Does anybody know how long EJ will be in Prison based on her charges alone?

On Websleuths, someone mentioned that if she told someone where Gabriel was she would only get a very short time in prison.

PHOENIX (CBS5) - The mother of missing baby Gabriel was back in court Friday morning.

Elizabeth Johnson still didn't offer up any details about where her son might be.

The judge in the case ruled Friday that as long as she gets her medication, she is competent and will stand trial in September.

Johnson hired a new attorney, named Marc Victor, who asked for more time to familiarize himself with the case.

The case could get delayed even further because the judge will soon be transferred out of criminal cases.

In another court maneuver and attempt to keep Elizabeth Johnson in check, a clinical liaison has been appointed to make sure the mother of missing “Baby Gabriel” stays on her medication so she remains competent to stand trial.

Yet, the beginning of that trial, which was supposed to start early last month, remains at least seven months away.

Johnson, who has been charged with kidnapping, child abuse, and custodial interference, is scheduled now to go to trial in September. Since her arrest in 2009, Johnson has remained incarcerated in a Maricopa County jail on a $1.1 million cash bond. In a case that has received national attention, Johnson has both said she killed her son and gave him to a couple she didn’t know in San Antonio.

The trial will provide Johnson, 25, the second time to answer questions as to what she did with Gabriel, who was 8 months old when she took him to San Antonio in late December 2009 while in the midst of a custody battle with Logan McQueary of Gilbert, Johnson’s estranged boyfriend and the father of the boy.

2 women about to face trial in baby Gabriel's disappearance

Now, both women are just days away from facing trial for his disappearance.

According to a memorandum filed by her attorney, Smith's psychologist said she acts impulsively without reflection where children are involved.

In Arizona, that's not allowed to be used as an excuse for a crime but her attorney believes it helps explain why she would help Johnson escape the state with her son, Gabriel.

Smith said her plan was to adopt the boy without his father's knowledge but once Johnson drove across the state lines, the boy was never seen again.

"It's in her nature to feel compelled to help, because of her religious beliefs, again because of her family background. She feels compelled to help, particularly when she perceives a woman in trouble or child in trouble," said Smith's attorney, Anne Phillips.

According to the filing, Smith is easily manipulated in stressful situations, in part to a history of abuse from her father and first three husbands. Because of that history, her psychologist said she is naively and unrealistically trusting.

"Her character in general causes her to act a certain way. Not with criminal intent but more in a misguided attempt to help," said Phillips.

Prosecutors are trying to keep Smith's psych evaluation out of court and are expected to paint her as a woman obsessed who would do anything to adopt Gabriel.

Smith's attorney predictably disagrees.

"What I think happened is that Tammi, a good citizen, a good Samaritan, a law-abiding person, got involved with the wrong person and it spiraled out of control," said Phillips.

I tend to agree with the prosecutors.  I'm of the opinion it wasn't merely a matter of being a good citizen, Tammi Smith had an agenda, and that was to adopt Gabriel.

Jury selection began Monday and opening arguments are scheduled for next Tuesday in the case of Smith, 40, who is charged with forgery and conspiracy to commit custodial interference in her alleged role in Gabriel's unknown fate.

PHOENIX - There's new information surrounding a missing child's father. Logan McQueary is back in trouble with the law.

McQueary is the father of Gabriel Johnson, a boy who went missing in 2009.

McQueary has been arrested five times in the past eight years. The latest incident was for trying to sell a stolen Nintendo Wii at a pawn shop.

He'll be in court on Monday, just one day before the trial is set to start for Tami Smith, a valley woman accused of helping Gabriel's mother after she left the state

A "character trait" is going to be Tammi Smith's defense?  The defense seems to have had quite the brain storming sessions to come up with that one.     And it sounds like Tammi shouldn't be around children imo.

Significant moves ahead in missing baby Gabriel case

While Elizabeth sits in jail, a hearing has been scheduled for Monday morning to address her lack of cooperation with court personnel.

Also Monday, Gabriel's father, Logan McQueary is expected to turn himself in to face charges of trafficking stolen goods.

Baby Gabriel's Pops Logan McQueary Pleads Guilty to Another Crime; Elizabeth Johnson Skips Court Again

There aren't many consistencies in the case of missing baby Gabriel Johnson, except for the boy's pops lengthening his rap sheet, and Gabriel's mom not showing up to court.

Both of those happened again this morning.
