Hi, Monkeys!  (Good morning, Trimm, thanks for all the updates!)
I've been sick with the flu the last couple of days.  (You know I'm ill when I can't lift my head to check in with my monkeys!)  I did see something interesting on another blog,
Casey's application for indigency before her first appearance.  While I can't copy it without adding a link to that blog, (I've got the document in Adobe Acrobat, but it won't paste here, someone help!) it's interesting in that Casey says she has an income of $1400.00 biweekly and savings of $1200.00.  Also, I saw her first appearance at court with her public defender, (pre-Baez) and the bemusement in the Judge's voice at her lack of remorse is very apparent.

I think her income was crossed out, it appears to be initialed by a DD as well.  http://blog.richardhornsby.com/wp-content/uploads/2009/12/20080717-Application-for-Indigent-Status.pdf

Good Morning Monkeys!

Good Morning tupelo......thanks for the link...she also says she has $66.00 ....that should read $600.00 per month expenses??  What expenses??

Monka, sorry to read you have been ill....so many people seem to have been ill over the holidays...hope you are feeling better.  Thanks for the link.  You are right about the Judge's voice....I also hear disgust!
Thanks, Sunny.  I'm still a little wobbly.  I had never seen this video before, which seems strange when I've followed this case so closely.  She is one cold, (dare I say frigid?) customer.

I remember the video.....but it was good to see it again......so many videos in this case.....sometimes it's good to go back and revisit them...there is no way the defense can argue against the videos...it's all right there .......the detachment, the arrogance, the coldness, the lack of concern.....sometimes I think all the State would really have to do is simply play all the video and the audio tapes for the jury. They would more than likely not have to udder a word to get a righteous conviction.

I seem to be here alone...oh well I also wondered who this was....Jeanene Barrett, a mitigation specialist with a degree in social work

Also works with Lyons and Mortimer....I think this is a big clue asas to how the defense might be trying to defend KC.....mitigating circumstances??

Mitigation Training Program

Training to save one life at a time

Mitigation investigation is both intensely personal and methodical. A mitigation specialist assembles the pieces of a client's life, whether they're birth records, grade school report cards, Boy Scout memorabilia or prison disciplinary records. A competent mitigation specialist also knows how to talk with a client and their family, sometimes about subjects such as child abuse and drug abuse. These skills are only part of the foundation of what a good mitigation specialist must do to present a compelling narrative about a client's life. The Mitigation Training Program builds upon that foundation, training specialists to obtain the best possible information to make the case for life.

Individuals currently conducting a mitigation investigation in a pending capital case will be given a preference among applicants to this program. All participants must sign a confidentiality agreement promising to safeguard the details of the cases discussed at the seminar. During the course, participants will meet in several plenary sessions to hear experts discuss subject areas critical to a successful mitigator, including psychological testing, interview techniques and working with the client's family. Additionally, group break-out sessions will be held daily to further explore subject areas from the plenary sessions in the context of participants' pending cases.

The Mitigation Training Program strives to equip participants with the tools needed to provide excellent representation to capital defendants throughout the country. By safeguarding the rights of capital defendants through effective advocacy, we hope the Mitigation Training Program will reform the administration of criminal justice by saving one life at a time.

The 2009 Mitigation Training Program will take place in May in Chicago

Attorney of Record in Record Time

Thanks tupelo!  It should be pretty ease to find out if JB ever handled a traffic ticket for JG shouldn't it?  We can get BOO to ask RG

Great Idea see me-

I already have, The answer is no. You would think since Mr. Hornsby went to great pains to look up the court records in his piece he could have done the easy part.

Moreover, if Baez had represented JG in any way, considering part of the defense strategy was to go after him, he would have a conflict of interest situation on his hands, potentially requiring a release from him.

Anybody think that would ever happen?

There is no record of Baez/JG, so why do an entire piece to state the obvious which we already knew, and then tag a rumor (unfounded and easily verifiable) at the end drawing in JG?

