Legal Analyst Bill Sheaffer on Casey Anthony Case
Witness for the Prosecution or Fall Guy for the Defense?
Posted in Latest Posts by billsheaffer on November 24, 2009

Attorney Bill SheafferFor Scotswoman and other contributors who have asked about Andrea Lyons, and what is behind her shenanigans and pre-trial publicity seeking escapades:  To look behind the curtain, or, to see how sausage is made as some call it, is often not very pleasant and sometimes downright ugly.  Such is the case with the recent release of the “teaching” tape made of Chicago law school instructor and attorney, Andrea Lyon’s lecture to Central Florida lawyers on the topic of defending death penalty cases during the penalty phase.  At this juncture, we will not address her distasteful and offensive remarks pertaining to judges, female prosecutors or jurors, but instead, limit our discussion to a particular statement made by her that cornerstones the latest defense strategy that can only be described as a scorched earth approach.  Ms. Lyon’s approach, which has been adopted by Baez, Baden and company disregards any consideration other than win at ANY cost, regardless of the truth, or consequence to  justice, the fair trial process or any innocent party ground under their boots.  Accordingly, let us now examine her statement as follows: “I understand that a lot of times our theory of the case isn’t a real theory.  Okay, it’s a way of us getting to the penalty phase.”  And contained in her words lies the fate of witness Roy Kronk.  He is only the latest victim of this scorched earth approach by the Casey defense team, but I suspect, not the last.  Looking behind the curtain to what this means:  Andrea Lyon has a job.  That  job, as she sees it, is to save her from the death penalty, should Casey Anthony get convicted in the guilt phase of her trial, and, to do whatever is necessary to accomplish this, regardless.  To comprehend this philosophy one must understand that there are lawyers that are so opposed to the death penalty, just as many non-lawyers are, that the ends justify the means.  Period.  I must ask that you not judge all criminal defense lawyers by the conduct of Ms. Lyons.  Most are competent, hardworking and passionate defenders who do not share this view of win at any cost, but still represent their clients with vigor, creativity and compassion, while preserving the integrity of our judicial system and not creating fall guys and ruining the lives of innocent everyday people.  But back to what this all means:  quite simply, the defense would sacrifice Roy Kronk, the meter reader, during the penalty phase when they argue that a compelling reason not to impose the death penalty is the reasonable doubt created by the implication that he is the killer of little girl Caylee.  A horrifying thought for anyone caught up in the criminal justice system as a witness or search volunteer?  And, will it end with a verdict in this trial?  Well, if I were Mr. Baez, I might be asking myself, when his job is done and all appeals have been exhausted, will I be next?

WJS

P.S.  To the many who have asked for the certification dates on the defense’s recently filed motion in limine and memorandum of law in support,  the motion and memorandum were certified to have been furnished by Jose A. Baez, to the Office of the State Attorney by U.S. Mail and/or  facsimile on November 18, 2009. But, both the motion AND the memorandum were signed as submitted by Jose A. Baez and Andrea D. Lyon, again, on November 18, 2009.

Thanks tupelo....

Just saw Joy Wray's youtube video of her prancing around sans bra in front of her child.
EEEEEEWWWWWWWWW!  I'm not sure, but I think I heard her daughter saying to stop.  That kid is going to have some severe problems.  And you know what?  It's not the
"Joy"-ful dancing I mind at all.  In a weird way, it's kind of sweet.  The tacky thing is putting it on youtube.  Who does that?  Why? Who needs that kind of validation?
Uggh.  Now I want to gouge my eyes out.

Casey Anthony defense: Equusearch volunteers searched remains site, found nothing
By
Drew Petrimoulx
@ November 24, 2009 1:01 PM Permalink | Comments (0)
The battle between Casey Anthony's defense and Texas Equusearch rages on with a new motion filed in court Monday.
The defense has argued for a complete list of participants in searches for Caylee Anthony, a task Equusearch says is invasive for the searchers and a finanical burden to the group.

Equusearch said only 32 people actually searched in area where Caylee Anthony's remains were found, while the defense argued there were many more.

During a hearing in August, the two parties and judge Stan Strickland agreed that the defense would be allow to examine Equusearch records and come back to the court if they found additional records that were relevant to the case.

In the latest motion, the Anthony defense identifies two volunteers who say they searched the area and were not included in the list of 32.

An Equusearch volunteer named Laura Buchanan told the Anthony defense that she searched the area on September 3, 2008 for approximately three to four hours and "didn't not notice anything unusual."

She adds that she didn't notice a "strange smell" or any "unusual animal or insect activity."

Buchanan told the defense that she believes "the remains of Caylee Anthony were not there during the time of our search."

Another Equusearch volunteer named Joseph Jordan told the Anthony defense that he searched the area on September 1, 2008 with five to six volunteers and two dogs. He was also not on the list of 32 searchers but didn't comment on whether he noticed anything out of the ordinary.

Keep in mind the defense is claiming it's the same area.  This is information being put out by the defense.  My BET is that it's not exactly the same area and likely 100 yards or so away.

No falling out that I'm aware of but let me read back.

Klaas...he posted here for a while..... did he get banned......

there a post on WS that he was organizing a search on 9/3/08...a Saturday (see below)...and I THINK he was the one who said he could only search on weekends and sometimes when he got off work.....

We will be meeting on Saturday, September 13, 2008 at 8:00am at the Publix at Chickasaw and Lake Underhill Road. The search locations will not be disclosed until that time. If you have an area you would like to search with the group, please print out the satellite image of the area you would like to search from either a mapping program or Google Earth and if you can recon the search location you are suggesting before Saturday to see access points and how many people we will need at the search location please do so. Any questions, please e-mail me at joe@momsforjustice.org

We look forward to seeing you out there! Make sure to brown bag your lunch and bring plenty of water for yourself. My organization does not currently have the funds to feed and water all you wonderful people as we have multiple cases going on at the current time.

