Good Morning Monkeys.

How the Grinch Stole Casey Anthony’s Christmas
December 2nd, 2009  Richard Hornsby
It was recently announced that Judge Strickland will address four of the Casey Anthony Defense Team’s motions at a hearing on December 11, 2009. They are:

   1. Motion to Preclude the Death Penalty Procedures
   2. Motion for a Protective Order Directing Orange County Jail to Destroy Videos of Family Visits
   3. Motion for a Protective Order Prohibiting Orange County Jail from Videotaping Attorney Visits
   4. Motion to Dismiss Counts 1,2, 4, 5, 7, 8 10, 11, 13 for Violation of Double Jeopardy Clause

The scheduling of the hearing on these motions provides not only a timely interlude in the progression of her Murder case, but also a timely and brief interlude from my two part series on her Check Fraud case (Casey Anthony: Insufficient Funds).

Unfortunately though, I think that this interlude will not provide Ms. Anthony with any early Christmas cheer, as it appears that Santa will not be giving her anything on her Christmas wish list – she must have been a naughty girl this year, tsk tsk…

Oh Casey, just what have your attorneys done?

Thanks for the link, Trimm.
I see he used the old Cin./Grinch video, LOL!

This is weird because there isn't much, I saw on In Sessions about it looked like a mess up with case numbers, and now I can't find it.

I saw it mentioned in some older posts.  http://boards.insessiontrials.com/archive/index.php/t-359816.html

Elgine Furlow (aka: Elgin Wilson Furlow Sr, Wilson Furlow, Wille G Covington, Willie Clyde Covington and more) filed a Motion to Dismiss which was filed on 10/22/09 with the clerk of courts in the case against Casey Anthony. He has a long history as a former inmate at the FLDC. It is unclear what his connection is to this case. However, he currently has other motions pending in the state of FL courts.            From Humble Opinion weblog.

ummmm thanks nrcg!  I wonder what this was about??  I did a search and a like to Blink came up but I didn't see a connection either.
It appears to be an error with case numbers, now if I could find where I was reading that on In Sessions, I would

You and I must have been looking at the same thing.
Maybe it was an error.
I think so, but don't know for sure.

Hornsby posted this and for me it answers a couple questions

Everyone needs to be 100% clear on something. Until the jury is sworn in, it does not matter what the defense claims to the media or in any pretrial hearing - they are not bound to those statements, nor can those statements be used against them in trial.

The only thing the defense attorneys can be held to, is the theory of defense they provide during opening statements.
And that is why I think the nanny bs, will be abandoned, or at least it would make sense to do so.

As usual I am several pages behind but while this subject is on my mind I want to address it (otherwise I'll get a new thought in my head as I read and forget about this one).  I'm curious and hoping one of you smart monkeys will know... If the "Zanny the Nanny" brew ha ha was testified to during the grand jury proceedings can it still then be brought up??

ANNETTE~  I am NOT one the smart monkeys especially about legal stuff but it sure seems like it could be brought up.

Death penalty motion due in Caylee case
Published: Dec. 3, 2009 at 12:12 PM
ORLANDO, Fla., Dec. 3 (UPI) -- Attorneys for Casey Anthony said they will argue a motion in court in Orange County, Fla., against the possibility of their client facing the death penalty.

The Orlando (Fla.) Sentinel said Thursday that Anthony's defense attorneys will attempt to convince Orange County Circuit Court Judge Stan Strickland to stop prosecutors from seeking the death penalty against Anthony, whose daughter Caylee was found dead in December 2008.

Anthony's defense team argues in a motion filed in September that prosecutors do not have sufficient aggravating circumstances to support a death penalty request in the first-degree murder case.

In addition to opposing the possibility of a death penalty request, defense lawyers planned to use a Dec. 11 hearing to target recordings of their client.
The Sentinel said the defense team will present motions aimed at stopping Orange County Jail officials from recording interviews with Anthony.

The lawyers will also seek the destruction of any previous recordings of their meetings with Anthony, 23, whose 2-year-old daughter initially disappeared in June 2008.

Here's something that bothers me.  If Kronk knew where Caylee's remains were because he heard it by the grapevine or daisy chain whatever that is,  why in the world would he wait from August until December 11 to go back and suddenly find her?  If it were I, I would have kept after the police until they finally listened to me and found her, then get the reward. (Well, actually I would call the police and say so and so told me and it originally came from Casey while chatting with someone in jail. In fact, I'd probably go to police headquarters so it wouldn't get lost in the many tips on the tip line.)  It really makes no sense at all that Kronk would wait and I don't think he did, nor do I think he heard anything at all from anyone at all from anywhere at all.  As I understand it, he was assigned to read meters in the neighborhood in August and then not again until December 11, at which time he saw the body.  Now, there is no law which prevented him from going back on his day or days off and "Suddenly" finding the body. That would be too hot to just wait around until being assigned there again. I don't think he knew, I don't think anyone told him, and I don't believe in psychics. IMO
