aug. 23rd, to discuss the motions.

The trial has already been pushed back twice: it was first scheduled for May, then June and most recently for Sept. 13th of this year.

Judge Joyce ruled that a pre-trial conference will be held in Cole County on January 9th, 2012 with jury selection beginning on Jan. 10th in Springflied. The Green County jury will then travel to Cole County for the trial.

Joyce said the trial is scheduled to being immediately after jury selection is completed.

Also of note, the Case Net scheduled hearing has her jury trial beginning at 9 a.m. on January 9. There is no status hearing scheduled on the docket at all. We'll do some checking next week, but usually Case Net is fairly accurate on hearing dates. Thanks!

as Elizabeth's mother I am very aware as to the dates of her trial January 9 is a pre-trial hearing ( status hearing) and january 10 is the start of trial ( jury selection). Your motto for KRCG is where accuracy matters and it may be little details to you but it drives me crazy for you to report something wrong everytime you report something on Elizabeths murder trial.

Thursday, December 22 2011

(Jefferson City, MO) -- The murder trial of Alyssa Bustamante, accused of killing a nine-year-old neighbor has been moved to the federal courthouse.

The trial, scheduled to begin Jan. 30, was moved for security concerns, according to an order released on Thursday. The order also cited concerns about rescheduling other cases in the Cole County Courthouse during the trial.

Bustamante is accused of killing Elizabeth Olten, a nine-year-old neighbor. Bustamante, now 17, was 15 when she was charged with stabbing and strangling the younger girl. The girls lived in St. Martins, just west of Jefferson City. She's being tried as an adult for the crime.

She is a very disturbed girl.  I pray that she NEVER EVER gets out of prison.  I don't believe there is any fixing her.  Sister you are right that is why she said that she killed her.

A police officer testified that Bustamante confessed to digging two holes to be used as a grave, then killing Olten five days later without provocation because she wanted to know what it felt like.
