Well, what might SP's defense be...accidental or one of his adult children are responsible?  Bet the mentally unstable son gets thrown under the bus.

That would be my guess (bolded by me in above)

   but I don't think it will fly..if it was found on all the computers in the house ..and the personal computer of Steve's..which I think it was..then I just don't think that will fly.  I think they are going to have to get more creative to get out of this one.

Maybe he could have tried to blame someone else if he hadn't taken so many pictures of himself as well.

Lake Erie Princess, I haven't come across any recent news about the charred wood pieces and clothing.  IIRC, LE said that it will take them three months to go over all of the things that they have collected regarding the investigation.

A Pierce County Superior Court judge in Tacoma, Wash. on Thursday granted a motion to continue the Nov. 16 trial date scheduled for 61-year-old Steve Powell. The judge set a new tentative trial date of March 20 and continued a so-called omnibus hearing in the case to Jan 12. At that hearing the judge can rule if certain evidence will be admissible at trial.

The child pornography and voyeurism trial for the father-in-law of missing Utah mother Susan Powell has been delayed until next March.

Steve Powell was arrested last month after investigators who searched his Puyallup home said they found more than 1,000 images of women who had been videotaped without their consent, including Susan. He also was charged with child pornography for images he allegedly took of young neighbor girls in the bathtub and on the toilet.

Powell has pleaded not guilty and is being held on $200,000 bail.

He did not appear at a pretrial hearing Thursday where his trial was delayed from next month to March 20.

"The hearing has been canceled due to a legal agreement," said the Coxes in a statement posted on the Friends and Family of Susan Cox Powell Facebook page Monday. "The children remain in state custody most likely through January. The grandparents welcome additional time with the boys."

The Coxes have also asked the court to appoint a guardian ad litem, an attorney who would represent the interests of the boys alone in court proceedings. The Coxes stated in their request that the children were having some difficulties with the custody situation.

I wonder what it means  "the hearing has been cancelled due to a legal agreement"?  And the article says the boys "remain in state custody most likely through January."  Since it says the Coxes welcome the additional time with the boys, I assume that's who they'll continue to stay with through January.  I wonder if any of this has to do with the psychological testing Joshua had to undergo to show he would be a good father if he had custody?  (Not sure of the wording)  Maybe he had issues that showed up? 

I think it's excellent the Coxes have requested a guardian ad litem for the boys.  I wonder what kind of difficulties the boys are having with the custody situation?  Maybe they don't want to keep seeing their father or they're afraid they'll have to go back to live with him?  The Coxes did well in asking for a guardian ad litem.  That way, the boys won't be pawns in the court, between the Coxes and the Powell's.  The guardian ad litem will represent the boys, right?  And the boys alone. And that's important, imo.  Especially after Josh's mom made the statements about how good a father Josh was.  I hope the Coxes are granted permanent custody of their grandsons soon.

Here's some information about the Utah Guardian ad Litem attorneys; they are assisted by court appointed volunteers referred to as CASAs (Court Appointed Special Advocates).  They work with the attorneys to represent the best interest of the child.  Sounds like a nice arrangement.

PUYALLUP, Wash. — The father of missing Utahn Susan Cox Powell says his grandsons are doing well living with him, but he wants information about his son-in-law's psychological evaluation, financial situation and information about whether he's moving.

In September, a Washington judge gave temporary custody of Josh and Susan Powell's two sons, ages 4 and 6, to Chuck and Judy Cox, Susan Powell's parents. The decision came following the arrest of Josh Powell's father, Stephen Powell, on voyeurism and child porn charges and in light of the ongoing investigation into the disappearance of Susan Powell.

A follow-up court hearing originally scheduled for Tuesday has been continued until next year.

But in newly filed documents, Chuck Cox updated the court on how his grandsons are doing at his Puyallup, Wash., house.

Cox noted that the boys were seeing both a counselor and a therapist who was working with them "on a number of issues," according to court documents.

While one of the boys seemed to be complying with the therapist, the other has been "somewhat reluctant" to work with her, Cox said in his court filing. Although he is doing well in school, Cox said the boy was "having nightmares" and was "afraid of the dark."

Finding any remains would end the nearly two-year mystery of Powell’s disappearance, giving her family answers and providing something else: evidence. But in the absence of discovering a body, bringing any criminal case in connection with Powell’s disappearance is a lot tougher.

Police have said little about what evidence exists in the case, but University of Utah law professor Daniel Medwed said the lack of a body would make it difficult, but not impossible, to file a murder charge.

“You basically need to have a mountain of circumstantial evidence,” Medwed said.

That circumstantial evidence would have to show the person is dead, was murdered and who did it. But a murder case with no body creates an obvious counterargument for the defendant.

“I could envision a defense attorney here saying, “Well ... we don’t have a body. We don’t even know that she’s dead,’” Medwed said.

West Valley City police Chief Buzz Nielsen said last week police are still waiting for laboratory testing of ashes discovered by cadaver dogs during the Topaz Mountain search that may contain human remains, and they are continuing to sort through a trailer full of evidence taken from the Puyallup home.

As Utah authorities work to solve the mysterious disappearance of Susan Cox Powell, Washington officials are focused on another unresolved problem: what’s best for her two young sons.

For now, Charlie, 6, and Braden, 4, are living with Chuck and Judy Cox, their maternal grandparents, in Puyallup, Wash. But where they will live permanently depends on the outcome of two court cases.

A Jan. 19 review hearing is set in the child welfare action brought by the state’s Division of Children and Family Services. A judge will then review how the boys are doing; what progress their father, Josh Powell, has made in addressing safety concerns; and whether any new services are needed.

“Everything is on the table at those review hearings,” said John Long, senior counsel in the Washington Attorney General’s Office.

Filings in that case are confidential, but according to a document filed as part of the second court case — a custody petition filed by the Coxes — Josh Powell recently signed an agreed dependency order that eliminates the need for a trial. That order likely spells out alternative plans for the boys’ future, including what their father must do to get them back.

In their case, Cox asked the court in mid-November to appoint a guardian ad litem, who represents children’s interests in court proceedings, so a custody investigation may begin. He also asked that they be allowed to review Josh Powell’s psychological evaluation.

Susan Powell's disappearance hits 2 year mark

WEST VALLEY CITY -- This week marks two years since West Valley mother Susan Powell went missing.

West Valley police have conducted several large scale searches for her, ranging from searching the home where her husband, Josh Powell, is living in Washington, to spending weeks in Utah's west desert and searching mines in Nevada.

Currently, Josh Powell remains the only person of interest in the case.

A court order prevents Susan's parents, Chuck and Judy Cox, from granting any interviews. They did, however, release a statement saying the case is still being actively worked and police have assured them the case will be solved.

News release

The Susan Cox Powell foundation announces that December 7, 2011 marks two years that Susan Powell, the daughter of Chuck & Judy Cox has been missing.

Susan Powell vanished from her home in West Valley City, Utah and was last seen by her husband Joshua Powell around midnight as he left for a camping trip with their two young boys, ages 2 and 4, with a blizzard approaching. Joshua Powell remains the only person of interest in Susan's disappearance.

The case is still being actively worked and police assure the family that the case will be solved.
