TrueTV is saying the defense knows they'll loose this decision but they are teeing everything up for the appeal.

BLOG: Live in the Casey Anthony courtroom

Casey Anthony is back in court Friday morning as her lawyers argue new motions in the case.  The hearing begins at 9:30AM.   I'll be blogging live from the courtroom.  Follow updates below:   
11:42 Judge says he has a lot to consider, will be issuing rulings at a later time.
11:38 George Anthony and Cindy leave the courtroom. (Casey crying.)
11:34 It clear in this case on why the death penalty was re-instituted. Caylee's body was found and the manner in which she was killed warrant the death penalty. Ashton was pointed in talking about the duct tape that was put over Caylee's mouth.
11:29 Ashton: Anyone who is accused of first-degree murder is illegible for death penalty. The jury will make the decision on the death penalty, not the state.
11:27 Jeff Ashton arguing for State: "That Mr Lyon doesn't like jurors who believe in the death penalty is germane."
11:15 Lyon: State is using death penalty to infringe on Casey's constitutional rights. Studies show death qualified juries are more conviction prone and more likely to arrive at wrong outcome.
11:09 Lyon: Death penalty meant for serial killers. Not people like Casey Anthony where there is not cause of death.
11:06 Lyon: All witnesses have said that Casey was a good mother.
10:56 Lyon: Prosecution not seeking the death penalty "in good faith." Only one aggravating factor met - child under 12.
10:52 Court has to insure that prosecution's decision to seek death penalty is not born of impermissible motives.
10:49 Dr Lyon now arguing motion to preclude death penalty. She says State is looking to get a pro prosecution jury. Prosecution believes Casey killed her daughter because she didn't report her missing. State's case is 100% circumstantial.
10:48 Judge will decide later today or tomorrow, but seemed to imply that he will allow it to play out in court.
10:44 Baez: Casey not being treated "like everyone else" in this case. Judge: "I will treat her fairly."
10:43 Judge will now hear motions on check fraud.

Apparently George's departure was short-lived.

Yes it was Brandi.  It did appear to be him that got up and left when Mr. Ashton was so eloquently discussing the application of the duct tape.  Holly Bristow and Mr. Schaeffer were intently watching both KC and the Anthony's while Mr. Ashton was speaking to the application of the tape.

Exactly one year after Caylee Marie Anthony's remains were found, defense lawyers argued why a judge should prohibit prosecutors from seeking the death penalty against the toddler's mother.

Casey Anthony's attorneys argued that motion and several others at a hearing this morning before Orange County Circuit Court Judge Stan Strickland.

The hearing began about 9:30 a.m. The courtroom is packed with media and local members of Texas EquuSearch. Casey Anthony's parents, George and Cindy Anthony, attended.

Strickland first heard arguments from defense attorney Diana Tennis, who represents private investigator Dominic Casey.

In their motion, filed in September, Casey Anthony's defense argued state prosecutors do not a have "legitimate interest" in seeking the death penalty against her.

The defense said there isn't enough evidence to establish sufficient aggravating circumstances to recommend the death penalty.

I share your disgust.  You are so right, this could have been over a year ago.  I keep thinking about when I heard the news that Caylee was found.  I had to pull over the car and cry.  (And I'm not much of a cryer.)  Thank God that the State of Florida has such competent and compassionate representation.
