Someone needs to explain to Ms. Smith that you can not be "exonerated" in a Plea Deal. Please join me and nearly 400 others who are saying on facebook page "No Plea Deal" unless it brings Gabriel home. If Tammi is innocent then she needs to go on with her trial. Maybe she is worried about what Elizabeth Johnson will say on the stand. We on "No Plea Deal" believe the trial may lead to information on where Gabriel is.

A Key Player In Disappearance Might Be Bargaining With Prosecutors

PHOENIX -- Gabriel Johnson has been missing for nearly nine months and one of the people who last saw him might be cutting a deal.

Tammi Smith, the wife of the couple who has been involved in the Gabriel saga since the beginning, on Monday said her attorneys are looking at a possible plea bargain on her forgery charge.

Police said Smith used a phony name on paternity documents when Gabriel Johnson's mom, Elizabeth Johnson, was trying to keep the baby from his father, Logan McQueary.

Smith said she doesn't deny putting her cousin's name on the documents, but she said she it wasn't supposed to mean anything. She also told CBS 5 News she's not guilty of the forgery charge or the conspiracy to commit custodial interference charge.

Smith said she doesn't want a plea bargain because she expects her name will be cleared on all charges. Her next court date is set for Sept. 27.

Smith's attorneys wouldn't comment on a plea offer in this case, but said in any case it's certainly a possibility.

Meantime, officials still have not been able to find missing baby Gabriel Johnson. His mother, Elizabeth Johnson, remains in custody in Maricopa County in connection with his disappearance.

Baby Gabriel's Mother Ruled Competent for Trial, Still Not Saying Where Child is

PHOENIX (CBS/KPHO) Baby Gabriel Johnson is still missing and his mother, Elizabeth Johnson, is still not talking to investigators about what happened to the infant, but Phoenix prosecutors have gotten one step closer to putting the young mother on trial - she's been declared competent to assist in her own defense.

Johnson disappeared with Gabriel on Dec. 26, 2009, but when police finally picked her up Dec. 30 in Miami, little Gabriel was nowhere to be found. The 23-year-old mother told police she gave the then 8-month-old child away to strangers in San Antonio, where her car was found. But she allegedly told a different story to the baby's father, Logan McQueary, in a text message, saying she had killed the baby and would tell him where to find Gabriel's "little blue body" when she was "safe" adding coldly "if the garbage don't [sic] come first."

She has since refused to speak to anyone about Gabriel's fate.

Elizabeth Johnson had previously been found incompetent in June, but a judge ruled Thursday that she's now able to understand the charges against her and assist in her own defense after she finished court-ordered treatment and therapy, according to CBS affiliate KPHO.

When Elizabeth Johnson disappeared she was reportedly in negotiations with a Tempe couple to adopt baby Gabriel in order to keep the child from McQueary. Jack and Terri Smith were quickly named as persons of interest in Gabriel's disappearance and were charged with forgery and conspiracy to commit custodial interference. Investigators say Terri Smith signed her cousin's name on Gabriel's birth certificate in order to get McQueary out of the picture, KPHO reported in January.

But now Tammi Smith may be negotiating for a plea bargain, her next appearance is scheduled for Sept. 27.

Elizabeth Johnson has been in the Maricopa County Jail since her arrest, no court date has been set.

Baby Gabriel's mother found competent for trial (with video)


Both the defense and the prosecution now agree: The mother of missing baby Gabriel Johnson is competent to stand trial.

The issue had been a matter of debate. In June, Elizabeth Johnson, 24, of Tempe, was found to be incompetent to understand the proceedings and to assist in her defense.


In August, a court-appointed doctor determined that Johnson was competent to stand trial.

At the time, her attorneys fought that ruling, and an evidentiary hearing on Johnson's competency was scheduled for Thursday.

Instead of continuing to argue the ruling, Johnson's defense team agreed on Thursday to skip the hearing and sign a stipulation that Johnson is competent. Her next court date is Monday.

"Miss Johnson does understand the proceedings" and is capable of assisting in her defense, Maricopa Superior Court Commissioner Stephen Holding said. "Therefore, she is competent to stand trial."

What was missing from the brief hearing was the defendant. It was at least the third hearing she has refused transportation to court, said her grandfather, Bob Johnson, of Scottsdale.

