While awaiting his first court appearance in the alleged murder of Chelsea, Gardner was being held in solitary confinement "so he can be observed and make sure he doesn't harm himself or nobody else harms him," the sheriff said.
    Oh please, too bad Chelsea, and his other victims didn't have someone over them observing and making sure no harm would come to them.

NRCG  Right, everybody has to walk on eggshells to make sure none of his civil rights are violated, and by all means we all are supposed to be awed if some publicity hound lawyer takes his case and let's all hear the sorid circumstances that drove him to act out............makes me want to puke   
I'm already for the look at the bad childhood and all the other bs that I'm sure will be spewed. I really don't care, and I really don't care what happens to him in the jail, except for the fact he may give up info about Amber if he indeed is the one responsible. After that, then let the guards turn their backs.

I'll say he was brazen as hell, traipsing around the grave sight all the while that park was crawling with LE and others. Even ppl. up in those houses could have been using binoculars to watch what was going on. Sure hope he gives something up about Amber, I've got myself convinced, it was him

We must remind all of us to not be in isolated areas, alone. What happened to run, walk, hike in twos????

Am saddened by all these events.

Remember these sex offender sites aren't always updated. We have to get on our local LE or whom ever it is to enforce the sex offenders to keep signed up and lists up-to-date. In the Donna Jou case the LAPD said they had too many to keep up with. Ugh

"Too many to keep up with"  that's a sad comment for any official to make.  I notice that there are task forces and manpower to document every tattoo and freckle on gang members but not enough to follow through with brutal rapists and killers too.   Sad, sad

I just got home and read this horrible news. I am so sad for the family and friends that she leaves behind. no chance to say goodbye or anything. Add to that she was just out for a run - something she did frequently.

Why is it that this country seems to want to protect the evil people and not protect the innocent and good people?  I am so sick of hearing about the "rights" of these people - they should be killed on sight - just like the old days - let God sort out the few that are mistakenly killed. I know I will give my kids an extra hug tonight.

Hi IBE,

I think Tim Miller originally came to San Diego to search for the family of 4.  While in SD they contacted him to assist in the Chelsea search.  It does not appear that TES had anything to do with the recovery of Chelsea's body though as I believe they mentioned FBI dive teams.

Doctor: State Should've Held Gardner In 2000
Local Psychiatrist Says John Gardner Should Have Been In State Custody

SAN DIEGO -- A local psychiatrist told 10News sex offender John Gardner should have never been let out of state custody based on the evaluation that was performed on him following a sexual assault on a 13-year-old girl back in 2000.

Dr. Mark Kalish said he felt there was no effort to have Gardner, linked to the disappearance of Poway teen Chelsea King, civilly committed under the mentally disordered sex offender statutes.

Kalish told 10News the statutes would have kept Gardner in a state mental hospital until psychiatrists and the court determined it was safe for him to return to the public.

Kalish said Gardner displayed a typical anti-social personality that takes no responsibility and projects responsibility to others.

"That makes treatment, like the doctor said 10 years ago, impossible," Kalish told 10News.

Kalish considers violent sex offenders like Gardner to be sociopaths, people who have no conscience and no regard for other human beings. He said they think about people as merely objects to fulfill their needs and desires.

"We don't think twice about killing an insect, a fly. These people don't think twice about killing another human being. It’s just an object to them," Kalish said.

Multiple sources close to the case told 10news that King's underwear was found near where she disappeared with Gardner’s DNA on it, linking him to the crime.

Kalish said, "Sloppy. It’s an impulsive act that they've got other things going on in their head. He's got to get rid of a body, so it may just have been a matter of oversight."

Psychiatrist Matthew Carroll evaluated Gardner in 2000 following a violent sexual assault on a 13 year old girl.

Carroll suggested Gardner receive the maximum sentence of 30 years for his crimes, but as part of a plea deal he got six years and served five of those.

Carroll concluded that "when combined with his callous attitude and refusal to admit to any wrongdoing, the defendant demonstrates that he is an extreme danger to others and needs to be imprisoned to protect society."

"He's telling the district attorney, telling the court, 'This man is dangerous. He's gonna do it again,'" Kalish said.

The plea deal was offered to Gardner by the district attorney at the time to save the 13-year-old victim the trauma of testifying.

