I believe Elizabeth murdered little Gabriel too.  No way do I believe she gave him away to a couple.  I wish I could think it were true she gave him away, but I just can't, and I would love to be proven wrong.

I believe Elizabeth murdered little Gabriel too.  No way do I believe she gave him away to a couple.  I wish I could think it were true she gave him away, but I just can't, and I would love to be proven wrong.

I guess with the Caylee trial, this one, and so many little ones missing, I am becoming resigned to the fact that justice does not have to occur on earth.  But I sure wish it happened more.

I honestly think this woman followed how the Anthony's behaved and figured, if she kept her mouth shut long enough she would be released.   Even if a body was found it would be too late to determine cause of death and all evidence destroyed. 

I feel as if it is open season on children.

Judge: Baby Gabriel's mom will stay in jail
November 1, 2012
PHOENIX -- Baby Gabriel's mother was in court Thursday morning, hoping that she would be released from jail until her sentencing.
Judge Joseph Kreamer said that wasn't going to happen, explaining that the application of Rule 7.2c of Arizona's Rules of Criminal Procedures renders Elizabeth Johnson "non-bondable."
According to Rule 7.2c, "After a person has been convicted of any offense for which the person will in all reasonable probability suffer a sentence of imprisonment, the person shall not be released on bail or on the person's own recognizance ...."
Kreamer cited the jury's conviction on multiple felonies with aggravating factors, going on to say that he thinks "in all reasonable probability" that Johnson will get prison time.
Elizabeth's lawyer, Marc Victor, argued that Johnson's sentence could amount to time served. He also said Johnson could conceivably get probation for each of her convictions. Probation for Johnson has been his goal since he took on her case.
"Beating the kidnapping charges means, at the end of the day, she's eligible for probation on everything else," Victor told 3TV's Ryan O'Donnell less than 24 hours after the verdict was announced.
During Thursday's court hearing, Victor said people who have pleaded guilty to charges similar to those on which Johnson was convicted were usually released on their own recognizance.
"You haven't heard 'boo' from the defense in terms of mitigating factors," Victor said to Kreamer. "You could sit there right now and know, in your head, that there probably will be several mitigating factors that you will likely find, even without Elizabeth Johnson saying one word to the court. We know it's all in how you weigh it, Judge.
"At this point, right now, it's not appropriate for you to say there is a reasonable probability of prison because the way the offense sits right now, prison is not required."
Kreamer didn't disagree.
"I understand what you're saying," he replied. "But under the language of the rule from my perspective, the rule still applies. ... [Taking everything into account] I can see me giving her consecutive prison and giving her more time than she's spent. ...
"I want to make it very clear to you and to Miss Johnson I haven't made the determination yet," Kreamer continued. "I understand, based on my knowledge of the case, that there could be substantial mitigation presented. I have a duty and will weigh that. ... But as we stand right now under 7.2c, under that standard, she's non-bondable from my perspective."

Johnson, who chatted briefly with her defense team before she was escorted from the courtroom, is facing between two and nine years behind bars, but her lawyer says he will fight for probation.
Kreamer -- who handled the sentencing of Tammi Smith, the woman who wanted to adopt Gabriel, in July -- set Johnson's sentencing hearing for Dec. 7.

A Superior Court judge said the mother of a missing 8-month-old boy will remain in jail until her sentencing Dec. 7 and could face more jail time than the nearly three years she has already been in custody.

Judge Joseph Kreamer said during a status hearing Thursday morning that Elizabeth Johnson's three felony convictions on Oct. 18 make her non-bondable.

Kreamer said Johnson's case "could be the worst case of custodial interference in the world" and that it was likely she could face more jail time. However, Kreamer said he was open to changing his mind and said that evidence and witnesses could sway his decision.

Kreamer was originally scheduled to set the sentencing date for Johnson at 9:30 a.m. Thursday, but her attorney Marc Victor filed paperwork last week requesting her release because he claims she is not a danger to the community.

On Thursday, Victor argued against the judge's decision, saying it was "not appropriate to say there is a reasonable probability of prison" because all the charges are eligible for probation.

Really, Bob?  I thought by your statements earlier in this case that you had a better grasp on reality.  If EJ isn't the same person, why doesn't she disclose the whereabouts of your great-grandson.  Why do you let her get by with an illegal adoption, at best, or a murder, at worst.   

Sorry to say it, Bob, but you are in for a rude awakening and much more heartache from you granddaughter.

I have a nephew I love like a son.  He is 33 years old and has had one horrendous life.   Of course, when I re entered his life and visited him in jail, he just knew this was his answer.   And it was for about a month, if that.    Long story short,   he was returned to prison and has been there for two years or so.  I feel so sad for what this grandfather is about to endure if she comes into his home.

She could be released if judge gives her lower end of the sentencing scale.

Johnson faces between two-to-nine years behind bars in the case involving the disappearance of her missing infant son, Gabriel.
 
She's already been in jail for nearly three years and will get credit for time served...meaning she could be released if the judge hands down a lenient sentence.

PHOENIX (CBS5) - We are just hours away from knowing if Elizabeth Johnson will be a free woman. Her sentencing is Friday. Johnson was convicted of unlawful imprisonment and custodial interference last month in the disappearance of her son, Gabriel.

Gabriel's father, Logan McQueary, won't be physically in the courtroom tomorrow, but he's going to call in and make sure the judge hears what he thinks before Johnson gets her sentence.

"I'm just going to be explaining what we've done for the past few years and how much pain it's put a lot of people through in my family and I don't think she should get off lightly," McQueary said.

We've just learned Johnson plans to say something during the hearing.

"I expect that she'll explain that she feels bad about what happened, she is going to probably apologize and just say how she feels about the incident, why she did what she did," Victor said.

"Her apology doesn't mean anything to me. I wish she would just tell the truth," McQueary said.

Johnson's lawyer said her grandfather, grandmother and twin brother will also give statements tomorrow.  So will McQueary's father and a few other family members.

With her son still missing, Elizabeth Johnson could walk out of jail on Friday.

If Elizabeth is released, her grandfather Bob Johnson told ABC15 she won't be going to his house.

"If she should be so lucky to get out of there, she's got to go into obscurity," Bob Johnson said during an interview Thursday night. "She cannot come to live with me or her brother, it's unsafe for her, it's unsafe for us."

Bob Johnson said it's unsafe for him because he said many people don't like Elizabeth and it creates a safety concern.

Bob went on to say his granddaughter is not a bad person, only a person who has made bad decisions, but admits we may never know what happened to Gabriel.

"She did what she did and whether she's paid enough for it or not, that's to be determined," Johnson said. "I think that there's a real good possibility that we will never, I repeat, never know what happened."

Bob Johnson and Marc Victor both believe Gabriel is alive.
