I think he thought it was odd because once again JAG was distancing himself from his own behavior...he didn't say he was the father or that he would be around to help, just she couldn't take care of a baby by herself...and yet if I read that right the girl he was engaged to was pregnant again.  JAG seems like he was in denial about all of his behavior..

Thank you for posting the probation report, I got the chills thinking he was a lifeguard at one time.  Sounds like he has had a turbulent life beginning at a young age - certainly not an excuse for what he has done it only firms up in my mind that he should never ever see the light of day again. He is a monster from he!!

Did Gardner Use Running Club To Target Women?

SAN DIEGO -- 10News received information that may indicate accused killer John Gardner used a social gathering that included his parents to allegedly target women to attack.

Photos obtained by 10News place Gardner's mother, Catherine Osborn, a nurse, and his stepfather, Kevin O'Reilly, a photographer, at an event at the Rancho Bernardo Community Park on Dec. 27 -- the same day he is accused of attacking a jogger.

The event was hosted by a local chapter of the Hash House Harriers, a popular group that is part drinking club, part running club. The group encourages members to adopt sexually explicit nicknames.

On Dec. 27, about 50 members met at Rancho Bernardo Community Park for a run scheduled for 2 p.m. Photos taken at the event showed Gardner's parents helping with the registration. 10News is still trying to confirm if Gardner had helped with the run's set up or participated in the run.

Hours before, in the park, a 22-year-old woman was jogging on the park trails. In a recent interview with 10News, the woman's mother said her daughter jogged past a man who then bodyslammed her to the ground. She said her daughter threw an elbow at her attacker and was able to get away. The jogger identified Gardner as her attacker.

Legal experts like defense attorney Jan Ronis expect prosecutors to take a close look at the Dec. 27 incident.

"Just to be able to place him in the general area within a general time is a significant point from the prosecution point of view," said Ronis.

When told of 10News' information, an aunt of the jogger said, "It's sick and wrong if he used his family's event to look for victims … but if having family nearby prevented him from chasing down my niece, that's good."

Officers of the running club declined to comment, but did say they don't recall ever seeing Gardner at any of the runs.

Thanks for the link, I took some notes from the John & Ken show when they interviewed an interview one of John's male relatives:

  • Relative said as far as what JAG was like, you see what you want to see
  • Of the conviction in 2000.  Said JAG's story was that the girl came on to him.  That she skipped school and came to his place.  That she was the aggressor and that he didn't actually rape her which is true, he fondled her and beat her.  Said that nobody in the family with the exception maybe of the mom, was aware of the psychiatric evaluation.
  • Asked looking back if there were clues - he said, yes plenty.  As a very young kid (7-8) he was prone to violence.  He recalled a time where at age 7-8 he got into a violent fight with another kidm while this relative was babysitting.  That JAG has always been immature and impulsive.  This relative believes there may be other victims.  That every dot needs to be connected.
  • Up until about a month ago JAG drove a gold pontiac.  It crashed a month ago and is likely in an impound yard
  • JAG's current girlfriend has a back honda that is missing a rear bumper that he had access to
  • When he got out of prison in 2005 he was on probation until September 2008.  From when he got out until Sept 2008 he had an ankle GPS monitor
  • Jobs - he is a journeyman electrician but he does all kinds of construction work and up until recently had work but lost his job recently.  He did all kinds of construction including laying concrete etc
  • Relative believes that the mom has been in DENIAL about JAG
  • As far as relative knows, no big trauma in childhood.  BIO dad died last year but hadn't really been in his life.  Only real father figure was stepdad in Lake Arrowhead/Running Springs.  That stepdad is probably the reason JAG made it through HS.
  • Asked if he believes JAG could be involved with Amber Dubois.  He says he is a man of science and hopefully DNA will tell the story.  He said everything needs to be looked into.
  • On 2/17/2010 this relative went to the Grandma's house in Lake Elsinore to tell JAG to leave.  They needed to get Grandma to the hospital.  On 2/19/2010 they took Grandma to hospital in Palomar and on 2/20/2010 JAG left Elsinore and and came down to Escondido area to his mom's townhouse
  • Relative was asked to get JAG out of Elsinore home but didn't explain why except to say JAG wasn't suppose to be there
  • On Sunday 2/28 the FBI was at the house in Elsinore and questioned this relative.  The FBI has asked this relative not to relay information he gave to FBI so this relative has to be careful about what he says.
  • Told FBI about timelines and what vehicles that JAG had access to.
  • Relative believes that JAG's actions have something to do with his relationship to his mom

Probation report cites predatory traits of suspect


LOS ANGELES -- A decade-old probation report on a sex offender accused of murdering California teenager Chelsea King contained a psychiatrist's conclusion that the defendant had "significant predatory traits" toward underage girls and should be kept in prison for as long as possible.