I am worried that now that poor Chelsea has been found, that Amber will be placed on the back burner. I hope to heck that they will seriously look for Amber and tie anything and everything to this monster! If he did something to Amber and others, their families need to know! Has anyone heard if he has lawyered up?

I am so sorry for this family and my sadness is just beyond words. I am so mad that these sex offenders are allowed out of prison time and time again to rape, torture and kill. After all they have rights they are human beings. Well what about the rights of citizens who never ever break the law? What about the victims? Our prisons and jails are so over crowded with people for smoking pot and not paying child support. What the hell is wrong with this picture? People can do years for robbing and stealing but commit a sex crime but they are almost guaranteed to get out to make someone another victim of their warped and crazed minds.

I am not just going to sit here anymore just reading. I have had it. There are so many sex offenders everywhere in this country. I am going to start looking them up in my area, print up flyers and take them around to different places and see if they will let me put them in the windows of their stores and the schools might be another place. I am going to write letters. I have just had it.
Carol good post - I couldn't agree more - I started a letter tonight and I intend on sending it to all the legislators in my state - this needs to stop.  If we can't do a better job to protect our young then we have a serious problem.

Governor Schwarzenegger Proposes Toughest Sex Offender Laws in the History of the State of CaliforniaGovernor Arnold Schwarzenegger today proposed the Sexual Predator Punishment and Control Act, which would give California the most stringent sex offender laws in the history of the state.

"Protecting public safety is my first priority and I want to provide greater protection for all Californians, especially our children, against sexual predators. The Sexual Predator Punishment and Control Act will give California the strictest sex offender laws we have ever had and ensure our state has the toughest penalties for the worst crimes," said Governor Schwarzenegger. "We want these criminals off the streets and away from our schools and children. Today we are making it perfectly clear to all the cowards who want to victimize innocent Californians: we will stop you, we will catch you and we will punish you."

The Sexual Predator Punishment and Control Act (SB 588 and AB 231) as proposed by the Governor today is being carried by Senator George Runner (R-Antelope Valley) and Assemblywoman Sharon Runner (R-Antelope Valley). The Act strengthens punishments, expands parole periods, keeps sex offenders away from schools and places where children frequently play, provides tools for tracking and control of paroled offenders and toughens punishments for the use of "date rape" drugs, child pornography and using the internet to lure children into sex crimes.

"These predators have been preying on our most vulnerable for too long," said Assemblywoman Runner. "Secrecy is their biggest tool to victimize our children and families. As a legislator, mother and soon to be grandmother, I feel my most important job is to keep these predators away from our children and within our sights."

Specifically, the legislation:

Requires registered sex offenders to wear a global positioning device for the rest of their lives.
Establishes the Predator Free Zone 2,000 feet from park where kids play and their schools.
Increases penalties for the possession of child pornography to a misdemeanor or felony, and automatically makes it a felony for second or more offenses.
Ensures sexually violent predators, prior to their parole, stay in a secure hospital until they can prove to a court they no longer pose a danger to society.
Makes it illegal to lure kids into online relationships with lewd intentions.
Establishes a sentence enhancement of five years for rapists who use a date rape drug.
Eliminates "good time" prison credits for habitual sex offenders.
Expands parole terms up to 10 years for predators who commit the most heinous crimes.
Expands and strengthens our basic sexual assault punishment statutes, including those for "One Strike" Sex Crimes, "Habitual Sex Offenders," and "Aggravated Sexual Assault of a Child."
"We need to equip our law enforcement with the best technology available in order to stop these predators from flying under the radar. Requiring GPS monitoring of sex offenders will be a huge deterrent and prevent many children from being victimized in the future," said Senator Runner.

Governor Schwarzenegger has worked to protect public safety and expand victims' rights in California since taking office. Specifically, Governor Schwarzenegger has signed legislation to strengthen Megan's law; worked to pass Proposition 69 to expand the state's DNA database; protected the integrity of California's Three Strike's Law by defeating Proposition 66; increased the ability of crime victims to participate in parole hearings; improved victim restitution laws; and appointed victim advocates to statewide commissions and offices.

So, this bill passed. The citizens of California gave it a green light. Then a U.S. District Judge curtailed it. We need to keep track of these people in PUBLIC office who overturn the policies that the people want on the law books!