"The first time she barricaded herself in her cell," he said.

Since Johnson is on full restrictions for poor behavior at the Maricopa County Estrella jail and cannot receive visitors, her grandfather attends the hearings for a glimpse of her.

"I miss her," he said. "I'm here to let her know that I am still involved and that I still care."

Arpaio's tune soon changed after Johnson assaulted two other prisoners, was thrown in the jail's loony bin, and placed on Joe's "loaf" program.

Sheriff Joe says he probably wouldn't eat his "loaf," either.

​The Maricopa County Sheriff's Office announced yesterday that Elizabeth Johnson, the mother of missing baby Gabriel Johnson, had been moved from the jail's general population to the its loony bin after assaulting two other inmates and then refusing to eat some of Joe's "loaf."

Despite Sheriff Joe Arpaio's public touting of Johnson as the model inmate, Johnson assaulted the two inmates by spraying cleaning products in their eyes and was placed in Joe's controversial loa program.

As you read yesterday, the loaf program, according to the Sheriff's Office, was created about 10 years ago to "prevent inmates from assaulting detention officers and other inmates."

Loaf, according to the MCSO, is nonfat, dry milk powder, an assortment of fruits and vegetables, chili powder, and bread dough compacted into one solid brick-like thing, which Arpaio forces inmates to eat when they misbehave.

According to Arpaio's office, after she was placed in the loa" program, Johnson gave a detention officer a document she called "My Advanced Directive's Will," in which she said she was starving by refusing to eat Joe's loaf because it was full of rotten vegetables and worms.


After refusing to eat the loaf, Johnson was tossed in the nut house for "evaluation."

From the sheriff's description of his loaf, Johnson's refusal to eat it sounds perfectly sane to us -- and the sheriff seems to agree.

After refusing an interview with New Times, Arpaio spoke to KPHO, telling the station that while his loaf isn't very appealing, it's nutritious and edible.

Then America's self-proclaimed "toughest sheriff" says he probably wouldn't eat it.

"I don't see any worms in there, but it's hard to tell, you know. Quite frankly, I don't know that I'd eat this," Arpaio tells KPHO.

But Elizabeth Johnson's refusal to eat the crap is grounds for a psychiatric evaluation?

Sorry, Joe -- we won't argue that Johnson doesn't belong in the loony bin, but...

A woman accused of kidnapping and custodial interference in the "Baby Gabriel" case has been ruled competent to stand trial by an Arizona court commissioner. Maricopa County Superior Court Commissioner Steve Holding upheld an earlier ruling by two court-appointed doctors who examined Elizabeth Johnson, mother of baby Gabriel Johnson.
Gabriel was last seen Dec. 26, 2009 in San Antonio, Texas. He was 8 months old at the time.

Attorneys for Elizabeth Johnson had appealed the ruling because they did not receive the doctor's report concerning her competency until the day of the August 12 hearing.
Custody Dispute Gone Bad

"We wanted additional time to review the report and have our experts take a look at it," defense attorney Nicholas Alcock told reporters. "We wanted to be in a position to digest
what the findings in the report were. We have submitted that report to the judge, and basically, it is our belief, as is our client, not to cause any unnecessary delay in the proceedings."

Johnson, 24, is being held on $1.1 million bond on charges of kidnapping, child abuse, custodial interference and conspiracy to commit custodial interference.

Locked in a custody dispute over Gabriel with the infant's father, Logan McQueary, Johnson sent him a text message saying that she had killed the child, stuffed his body in a diaper bag and put him in a dumpster.

Landfill Searched for Baby Gabriel

 After she was arrested, however, Johnson told police that she gave baby Gabriel to a couple that she met at a park in San Antonio. Since that statement, Johnson has refused to cooperate with police in trying to locate the baby. It is not known if Gabriel is dead or alive, although investigators searched a landfill in response to the text messages she sent to McQueary.

Another hearing is schedule in the case today to set a timeline for the trial.

Women in case of missing Ariz. baby to be in court

PHOENIX — The mother of an Arizona baby missing since December and his would-be adoptive mother are scheduled to be in a Phoenix courtroom Monday morning.

Elizabeth Johnson and Tammi Peters Smith are scheduled for pretrial conferences in Maricopa County Superior Court.