Interesting... Do you think that the program is for defending the client or for request for leniency in sentencing after a conviction?  Maybe both?

That approach to defending kc ( mitigating circumstances) seems like the most logical but seems like there would have to be some form of acknowledging guilt. If there hadn't been so many accusations thrown around at so many people, had they tried to present kc in a more sympathetic light before it might have been better. It seems hard for me to believe that they don't have a definate defense direction already. How are they going to explain, who are they going to sacrifice as the killer???

Good afternoon Monkeys.  My understanding of the role of a Mitigation Specialist is that person collects a person's life story in efforts to determine any mitigating factors (things which will elicit sympathy and possibly render a life sentence) for which a jury should consider in the penalty phase should there be a Murder 1 conviction in the guilt/innocence phase.  Certainly, any evidence collected can be used in the guilt/innocence phase but more often it is used in the penalty phase.  Typically, the mitigation specialist has a background in social work or clinical social work.  They look for statutory mitigating factors, or those that are recognized by law and are defined by statute and the jury must weigh these against any aggrevating factors, as well as non-statutory factors or those things they deem as non-statutory (not defined by law) but which the defense deems they have proved and which should weigh against aggrevators.  The mitigation specialist really focuses on the defendant and thier life/social hsitory and interviews the defendant, family, friends and any others they deem relevant.    Here is a link to a short synopsis.  http://www.aclu.org/capital-punishment/mitigation-capital-cases-hofstra-publication

Thanks POOKY~      In my mind sometimes I just can't grasp the defense mentality. Go the full gauntlet of fantastical culprits, constant uphill battle to present kc as a wholesome mother, defiant stance about plea...... Wonder is is kc, herself, willing to wait it out, secure in her own pathological mind that she will not, can not be convicted. I don't understand why they do what they do.

Casey Anthony Update: Caylee Anthony's Death Case Moves Forward
December 29, 2009 by
Meg G.
A Casey Anthony update is warranted, as many individuals are following the story of the death of baby Caylee Anthony very closely. It's always very hard to imagine that a parent that is charged with providing tender,
Casey Anthony Update: Caylee Anthony's Death Case Moves Forward
Date: December 29, 2009
loving care to their children would be implicated in the baby's death. Of course, our judicial system is set up so that Casey Anthony, Caylee's mom is innocent until proven guilty.

Over the past year, the prosecution has released new evidence in the case - including many photographs. Some of these images show how the accused acted around the time her baby went missing.

What's shocking about the pictures that have been released is that Casey's overall look has went from quite racy to ... well, frumpy in the wake of the investigation. Some individuals think that she has changed her appearance to gain the sympathy of a jury of her peers.

Also shocking to many is that Casey Anthony was seen partying while her child was missing. Not very many mothers would be able to function - let alone get dressed up and go out - while their baby was gone. It was only after she was arrested that she started to look distraught.
It was recently announced that the accused is eligible for the death penalty. CBS Crimesider reports that the prosecution will seek the death penalty in this case. This is very serious, as in Florida there has only been 2 women put to death and one woman on death row. The woman currently on death row is convicted of burying a couple alive. One of the ladies that have been put to death is known as the "Black Widow." She also received a life sentence for drowning her child.

In addition to being charged with the murder of her daughter Caylee, Casey was also charged in September 2008 with 10 counts of fraud. She was also arrested in July 2008 for failing to report her daughter missing - which lead to charges of child neglect and lying to police. She allegedly didn't report Caylee missing for one month, and maintains that a babysitter kidnapped her.

Thanks for the visitor's log info, Sunny.  What I find interesting is that Yuri visited her on August 13th of this year for nearly an hour.  We haven't heard this before, at least I haven't,) so what's up with this?  Wouldn't Baez have to be present for this "interview"?
Maybe she was bored, and he is really cute, after all.  Monkey Devil!
Also, why was Mortimer Smith's visit called "other"?  Perhaps he was dropping off Christmas gifts...
