Baby Gabriel Case: Second Arrest, Still No Sign of Missing Child (with video)
Tammi Smith Arrested Today for Custodial Interference, Forgery

It is the latest twist in the case of missing 8-month-old Gabriel Johnson: Tammi Smith was arrested this morning for forgery, custodial interference, and conspiracy to commit custodial interference, said police in Tempe, Ariz.

Smith, 37, was arrested at 11:10 a.m. at her home in Scottsdale, Ariz., according to the police. She and her husband, Jack, said they were in talks to adopt Gabriel before he disappeared in December.

Sources told ABC News that authorities do not believe Smith knows Gabriel's whereabouts. She was arrested for her alleged involvement in a wrongful adoption.

Smith's attorney, Michael Kimerer, said there would likely be a bond hearing this evening after she is transferred to the Tempe, Ariz., jail.

The Smiths were previously named as persons of interest in Gabriel's case. Police served a search warrant on their home, believing the two may be withholding information. Police took their phone records and laptop.

Kimerer said Smith has always been forthcoming in her meetings with the police.

"When Tammi went and visited the police she told them everything she knows," he said.

Gabriel's mother, Elizabeth Johnson, and the boy's biological father, Logan McQueary, were in the middle of a custody dispute when Johnson fled Arizona with Gabriel before Christmas. She allegedly sent text messages to McQueary, saying she had killed their son and left his body in a trash bin.

Gabriel Johnson before his disappearance was arrested Tuesday morning, almost a month after being named a person of interest in the case.

Tammi Smith, 37, of Scottsdale, is facing charges of custodial interference, conspiracy to commit custodial interference and forgery, all felonies.

Police arrested her at her home in the 16500 block of East Desert Vista Trail in north Scottsdale shortly after 11 a.m. She was taken to the Tempe Police Department before being sent on to a Maricopa County jail to be booked. Police are planning an afternoon press conference to release more details.

Police have said for nearly a month that they believe Tammi Smith and her husband, Jack, know more about Gabriel Johnson's disappearance and named them persons of interest on Jan. 7.

The 9-month-old boy has been missing since his mother took off with him on Dec. 18. Elizabeth Johnson, 23, was arrested in Miami on Dec. 30 without the child after spending about a week in San Antonio. She has been indicted on kidnapping, child abuse, custodial interference and conspiracy to commit custodial interference.

Logan McQueary, 25, the child's father, told reporters he felt extorted by the Smiths and said they told him Johnson would return if he would sign over his parental rights, something they had asked him to do for several weeks after he broke up with Johnson.

Tammi Smith told The Arizona Republic last month that she texted and called Johnson up until her arrest. Smith insisted she was trying to find out where the baby was and coax Johnson into returning to Arizona.

The child was last seen with his mother in San Antonio, where she spent Dec. 22 to Dec. 27 at two motels in the city. She then left her car at a Motel 6 next to a bus stop.

Johnson has refused to talk to investigators, but she told a local television station
that she gave the baby to a couple she met in a San Antonio park.

While on the run, she texted the baby's father. He said she told him in a subsequent phone conversation that she killed Gabriel and was leaving the country. Police tracked her cell phone to Victoria, Texas, according to court documents. Police have recently said hope of finding baby Gabriel dead or alive is waning.

Early in the investigation, police questioned Jack and Tammi Smith, who said they had temporary guardianship of the child for about 10 to 12 days at the beginning of December.

A Tempe police detective saw paperwork on the guardianship while at the Smith home checking on the baby last month, though they were not court-issued documents, so the papers' authority is unclear, Carbajal said.

Smith said she met Johnson at an airport during a layover. She spotted the young mother and said she looked tired and depressed. Smith said she went up to Johnson and asked if she was looking for someone to adopt the child, and Johnson said "yes," though the father refused to sign over his rights.

Smith said she and her husband spent seven months trying to adopt Gabriel and that his parents wanted to give him up at different times. Johnson and McQueary never seemed to be on the same page, she said.

McQueary told reporters that that wasn't the case and that he never wanted to give up his child.

Smith told The Republic in a phone interview last month that she got a text from Johnson denying that she'd killed Gabriel and telling the Smiths that she sent the message to get back at McQueary.

"Neither of them want the baby," said Smith, who lives in north Scottsdale and owns a colon-hydrotherapy practice. "Most likely, she's left him with another family she's chosen like she had chosen us."
