Bustamante Entering Missouri’s Prison System
February 10, 2012 6:37 AM
ST. LOUIS, Mo. (KMOX) - Sentenced to life in prison for murdering her nine-year old neighbor, Alyssa Bustamante is now entering Missouri’s Prison system, her home for at least the next 33 years.
Since she is now 18 years-old, Bustamante is going through the same routine as all other adult new prisoners: being physically and mentally examined, and receiving the system rule book and other information at the women’s facility in Vandalia.
System spokesman Chris Cline says she is in segregation now, and testing will determine when she moves out and where she goes next. Cline said, ”her case has a little more notoriety than other cases and obviously that’s something we take into consideration”

Muddy clothes, shovel seized from Mo. teen killer

In response to the AP's request, Cole County Circuit Judge Pat Joyce released some of those documents but redacted portions relating to a confession Bustamante gave to police two days after the murder that the judge previously had suppressed from being presented as evidence.
In addition to seizing a diary that had been hidden under a blanket in Bustamante's bedroom, the newly released documents show authorities also took muddy jeans and clothing that appeared to have blood stains on them, as well as two shovels. Details about the seizures were included in the transcript of a secret court hearing held Aug. 23 on a defense motion to suppress the evidence. The judge ultimately rejected that motion, and the blood turned out to be from Bustamante.
"No blood from Elizabeth was found on anything that was seized from that home," Bustamante's attorney, Charlie Moreland, said Tuesday.
The day after Elizabeth disappeared, Bustamante skipped school and went to the home of her 16-year-old boyfriend. Court documents show the boyfriend was interviewed eight times by the FBI and Missouri State Highway Patrol over the ensuring seven days. The boyfriend told authorities that Bustamante had mentioned that her little sister's friend was missing and that police had searched her house. The boyfriend said he also found a black knife or box-cutter in Bustamante's backpack, a weapon Cole County Prosecutor Mark Richardson said Tuesday was much smaller than the knife used in the murder.
The boyfriend denied knowing about Elizabeth's death until being informed of it by the FBI, which caused him to become ill and later vomit, Bustamante's attorneys wrote in a Jan. 9 court filing that had been kept secret. The court filing, which sought to block the boyfriend from being called to testify at the trial, said the boyfriend later failed a polygraph test. But he never was charged with a crime.
"All the evidence we had pointed to only one person (Bustamante) being involved in the murder," Richardson said Tuesday.

This is someone that LE should study. Find out how her mind works and you might have a chance of understanding others before they commit a murder.

Mother files wrongful death lawsuit
9-year-old’s family sues Pathways and teen killer
Sunday, October 28, 2012
Elizabeth Olten’s mother has filed a wrongful death lawsuit in Cole County, three years after the 9-year-old girl was murdered near her home on Lomo Drive, south of U.S. 50 in St. Martins.
Defendants in the suit are:
• Alyssa Daileen Bustamante, now 18, who pleaded guilty Jan. 10 to second-degree murder in the case and now is serving a life sentence, plus 30 years for armed criminal action, at the state’s Women’s Eastern Reception and Diagnostic Center, Vandalia.
She was 15 on Oct. 21, 2009, when she strangled and stabbed Olten, a neighbor and friend of Bustamante’s younger sister.
• Pathways Behavioral Healthcare and two of its employees.
Mel Fetter, president and CEO of Compass Health, Pathways’ parent company, said in a Friday afternoon e-mail: “We are aware of the suit but, obviously, cannot comment on pending litigation.”
The case was assigned to Cole County Presiding Circuit Judge Patricia Joyce. No hearings had been scheduled by Friday afternoon.
In the lawsuit, Patricia Preiss said her daughter “died related to certain actions or omissions of Bustamante and the other defendants.”
Noting that Bustamante “was under care and treatment of Pathways” and its employees, the nine-page lawsuit argues: “Bustamante’s violent propensities were well-documented from a young age, including but not limited to a declaration on her ‘Myspace’ page that her hobbies were ‘cutting; killing people,’ a video wherein Bustamante electrocutes her younger brothers, a picture of Bustamante holding a knife to another girl’s throat, and other evidence ...”
Preiss said Pathways’ employees “were aware of the same violent propensities of Bustamante, as well as the specific, identifiable threats to harm Olten (but), despite actual knowledge of the threat Bustamante posed to Olten, none of these defendants took actions to detain Bustamante, none took action to result in her detention, none warned Olten or Preiss of the specific threat on Olten, nor did they take any action that might have prevented Bustamante from harming Olten.”

