Governor Asks State Board To Review Sex Offender Case

SAN DIEGO -- Gov. Arnold Schwarzenegger Friday directed the state Sex Offender Management Board to review the John Albert Gardner III case to determine whether systemic changes or improvements can be made to better protect the public.

Gardner, a 30-year-old registered sex offender, is charged with the rape and murder of 17-year-old Poway High senior Chelsea King.

She disappeared Feb. 25 while running behind Rancho Bernardo Community Park. Her body was discovered five days later in a shallow grave in a tributary of nearby Lake Hodges.

"We must learn from what happened in this case to make sure the public is protected from sexual predators," the governor said. "I have asked the Sex Offender Management Board to review this case and recommend what policy changes or improvements need to be made to make our communities as safe as possible."

Schwarzenegger signed legislation in 2006 creating the Sex Offender Management Board. The board was tasked with assessing practices in the management of sex offenders under supervision and making recommendations for the Legislature on how to implement the changes.

State corrections officials said Gardner racked up seven parole violations during the three years he was on parole for attacking a 13-year-old girl in Rancho Bernardo in 2000, but none were considered significant enough to send him back to prison.

Gardner served five years of a six-year prison sentence for attacking the neighbor girl in his mother's Rancho Bernardo townhouse.

The District Attorney's Office made a plea deal with Gardner to spare the victim from testifying at trial, despite a psychiatrist's report that Gardner showed no remorse and should get the maximum sentence of 30 years in prison.

Gardner was registered as a sex offender in Lake Elsinore but was staying with his mother in her townhouse when he was arrested in Chelsea's death Feb. 28. The townhouse is about a mile from Rancho Bernardo Community Park.

In addition to Chelsea's death, Gardner is charged with attacking a young female jogger in the same area in late December. In that case, the jogger elbowed her attacker and ran away.

Gardner is also a focal point of the investigation into the February 2009 slaying of Amber Dubois, according to Escondido police. The Escondido teen was 14 when she disappeared while walking to school. Her body was found earlier this month.

Escondido police said someone compelled by Chelsea's death came forward with a tip that led to the discovery of Amber's body in the Pala area.

Gardner could face the death penalty if convicted of Chelsea's death. A preliminary hearing is set for Aug. 4.

This is the John Albert Gardner III that Jennifer Brandt knows.

The wacky guy who walks into convenience stores wearing nothing but a paper bag over his head and yells, “I’m naked.” Or holds onto car bumpers to get hauled up mountain roads on in-line skates as they smoke and melt.

Brandt, who graduated with Gardner from Rim of the World High School in Lake Arrowhead in 1997 and was a close friend for the next few years, remembered him as “kind of wild and crazy, always trying to get attention.”

Gardner, convicted of molesting a 13-year-old girl in 2000 at age 20, is now accused of killing and raping Poway teenager Chelsea King, and is under investigation in the death of Escondido teenager Amber Dubois.

Brandt, 31, who lives in Indianapolis, Ind. now, said today that Gardner so liked to be the center of attention that before one of his court appearances in 2000 he flexed muscles in a shirt and tie for a camera, then climbed a tall tree wearing bluejeans and no shirt.

That day, Brandt said, Gardner took off his court get-up — and threw on the bluejeans temporarily — to help a friend unload lumber from the back of a truck.

Brandt said several friends from the San Bernardino Mountains were gathering in Cedar Glen to wish him well in court before he headed to San Diego with some of them.

“He professed his innocence to us, and since he had never done anything like that, we believed him,” she said.

Brandt said she was close enough to Gardner before his 2000 court conviction that he would confide in her about the bipolar disorder that he’d been diagnosed with and that sometimes he showed signs of it.

“Most of the time he was pretty up,” she said.

He told her he felt suicidal after one girlfriend broke up with him, and he told her a male relative had sexually abused him more than once when he was younger.

One time, she was visiting Gardner in Rancho Bernardo, where he moved in 1998, and she drove him to a grocery store, where he stole two bottles of booze.

“When he came out, he didn’t have any bags,” she said. “And I said, ‘Why did you go in?’”

