Casey Anthony To Appear In Court Today
Accused Murderer To Go Before Judge Thursday Regarding Financing Defense

ORLANDO, Fla. --
Questions are arising in the case against Casey Anthony regarding who should foot the bill for her defense.

Attorneys for Anthony, who is charged with murder in the death of her daughter, Caylee, said she can't afford it.

An indigency hearing will be held Thursday at 11 a.m. at the Orange County courthouse to address the issue.

Both the state and Anthony's defense attorneys will talk about her financial problems.

Jose Baez, Anthony's lead attorney, said that since the state changed its direction to the possibility of a death sentence, Anthony's defense got even more expensive.

Baez said his client was willing and able to pay for her defense until the state changed their position and decided to pursue the death penalty.
In the past, Anthony paid Baez $90,000 in fees and Andrea Lyon, another of her defense attorneys, $20,000 for services.

WESH 2 has pressed Baez as to where the money came from, but he said he won't discuss the issue of money, citing ethical violation.

It is unknown whether Judge Stan Strickland will ask Anthony to talk more about where the money came from Thursday in court.

George Anthony is also expected to attend the hearing. Recently, a woman claiming to be his mistress said he told her Caylee's death was just an accident.

Casey Anthony's father denied the affair and the accident statement through his attorney.

Anthony, 23, is charged with first-degree murder. The remains of her daughter, Caylee, were found in a wooded area near the Anthony home in Dec. 2008. Anthony maintains that a nanny by the name of Zenaida Gonzalez kidnapped Caylee.

She will turn 24 years old on Friday.

Judge To Decide If State Will Pay For Casey's Defense

ORANGE COUNTY, Fla. -- Attorneys for Casey Anthony will ask an Orange County judge to allow taxpayers to pay for her defense at a hearing Thursday morning.

The Orange County Clerk of Courts already declared Casey indigent, but now a judge has to agree.

Even if the judge approves Casey's request, a state agency says it still has big questions. They want to get a good look at her bank accounts. How Casey was able to fork over thousands to her lawyers when she had no job, and how did that money run out are just two of the hard questions her defense will have to answer.

Casey's lead attorney Jose Baez has never explained where that money comes from. On Thursday, he may be forced to answer.

Hundreds of witnesses, piles of paper work and travel expenses could all soon become the financial burden of taxpayers.

At a hearing scheduled for 11:00am Thursday, a judge will decide whether taxpayers will foot the bill for Casey Anthony's legal fees. However, before that can happen, her defense team will have to prove to the Justice Administration Commission and the judge that she is broke.

Affidavits show Casey has already paid more than $100,000 in legal fees to her team that includes Jose Baez and Andrea Lyons.
Most defendants who are declared indigent get a public defender, but because Casey and her lawyers have already established a relationship she would get to keep them.

If Casey's request is granted by the judge, her team does not just get a blank check. She will only get money for state approved expenses like investigators and court reporters. Also, if the judge thinks Baez has misspent any of the money he has made, the lawyer could have to fund some of his own services.

SECRET INVESTIGATION COMPLETE

Meanwhile, a secret investigation into new evidence in the case against Casey is now complete.

Eyewitness News first reported last month when a judge gave prosecutors permission to keep the new information secret until an investigation was complete. It is possible, now that the investigation is finished, the judge will unseal that new information.

Just her orange jumpsuit? Hair in a bun? Little bit of ash smeared on her forehead? Come on, she's gotta look poor? I hope they wipe off her $4 a day cheese puff habit off her fingers first.

ORLANDO -- The State Attorney's Office has already spent more than $30,000 to prosecute the case against Casey Anthony.

More than $25,000 was paid to a forensic entomologist. Another $5,000 was paid to a University of Florida Soil and Water professor.

The State Attorney's Office tab for the case is already at $35,651.

Former Orange County prosecutor and defense attorney Will Jay says costs will go even higher as more witnesses in this case are deposed and more experts are needed.

News 13  compared this case to another Orange County first-degree murder case that just wrapped up.

A jury found Stacey Kananen not guilty of murdering her mother.

The case lasted about 2 1/2 years, and cost the State Attorney's Office a little more than $3,000.

Thursday's hearing won't be about prosecutors spending though.

Casey Anthony's defense has already collected more than $110,000 from her.  They're now asking that she be declared indigent.

Basically, they say she's broke and needs public money to continue her defense.

“And when the attorney fees are $110,000, the JAC (Justice Administrative Commission) is going to raise eyebrows,’ Jay said.  “And say, 'Whoa if you can pay that much in attorney fees, why should we think you're indigent for costs?’”

The JAC would hand out the money should Anthony be declared indigent.

JAC officials told the court already they have "severe concerns" regarding Anthony's request.

One drawback for the defense if their request is approved is every expense will be thoroughly examined, and it'll be public record.

“Once you're on the public dollar, everything will be up for review.  So the prosecutors will have their hats tipped off as to what the defense is up to,” Jay said.

If Anthony is declared indigent, that public money does not get spent on lawyers’ fees, only expenses.
   
There's a set list of criteria in Florida statutes that spells out how much money can be spent on a private investigator or travel expenses.
   
The hearing is scheduled for 11 a.m. Thursday.

The Orange County Clerk of Courts has declared Anthony indigent, but Circuit Judge Stan Strickland must approve it.

If the judge does, taxpayers will be on the hook for some of the costs to defend her.

Anthony is accused of killing her daughter Caylee. Her trial is scheduled to start in May 2011. Prosecutors are seeking the death penalty.

Who are the twin sisters saying that George Anthony described granddaughter Caylee’s death as an accident?

WKMG-Channel 6’s Tony Pipitone last night supplied some unflattering details, including their multiple arrests, in a first-rate report. The two women, who have numerous aliases, also have prior records for theft and attempted burglary of a structure, Pipitone reported.

Skye Benhaida, who is Cecilia Holloway, has said that her sister, Crystal  Holloway (also known as River Cruz), had an affair with George Anthony.  Crystal has said she had an affair with Anthony, the father of Casey Anthony.  Casey is charged with first-degree murder in the death of her daughter, Caylee.

Cecilia, however, doesn’t always back up Crystal’s version of events, Pipitone explained in a well-written report.

Cecilia wrote that sister Crystal is a liar in a 2009 letter to a judge, Pipitone reported. Cecilia’s allegation: Crystal lied that Cecilia’s husband had beaten up Cecilia.

Even so, Cecilia has told WFTV-Channel 9 and HLN’s Nancy Grace that Crystal had the Anthony affair. The affair allegation is also in the latest National Enquirer, which wouldn’t tell Pipitone if it paid for the sisters’ story.

How credible is their story?

Pipitone noted that Cecilia was in jail from August 2008 to January 2009 – ”the time the affair was supposed to be blossoming,” Pipitone said.

Brad Conway, George’s attorney, said that Pipitone’s findings show the sisters “are questionable people.” Conway has denied the affair and that George said Caylee’s death was an accident.

But that’s not all.
The sisters were linked to the theft of more than $1,000 in jewelry in 2008, Pipitone reported. At a pawn shop, the thief “showed Crystal Holloway’s driver’s license but left behind Cecilia Holloway’s thumb print, so Cecilia is the one who when to jail for five months,” Pipitone said, a memorable line.

Cecilia was booked in jail the same day Casey was coming out, Pipitone added.

The women didn’t respond to WKMG’s repeated requests for comment, Pipitone said.