Mon Nov 13 2006 (Updated 11/14/06) Residency Restriction in Jessica's Law is Blocked by Judge on Day After Election
 On November 7th, California voters overwhelmingly approved Proposition 83, or "Jessica's Law." It adds extra punishments, ex post facto, onto Registered Sex Offenders. An anonymous poster to Indybay wrote, "I'm surprised that the winning majority was less than 95%. After all, most citizens think that all RSO's are like the worst of the worst... Few people understand that their neighbor might be an RSO, perhaps convicted for 'indecent exposure,' perhaps many decades ago. But almost a third voted No. These must be the voters who bothered to read the pro and con arguments in the voter info booklet. There they could see that the proposition contains many new laws --- including one which has become a disaster in the state of Iowa. One aspect of the new law says that... that RSO's (even the mildest offenders, and no matter how long ago they offended) cannot live within 2,000 feet of a park or school."

He or she says, "That may sound reasonable -- until you draw a map of the forbidden areas. Then you find that RSO's will be driven out of cities, and even suburbs, into remote rural areas. Those areas lack rental housing, lack jobs, lack psychotherapists, et cetera." Those areas also lack the resources for enforcing the required registration and GPS monitoring of past offenders. CALCASA points out: "California voters made one thing very clear on Election Day, that they are passionate about ending sexual violence and serving victims. Proposition 83 will cost at minimum, hundreds of millions of dollars annually but not one dollar will be allotted to victims or victim services." The law also does not distinguish between offenders who are at a higher risk of offending again, or between the level of violence involved in certain kinds of crimes (public exposure and public urination are viewed by most as nonviolent offenses). The law expands upon Megan's Law, which was named after a girl who was raped and killed in New Jersey. Jessica's Law is named after a Florida girl who was raped and killed by a repeat offender. The majority of California's RSO's have not committed a violent crime related to children.

The day after the election, registered sex offenders won a reprieve. The buffer zone around parks and schools "may well be an unconstitutional retroactive penalty," according to U.S. District Judge Susan Illston. She issued a temporary restraining order blocking enforcement of the provision in four Bay Area counties at the request of a man who said the initiative would force him out of the community where he has lived for more than 20 years. She ruled that the plaintiff, who was identified only as John Doe, would likely be able to demonstrate that Prop. 83 is a punitive measure that should not be imposed on people who committed sex crimes before voters had passed the measure. She stopped enforcement of the residency restrictions until November 27th, when a hearing will be held before another federal judge on a preliminary injunction that would extend the ban. The order applies to San Francisco, Alameda, Marin, and Sonoma counties, whose district attorneys were named as defendants, along with Gov. Arnold Schwarzenegger and state Attorney General Bill Lockyer.

Missing California teen's body believed found

SAN DIEGO -- A body found in a shallow grave Tuesday is believed to be that of 17-year-old Chelsea King, whose disappearance led to the arrest of a registered sex offender, authorities said.

The remains were found buried in a park about 10 feet from the shoreline of Lake Hodges, San Diego County Sheriff William Gore said.

"Although positive identification has not been made, there is (a) strong likelihood that we have found Chelsea," he told reporters.

Gore said he had informed the teen's parents.

"Obviously they are devastated and I ask that you respect their privacy during this extremely difficult time," he said.

Hours later, several thousand people holding candles and tearfully embracing joined the teen's parents, Brent and Kelly King, in a vigil outside St. Michael Catholic Church in suburban Poway.

Brent King spoke briefly, thanking everyone for their efforts to find his daughter.

"One of the nicknames that I've always called my daughter is my Angel. She's my angel forever," he said.

"I want to thank you. Chelsea wants to thank you," he said.

When someone shouted, "We love you," Brent King responded, "We love all of you."

ESCONDIDO, Calif. -- The man suspected of in the death of Chelsea King was being watched more than a year ago by the family of missing teenager Amber Dubois.

On Tuesday, 10News spoke with Amber's mother, Carrie McGonigle. She said her family asked investigators with the Escondido Police Department to check out 174 registered sex offenders living within the area of Escondido High School where Amber, who was 14 years old at the time, was last seen February 13, 2009.

McGonigle said she was angry when she heard about John Gardner's arrest, "'Cause I asked numerous times for Escondido PD to check out every single one."

