HOUSTON - A 40-year-old woman is facing an injury to a child charge on allegations she nearly starved a 21-month-old to death.

Joy Michelle Padilla is accused of failing to provide adequate food and nourishment to a 21-month-old girl who was left in her care over a 10-month period, according to a probable cause document.

The baby's mother had been arrested in February 2009 on a prostitution charge and appointed her adult stepdaughter as her power-of-attorney, according to the probable cause document.

The stepdaughter then left the child in care of Padilla until the child's mother was released from jail, according to the probable cause document.

In Novemer, the stepdaughter returned to Padilla's to pick up her stepsister, but Padilla refused to hand over the child, according to the document.

The child's mom then went to Padilla's house to get her daughter back, but she was shocked at her daughter's condition, according to the document.

The mom claimed the baby was so emaciated that she couldn't even recognize her, according to the document.

That's when the mom called an ambulance and police to the location, according to the document.

An investigation was launched, and detectives determined that the girl had weighed 25.5 pounds in February when she was released into the care of Padilla, according to the document.

By November, the child had weighed only 16 pounds and 13.3 ounces, according to the document.

The child was transported to Texas Children's Hospital, where she was treated for malnutrition and dehydration.

Padilla was then charged with injury to a child. Her next court date is scheduled for March 8.
