State says Chelsea King suspect found through DNA

SAN DIEGO, Calif. (AP) – A convicted sex offender charged Wednesday with murdering 17-year-old Chelsea King while raping or attempting to rape her was linked to the crime by DNA found in her clothing, a state Justice Department spokeswoman said.

The break led to the weekend arrest of 30-year-old John Albert Gardner III as thousands of people still held out hope that an extensive search would find the teen alive even though she had not been seen since last Thursday.

Prosecutors declined to answer questions about the evidence against Gardner.

However, California Department of Justice spokeswoman Christine Gasparac told The Associated Press Gardner was identified after the semen from clothing found by investigators was run through a national database.

The DNA had been detected by the San Diego County crime lab and forwarded to the state, where technicians ran it through the national Combined DNA Index System.

"We were able within two hours to get a match to Gardner, and they were able to make the arrest," Gasparac said.

On Wednesday the 30-year-old Gardner stood silently in court, wrists shackled to his waist and eyes mostly cast downward, showing no emotion as an attorney entered pleas of not guilty in the potential death penalty case.

San Diego County prosecutors charged Gardner with one count of murder with a special circumstance allegation that the crime occurred in the commission of rape or attempted rape.

A second count of assault with intent to commit rape was filed in connection with a December attack on another female.

The victim's parents, Brent and Kelly King, struggled to maintain their composure as they watched the courtroom scene.

District Attorney Bonnie Dumanis said a decision on whether to seek the death penalty would be made later.

"It is a very somber decision," she said.

Gardner's public defender, Michael Popkins, did not address reporters.

Superior Court Judge Joseph Brannigan ordered that Gardner, previously convicted in a 2000 molestation, be held without bail.

The Lake Elsinore man was arrested Sunday as a huge search was under way in a wilderness park in northeastern San Diego, where King's car was found parked Thursday night with her belongings inside.

A body was finally found in a shallow lakeside grave on Tuesday, and authorities said they believed it was King, although formal identification by the coroner was pending.

Dumanis said the case has "rocked San Diego."

Early Wednesday, a spray-painted message was found on the garage at the home of the suspect's mother. It said, "Chelseas blood is on you. Move out." Police did not know who painted it.

Gardner lived at the Rancho Bernardo home in 2000 when he molested a 13-year-old neighbor. The home is down the street from an elementary school and near the park where King was last seen Thursday wearing running clothes.

A piece of paper taped to the front door told visitors to leave.

Thousands of people joined the search and then mourned the Poway High School straight-A student at a candlelight vigil Tuesday night.

Brent King thanked supporters on the lawn of St. Michael's Church in Poway.

"She's my angel forever," he said.

Gardner pleaded guilty in May 2000 to molesting the 13-year-old female neighbor and served five years of a six-year prison term. Prosecutors said he lured the victim to his home with an offer to watch "Patch Adams," a 1998 movie starring Robin Williams.

The girl was beaten before escaping and running to a neighbor.

Gardner "never expressed one scintilla of remorse for his attack upon the victim," despite overwhelming evidence, prosecutors wrote in a sentencing memo.

He had faced a maximum of nearly 11 years in prison under terms of a plea agreement, but prosecutors urged six years.

Dr. Matthew Carroll, a court-appointed psychiatrist who interviewed Gardner, had urged the maximum sentence allowed by law. He said in court documents that Gardner was a "continued danger to underage girls in the community" and an "extremely poor candidate" for treatment.

Dr. Mark Kalish, who shares an office with Carroll, said his colleague was saddened and angered by the news about Gardner, feeling his advice was ignored.

"He didn't want there to be any ambiguity or doubt about his assessment. He laid it out there and he was essentially ignored by the district attorney's office," Kalish said. "How much bigger a red flag could Dr. Carroll have raised?"

Kalish said Carroll was referring calls to him because his colleague, who does work for the county, did not want to discuss the case publicly.

"How are you going to treat someone who says you got the wrong guy?" Kalish said. "This girl ran out of (his) house with her pants down. Come on!"

The district attorney's office has declined to comment on the 2000 case.

Gardner was on parole for three years, until September 2008, state records show.

San Diego police said Gardner also was linked to an assault on a 22-year-old Colorado woman who managed to fend off her attacker on Dec. 27 in Rancho Bernardo Community Park on the northern edge of San Diego, where King's 1994 BMW was found. The second count against Gardner alleges the assault occurred on Dec. 27 but did not specify if it was the incident with the Colorado woman.

San Diego police Capt. Jim Collins declined to describe the evidence connecting Gardner to the December assault but said a swab taken from the victim's elbow did not match Gardner's DNA.

Collins said the victim elbowed the attacker in the face after he demanded money, and he ran off. Collins said the case was treated as an attempted robbery, which was why that DNA wasn't sent for analysis until Monday.