Family friend Linda Walkup said Chelsea King could have been saved if investigators checked in on people like Gardner.

"Had he been looked at from the beginning maybe, possibly, we could have stopped what's going on with Chelsea right now," said Walkup.

Instead, Amber's family and friends began their own investigation. They located the homes of 147 known registered sex offenders in Escondido, San Marcos, Poway and Rancho Bernardo. They drove by their homes and even staked out some of those homes. One of the stakeouts was almost a year ago, outside an Escondido apartment belonging to Gardner at the time.

Family friend Vinnie Spucces showed 10News reporter Joe Little the notes they'd taken on March 28, 2009, about Gardner. They couldn't believe it when he was arrested.

"My wife dropped to the ground and says, ‘We were there. We got his picture,'" said Spucces, "We were shocked."

The family told 10News they were holding out hope that Chelsea and Amber would be found together, alive.

Spucces told 10News by phone Tuesday's discovery of what appears to be Chelsea's body is a blow to the King family and their own search for Amber.

About 5 years ago, I started my exercise regimen of walking.  I walk 2-4 miles a day most days.  When I started this, I got up one morning and decided to go out and walk in our neighborhood just as the sun was rising.  I never realized how deserted the streets are at sunrise and I was soon confronted with an unsavory character who looked at me with a not so nice look.  I crossed the street to avoid him and actually I hurried home.  After that I never walked that early in the morning by myself again.  Sometimes people just don't think.  This is something that needs to be stressed to EVERYONE.  We must be careful not to isolate ourselves.  How horrible to have to be so scared!!

Update - Tuesday 4:15 p.m.

Escondido, CA - A body has been located in a shallow grave near Lake Hodges and is believed to be that of Chelsea King.


Rim High graduate John Albert Gardner III is suspected of raping and killing the 17-year-old King.


San Diego County Sheriff Bill Gore told a new conference he has notified the family it was a "strong likelihood" the body was that of the missing teenager.



The body was found early this afternoon by searchers looking for the Poway High School senior.

San Diego, CA - The suspect in the possible murder and rape of a 17-year-old San Diego County girl has been confirmed to be a 1997 graduate of Rim of the World High School.

John Albert Gardner III, now 30, was a resident of the Running Springs area while attending Rim High, according to a school source who spoke on the condition of anonymity because they were not authorized to speak on behalf of the district.


Gardner, is suspected of abducting 17-year-old Chelsea King on February 25 while she was running near Lake Hodges at Rancho Bernardo Community Park. Her automobile, a BMW, was located with her cell phone and iPod still inside the vehicle.

Search teams continue looking for the Poway High School senior in and around Lake Hodges.


In 1998, Gardner was convicted of disturbing the peace in Twin Peaks Superior Court related to what was described as a disruptive presence at a school, according to court and police records obtained by RIMOFTHEWORLD.net. He was listed as a Running Springs resident at the time of that conviction.


San Diego County Sheriff William Gore, who appeared on ABC's Good Morning America with the missing girl's parents, explained Gardner was linked to King's disappearance by a piece of physical evidence uncovered by investigators.


Gardner, a registered sex offender who served five years in prison for lewd or lascivious acts with a 13-year-old girl in 2000, is being held at the San Diego Central Jail in San Diego. His current Megan's Law registration show he is a resident of Lake Elsinore and he renewed his registration in November 2009, according to authorities.


Deputies arrested Gardner at a Del Dios restaurant — Hernandez Hide-A-Way — located on the west shore of Lake Hodges on Sunday, February 28.


Since the investigation began, Gardner has also been linked to a December 27 assault of a 22-year-old female jogger in the same park and have taken a new look at the case from last year involving the disappearance of Escondido teenager, Amber Dubois.

Well.  I get to sit here and wait for my son to come home - he plays French Horn at Poway High too.

Kind of hard to explain this to a 16 year old kid.

Adam I am so sorry. I know what that talk is like. I live in Tracy California and just under a year ago a little angel named Sandra Cantu was kidnapped. We all searched for her, we all prayed for her. My children helped in the search by passing out flyers. When they found her it was one of the hardest talks I had to have with my children, somehow I got through it and some how I am sure you did as well. There is no easy way to explain to our children that monsters ARE real. Please accept my prayers and support for your son and for your community as you work your way through your grief.