He proceeded to pull out two bottles of alcohol from his pants, she said.

She said she didn’t see him drunk or drinking often, but that day, “We went back and got drunk and got silly.”

Another time, he gathered some friends from San Bernardino County and drove them down to watch an ice hockey practice of his, she said.

“He loved ice hockey,” she said. “It was something he was passionate about. But he got kicked off or didn’t make the team because he had been late several times. They didn’t want him around if he was going to be late.”

Gardner first told his friends that the 13-year-old victim he molested and hit in the head in 2000 was blaming him for something a boyfriend did to her, Brandt said.

After he pleaded guilty, these friends stopped supporting him and “were all devastated,” she said.

“It was so horrific that none of us wanted to talk about it at the time,” Brandt said.

And none of her friends have any desire to talk about the latest allegations, she said.

“He learned a lot of bad habits in prison,” she said of Gardner. “But he earned the right to be there.”

Brandt said there’s no way anyone could have predicted their friend would face the future he does.

“You can put all that together and say this is what has led up to that,” she said. “But there are people out there who have all that done to them, and they don’t go around killing people. You just never know who it’s going to be and what’s going to cause it.”

Memorial Celebration for Chelsea King

 
LOS ANGELES (KNX 1070 NEWSRADIO)  -- Thousands are expected to attend a public memorial for Chelsea King tomorrow afternoon at Poway High School. The memorial has a scheduled start time of 2 p.m. and will be held at the high school's stadium.

Poway High School stadium, which can seat about 6,000 people, is expected to be at full capacity. Priority passes are being given to the King family’s relatives, friends, supporters and members of the Poway High School community. After pass-holders are admitted, the public will be allowed in as space allows.

The King family has asked that people tie a blue ribbon around a tree in their communities to honor Chelsea or make a donation to Chelsea’s Light, which can be done at any Wells Fargo Bank in the United States.

Chelsea's Light fundraiser held at Lake Poway

POWAY — About 75 children and their parents gathered Friday afternoon on a ball field at Lake Poway for a self-defense and safety-awareness fundraiser with profits going toward Chelsea’s Light, the charity established by the parents of slain Poway teen Chelsea King.

Organizers, based on social networking and word of mouth, had been hoping for a larger crowd. Brent and Kelly King, Chelsea’s parents, did not attend but a letter on their behalf was read to the gathering:

“The compassion, love, and strength displayed by the community has been beyond words. We need to stand together and fight on all fronts to provide our children a world safe from the nightmare we are experiencing.

“What you are doing today honors both Chelsea’s spirit and her wish for everyone to be empowered in all aspects of their lives. Chelsea was a very strong girl. Be assured that her soul is even stronger now and helping to drive each of us.

“She is with you all today. She is encouraging and cheering you on. Chelsea is and will always continue to be the light that guides us. It will never dim with your love and dedication to help make this a safer world for our children.”

The children heard a representative of the Sheriff’s Department tell them to always be aware of their surroundings and to never go out in public alone. And a Tae Kwon Do expert showed them techniques to fight off an attacker.

Lake Poway is less than a mile from Poway High School where Chelsea had been a senior. On Saturday, a “memorial celebration” will be held at the school’s stadium.

Sorry but these images of him before his 2000 court for the beating and molestation of a 13 year do not look like "Catherine Osborn, wrote to the judge in the 2000 case that he accepted 'full responsibility for his actions.'"  I am not a psych nurse so could be wrong.  JMO

Doctor: Gardner's Childhood Could Explain Adult Behavior

SAN DIEGO -- A local psychologist told 10News John Gardner's childhood could explain his behavior as an adult.

10News spoke with psychologist David Gruder, who said, "Children learn from modeling. All of us learn from what's modeled to us. Not from what we're told."

10News learned Gardner's mother, Cathy Osborn, is a member of the Hash House Harriers, an adult running club. Pictures obtained by 10News showed club members, including Osborn, partying half-naked or completely naked after a run.

Gruder said any child exposed to such behavior would be impacted.