All maps and areas of interest when complete will be turned over to law enforcement and Texas Equusearch to help in their search efforts.

Also, if you do not have a desire to search and you are only out there to speak with media or cause a problem, you will be asked to leave. There will be no drama in this search or personal attacks on anyone in the family. Keep your opinions to yourself and if you are a protestor at the Anthony home you ARE NOT welcome on our search. This is a private search and you will be searching at your own risk. We will not have any EMS on site. This is not a Texas Equusearch effort, this is an independent effort by S.A.V.E. Kaylee www.MomsForJustice.org and you will be out there as an INDEPENDENT SEARCHER that will NOT be affiliated with any organization. You are completely responsible for your own actions and health. Speaking with media about search locations will not be permitted.

Sunny - he was not banned at SM but there was a group of people attacking him online and he started keeping a lower profile.  To my knowledge there was no falling out with Tim Miller and I doubt he searched the EXACT area.  Time will tell I guess.

yes it is.... I just found this post on SM

My group from Texas Equusearch that Red searched with went out the other night to see the site and put up our temporary memorial... it was very emotional.  I am so happy she was found before Christmas also Klass.  It was very hard to realize how close we were so many times.  I can't imagine how many more nights and weekends I could have handled searching.  I dropped 4 classes, totaled my car... Mr. Krunk gave me the best Christmas present I could ask for.  Peace of mind knowing that she will have a proper burial. I wish people would lay off of him... the local news plays into the suspicion just to make a story... they are all so ridiculous!

Motion filed to get Anthony civil trial heard

Updated: Tuesday, 24 Nov 2009, 12:19 PM EST
Published : Tuesday, 24 Nov 2009, 12:19 PM EST

ORANGE COUNTY, Fla. (WOFL FOX 35) - Lawyers for a woman suing Casey Anthony for defamation have filed a motion with the court asking that a trial date be set.

Anthony has pleaded not guilty on charges that she killed her daughter, 2-year-old Caylee Marie, claiming a babysitter named Zenaida Gonzalez kidnapped her toddler. Caylee was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's home in December.
Investigators believe Anthony made up the story about the nanny. A woman named Zenaida Gonzalez claims in a defamation lawsuit that her reputation was damaged as a result of Anthony's story about the nanny.
In the motion Zenaida Gonzalez’s attorneys are asking the clerk of the court for the next available trial jury and state they expect the trial to last for five days.

Good for Mr. Morgan!  If anyone has an open-shut defamation case, it is Mr. Morgan's client.  The mere fact that Law Enforcement zeroed in on her, is grounds alone for her lawsuit, IMO.   All anyone has is their good name and hers was surely placed in jeopardy.

OK Monks, I  have satisfied myself that Joseph Jordan was not at the exact spot...
Help me find out how long a long a body would smell after death.....this Laura Buchanan (I think that's right ) says she searched and didn't smell anything.....I do not believe there would have been any decomp odor in September. First of all she would have already been skeletonized and the area was covered with water. She also says she saw no unusual bug activity???  Is she an entomologist? She is not from the FL area so how would she know if the activity was unusual or not?  Bet the skeeters were bad with all that water though~!

Source: Forensic Trail To Connect Anthony To Remains
Souces Points To 3 Key Pieces Of Evidence

POSTED: 4:17 pm EST November 24, 2009
UPDATED: 5:39 pm EST November 24, 2009
ORLANDO, Fla. -- Three findings buried deep in the trove of forensic evidence could be the link between Casey Anthony and her daughter's remains in the woods, a source said Tuesday.

In a report from the so-called "body farm" in Tennessee, Dr. Arpad Vass found a substance called "adipocere," which is commonly referred to as "grave wax" on paper towels recovered from a trash bag inside Anthony's car trunk. That dark, flaky substance he said comes from decomposing fatty tissues in humans and pigs.
In a more recent report, entomologist Neil Haskell found coffin flies on the paper towels and inside Anthony's car trunk. He concluded someone wiped up decomposition fluids in the trunk.

Anthony's attorney Jose Baez, said, "I've got four lawyers who are dying to cross-examine him."

The source within the investigation also points out an FBI lab finding that hairs recovered from Caylee Anthony's skull and to the single strand with the so-called death band recovered from the trunk.

The FBI report said they exhibit the "the same microscopic characteristics" and are "consistent with originating from the same source."

While that FBI report states the hairs do not constitute a basis for absolute personal identification, it can be argued the hair from a dead body inside Anthony's trunk matches strands from Caylee's skull.

Haskell also concluded that from the colonization of coffin flies at the scene, Caylee's remains were dumped there as early as late June. Combine that with evidence of "grave wax" from the towels and matching hairs from the scene and trunk, it appears to be a forensic trail leading right back to Casey Anthony, the source said.
Baez has declined to discuss these forensic issues specifically. His team has mentioned that the duct tape found on Caylee's skull was contaminated and contained a hair that did not belong to Caylee or Casey Anthony.

Anthony is in Orange County Jail on a charge of first-degree murder in connection with the death of her daughter Caylee, whose remains were found in Orange County woods in December 2008.

Zenaida Gonzalez's Attorneys Ask For Trial Date

Attorneys for the woman suing Casey Anthony for defamation are asking the judge to set a trial date.

In a notice filed on Tuesday, attorneys for Zenaida Gonzalez said they are ready to take their case to trial. John Morgan said he expects the trial to last five days.

Gonzalez said Casey Anthony ruined her good name and reputation by claiming someone named Zenaida Gonzalez kidnapped her daughter, Caylee.

Anthony is charged with first-degree murder in the death of her daughter.
