Could it be that the reason that judge has not dismissed the case is that there are legalities which the Kalpoes' attorneys claim justify not conforming to McGraw's attorneys request for case documents.

1.  The Kalpoes are no longer suspects in the Natalee Holloway case and/or ...
2.  The Natalee Holloway case is still an open investigation.

Just speculating.

Holloway Case: New Kalpoe Documents

KELLY: I believe David Koch (ph), one of the attorneys for the Kalpoes actually signed a declaration at the court indicating that even if the court ordered the documents be turned over, they were not going to turn them over, which was sort of, for lack of a better word, arrogant on his part. The court did not necessarily like that.

But I can't see them both using the courts as a sword and then a shield. They can't bring this action, they can't seek damages and not obey the orders of the court and expect their case to go forward.

Can you believe our mild weather and ... the 2010 Winter Games just two weeks down the road.  We are hosting out-of-town guests from the States ... Eastern Canada and ... Japan.  Rooms are all ready.

Rather than forking out the big bucks for event tickets ... we justified a purchased of a large screen television.

The way I understand it -- the judge in this "pre-trial" stage cannot make a judgement about the "merits" of this suit -- he can only rule on whether one side or the other is following the law and information requests. He cannot simply say that the "Kalpoes" are public figures -- that is for the trial.

It sure is cold.  I went to dinner tonight with my sister and when we got in the car she had the seat warmers on.  I always turned them off but tonight I didn't.