"The defendant does not suffer from a psychotic disorder," a probation officer quoted Dr. Matthew F. Carroll as saying for the report. "He is simply a bad guy who is inordinately interested in young girls."

Carroll further said John Albert Gardner III's "predilection toward younger girls is a problem. He manifests significant predatory traits and is a danger to the community," the officer wrote.

The report released by the San Diego County Superior Court on Tuesday was prepared in 2000 for the sentencing of the then-21-year-old Gardner after he pleaded guilty to committing lewd and lascivious acts on a 13-year-old neighbor girl who had skipped school. The victim was also punched repeatedly before escaping.

The probation officer recommended a so-called middle term of six years, reasoning in part that Gardner had no prior criminal record. A judge ordered the six-year term and Gardner served five before being paroled.

The report says Gardner moved to five different cities through his childhood and recounts the breakup of his parents when he was 5. It also details his work in construction, as a lifeguard, ride operator for four months at a Santa's Village theme park, and at a fast-food restaurant and sporting goods store.

Carroll expressed doubt of Gardner's claim of having attention deficit hyperactivity disorder that required up to 18 medications, noting he hadn't taken medications since age 16 but still had a 3.2 grade-point average in high school, had done well in life and had a relatively high IQ, the report said.

"Therefore, Dr. Carroll's conclusion is that the defendant is 'just a bad, bad kid,'" the officer wrote.

The report also noted that the psychiatrist was disturbed by a trespassing incident in which Gardner had been hanging around a high school, as well as a statement by Gardner that a purported fiancee had an abortion because she was afraid she couldn't raise the child by herself.

"This statement seems very odd to Dr. Carroll," the report said. "He finds pervasive oddness in this case."

A defense sentencing memorandum dismissed the mention of the high school incident, saying Gardner was a student there at the time, it was after hours and no charges were filed.

Gardner, 30, is now charged with murdering King, 17, of Poway, with a special circumstance of rape or attempted rape. She disappeared Feb. 25 and her presumed body was found March 2 buried in a park near the communities of Poway, Escondido and Rancho Bernardo north of San Diego.

Fix system that lets sex offenders walk, kill

Like most in the San Diego area — especially those of us who are parents — I've spent the last few days processing the events surrounding the murder of 17-year-old Chelsea King with a mixture of sadness, frustration and rage. Mostly rage.

Naturally, most of this anger is aimed at John Albert Gardner III, a 30-year-old registered sex offender who was charged last week in King's death. The more we learn about Gardner's numerous brushes with the law, the more anger builds over a defective system for dealing with sex offenders.

Factor in that there might also have been a series of foul-ups by law enforcement agencies, prosecutors and the courts with regard to these earlier cases involving Gardner and your blood begins to boil.

King's disappearance became a national story when 6,000 volunteers turned out to search for her. Now that her body has been found, we might just be at the threshold of a national crusade to fix the broken laws that are supposed to deal with sex offenders.

Gardner, who previously served five years for sexual assault, also has been charged with one count of assault with intent to rape in an attack on a 22-year-old female jogger in December in the same park where King's car was found. And police say he is a person of interest in the case of Amber Dubois, a 14-year-old who disappeared in Escondido, Calif., in February 2009 and whose remains were discovered Saturday. Nine months after Dubois' disappearance, Gardner registered as a sex offender at an address that was just two miles from the school she attended.

But while prosecutors go about building their case against Gardner, the public should be evaluating the institutions that are charged with protecting them and their families. Not one cog in the wheel should get a pass.

And if it turns out that someone did slip up — by not warning the public that other young women were attacked in those neighborhoods, or by being too quick to offer a plea bargain to Gardner in 2000 when he was charged with molesting a 13-year-old girl, or by not subjecting Gardner to the level of monitoring that he clearly deserved after he was released from prison — resignations should follow. After all, in this line of work, incompetence and neglect can come at a high price.

In a more perfect world — or at least a society with a more efficient criminal justice system in which sex offenders get longer sentences and are subject to more thorough monitoring once they get out of prison — King might be alive today. In fact, if there is any good that can come of this horrible tragedy, it might be in the form of a new political movement to strengthen the laws for dealing with sex offenders and close some of the loopholes that now render many of the present statutes useless.