"If this is part of the environment that a child grows up in, then that child starts to believe as a child that this is part of what's normal and that it's OK for them to follow in those footsteps," said Gruder.

There is no proof that Gardner ever saw his mother with the club or knew about it.

Meanwhile, a childhood friend of Gardner's told a Lake Arrowhead (Riverside County) newspaper that as a teen Gardner admitted to having bipolar disorder. He also said he had been sexually abused by a male member of his family.

Gruder said that shouldn't be a surprise because many sexual predators were victims themselves, and those victims react differently as adults.

"They'll either go to one extreme where they become very, very asexual or anti-sexual, or extreme in terms of their hatred of sexuality or they will go to the other extreme or become very indulgent in their sexuality. But that indulgence can take many forms," said Gruder.

Gruder said none of what happened in John Gardner's childhood is his fault.

"The responsibility for doing the damage is of course on the shoulders of those who did not parent this boy properly," Gruder said.

However, according to Gruder, Gardner's actions as a 20-year-old, when he was convicted for committing a lewd act on a 13-year-old girl, cannot be blamed on anyone else.

"The responsibility of adult actions is squarely on our shoulders as adults and not with our parents anymore," Gruder explained. "That's part of what being a mature adult requires of us."

Gruder said the only time someone else could be held responsible is when the suspect is a ward of the state and considered insane, and Gardner was neither.

Girl grabbed while running in Kit Carson Park

ESCONDIDO – A student training for her high school cross-country team was grabbed by a stranger while she was running through an Escondido park Thursday afternoon, police said.

The 17-year-old was jogging through Kit Carson Park about 3:25 p.m. when she fell behind other runners and bumped into a man in the park, said Escondido police Lt. James Stuard. The man then grabbed her by the arm and asked her to “stick around for a while,” Stuard said.

The girl broke free and contacted a park ranger, who called police. Officers searched the area by ground and with a helicopter, but the man was not found.

The man was described as white, 25 to 30 years old, about 5 feet 8 inches tall, weighing about 130 pounds with brown hair and a reddish beard. He was seen wearing a black shirt, dark blue pants and glasses.

He was with another white man, about the same age and 5 feet 9 inches to 6 feet tall, who was described as “unkempt,” Stuard said.

Dr. Divy Kikani, a psychiatrist who treated Gardner for bipolar disorder, wrote that his patient was "extremely remorseful" for inappropriate sexual relations with two girls, ages 13 and 14. This creep really did not have much time assuming she went home from school, got ready, etc. before going out. How fast can a person really dig a grave? This is an interesting theory.  Does anyone know the timeline?  It seems that there wasn't a lot of time.  How close to the car was Chelsea found?  I'm sure Dad would have started searching close to the car.  He probably came real close to her if she was found close.  Could JAG have planned this out?  I have read reports that a knife was found close by...and then reports from a prior attack seems to describe JAG and an unkempt male.  Was someone helping him?  Was he planning this ahead of time?  I really didn't think so until I read some of the comments made.

Though Westerfield was guilty, the "court of public opinion" put the Van Damms on trial for their lifestyle.

All that it would take was one to render justice into hamburger. Westerfield was hoping that such was to be.

Now, ten years into the new millenium, John Gardner faces the needle for two counts of kidnapping, rape, and murder-- but will justice prevail?

All that it takes is one juror to cheat the State of the supreme penalty. Only one to give him life in prison-- but his life will be short.

For if Gardner is convicted and given two life terms for his misdeeds, it would still be a death sentence-- only carried out by his fellow convicts.

Either way-- it's "DEAD PERV WALKING" if Gardner is convicted.

Why did that schmuck get out, when he belonged at Coalinga State Hospital... never to breathe free air again?

Death, be not proud of your deed-- for you took two innocents, but left us with a real schmuck that you should have taken!

REGION: Gardner drove 3 cars, was stopped several times
Murder suspect cited for marijuana possession, traffic violations


Over the last three years, registered sex offender John Albert Gardner III was stopped at least seven times in San Diego and Riverside counties for traffic violations.

He drove at least three separate cars, including one matching a vehicle involved in a 2009 Lake Elsinore attempted child abduction, according to officials and court records.