Mom Says Shrink Ignored Tell-Tale Signs of Killer
Thursday, October 25, 2012
JEFFERSON CITY, Mo. (CN) - A psychiatrist ignored the "well-documented" violent propensities of a teenager who murdered her neighbor, a mother claims in court.
Alyssa Bustamante was 15 when she killed 9-year-old Elizabeth Olten on Oct. 21, 2009.
Bustamante pleaded guilty to the murder and is serving a life sentence. She led authorities to the body, which she had buried at one of two grave sites that she prepared a week prior to the murder.
The girl told police she killed Olten because she wanted to know what it felt like to kill somebody, and she had written in her journal afterward that the experience was "pretty enjoyable."
Patricia Preiss says her daughter, Olten, would still be alive if Bustamante's psychiatrist, Dr. Nigar Sultana, had taken heed of the warning signs.

Teenage 'thrill killer' must spend at least 35 years behind bars for choking and stabbing her nine-year-old neighbor, as judge denies new trial
3/10/14
Alyssa Bustamante was 15 when she killed neighbor Elizabeth Olten, nine, and buried her in the Missouri woods in 2009
She wrote in her diary that it was 'ahmazing' and 'pretty enjoyable'
She was initially charged with first-degree murder with a mandatory life sentence
She accepted a plea deal in 2012 and sentenced to 35 years jail
Several months later, the U.S. Supreme Court ruled juveniles can't face automatic life sentences without the possibility of parole
At a court hearing in January, the now 20-year-old Bustamente testified that she wouldn't have accepted the plea deal if she'd known about the national legal change
A judge has now denied a new trial saying the evidence against her was strong and her attorneys weren't incompetent
A judge has denied a new trial for a young Missouri woman who pleaded guilty to murder for the slaying of a nine-year-old neighbor girl but later sought a do-over because of a U.S. Supreme Court case invalidating mandatory life sentences for juveniles.
Alyssa Bustamante was 15-years-old in 2009 when she killed Elizabeth Olten and buried her in a wooded area west of Jefferson City.
Bustamante wrote in her diary that it was an 'ahmazing' and 'pretty enjoyable' experience.
She originally was charged with first-degree murder, which would have carried a mandatory life sentence without parole.
But shortly before her 2012 trial, Bustamante pleaded guilty to second-degree murder and armed criminal action.
She was sentenced on the murder charge to life in prison with the chance of parole, plus 30 years for the other charge.
Several months after Bustamante pleaded guilty, the U.S. Supreme Court ruled in a separate case that juveniles cannot face automatic life sentences without the possibility of parole.
Bustamante then got a new attorney, who claimed her original public defenders were ineffective.
At a court hearing in January, the now 20-year-old Bustamante testified that she wouldn't have accepted the plea deal had she known about the possibility for the nation's high court to wipe out mandatory life sentences for juveniles convicted of murder.
But Charles Moreland, one of her original attorneys, testified that they had talked to her about the issues pending before the Supreme Court.
He said Bustamante 'stood a very strong risk of being found guilty' by jurors of first-degree murder had she not pleaded guilty to the lesser charge.
Cole County Circuit Judge Pat Joyce wrote in a decision dated Thursday, but released today, that Bustamante's request to set aside her guilty plea and sentence was 'meritless' and her original attorneys weren't deficient.
