Curacao – MLAT Request Filed in Former ISC School Teacher Case

U.S. authorities filed a Mutual Legal Assistance Treaty (MLAT) request in an attempt to receive the confiscated belongings of Stephen Wayne Sudduth. Sudduth, a former International School of Curacao (ISC) teacher, is indicted in the U.S. after law enforcement officials in Texas found 57,000 images of child pornography and 1,000 videos of sex involving young children on his computer.

He faces 30 counts of possession of child pornography and 10 counts of promotion of child pornography. Sudduth was arrested in July 2008, and remains in jail in lieu of US $500,000 bail.

The court in the U.S. denied his attempt to get his bail reduced. Sudduth taught kindergarten at ISC from 2006 to 2009. (La Prensa)

SIXTH JOINT MOTION FOR CONTINUANCE

The parties move this Court for a continuance of this case, and respectfully show as follows:
Stephen Sudduth is charged with engaging with illicit sexual conduct, sexual exploitation of children, transportation of child pornography, and possession of child pornography. The pretrial conference hearing is set for July 23, 2012.

Mr. Sudduth has related charges pending in Texas state court. Counsel’s latest information is that Mr. Sudduth’s trial will be set in state court in November 2012.  The state has no intention of dismissing those charges and intends to pursue its prosecution against Mr. Sudduth. Mr. Sudduth was arrested first by the state, and is therefore in primary state custody. He was is in federal custody by virtue of a writ of habeas corpus ad prosequendum, but was, by agreement of the parties and this Court, returned to state custody to stand trial in state court before resolving his federal case.

The parties have completed the discovery and investigation, and have engaged in plea negotiations. The government has offered a plea agreement, which is currently under consideration by Mr. Sudduth, and which, if accepted by Mr. Sudduth, would resolve the federal charges without a trial. Mr. Sudduth cannot plead guilty or otherwise make any incriminating statements in federal court, however, because those statements will be used against him in the state prosecution. At the same time, because there is a possibility that this federal case could be disposed of short of a trial, the parties believe that conducting a trial in federal court would be a waste of judicial resources, and would be an enormous inconvenience to the government, the defense, and the lay witnesses, many of which are young minors who reside outside of the United States.

It would therefore be in the interest of justice to continue this case pending resolution of the state charges, and such a continuance is hereby requested.

AUSTIN (AP) — A former elementary school teacher in the Austin and Houston areas has been sentenced to 60 years in prison in a child pornography case.

Prosecutors say 38-year-old Stephen Wayne Sudduth of Sealy was sentenced Tuesday in a plea deal. Sudduth pleaded guilty to three felony charges of child pornography promotion.

Investigators with the state attorney general's office in 2009 arrested Sudduth after finding more than 58,000 illicit images and videos on his computers. An Austin County grand jury indicted Sudduth on 30 counts of possession of child pornography and 10 counts of promotion of child pornography.

WILLEMSTAD -  The former Curacao International School teacher, Stephen Wayne Sudduth was sentenced to 60 years in prison for the possession and distribution of infant pornography.

The first reaction in Curacao and in the United States is that he received the punishment he deserved. Curacao Chronicle and Notisia360 have published various article on this case. After long waiting, and there were even those who thought that this case was going to die, finally there is a sentencing.

I'm wondering if that's just the "state" charges?  He had federal indictments too.  I'll see if I can find out what's going on with that.  The last I read, he'd been offered a plea deal on the federal charges but it was on hold until after the state's case was final.

Will we ever know if he operated alone or was part of a larger child pornography ring?  That's a nagging feeling I've had from the beginning of this.  His time in Curacao is highly suspect IMO.

An international row has broken out on the Dutch island of Curaçao following the arrest of a former teacher for the possession of child pornography in the United States. Until this summer, the 34-year-old man had been teaching infants at the island’s prestigious International School.

The man, US citizen Stephen Wayne Sudduth, was arrested in Texas at the end of October for possessing and distributing child pornography. In a raid on his home, the Texan Cyber Crimes Unit found 57,000 pornographic photos and 10,000 videos containing sexually explicit material featuring young girls stored on his computer and external media.

The news has met with a heated response from parents at the school on the Caribbean island in the Netherlands Antilles. They say they had complained about the man’s behaviour during his time as a teacher.

The local Antilliaans Dagblad newspaper reports one parent as saying, “From the start the man behaved strangely. He ignored the boys and entirely focused on the girls in an almost excessive way. We complained several times to the school about Sudduth’s behaviour, but we got no response. Instead he was actually given an extra job at the after-school club.”

However, the school says Mr Sudduth was carefully vetted before being appointed. Officials from the school in Texas where Sudduth worked from 2000 to 2006 also say background checks revealed nothing that would have excluded him from being a teacher.

In a news conference, Texas Attorney General Greg Abbott did not rule out that there may be further arrests in the case, as he expected Mr Sudduth was part of a larger child pornography ring. He said the extent of the collection and number of children abused in producing the material was shocking.
