Two years ago today, Morgan Harrington disappeared after a concert in Charlottesville. While her remains were found a few months later, the only clue police have to a suspect in the case is a forensic link with a Fairfax City sexual assault.

The Virginia Tech student was at a Metallica concert at the University of Virginia's John Paul Jones Arena on October 17, 2009. She left the venue and wasn't able to get back in.

Witnesses reported seeing her later that night hitchhiking. She wasn't seen again.

The last reported sighting of Morgan Harrington alive placed her on a bridge in Charlottesville trying to hitch a ride at about 9:30 p.m. Oct. 17, 2009.


This morning, Gil and Dan Harrington of Roanoke County, the Virginia State Police and others gathered at the Copeley Road bridge to focus renewed attention on the abduction two years ago of the Harringtons’ 20-year-old daughter, then a student at Virginia Tech, and her subsequent homicide.

Security agency sued in Harrington death
Morgan Harrington's mother said guards should have let her daughter re-enter a Charlottesville concert two years ago, on the night she later disappeared.

Gil Harrington, as administrator of her daughter's estate, seeks $3.5million from Regional Marketing Concepts Inc., doing business as RMC Events.

The lawsuit was filed Oct. 11, less than a week from the second anniversary of Morgan Harrington's abduction. She was last seen alive attempting to catch a ride on a bridge near the John Paul Jones Arena, where the concert headliner was Metallica.

The lawsuit alleges that RMC, providing event security that night, should have known that Morgan Harrington had suffered an injury inside the arena and also should have allowed the young woman to return to the concert after she had left the building.

The lawsuit reads, "As a result of the defendant's failure and refusal to allow plaintiff's decedent to re-enter the arena, or report her attempt to do so, plaintiff's decedent was left isolated and alone outside the arena where she was subsequently abducted and murdered."

Dan Schmitt, president of RMC Events, said he could not comment on the lawsuit.

The lawsuit also alleges that RMC Events personnel should have known that Morgan Harrington had "suffered an injury to her face" after leaving her seat in the arena to go to the restroom because the injury had been reported to event staff. Schmitt said he could not comment on this specific allegation.

State police investigators have said they believe the young woman might have fallen on the concourse and hurt her chin. They've acknowledged also that Morgan had been drinking that night.

I believe I read somewhere that one suspicion is a "security" type person at or around the arena was thought to be involved.  We have conclusive DNA from Morgan that an African male was involved with her murder somehow.  Surely, narrowing down the "security" that evening has been done??

University Police Lt. Melissa Fielding said RMC Events Inc. hired its own security for the concert that took place at the arena.

“We are here for law enforcement purposes and safety is a part of that,” Fielding said. “[But] the police department was not notified that Morgan was in need of assistance [Saturday night] … by any citizen or any member of the security group.”

Online court records for Roanoke County Circuit Court list the claim as a “catch-all” complaint. Law Prof. George Rutherglen said this label denotes “miscellaneous civil action.”

The current policy for arena re-entry is the same. The John Paul Jones Arena website states, “exiting and reentering with the same ticket is not permitted.”

Rhonda Rogers, senior deputy clerk for the Roanoke County Circuit Court, said no trial date has been set for the Harrington case. “It’s up to the parties involved,” she said. “If they settle beforehand there is no trial.”

In a press conference Monday, the Harringtons continued to push for anyone with any information about the case to come forward. “It doesn’t matter how small it is,” said Dan Harrington, Morgan’s father. “We need to remember that the person who did this is still at large.”

The $3.5 million suit against Regional Marketing Concepts Inc., doing business as RMC Events, was filed October 11 in Roanoke. While the president of RMC Events has declined to return our phone calls, the Hook caught up with Morgan's mom, Gil Harrington.

Why the lawsuit?
Gil: Questions remain about what happened that night, and this is about retaining our ability to ask those questions.

Why now?
Gil: We really had been considering it, and the statute of limitations was beginning to run out.

Sexual assault cases on VA campuses rarely result in criminal prosecution

The Richmond Times-Dispatch released an analysis of forcible sex crimes at seven Virginia universities this week which found that no cases involving student-on-student assault resulted in criminal prosecution from 2008 through 2010.

In the 15 crimes reported at the University between those years, only two people were accused and convicted — neither of whom were students.

The Times-Dispatch analysis also showed that Virginia Tech was the only university to report it had expelled a student for sexual misconduct.

Claire Kaplan, director of Sexual and Domestic Violence Services at the University’s Women’s Center, confirmed the findings of the study, saying “it addresses some of the problems that prosecutors have.”

The study revealed that victims rarely pressed charges and if they did it was very hard to prove their allegations because of a lack of evidence.

“I’ve been in this office for more than 20 years and can count the number of criminal charges that were filed against U.Va. students for sexual assault on two hands,” Kaplan said.

Allegations of sexual misconduct are typically handled by University police. Former University student Kathryn Russell took issue with that policy after a student she accused of raping her was acquitted by the University’s Sexual Misconduct Board.

The Russell family is now pushing for Kathryn’s Law, or House Bill 2490. This proposed legislation would transfer oversight of investigations concerning sexual assault cases on college campuses in Virginia to local or state law enforcement, bypassing university police departments.

The Virginia State Crime Commission is currently considering the bill. Dan and Gil Harrington, parents of the slain Morgan Harrington, have voiced their support for the legislation. They are scheduled to speak with the commission about HB 2490 tomorrow.
