And if the Kalpoes have to appear for their deposition in California on or before June 1, 2010 then they must be expecting that the court date will be moved.  As of now the JURY TRIAL is still set for May 17, 2010.

Well so much for May 2010 jury trial getting closer.
The delays seem to be never ending.

I would say YES! .........................I would also say the Kalpoes would never pay.  However, I would think the Court could hold the Kalpoe's attorneys under sanctions as they condoned the fiasco. Courts look very dimly upon "officers of the court" playing games.

Klaas ... thanks for the update.  It would make sense that the Kalpoes would be required to appear for disposition PRIOR to the established court date.  The Kalpoes attorney have failed to complied with the court orders time and time again but ... the judge/s will not dismiss the case.
 
 

I do not know what the legalities are but ... if IIRC ... Kay Skeeters prevailed in the lawsuit brought by the Kalpoes against the estate of his late husband but ... it was her who was responsible for the costs incurred defending the lawsuit.

Thanks Wreck - that's what I figured and I know the Kalpoes would never pay.     So the Kalpoes are really between a rock and a hard place right now.   Monkey Devil!

As officers of the court lawyers have an absolute ethical duty to tell judges the truth, including avoiding dishonesty or evasion about reasons the attorney or his/her client is not appearing, the location of documents and other matters related to conduct of the courts

I don't know....we will have to look it up.  Doesn't seem like they could just slink back under

From the hearing on Friday 1/29/10 only one document.  It is the Minutes of the hearing.  Looks like the Kalpoes have been ordered to give their depositions in the USA

The irony of a Chicago law firm,NOT!Like 2k sat down and researched law firms in the USA.... Be interesting to know who was in the room when the decision was made for the lawsuit to move forward,and who chose the FIRM!Seems they weren't to concerned with travel costs,barring this firm doesn't have an office in LA.