Hi, this is my first time posting...so, hopefully it will be correct.  It disgusts me that our children are not protected better by our government...that drug use(which is a serious thing) carries more time in prison than beating/attempting to rape a young girl/boy.  Drug addiction can be helped(though it does fail often)...sexual deviants cannot.  Here in Florida we have the same issues as California, regarding the release of sex offenders into our communities.  Our sheriff, Grady Judd is one of the best though...and he makes sure that the public is aware when sexual predators relocate.  He is famous for sting operations...such as Operation Protect where 14 men were arrested for possession of child porn...I wish there were more public officials that were as aggressive as he is.  My family prays for the families of all of these children. On a different note...I wanted to post some different things that I have found while "investigating" this scum JAG.  Most of it I have found in here already...but I have found a few forums that have comments that are interesting...

ok all you smart people.. #1... he has not been convicted yet... what happened to americans? what happened until innocent until proven guilty? #2...you don't know this guy... he is a person too and needs a lot of help. #3.... this man has not always been this way. I agree ... they should not have released him the first time... they should have gotten him the help that he needed. He was a good man at one time.. Just in case none of you know. He has been in Lake Elsinore for a while stocking our kids. A few months ago a bulletin went out to all parents of the Lake Elsinore School District about this guy. He was seen an numerous schools. But did the police find him? No, they just waist their time doing what ever they do. Sitting at stop signs for someone to run a stop sign. Maybe if they paid more attention to keeping our kids safe we wouldnt have this issue. He was accused once FRY him and we never have to worry again about our kids.

there is a story out of escondido about a husband and wife that saw a guy watching girls running last fall in jesmond dene park..they believe it was Gardner and he was in a light colored older pontiac sedan. I think its the same dirt bag.

GPS for Sexual Predators

I can locate my car and even find my phone with a tracking device. So why not do the same with Registered Sex Offenders? It's time they give up heir ability to roam freely once they are convicted of such a horrible crime. As a lawyer, I believe strongly in protecting the rights of the accused, even of the convicted - but not at the expense of past and future victims. They have rights too, most importantly the right to live. Yes, I am a lawyer, but I am also a son, a husband, and a father. I want my loved ones to be protected from known dangers. This is not a science experiment - we needn't gamble with innocent lives. We've done that far too many times and too many people have lost.

Ask the family of Chelsea King.

John Gardner III, a convicted sex offender and a dangerous predator, was arrested and charged for the vicious rape and murder of this beautiful high school senior. Chelsea, a straight-A student, musician, and long distance runner, had a lifetime of promise wiped out in a horrible crime that did not have to happen. She had gone to a local park to run on the trails and she never came home. Her body was discovered in a shallow grave covered by debris.

Gardner, who stands accused of this heinous attack, was convicted in 2000 of a sexual assault on a thirteen year-old girl, whom he beat and molested after luring her to his home. Her friend who testified against this monster at his preliminary hearing when she was just fourteen, still lives in the same neighborhood ten years later. Incredibly, as of last week, so did this predator. Not a single resident was notified that Gardner was released after serving just five years and that he was, once again, living among them. How many young women were needlessly put at risk? Consider fourteen year old Amber Dubois who went missing from the area a year ago while walking to school. Authorities now suspect Gardner in Amber's disappearance. Or think of the young Colorado Springs graduate student who was attacked last December 27, while jogging in the same area from where Chelsea went missing. She successfully fended off her attacker. She has reportedly, since been shown Gardner's photo and proclaimed, "He's the same guy." Gardner has yet to be charged in that attack or the abduction. He has pleaded not guilty to the rape murder of Chelsea King.

Still, why weren't residents put on alert that this monster was in their midst, on their street, and incredibly, just 1,000 feet away from an elementary school? What system of justice protects criminals but not the public? How many people have to be victimized, raped or killed for us to rise up and say, "enough!"

I say that time is now.

My iPhone has a GPS chip which enables me to find it if it is lost or stolen. Many cars have a similar device. We insert microchips in our dogs and cats for identification - why can't chips be implanted in convicted sex offenders to make sure we always know where they are? I suggest that for certain crimes - crimes which are so repulsive and for which studies tell us the perpetrators are never rehabilitated - we should require that a tracking device be placed on (or in) every sexual predator as a condition of their release from prison. One offense is enough. Forget three strikes. Strike one: go to prison and win a GPS for life.

Is this an abridgment of their civil rights? No. Those rights were relinquished after their conviction. Felons routinely lose their right to vote, own a gun or hold public office and no one calls "foul." Why should they be allowed to move about freely, invisibly, putting so many others in potential danger? Registries alone are not enough. We need to know a predator's whereabouts BEFORE he can strike again - not after. I want to be able to log onto my computer and KNOW where these predators are living, where they are hiding. Consider it a digital scarlet letter. "P" for predator.

I did read the grandma lives in the house in Lake Elsinore, but I don't believe I've seen her name anywhere.