Gardner is charged with the murder of Poway teen Chelsea King and is a suspect in the death of Escondido teen Amber Dubois. The teens were found dead five days apart, in separate North County graves early this month.

The grim finds, combined with revelations of Gardner's sexual assault history, have unleashed waves of anger and calls for stronger sex offender laws nationwide.

Amid that anger and those calls, authorities continue to investigate whether Gardner is responsible for other violent child sex crimes.

His traffic record adds somewhat to Gardner's picture. It shows, at least, the cars he drove, when and where he drove them, and some of his legal troubles.

According to a citation from a June 11, 2009, traffic stop, Gardner was driving a gold 1999 Pontiac Grand Prix north of Escondido. (A car of similar make and model was seized Thursday from an Escondido junk yard and taken to a city holding facility.) He was cited for driving without insurance on Interstate 15 near West Lilac Road. The gold Grand Prix matches the description of a vehicle used in an attempted child abduction reported on Oct. 28, 2009, in Lake Elsinore.

In that case, a man reportedly tried to take a girl at gunpoint as she walked to school on Machado Street. The girl's description of the suspect, and a composite sketch of him, bear a strong resemblance to Gardner.

Riverside County sheriff's officials refused to comment Friday about whether Gardner is a suspect in the October 2009 attempted abduction. They've said in the past they were looking into the possibility Gardner was connected. On Friday, they cited a gag order issued by a San Diego Superior Court judge this week in the Chelsea King case.

In addition to the June 2009 stop, Gardner's other traffic violations include:

-- Jan. 30, 2010; cited for expired registration and no proof of insurance in Lake Elsinore during a DUI checkpoint. He was driving a black 2002 Nissan Sentra at Corydon and Cereal streets.

-- April 2, 2009; cited for having an open container of alcohol, driving without a license and without a license plate on the front of the car in Escondido on El Norte Parkway at North Iris Drive. Gardner was driving a gray four-door Ford Focus at the time. The year was not noted on the citation.

-- Nov. 19, 2008; cited for misdemeanor marijuana possession while driving in Oceanside near Buccaneer Park. Gardner was driving a white 2004 Chevrolet Silverado truck at the time.

Gardner was ordered to pay several hundred dollars in fines in each case.

Court records also show Gardner was convicted of speeding in June 2008 and of a red-light violation in December 2006. Details of those cases, including the type of car he was driving and where, were not available Friday.

Gardner is listed as an Escondido resident, living at a Rock Springs East apartment complex, on the citations from November 2008 and June and April 2009.

The complex is less than two miles from Escondido High School. Amber Dubois vanished Feb. 13, 2009, while walking to the school. She was 14 at the time and a freshman.

Escondido police refused to comment Friday about anything related to Gardner, also citing the recent gag order.

Amber's remains were found in a grave north of Pala on March 6, after more than a year of extensive searches.

Chelsea King vanished Feb. 25 after going for a run at Lake Hodges. Her body, after a week of searches, was found in a grave near the lake on March 2.

Gardner remains in custody without bail.

O/T but shows the anger about RSO.  Yesterday my husband brought home a flyer from Boeing in Huntington Beach Ca. It showed 5 SO's living in a hotel in HB with their pictures and what they did, except for one. My husband just called me and there is a demonstration going on at the hotel and hosts of a radio station are there, sorry I don't know what station. And Boeing will no longer suggest this hotel to people that come there on business. The hotel is the Extended Stay of America 5050 Skylab Road.

I applaud Boeing for at least standing up some. The fact is that way too many people buy the BS that SOs can be changed. They CAN NOT. It is amazing to me that even when the average person knows that once a pervert always a pervert, the powers that be can not see it. SOs are great at hiding - they can hide where ever they are. I can almost understand the average person being fooled by them, but not the people in power that see, time after time, the simple fact is that SOs do not change. Strange how we are learing to accept that gay/bi/transgendered people do not choose their sexual orientation and can not be "changed" but we fail to see that SOs also can not be changed. Just so stupid to me.