Californians know how to make change. The three-strikes law, where a third serious felony conviction brings a life sentence, was enacted here in 1994. Later, more than 20 states adopted their own versions to combat recidivism and limit judicial discretion.

It's time to do it again. There is nothing more fundamental to the survival of a society than its ability to protect its children. Stories like that of Chelsea King remind us that we don't always do a good job at that. In fact, sometimes we fail miserably. When that happens, lives are lost. Others are destroyed. Changing the law is how we can begin to make amends.

As for Gardner's fate, San Diego County District Attorney Bonnie Dumanis has said that she hasn't yet decided whether to seek the death penalty because it only “should be used and exercised in those cases that are the most serious.”

Don't think about it too long, Madame D.A. Criminal cases don't get more serious than this. It's because of predators who refuse to admit what they've done, let alone show remorse, that we have capital punishment in the first place. So if Gardner is convicted, we should make sure that he gets to experience the concept up close.

Schwarzenegger orders change in parole file policy

The governor wants documents on paroled sex offenders maintained indefinitely. The change was made after a lawmaker sought the file of a suspect in the Chelsea King case. It had been destroyed.

Reporting from Sacramento - State prison officials, drawing fire for destroying the parole file of a man under scrutiny in the disappearances of two teenage girls, reversed their recordkeeping policy Tuesday on orders from Gov. Arnold Schwarzenegger.

John Albert Gardner III was charged last week in the suspected killing of Chelsea King, 17, of Poway and is a person of interest, police say, in the slaying of Amber Dubois, 14, who disappeared on her way to school more than a year ago. Her skeletal remains were found Saturday in northern San Diego County.

A convicted sex offender, Gardner, 30, was discharged from parole in 2008, and his file was purged after a year under departmental policy.

Assemblyman Nathan Fletcher (R-San Diego) requested the parole file earlier this month and, he said, received only a one-page summary of Gardner's interactions with the state correctional system. On Tuesday, Fletcher called for an investigation of state recordkeeping practice by a legislative panel and the inspector general who monitors the Department of Corrections and Rehabilitation.

Later Tuesday, the governor told corrections officials that all records relating to paroled sex offenders should be maintained indefinitely.

"It is in the best interest of public safety to retain all information on these individuals and to make as much information as possible available and transparent," he said in a statement.

Prisons chief Matt Cate said he had directed parole staff to make the policy change immediately.

Gardner's family took part in run on day of attack
The event at Rancho Bernardo Community Park came hours after jogger assault

Hours after registered sex offender John Albert Gardner III allegedly attacked a lone jogger at Rancho Bernardo Community Park, his mother and stepfather went for a run on the same trails as part of their jogging group.

Mother Cathy Osborn and stepfather Kevin O’Reilly, members of a local running and drinking group called Hash House Harriers, went to the park for a 2 p.m. group run on Dec. 27 — hours after the 10:30 a.m. attack on a 22-year-old college student, according to online group photos and a group newsletter.

There is no indication that Gardner was at the afternoon event or involved in the club.

Gardner, 30, has been charged with assault with the intent to rape in the jogger attack, and is charged with rape and murder in the death of Chelsea King, 17, of Poway, who was running in the same park two months later.

A run club member identified as “DrZaius” — whose contact information on the group Web site matches O’Reilly’s — did a write up on the event for the newsletter. It mentions the morning attack.

“Disturbing news at the start.” he wrote. “(Two members) who live next to the park, came out to give us word that a girl had been attacked that morning in the trails where we would be running.”


O’Reilly and Osborn live a mile from the park and have not returned calls and e-mails seeking comment.

Their presence at the park that day was reported last night by KGTV Channel 10, a news partner of The San Diego Union-Tribune, and was discussed in several online forums.

Hash House Harrier members who know the couple declined to comment yesterday.

In San Diego, the club’s chapters are perhaps best known as hosting the annual Red Dress Run, when male and female members don red dresses. Many in the group use sexually explicit monikers and often drink after running.

San Diego police classified the Dec. 27 assault at the time as an attempted robbery because the assailant demanded money from the jogger after tackling her. The victim, who goes to college in Colorado Springs, was able to elbow him in the face and escape, the victim’s mother has said.

I don't even know what to think anymore  I just know we took the kids to Santa's Village several times, and there are just tons of young people there of course.
