Also filed was a letter from an Estrella jail religious advisor who says she gives spiritual counseling to Johnson.

"Elizabeth has been completely cooperative and responsive," wrote the advisor, E. Joy Marshall. "She has manifested willingness to learn and to grow and has consistently displayed an outstanding attitude and commendable effort . . . "

For several months, Johnson was placed full restrictions for poor behavior at the jail and could not receive visitors or make phone calls.

PHOENIX -- He says he did nothing wrong, but his questioning of missing baby Gabriel's mother, Elizabeth Jhnson, could possibly destroy the whole case against her.

Johnson is charged with kidnapping Gabriel, and San Antonio police are investigating her on suspicion of murder.

Detective Jesse Salame interrogated Johnson without her lawyer's knowledge in the Estrella Jail last summer.

Recording: Detective Says Elizabeth Johnson Admitted Killing Baby Gabriel

In an audio recording obtained by CNN affiliate KPHO, a San Antonio police detective reportedly told missing baby Gabriel Johnson’s father that the boy’s mother admitted to killing him when he interviewed her in jail last summer.

According to KPHO, Detective Jesse Salame called Logan McQueary and attempted to explain why he questioned Elizabeth Johnson without her attorneys present—an action that the defense has tried to use as a basis for dismissing the kidnapping case against her.

In the recorded call, Salame reportedly states that Johnson said she killed the 8-month-old child because “she was frustrated with everything and frustrated with you and frustrated with Tammi [Smith]” and she didn’t want either of them to get custody of Gabriel. KPHO also reports that Salame claimed he was close to getting her to tell him where Gabriel was when her attorneys interrupted them.

On Monday, Johnson refused to attend a status conference in Maricopa County Superior Court where a judge scheduled arguments for March 1 on her attorneys’ motion to dismiss the case. A supplement to the prosecution’s response to that motion was ordered sealed, along with their objection to Johnson’s waiver of appearance at court hearings.

Yes.  There are so many who have acted badly with their own agendas.  Sadly, I do not believe that Gabriel will be found, but I do wish that all who contributed by their actions face court and get punished.

Oh my it sure would be interesting to hear what a professional psychiatrist would have to say about this letter.  She is nuts.  Thank you so much for all the updates on Northern, it is terribly sad but I think this case has gone cold. I hope beyond hope EJ stays incarcerated and that Tammi Smith pays in some way shape or form for polarizing this entire tragedy.

PHOENIX -- The case against Tammi Smith, the woman accused interfering with the investigation into the disappearance of Gabriel Johnson, is moving forward.

On Monday morning, Maricopa County Superior Court Judge Paul McMurdie denied a motion by Smith's attorney's to have her case sent back to the grand jury.

Smith is charged with conspiracy to commit custodial interference and fraud in the case of missing Tempe baby Gabriel Johnson.

In less than two weeks, an attorney representing the Tempe mother of missing "Baby Gabriel" Johnson will argue before a Maricopa County Superior Court judge and prosecutors to drop the charges against her and dismiss the case.

Elizabeth Johnson, who told authorities she gave her son away, has also said that she killed him.

On March 1, Attorney Daniel Raynak plans to pick up where Johnson's former attorney Nicholas Alcock left off in contending that her Sixth Amendment rights were violated when Jesus Salame, a San Antonio police detective, interviewed her in jail without her legal counsel present.

Tammi Peters Smith of Scottsdale, who once was interested in adopting the boy, is charged with forgery and conspiracy to commit custodial interference in connection to the case. Johnson claims that Smith arranged for her to give Gabriel to a couple she didn't know at a park in San Antonio. On Monday, Maricopa County Superior Court Judge Paul McMurdie denied Smith's motion to have her case heard before a new grand jury.

Johnson's grandfather, Robert Johnson of Scottsdale, said Elizabeth calls him almost every day, and she is optimistic that the case against her will be dismissed.

"That's no surprise," he said. "Personally, I would like to see that happen, but I think the judge is going to have a helluva hard time dismissing the case on a technicality when they don't know where the baby is. If Elizabeth's constitutional rights were violated, does that override the fact that they still don't know where the baby is?"

He added, "Elizabeth always said that Tammi orchestrated the whole thing and she would be the best one to talk to. I did not believe or understand this in the beginning, but Tammi's in trouble, too - and I think she knows where the baby is."
