Jury to decide fate of Tammi Smith

PHOENIX -

Closing arguments were made Tuesday in the case of Tammi Smith, the woman accused of forgery and custodial interference in the case of missing baby Gabriel.

This case is now in the hands of the jury.

It has been five weeks of a very complicated trial, centered around 40-year-old Scottsdale mom Tammi Smith and her desire to adopt a baby.

In closing arguments, prosecutor Angela Andrews painted Tammi Smith as a desperate woman.

"We can show the defendant wanted to have a child of her own. She was doing everything she could to make sure she found a sibling for a child she already had," said Andrews.

The question is, did Tammi Smith break the law in her efforts to adopt 8-month-old Gabriel Johnson?

She is charged with forging a court document lying about who Gabriel's father was, and interfering with parental rights.

Smith is not accused in the baby's disappearance. It's the baby's mom, Elizabeth Johnson, who is in jail awaiting trial in the baby's disappearance.

To this day, no one knows what happened to the child.

Closing arguments in Baby Gabriel fraud case .

In her closing argument Tuesday, prosecutor Angela Andrews slammed Smith as a manipulative liar, saying, "The defendant wanted this child for herself. She wanted to make Gabriel Johnson her own and she was going to do that at any cost to Logan McQuery."

During her closing argument, Smith's defense attorney, Ann Phillips, told jurors that her client "was not obsessed" and that "it's not a crime to want to adopt" a child.

Phillips then laid blame on Johnson and on Tempe police, saying Johnson manipulated Smith and that Tempe cops "needed a villain."

I listened to the closing arguments.  I think the State did a good job.  I just hope the jury realizes how Tammi's words cooked her own goose.

Seahorse, I think TS created an environment that pushed EJ to the limits.  However, I still am unsure if TS didn't arrange for someone to take the baby.  It is so hard to comprehend with such effective liars as EJ and TS.

Today is 3rd day of deliberations.  At end of day yesterday they had only actually deliberated for 4.5 hours.  I hope I am wrong but I am feeling a hung jury coming up.

I agree with you Sister, she created an environment that pushed EJ limits, nicely
worded.

TS, helped ignited her rage and fury, to a point of no return. 

EJ, was a lone soul, without any plan.

I do think, Gabriel would still be here, if TS kept her nose out of the Custody issues.

TS gave EJ, a false sense of security. IMO
